YOU! >> [laughter] >> IDIOT IDIOT >> YOU DON'T CARE WHAT YOU'RE DOING TO MY mental health, but it's doing to me. >> You know you could have just called me in to the sheriff's office instead of trapping me. >> We weren't trapping you. >> So he broke my nose but I'm being arrested. >> On January 3rd of January 2025, officers from the Caledonia, Wisconsin Police Department responded to a domestic disturbance involving mutual allegations of physical assault. What made this case significant was not the dispute itself. It was what investigators did before making any arrest decision. They reviewed the home security camera footage in full. >> You cheated and I found out. And now that you're and now you're really getting now we're really not going to work on things. >> I don't care if he is your dad. >> I'm going to have to make it work. >> I'll find somebody who doesn't care. >> I'm going to need somebody. >> No, are you okay? I'm just not involved in that. >> I don't give a [ __ ] I can make it work. >> I don't know what to do anymore. >> I don't know what she's talking about. >> You! >> Can you get that? Okay. She's home. So you cheat and then you wreck the house up. That's that's really really nice. >> Well, you threw my [ __ ] house up in a week. Yeah, I found a different spot. >> That's not true. I'm sitting here. >> You can change your daughter. I'm >> Get in the car. Wow. [clears throat] So you cheat and then you do this >> Yeah, I >> Wow. >> Yeah, I [ __ ] AM BECAUSE YOU'RE CALLING ME A LIKE I DON'T EVEN HAVE ANY FEELINGS. LIKE I'M NOT A REAL PERSON. LIKE I DIDN'T GO THROUGH SOMETHING REAL LAST LAST YEAR. ARE YOU KIDDING ME? >> WE WE ALL DID. DIDN'T ANYBODY CHEAT? >> NO, YOU DON'T YOU CAN'T GIVE A [ __ ] ABOUT MY MENTAL STATE. I WAS A [ __ ] YOU. >> YOU DIDN'T GIVE A [ __ ] ABOUT ME EITHER. >> YES, I DID. WHEN I COULDN'T HANDLE MY OWN [ __ ] YOU DIDN'T CARE ABOUT THAT. YOU COULDN'T BE STRONG ENOUGH. >> OKAY, it's my fault. Okay, I don't I don't care. Doesn't matter. Go. >> YOU [screaming] HAVE NO IDEA WHERE I WAS AT. WHAT? AND YOU DON'T YOU CARED YOU DIDN'T CARE THEN. ALL YOU CARED ABOUT WAS THAT I WAS MAKING SH- THAT MY FEELINGS WERE MADE UP. >> WELL, I don't care now. >> Are you serious? >> I don't care now. You don't understand this is over. I'm not going to give up on us. >> The couple had clearly reached a breaking point, but while the emotions on both sides seemed raw and real, officers were looking for something much more specific and the cameras gave it to them. >> No. I already told you there is no chance in hell. I will never forget that. >> I am erasing the iPad. I'm going to give you my password. You didn't answer me. >> No, this is not a relationship. Do you realize that you are never going to have to see my face ever again? You have shown me how little I mean to you. >> That's not true. >> You have shown me how little our beautiful little family meant to you because he was more important. Try to enact your own pain here. >> I'M FEELING IT RIGHT NOW. PAIN AND REALLY BAD TWICE. Are you kidding me? I have to LIVE WITH THE FACT THAT I'M NEVER GOING TO BE GOOD ENOUGH FOR THESE KIDS. >> YEAH. >> I HAVE TO LIVE WITH THAT NOW. >> DON'T DON'T DON'T DON'T >> [screaming] >> STOP SCREAMING IN front of the kids. You guys You're doing this in front of the kids. Go for a drive. Stop. >> [laughter] >> You need to stop right now. Your kids are staring at you. You cheated on me. Get in the car and go for a drive. You are going to >> I GO FOR A DRIVE I'M FEELING SOMETHING gross to me. >> All right, you cannot do this in front of our kids. >> I can't keep living like this with what he's doing to me. >> Renee, you did this to yourself. You slept with somebody. You're only doing this because you got caught. >> NO, I'M DOING THIS BECAUSE I'M devastated and I'm losing you. >> Well, then why are you worried about losing me now after you cheated on me? What about all the times before that? You didn't give a There's a There's a There's a >> After what I saw what the cameras captured >> Do I care about you as a mother of my children? And I don't even know. Whatever. >> You don't call somebody a over and over and over. >> I'm sorry. >> I was I was very angry that you >> and over. >> I was very angry that you cheated on me, Renee. And I had every right to be. >> I can't live without you. >> Well, you're going to have to learn how. I can't live with someone who cheated on me. I told you that. >> I'm not just somebody. >> I cannot live and/or be with someone that cheated on me like that. That is a That's a That is a deal breaker. You don't >> I'M NOT JUST SOMEBODY. I'M THE MOTHER OF YOUR KIDS. >> Which makes it even worse that you cheated on me. You do not get to cheat on me and do what you did and say all of those disgusting things. And then you don't get to sit here and cry and scream at me and demand that I give you another chance. >> I'm not demanding. I'm begging. >> And I'm telling you no. >> Like a peasant. >> I'm telling you no. You don't get to do this. You don't get to go off and do something like that and expect me to still be here. >> I don't expect it. >> You don't I Well, it doesn't matter. You are expecting me. You You You You're >> I'm not expecting it. I knew what your reaction was going to be. >> You say we're not over. We're not over. I'm telling you we me? >> didn't I don't want to be over >> Renee family was the most important thing to me and now I have nothing. >> Why did you do that? Stop. Stop. Stop. >> [music] >> Stop. Denise Jesus, you're scaring us. STOP. STOP. STOP. STOP. YOU'RE SCARING US. >> AS THE ARGUMENT REACHED ITS PEAK, Denise >> You are >> Denise Barr. >> Denise Barr. Sounds like you called for a standby, right? I'll tell you what, I'll explain everything. I need you to hop out of the car for me. >> Oh [ __ ] >> All right, step right back here. Denise, we're going to explain it further, but right now I need you to turn around, place your hands behind your back. You're being placed underneath arrest. >> I'm sorry, what? >> I'll explain everything in a minute, ma'am. >> Okay. >> You need to be cooperative and decent with us. >> I'm sorry. >> Okay. I want you to turn around and put them in front. >> I'm sorry. >> We'll explain further. Just going to need some time, okay? I know this is probably a confusing situation for you and I understand that and we are going to explain it further, okay? >> Yeah. >> All I can tell you right now is I know that you've been in contact with the detectives, Detective Geranzen and Detective LeBron throughout today, right? >> Yeah. >> So, what we're going to do is we're going to transfer you down to the sheriff's office. They're there, okay? And then they're going to talk to you and they might be able to put um shed some light onto this situation as to why what's happening, okay? And I know this is a lot, but the detectives will be able to provide more information than what we can cuz we don't have a lot of answers. We've been in contact with them, so >> call me into the sheriff's office instead of trapping me? >> We weren't trapping you. This is we were just told to come here and and try to make contact with you and then bring you down to the sheriff's office. >> The lady told me to go to the house and someone was going to escort me and then help me get my kids medical supplies. >> Okay. I think maybe there was some miscommunication. There. >> think so. >> Oh, okay. Well, I I don't know about going to the house to get medical supplies. I know that we were told to come here and maybe things change, things evolve in this job constantly and information is constantly changing between us and detectives or they learn more things or they learn new things, which maybe that's why the situation has changed to not going to the house anymore to meeting with us. I don't know that. I don't want to speak to that. I don't want to give you bad information because >> I don't know anything >> know anything about this case at all. None of us do here, okay? >> So, he broke my nose but I'm being arrested. >> the back of the residence. >> And I don't even want to get into the case details with you, honestly, because I don't know any of the case details. >> No, I know. It's just >> So, detectives >> I had to say it out loud. >> What the officers didn't know yet was that Denai had a >> So, again, we're going to go back down to the sheriff's department, okay? And then you'll get to talk to the two detectives that you talked to earlier. Let's get this squared away. All right. >> Is this going to take a long time? >> I'm not sure. >> What happened from last night to this morning? >> Um well, I I guess it started Friday, but it's like very easily paraphrasable. Thursday night is our working out. And we had this whole back and forth over the weekend. Um He has controlling and violent behavior. Uh he broke my wrist in August. Um last December, we got into an altercation. My face was bruised, my shirt was ripped off. I'm pretty sure he broke some ribs, but he didn't go in cuz that's what you do if you broke your arm anyway. We don't. And I wasn't even sure if that was just like a one-time thing at the time or what and serious assault, whatever. So, this morning I got up wrist and being some separate better if you have medicine. Probably shortly after my arm is broken. And um We're fighting about what we did New Year's Eve or what we didn't do, right? Um this morning I woke up and I hadn't moved all of my stuff out of like his bathroom or anything, so I went into the like the master bathroom, so I went in there to brush my teeth. He got up and he was like, "I can't sleep. I can't da da da and he just started I work here. It's a half an hour drive and he kept yelling and yelling and then I started yelling and um we were a couple inches from each other's faces and he just wound up and head butted me just out of the blue. >> She attempted to deny. Ever use a weapon against her or threaten to use a weapon against you? >> Like which weapon? Like a gun or a knife? >> Gun, knife, bat. >> She She hit me with like something in the kitchen or something. She threw something at me. Okay. Um she only threatened to use the gun on herself. >> Okay. >> Yeah, she kept putting the gun in her lap and threatening to kill herself. >> Has she ever attempted to kill herself? >> Not that I know of, but she's she's threatened it. >> Okay. >> I don't know how to I don't know how you want to word that one. >> All right. I'll just put no because uh it says attempt, but she you said she did mention about killing herself, but never attempted. >> Yeah, but she's only she's never actually gone through with it, but I mean saying I'm going to kill myself with a gun in my lap is it wasn't loaded, but it still was you know what if I walked in 6 minutes later? >> Right. Right. >> But it's just No, it's just the only thing it's been is just the violence of her throwing things at me or across the house or pushing me or things like that. >> Okay. Did she Did she have physical contact with you today? >> Yes. >> [clears throat] >> Did that physical contact cause you any pain? >> Um >> Under Wisconsin statutes, section 968.075, officers responding to a domestic abuse call are legally required to identify and arrest the predominant aggressor when probable cause exists regardless of who called police first. The predominant aggressor is determined by three factors: prior history of domestic abuse, severity of injuries inflicted, and the relative credibility of each party's account. In this case, the security footage directly contradicted the initial account provided by the wife. That footage constituted lawful probable cause obtained with the husband's consent as a co-resident of the home. Under the Fourth Amendment in the United States Supreme Court's ruling in United States versus Watson, a warrantless arrest is constitutionally valid when probable cause exists and the arrest occurs in a public place. Both conditions were met. >> Where did he headbutt you? Where is there any bleeding or any >> Oh my god, it bled all over the carpet. Immediately it just started, just gushing. There was nothing else after that. >> What was his reaction? >> He said, "Why did you headbutt me?" He said, "Uh why did you do that?" Where his cut is on his head, there's no way I could have headbutted him like that. I would have had to have been standing on a ladder. And I was like, "Are you kidding me?" I said, "Are you kidding me?" I didn't move. But no, there's a huge puddle on the carpet in the hallway and then cuz it was in like the door jamb to the bedroom. So I was trying to leave to go to work. So there was a big puddle like this big in the hallway and then I obviously went to the sink. I like ran to the sink and I got a towel to wipe off the sink. And he was cleaning it up when I grabbed the phone sleeve. And he tried to like block the bedroom door and all that good stuff, but I didn't There was nothing physical after that. I just kept threatening to call 911. And he eventually let me take them. And I told him I would leave. I lied. I was just going for the day. I'm going to my friend Jordan's house. I was going to go to her house after this, but I was just going to go to her mom's house now. >> Denai's version was picturing a woman trying to leave a dangerous situation, but after watching the surveillance footage, it was clear that she didn't comprehend that the officers knew better. >> How many times were you struck? >> Just today or the whole week? >> today. >> Uh Why you just say no? She tried to hit me and all this stuff. She tried to hit me in the crotch which was one and then pushed her face hard up into mine and that's when I stood up and that was all this thing happened like six times I guess. >> Uh was the physical contact intentional? >> Yes. >> Did she damage any property? >> Yes. >> And what was damaged? >> Not the floors and all that kind of thing, but just for So this morning, no. >> Okay. >> But then just the weekend, she damaged my floor. >> Um she broke two vases. Um she broke a glass big Christmas tree that my mom gave me like 15 years ago. Um but she just slammed the door really hard and I had to fix the jam, but that's the main thing. Didn't break anything. >> So the reason um we are here We spoke with you earlier um and we always want to get both sides. With this department of having a lot of moving parts um we contacted and spoke with other parties involved which led us to kind of hear kind of hear being in custody right now. I have to read you Miranda, okay? But you're in handcuffs. >> I understand that. I just didn't know why. >> And I want to explain all of that to you. We just kind of want to get a better understanding because there was things that were left out this morning. I watched And and that's why I want to Yeah. We do this and I I'm hoping to have a conversation with you. >> Yeah. >> Um about it. >> Yeah. >> Not what I do. I think it leaves all that out, but what's going to happen next is obviously your in handcuffs. Um we were watching some different video and there was just I'm just going to be blunt and kind of tell you what it's what's going on. You don't want to talk to me, which is fine, but I think I owe you white and hand cuffs. Um we watched different videos of um just arguments um I watched videos of you holding your daughter and um throwing like listening to the arguments back and forth enduring vases um in the living room. Um and you punching yourself in the head, you hit your head on the door, um and it was a rough weekend for everybody, but the reason we're here today is like you um the cause of these arguments and what not and you never said that this all kind of stemmed from um cheating. And when I watch videos and listen to the language and see everything it it it's a complete 180 of what our conversation was today and I don't want you to answer any questions because you want a representation, but I just wanted to let you know that's the reason we're here today. Um because I err on the side of caution, I don't take sides, um and I really feared for the kids. >> wasn't looking to have you get into trouble either. Um he doesn't get a say in this. Uh he doesn't get to choose just like you didn't as far as pressing charges. I know everybody thinks about it that way. In Wisconsin for domestic laws, we don't have a choice. Somebody has to go to jail if it rises to a certain level. >> If he didn't go to jail, he gets off. >> So >> he can break my nose. >> I just wanted to put that out there. >> still going on with his life. >> But we also want to now kind of figure out what the best solution is um to kind of address the kids for the time being. >> And this And this is I'm thinking hypothetically, I would have felt like because I didn't do my job. Because emotions can take the best of us. And I saw in the video clips with both of you where emotions can get the best of you and you aren't the person that you really are because emotions are high and I want you to be the best version of the mom you can be and that you just said that you >> be in that environment. There's no way. There's just some environment that I remember you and I was working under you. You know, I love you, buddy. Yeah, I cheated on him, but who wouldn't? Something like that I think she'll have to sit on the head where When I talked to you this morning, you had no worries or concerns and said he was a good dad and he said the same thing about you for the kids. Um you were a great mom. And I didn't report him the same And neither of you. This is All part of this is out of your hands now, both of your hands. >> just want to get called before almost 72 hours straight. But that's why I'm going to have to go somewhere. You can't sleep there. >> The wife alleged that the husband head butted her unprovoked. The husband's account, corroborated by the footage, described the wife initiating physical contact including an attempted kick and pressing her face forcefully into his. Under Wisconsin statute section 940.19, battery requires the intentional infliction of bodily harm. The physical contact described and documented on January 3rd he meets that legal threshold and it was initiated by the wife, not the husband. The footage also documented the wife striking herself, punching her own head, and hitting her head against a door. Self-inflicted injury used to fabricate visible evidence of abuse is among the most serious forms of evidentiary misconduct in a domestic case. Prior to questioning at the sheriff's office, detectives administered Miranda warnings insistent with the Supreme Court's ruling in Miranda versus Arizona. The wife had already invoked her right to representation and the detective respected that boundary entirely. A critical point. In Wisconsin, the victim does not control the charging decision. Under section 968.075, neither party can opt out of prosecution once probable cause is established. The mandatory arrest framework removes that discretion precisely to protect victims from coercive pressure. The Caledonia detective receives an A- minus. The decision to review all available footage before making an arrest determination reflects evidentiary discipline that prevents wrongful arrest and withstands Fourth Amendment scrutiny. The wife receives a D. Filing false accounts with law enforcement, particularly when objective camera evidence exists, carries potential criminal exposure. Under Wisconsin statutes, section 946.41, obstruction of an officer. The husband receives a B. His account was corroborated by the footage and he cooperated fully. However, mutual emotional escalation throughout the weekend means his conduct was not without fault. The legal lesson here is direct. Home security cameras are not merely deterrents, they are evidentiary instruments. Courts treat contemporaneous video footage as among the most reliable forms of probable cause available to law enforcement. More importantly, anyone involved in a domestic dispute should understand that false statements to investigators carry independent criminal liability entirely separate from whatever the underlying dispute may have involved. The presumption of victim status does not survive contradictory objective evidence. In Wisconsin, and increasingly in jurisdictions nationwide, investigators are trained to let the evidence, not the first caller, define the case.
