Four charges were filed that night, two counts of battery, disorderly intoxication, and resisting an officer without violence. The central legal question is not whether the arrest happened, but whether each charge had an independent lawful basis. >> She can go to jail for resisting and disorderly intox. >> What did she do that was resisting? I just I saw what happened over there. >> I told her to stop. >> Because she keeps she keeps yelling, "Fuck. Fuck." >> [ __ ] >> And then tell her to stop, she keeps walking. >> The other one in there >> Who is still working on trying to get a hold of her? >> Yeah, well, she she's tearing on I don't know what she's going to do. >> I asked her to leave, too, and she didn't want to go. >> Okay. And then deputy's giving her instructions and he's not listening. She's not listening and we have to put our hands on her. Go ahead. >> I get it, sir. There's nothing you can do. >> Uh it's going to be up to Deputy Hal more than likely, so I have to figure it out. Excuse me, guys. >> Where is he at? Can I >> Tenfold. I could put her on the phone and say it's whoever. I I can >> Well, she she she was pointing at the picture like I was supposed to recognize him. >> Barack Obama calling on my phone. >> Like I was like I looked at the picture and I was like who is that? >> You're She was asked three times to let's take this outside. >> She was yelling commands and she was walking off saying [ __ ] this and [ __ ] that. [ __ ] this and [ __ ] that. She said I forgot the name >> Okay. >> Once. >> Yeah. >> Once ago this. You say 54. >> So what's cool with that? You're still trying to get somebody? >> No, he said show me out of the >> I know I got to finish my time. >> He walked He showed me out of the beach. >> You said there was two people in 20 watching all of them. >> Yeah. >> This is definitely happening. >> Hi sir, I'm Kelly. I'm over here, sir. >> I'm I'm the one that's not drinking. >> Okay. Well, >> I'm staying with her. >> Okay. Well, when I give you a lawful command to stop and you're yelling and cussing in the parking lot, sir, and you continue to walk away from me, and then you you resist when I'm trying to put you in handcuffs, you go to >> jail. >> Okay. >> I I She forced my hand with it. If she would have stopped and talked, I would have told her to chill with the language, no need for that or anything else. But >> I understand. So where's she going to be, honey? Is she going >> She's going to go to central, it's going to go. >> Okay. Can we please Can I take them home or no? Okay. I understand that she went too far. I respect I respect his decision, but >> When when you when you when you when you make me put your my hands on you, I'm I'm bound by law. >> Yes, sir. I get that. I get that. >> She's She's She's not from here. >> All right. Well, >> she was visiting, but I get it. >> All right. I'll make sure that the rest of them get home. >> I live right over here, honey. >> I know. I I got you. >> So I'll take them to my house. Well, I'm going to miss Kelly. >> She's going to my house. >> Do we have to do a file a charge? >> For what? >> Because she hit me in the back of the head. This is what started the whole thing, and I wasn't going to >> Who hit you? >> The lady that y'all took in for disorderly. >> Uh-huh. >> I don't know her name. >> Okay. >> Was wearing the Bama shirt. I have no idea, but like I had no idea, but apparently all night she was behind me like flipping me off. Because I every time we would score, I would stand up and cheer. >> Uh-huh. >> But I mean I never left my table. And then when I don't know, something happened and they scored, and she's like, "Oh, yeah, you're cheering for your team, but we're still winning." And I sat back down, and then something happened, and she came over and got up behind me, and then she just like slammed me in the back of the head, and then she punched my husband, and then that's when the owner went over and told her to calm down and stay at her table. And that's when she hit him, Kevin, you know. >> Okay. >> But like I was going to let it go, but I don't think I should let it go because she I need to know what I need to do. >> Uh, it's as simple as filling out a witness statement as far as >> like call tomorrow? Do I do it now? I don't >> Yeah, we can do it now. >> Okay. >> Um Yeah, just >> I have like a knot on the back of my head. Like I have like legitimate >> Do you mind if I just feel it? Just to >> Not at all. >> Where is it at? Here? Right here? What did she hit you with? >> I have no idea because she was behind me. I don't have a clue. I have zero clue. Like I was sitting in my chair. I never even got out of my chair. There's a million witnesses. I mean, when I went to the bar to get a drink, some girl goes, "I want to buy you a drink because you've been such a good sport all night." And I said, "What do you mean?" She's like, "Well, she's been back there behind you flipping you off." I had no idea. And then when all that happened, she like nailed me in the back of the head, and then my husband stood up, and then she punched him. >> Okay. >> And it just went from there, and and he's like, "Let it go. Let it go." I'm like, "No, I'm not going to let it go. That's ridiculous. I've never been hit. I've never been in a fight. I'm like, I'm a nurse. I'm like the one taking care of everybody. I don't do this." So And so I told Kevin, I was like, "You know what? This is fun, but I'll watch the game at home from now on. I'm never doing this again." >> Right. >> Ridiculous. >> And you saw obviously I don't know I don't know if you were out here tonight >> until she hit y'all. >> Well, she tried. >> But I mean I'm like That's what it When Kevin told me that I'm like, "You know what? I was going to just let it go, but I don't think I should cuz that's ridiculous. If you can't handle your liquor, don't go out and drink." >> Uh-huh. So your information up top >> Okay. >> If you obviously you don't know her name, but if you'll just put kind of what she was wearing and that kind of stuff and then just a synopsis of basically what >> date, correct? >> It is the 12th. And it's 8:54 now. >> Okay. >> Don't worry about the complaint number, I'll get that for you. And just basically a little synopsis of of what the events were, the kind of what you told me. >> Yep, I'm a nurse, I'm good at that. >> And then I'm going to go up here and watch the surveillance footage real fast and then we'll go from there. Hi Tonie. >> What? >> Tonight you're being arrested for two counts of battery. >> Are you [ __ ] kidding me? >> Disorderly intox and resisting officer. All right, we're going to get you up to the Santa Rosa County Jail. >> Are you [ __ ] kidding me? >> No ma'am, we're not. All right. >> I'm waiting on a ride. >> You're good. >> I'm not getting a ride. >> Well, she she's also got two counts of battery. >> For what? >> For punching a a patron in the back of the head as well as punching her husband. >> She I will tell you she did not punch that lady. >> She did. I watched the video. I watched her surveillance video of it. >> Okay. Well, I only saw what I saw, but if you watched the video >> I watched the video, she punches her in the back of the head and then when he he stands up to defend his wife, she punches him in the shoulder. >> Okay. I didn't >> She doesn't She doesn't even have a recollection of what happened out here. So, that's how intoxicated she is right now. >> Okay. >> So. >> I trust you. >> But >> Y'all are Y'all are >> Yeah, so she We're going to get her up to the jail so she can calm down and and chill out. Um, but she Like I said, she's going to have to count the battery as well, okay? >> Okay, so that's obviously going to make her bond go up. >> Yes, ma'am. >> Okay. Does that Does that determine the amount of time she stays in there or is it just the >> It It the >> the amount of time? >> Yeah, if if she has to blow under a 0.05 to be able to get out. >> Okay. >> Um, it's for safety reasons and everything of that nature. Um, so but as soon as she's able to blow under that, then she can she can be bonded out and everything. >> Okay, so the battery charges doesn't have anything to do with the extension of time? >> It's a It's a first-degree misdemeanor, okay? All right. Have a better night. >> Nobody antagonize me. >> [ __ ] that [ __ ] >> I love you, Amber. >> I don't believe she can hear you, Ms. Tony. >> [ __ ] you, okay? Shut up. [ __ ] Cut this [ __ ] [ __ ] >> Believe This is Scottish bagpipe music, ma'am. >> What? >> This is Scottish bagpipe music. >> Scottish bagpipe music. Play me what >> Share your thoughts below. >> Starting with battery. Florida statute section 784.03 defines battery as intentional unconsented physical contact with another person. Injury is not required. Contact is sufficient. The statute is one of the lowest evidentiary thresholds in Florida criminal law. Here, surveillance footage reviewed on scene confirmed two separate strikes, one to a patron's head, one to her husband's shoulder. Physical evidence corroborated by a visible injury and multiple witnesses meets the probable cause standard for both battery counts. The disorderly intoxication charge is governed by Florida statute section 856.011, which requires intoxication causing a public disturbance. Knocking drinks off a table, yelling profanity in a parking lot, and refusing repeated lawful commands collectively satisfy this threshold. Now, the most legally contested charge, resisting officer without violence, under Florida statute section 843.02, this charge rises or falls on one question. Was the underlying command lawful? If the command lacked legal authority, resistance to it cannot be criminal. The subject's profanity in the parking lot is protected speech under the First Amendment as established in City of Houston versus Hill in 1987. Profane speech directed at law enforcement, however offensive, does not constitute disorderly conduct standing alone. However, the deputy's authority to conduct the formal trespass procedure and collect identification is independently lawful under Florida statute section 810.09. The subject's refusal to comply with that specific lawful function, not merely the command to stop cursing, provides the legal predicate. When the deputy initiated physical contact to enforce that lawful procedure, and the subject pulled away, section 843.02 was triggered. Under Graham versus Connor, the force used, soft empty hand control, is judged by what a reasonable officer would do given the known facts at that moment. An intoxicated, non-compliant subject with a prior physical altercation on record justifies the force level applied here. The deputy receives a B. The battery charges were properly supported by surveillance footage, physical evidence, and witness testimony. Force was proportional. However, the statement, "You want to act like a dumbass, you get treated like one." is a direct liability in court and a failure of professional communication that no amount of otherwise sound police work can erase. The subject receives a C+. Her verbal conduct was constitutionally protected. Her physical conduct inside the bar was not. Two battery offenses against uninvolved patrons, resistance during handcuffing, and refusal to comply with a lawful trespass drove every charge she now faces. Bar management receives an A- clear communication, timely cooperation, and surveillance footage that ultimately made the case. The takeaway from this encounter is precise. Protected speech ends where intentional physical harm to another person begins. An officer's demand that you stop cursing carries no legal weight. An officer's demand that you provide identification during a lawful trespass does. Knowing the difference and acting on it is the line between leaving a bar angry and leaving in handcuffs.
