On June 22nd, 2025, a theft report at a Walmart in Palm Beach County, Florida became a criminal case against the reporter himself under Florida statute 837.05. This statute criminalizes knowingly providing false information to law enforcement about any alleged crime. First degree misdemeanor, up to 1 year in jail, $1,000 in fine, plus investigation costs under the July 2025 amendment. All right, so what's going on, man? What was that? You got your police report? Okay, listen, you understand that if you make a false police report, you're going to jail. What was that? Okay, I just want to make that very clear. Huh? Okay, so if we review footage, what are we going to see? Okay, so All right, so give me a run down of what happened. You saw it? So you never saw anybody go in the back of your car? So you basically I'm not That's not what That's not what I'm saying. It just seems very They're saying that they reviewed footage and that's not what they see. I I didn't get to review the footage myself. I don't know. I have to go see it myself. Cuz you're saying one thing, they're saying another thing. That is not important. No, it's not. That's something that I have to investigate. No, it makes me feel like somebody here is lying. Cuz if you're saying one thing, they're saying the complete opposite. Someone's lying, either you or them. Is that not true? Okay, so what did they do? So you loaded up with groceries, all of them? You said you put groceries in the car? Okay, so you put everything in the car? Okay, and then where were you after that? So you went to go put the to push the car all the way? And by the time you came back, everything was gone? Okay. Right? You come back and there's nothing in the trunk anymore. So you never noticed the groceries missing when you got in the car? All right. Do you have the receipt? So you basically got the receipt and you went and got everything back. Yeah, you can't do that. I I I understand, but it's not That's not on them. No, it's not. They're not They're not responsible They're not responsible for it. Okay, you can say what you want. I'm telling you what they're telling me. They don't want you leaving with the groceries. They don't want you leaving with the groceries. It's just as simple as that. And they're allowed to do that. It doesn't matter. They're not They're not held responsible for that. Which I am. It doesn't matter. It's up to them. It's a private business. If you don't If you If you feel like they're responsible for it, take them to small claims court and sue them. But you can't walk out with these groceries like this. Yeah, I don't I I don't know what you're doing, but I'm letting you know that if you walk out with these groceries, right, you're shoplifting. You paid for the ones that got stolen. But you have to go through the process. Well, I don't know if they want you doing that. What's uh Do you have the information? I'm letting you It's a private business. Do you understand what that means? Do you Do you understand that Do you understand that it's a private Are we done? I'm trying to explain to you it's a private business. Okay. If you walk out with those groceries, you are going to jail. This is what we see. This is what we saw. Do you want to listen or not? Okay. They're talking to him? Who's doing that? Okay. Yeah, I'll I'll I'll review it. I'll don't worry. I'll review it. Okay. Yes. And I And just just to just to clarify. If you were there So question, if you noticed that your groceries were gone, why didn't you call us when you got home? Well, but why not call us when you noticed that they were gone? That's what I'm saying is it's not This doesn't make sense. A normal average person would And they're saying that they saw that they Mr. Hayes, we get that. We get that. No one is saying that you guys are already in the back of the parking lot. Look like y'all were doing some [ __ ] So you guys According to your video, it does seem like maybe you are doing some [ __ ] Oh my god, I come here every day. Okay, so if I review it and it is what they're saying and you basically lied But if the video says If the video shows something completely different than what you're telling me, what's lying, the video or you? So what I'm saying is enough of the games. You But according to them According to them and according to the video Listen, according to the video, I'm going to go over here and I'll review it. Maybe they're seeing something that they shouldn't. All right? Let me review it and I'll come back. Are you going to stay here or are you are you going to dip as soon as I leave? You walk out with those groceries. I'm just making it very clear. Dude, if I If I swear this dude in and he gives me the lie around again, I'm taking the jail. Damn. What's that? If they didn't go to get their groceries, they got to eat, so. All right. I want to discuss stuff now. Go ahead. Not [ __ ] All right. What they claiming is still in the store. Something. Yeah, he's full of it. So, this is him putting the groceries in his truck. Right. I don't know what these people are saying to them, cuz he looked he looked like he's facing it at this point. Cuz I see the pole up on the back of his head, too. Yeah. All right, he's taking them out. Right. All right. Look, no, no. I don't see this [ __ ] anymore. Do you see him? He's taking the groceries out of his truck and putting them back into the shopping cart. 31665 is Literally pulled You see the stuff is still in it? >> Yeah. Some of the stuff is still in there. He parks it right here. With groceries still inside of it. That's tomorrow. I'll speed it up. He walked straight back to his car, closes the trunk, gets in his truck. All right, Mr. I can't even sleep. There's some truth to what you're saying. Thank you. So, hold on. Let me Let me just get this all squared away. >> [laughter] >> Uh This is Walmart, the main bro. I come here every other A lot of these [ __ ] that work here, that's why they talking to me cuz they personally see me here every day for years. >> you. I got you. >> Like bro, this [ __ ] crazy, bro. I'm not even mad You know what I'm mad at? I'm mad at this [ __ ] store, bro. I spend money in this [ __ ] every other day and you tell me you can't stand this? That's why I came the way I came, bro. >> trying to They supposed to easy say, "Oh, it's 50 60 bucks." I'm thankful for her, Walmart. They ain't even let me spend my money, bro. I got you. So, listen. Listen. It's your receipt. Like they said, you have to have a police report. And I personally have 10 hours of follow-up sitting in the Walmart for 95. All right, it is Today's date, it is 12:06. >> 12:06 p.m. It is 13:33 hours. This interview is conducted at Walmart located at 1 North Congress. >> I am Deputy Barker of the Palm Beach County Sheriff's Office. Uh do you speak English? Yes. Okay, are you under the influence of any medications that would affect your ability to tell the truth or understand the questions I'm about to ask you? No. Okay, do you have any mental condition or impairments that would affect your ability to answer my questions? >> No. Do you swear and affirm that the statement you are about to give is is the truth? Yes. Okay, do you acknowledge that whoever knowingly uh provides a false sworn statement under oath shall be guilty of a first degree uh punishable by imprisonment up to 1 year? Yes. Okay, is there anything that I failed to ask you? Okay. All right, raise your right hand. Do you swear that everything you're about to tell me is the truth and the truth only? Sure. What's that? Sure. Yes. >> Okay. So, just cuz I know I asked you what happened, but now just give me a recount of everything that happened. So, you you came here to buy groceries, right? >> groceries. I went outside to my car to load them and I assume when I walked away to put the cart away, somebody went in my trunk and took them out before I could close it. Okay, so when you >> cart, I don't know. I got you. So, when you loaded up the groceries, you loaded them in the truck, in the passenger seat, on the >> No, in the trunk. You put them in the trunk. >> Correct. Okay, and then before you're telling me on your key thing >> closed. Right, on the key thing you closed it from your keys. Correct. Right, and then you took the shopping cart >> all going to be documented on paper though, cuz the last time I ever seen the >> No, this is 100% going on paper. I'll give you a case number. All right? >> Cool, cool. All right, so once you loaded up the groceries, you took the empty shopping cart and you basically went to go put it like on the side. >> the cart I got in my car and I went home. When I got home, no groceries. So, when you got in the trunk I mean, when you got in the car, the trunk Did you Did you notice that the trunk was up or down? Obviously it would have been down. >> It was It was closing. It was closing. It was in the process of closing when I was walking to my Okay. By the time I got in my car, my trunk was closed. Okay, so then you got home and then there was no groceries in my car. Okay. >> I sent my kids to get the groceries. They came They come to meet me in the back. So, I got in my house. I told my children to go get the groceries and they said, "What groceries, man?" No groceries in the trunk. Okay. Um Do you know Do you know how much the groceries were? Like what you bought exactly? So, I'm trying to figure out did they target you because of high-end items? I'm feeling in this hot spot like a duck. No, cuz what I'm saying is >> I wish I would have been on beat. I should have been on beat, but two guys were in the back doing some slick half easy like dumb playing this [ __ ] so I'm Everybody was chasing on that [ __ ] I spent I spent $63.52, which is I understand. Okay. Um So, on the video it shows that there's a car that parks next to you. Do you know who that car was or who those people were? >> that parks next to me? No, I don't know I don't know them people. I don't know them. I never seen them people before. >> you never really saw who took the groceries. >> 10-13 copy at 22 Congress. Cuz it makes sense now why they were so [ __ ] talking to me. Like it's like they were You know >> their name? No, I don't know their name. Nope. All right. >> seen them before. So, listen. I I tried talking to Target, right? >> to South Tower 1785 to 11. I talked to Walmart, to the people there. I'm like, "Listen, if this man got his groceries stolen, right?" Are you guys responsible, right? If something gets stolen. And they said, "No." And the way they explain it is Say Say you're shopping here, right? And you have your phone. You take your phone and you're shopping. You take your cell phone and you put it like where the kids sit, right? And you walk out, you go buy some other stuff and some And somebody And somebody comes and they steal your phone, right? They're saying that person's liable. Now, >> be in the copy and you both know that's not the same person. I would That [ __ ] Like you even said that [ __ ] looks a little targeted. This is our parking lot. You not You not keeping your patrons safe. I'm a patron. And I'm somebody who comes on the regular. I live right here. I come a lot cuz at the end of the day I do understand what you're saying. You got to be responsible for your own [ __ ] But if somebody's taking your [ __ ] out while you're putting it in, that's a [ __ ] one-two right there that you [ __ ] ain't stepped on. And on top of it, that's a whole different analogy. Okay. So, listen. Bro, I'll I'll repay for it, bro. I can do that, bro. I can I can repay for this [ __ ] I got bread. I Listen, I'm not It's not It's not a question about >> that I'm mad at them. I'm mad at them. I'm not even My My people ain't even with y'all. It's It's You [ __ ] watch me come in here every day and spend money and then they going to act like this $60 going to kick in and then in the middle of doing Christmas and they know I got Come on, bro. Yeah, I'm mad. Do you want me to see if they can do like a store credit? >> Something, bro. Like I just got robbed and y'all playing and treating me like I'm a suspect. Not you. I'm saying like they Bro, you came in here feeling how you felt based off their energy, bro. Based off their energy. I'm somebody who come and spend money in this thing every day, bro. I'mma be here tomorrow whether you here or not. I'm going to be here. And I just got robbed for the first time I come here for years and you [ __ ] ain't even trying to look out. Y'all just Y'all coming at me sideways. They made up a whole story. I put my groceries back in the cart and pushed the cart away. Come on, man. Trust me, I'm keeping my [ __ ] together, bro. This [ __ ] crazy, bro. All right. Is the store manager here? Can you ask for them? So, that that's going to be our next step. South. All right. It's 123 and then 1015. Um I'mma stay right here. I just want to say one thing. I'm not going to Yeah, you see I'm not disrespectful, bro. I'm not overreacting, bro. I just want to say one thing, bro. They can lay their hammer down and judge me down all they want, bro. >> So, So, look. Listen. Let's say it again. What's your question? So, So, okay. So, we understand >> It's Ninja Warrior. Yeah. Damn, why you got to have the Don't you know we hate when we see y'all with the gloves? That mean y'all come for business, bro. Why you got to have the gloves, bro? Uh So, listen. I'm the good guy, bro. Believe it or not, I'm the good guy. Listen, so Walmart's a private business, right? You understand that? Yes, sir. I hear you. So, say >> Even though the How How's they private? They all over the world, though. It doesn't matter. >> damn, I didn't know they were private. So, they own this property. Meaning they can trespass and trespass. Right, it's private. If they tell me to leave, I'll leave. So, listen. Nobody told me I'm I'm trying to get somewhere with this. So, say you go to your homeboy's house, right? Right. Private. Private private property. You park your car there. Correct. Somebody comes and breaks in your car. Who's liable? Your friend? No. No, I don't think >> So, why is it different for Walmart? It's a private business. It's the same thing. It's their parking lot, bro. And that's even when I But listen, listen. What I'm trying to defend I don't want to go back and forth with nobody. I'm not that type of dude. You see it when I even when I ask Google, they're mutual. They don't know you or me. But even Google said they're liable, bro. Like I'm I'm just saying from everything I've ever learned from a little kid coming up, the where the where the incident happens matters, bro. If a person go out there and slip or get hit if It's a civil. It's not criminal. Oh. Okay. It's civil. That's what I said. See, that's why I don't want to go back forth. I'm not even a lawyer. No, no, listen. I'm just saying >> I'm not a lawyer either. I'm just I told Tell him what I told you. I'm not even mad at y'all, bro. I'm mad that as a citizen, bro, I come here every day, my [ __ ] I come here every day. I spend money here every day. These people didn't even act like they gave a [ __ ] bro. I come here every day for years, bro. I spend my money. Now now EBT card so that's what's pissing me off, bro. It's like bro, you treating me like a suspect. But I'm telling you I just got robbed doing cops. Cuz they know I got robbed. Like bro, like even damn act like you give a [ __ ] Don't act like they're unnecessary and just give him a [ __ ] He did it. Bro, I did I did. He did. I'm not lying, bro. I got robbed, bro. It feels weird saying I can't believe it. That's not That's not robbery. That's not how we view it. What do you What do you view that as? If any Cuz you're alleging burglary, not robbery. Robbery is where they take something with force. You know what I mean. Yeah, they tried to take something with force. Sorry. Yeah. I got burglarized. Um So yeah, anyway. >> You you may even lose your job. So, the reason why I'm trying to explain it to you is if you feel if No, no, if you feel like you're liable, sue them. I got to sue them. I got to sue them. You got to sue them in small claims court. You know what I'm saying? Okay. So that's what you got to do. Third Third right now talking to the manager, showing them everything and seeing if they can work something out where they can give you store credit or something. Okay. All right. Let's check. I'm going to check with them cuz I I've been here an hour. I'm ready to go home. I'm ready to go smoke my black, bro. So if you want to do this the right way I know I'm saying can we get their answer? I don't want nobody to Are you the registered owner of that car? Yeah, that's my car, bro. Okay. Anything else in that car that was stolen? No, nothing else was stolen out of my car. Just the groceries? Just the groceries. Smooth [ __ ] And they left no groceries whatsoever. No groceries. I even had other I had other [ __ ] they could steal out of it. Y'all they took all the Walmart bags. Them [ __ ] hungry, boy. I can't believe I got got, bro. That's some jet [ __ ] All right. The state must prove five elements beyond reasonable doubt. The defendant knowingly gave false information to a law enforcement officer concerning an alleged crime and knew the recipient was law enforcement. The critical element here is knowingly. The deputy's early warning about false report consequences is legally significant. It establishes notice and supports the prosecution's case that any subsequent false statement was knowing, not mistaken. Physical evidence trumps witness statements. Video surveillance provides objective records that courts heavily favor. When the deputy personally reviewed Walmart's footage showing groceries abandoned in a cart rather than stolen, probable cause crystallized. Under Graham versus Connor, the Fourth Amendment reasonableness standard requires judging officer actions from their perspective at the moment, not hindsight. The deputy had verbal false statement, contradictory video evidence, personal review, and subject's refusal to modify account. So look, listen. I reviewed footage, right? And what they're saying is correct. What is >> You walk over there. You load up some of the groceries inside of the trunk and then you take them out. You take the shopping cart, you move it across the street, you leave the shopping cart with the items in the shopping cart, you get in your truck, you drive away, and then that car that parked next to you come and takes the groceries. So for that reason, which I explained to you beforehand, if you provide a false statement, I'm going to take you to jail. >> came out and said you just >> Stand up. Put your hands behind your back. I was telling the truth. Up and put your hands You just came out earlier and told the truth, bro. We're not going to play this game. He's lying. He just came out here and said they was telling the truth to what I said. Yeah, you did put the groceries in the car. So that is truth. No, y'all lying. Stop Stop tensing. Stop tensing. Why are you calling out doing all that, bro? And I just asked bro to tell me what they want to do, bro. Why are you doing this, bro? What is wrong with you, jerk? What's wrong with you, man? You a psycho, bro. Relax. This man is straight laughing at me, bro. Relax. Relax. Cuz you keep tensing up. He just said relax pulling on me, bro. All right. What the [ __ ] is going on, bro? You're going to jail. I got robbed. Let's go. Come on. What I told you? Oh [ __ ] What I told you? I got a problem with white people. What you going to do? What I told Do this [ __ ] bro. I'm telling Hey, see how Relax. I got robbed and I'm going to jail. What the [ __ ] If you got ROBBED AND GOT TAKEN TO JAIL, what would happen to you? What would happen to you? You didn't get robbed. Bro, yes I did. You provided a false statement and you're going You're lying. Okay. And you look You came out and said you look at the camera and seen I ain't lying. That's not what I said. Didn't you say I wasn't lying earlier? Why you playing me right now? That's not what you said. Some of the things you said You're lying, bro. Stop tensing. Stop resisting. Bro, you [ __ ] is wrong as [ __ ] Bro, what the [ __ ] is going on? What this [ __ ] is? I want to beat up on the What the [ __ ] is going on? He pulling on me. He lying. You straight flipping me right now. You You mental counseling or something. You know what you just did. I know y'all all know what you're doing, bro. What is y'all doing? Oh man, bro, what the [ __ ] I don't give a Bro, only thing what you doing is y'all cooking cops, bro. Okay. This man just said only thing I can do is see if they'll give me a store credit. Then now you saying I'm lying and a false statement. Hey, bro, you flipped the script. There was no script. I came out to buy groceries, bro. And I got robbed. Bro, what Let's go. What I told you? Robbed, bro. Put your hands in the back of the car. How do you sleep at night, bro? You You throwing an innocent man in jail. I got robbed. I GOT ROBBED AND YOU'RE THROWING me in jail. And you're going to catch another charge. Oh my god. What is wrong with you? The subject's question, if I was white, would you do this, raises 14th Amendment equal protection concerns. However, objective probable cause based on video evidence provides race neutral justification. When versus United States confirms arrests are constitutional when objective cause exists regardless of subjective motivations. First Amendment protects critical speech toward police. Calling officers crooked or psycho during arrest is protected expression, not additional crime. The deputy correctly did not charge for verbal protests alone. Grading the deputy, B minus. Strong probable cause development, proper evidence review, professional arrest technique. Weak communication during confrontation, inadequate response to bias allegations, limited de-escalation sophistication. Grading the subject, D plus. If the report was knowingly false, this constitutes criminal conduct wasting public resources. Doubling down after clear warning demonstrates either remarkable confidence in false narrative or poor judgment. Physical compliance prevented escalation, his only strong point. Key lessons: For citizens, filing police reports carries legal weight. Provide only information you know to be true. Video evidence will likely contradict false accounts. Physical compliance during arrest, even if you believe them wrongful, prevents additional charges. For law enforcement, early warnings protect both parties. Personal evidence review is essential, not optional. When citizens raise bias concerns, address them directly and professionally. De-escalation requires more than repeatedly saying relax. This case demonstrates how surveillance technology has fundamentally changed criminal investigations. What might once have been a he said, she said dispute is now resolved by objective video evidence, cutting both ways for truth and accountability. The distinction between honest mistakes and knowing false statements remains critical. Florida law doesn't criminalize confusion or memory errors, it targets deliberate deception. The repeated restatements after warning here suggests the latter. Let us know if there is an interaction or legal topic you would like us to discuss in the comments below. Remember, your rights matter, but so do your responsibilities. Understanding both makes you a better informed citizen in every law enforcement encounter.
