On March 21st, [music] 2024, officers with the Springfield Police Department responded to a report [music] of a woman passed out behind the wheel of a running vehicle in a parking lot on West Republic Road. When officers arrived, they found [music] the driver barely responsive and the vehicle filled with signs something was seriously wrong. >> So, she was passed out in the car. >> Okay. >> She got a bunch of alcohol right there. >> All right. >> She says she hasn't used in a while. >> Talk with her yesterday. she overdosed on was having a methodon reaction yesterday. >> Okay. >> At the other place. So, >> um I haven't pulled her out. I've got uh the car was on, was not in gear. Car was on. Um I yanked uh turned it off, pulled the keys out, and the keys are up here. It was so loud I can hear it as soon as I got out of the car. What >> the stereo? >> Oh, okay. >> So, um I I can't tell if her foot was on the gas or not cuz um I thought I heard it rev, but I may not. I don't know. I guess it's hard to tell. So, >> I haven't done any fields or anything. So, >> hold on for just a second. I'll see if I'll take this or Parker will Hey, uh, do you want this for training? You want me to go ahead and take it? Like, it doesn't matter to me, but I just wanted to offer it. There's alcohol containers. Apparently, she overdosed yesterday. Okay. All righty. I'll I'll deal with it. You're welcome. Bye. Hello. What's your name, ma'am? >> Just Emily. >> Emily. So, Emily, what's going on today? >> Um, I was just tired. >> Tired? Okay. Have we drank anything today? >> Uh, no. >> Nothing. Like even earlier, like a couple hours ago, or anything like that? Any alcohol or anything? >> Well, I didn't I didn't drive up here. Um, I had a friend um whose car was parked over here and um he actually drove up here. >> Okay. So, somebody else drove you in their car and you just hopped over into yours. >> No, they were with me in this car. >> Oh, okay. So, someone else drove up here and then they left and you just were hanging out. Yeah, I was waiting for my boyfriend to uh come up and drive. >> Gotcha. So, but have you drank anything today though? >> The reason why I'm ask is cuz medical's here, so they're going to ask you the same questions. >> Why medical here? >> Well, because you were passed out in the vehicle, so they just naturally come. Do you need medical? Okay. >> She doesn't need you, I guess. >> All right. >> Thanks, guys. >> Take care. >> You as well. >> Okay. Well, have we used any drugs recently? Nothing today. Okay. When's the last time you used? >> I don't use anything that I'm not prescribed. >> Okay. What What prescriptions do you take? Um, I take clonopen. That's just um whenever I have anxiety. >> Whenever you have an anxiety attack. Okay. When's the last time you took your clonopin? >> Um, a few days. >> Few days. Okay. Um, anything else that you're prescribed that you take daily or as needed? Method. Okay. >> You haven't taken any today? Okay. Um, how much When's the last time you took that? Do you take it in the morning, at night, a couple times a day? >> I took it yesterday. >> Okay. Fire is probably coming for us, so give us a second. All EMS comes. We're sending them away though. Yesterday you said though their siren's not drowning us out. >> Okay. >> I'm hoping they go for us. >> All right. Well, >> so we got to deal with what we got right here. Okay. So, you're in the car while it's running everything. You're in control of the vehicle. So, I need to do some field sobriety tests. Okay. >> You're You're in operational control of the vehicle. >> I just have the air condition. >> You're in operational control of the vehicle, though. Okay. You don't have to actually be driving down the roadway. All right. Do you want to do any fields? [screaming] Why don't you go ahead and step on out? Okay. I don't actually drive the car. I don't understand why. Go ahead and step out of my other vehicle. Okay. Yeah. I'm just going to have you step to the back. All right. I'll pick those up for him and put them in your car for you. Okay. Okay. So, do you want to do any field sobriety tests? >> I only had to do this if I was driving. >> No. So, let me explain the reason behind this. Okay. You're in operational control of the vehicle. You're in the vehicle in the driver's seat while it's running. You're impaired and you have a lapse of judgment and you put it in reverse and start to drive away. That's where the issue lies. Okay. >> Huh? >> I didn't do that. >> No, I'm saying that's where the issue in lies is you have the ability to just go and then back into somebody. So that's why Okay. I was really You want to do a breathalyzer for me? Is that a no? No. You don't want to. Okay. Right now, you're under arrest for DWI. Go and put your hands behind your back. >> DWI. I was just driving. You're >> in the vehicle. >> In the driver's seat. for my boyfriend. >> Put the vehicle on after we after. >> Unfortunately, that's that may be the case, but when you're intoxicated, that doesn't help. That's what causes the problem. You can't be in the driver's seat. >> Do you want your Do you want your phone to go with you? I can't take this with you cuz they're going to make it throw away. So, you want this left in your car so that we don't have to throw it away? >> Yeah. >> Thank you. Okay. his boyfriend. >> Yes, we can do that. Um, >> Corporal Wilkinson here. He'll help you call your boyfriend. Okay. To let him know what's going on. Does that seem fair? >> What's the passcode to get on so I can call your boyfriend? >> Change this DWI. Give me the log and pull case number. No readback. And I'll need female for search, please. Hey, this look we're out here with Emily and she is going to jail for DWI. She would like somebody she would like me to come get her vehicle for her. over there. >> Emily, I took the keys out of the ignition for you. They didn't kill somebody. I pulled them out. >> I don't understand how I can hear when it was just sitting here. >> These are fun to do when the vehicle is on. If you're in the driver's seat intoxicated, you are in you are in control of the vehicle. I understand that. But the problem is that when you're intoxicated while in the driver's seat, you don't make good decisions. We've already established this. Unless you're a revoked driver, I can tell you that. >> I know. I wasn't driving. >> Yeah. You don't get charged with the revoked. >> Yeah. Heat. Heat. these. Oh, most of them are empty. So, and then there are some that are full. Emily, do you have anything on your person that the female officer is going to find? Okay. So, we're going to wait for them to be here. It's probably be another 10 minutes. Okay. So, your 4 hours started from the time you're arrested. Okay. So, your time's already started on that. >> No, I can't. Are you currently pregnant right now? >> No. >> The reason why I asked cuz I just saw some baby stuff in there. So, I was just wanting to know. >> Can I please please hit my vape? >> No, I can't let you hit it right now. >> Why? >> Cuz in all honesty, I don't know what's in your vape. >> It's just nicotine. >> Do you have a cigarette? I can let you smoke a cigarette instead. You want to do that? >> Okay. This is Emily. She's under arrest. Okay. How long did boyfriend or whoever say it wasn't for? There's >> probably 30 empty bottles of shooters throughout yesterday. It didn't do anything. There's Clin and Methodone and Vance and Gabit, all the good [ __ ] She's been nice. Just not to hit you up later. >> That's it. I appreciate it. Uh, have you guys sit here for TJ or CJ? >> DJ. >> And DJ. I was wrong on both of them. So DJ's going to come. We just need to get him identified. >> DJ's real name. >> Dylan. Dylan. Okay. >> Okay. So, uh, get them identified. These are left in the front seat. Okay. >> So, uh, they also had the gummy shrooms. >> Oo. Um, cratom and little bit of I saw it. wasn't going to mess with it. >> So, appreciate it. >> Yeah. >> During the drive to the Green County Jail, the officer briefly turns his body camera toward Emily to document her condition in the back seat. >> All right, Emily, let's go and step on out. Okay. All right, step on in and go to the right. Step on in. >> You been here before? >> Yes. >> You did any drinks today? >> No. Is this normal for you to act like this then? >> Like you're talking very slow. Is this normal? >> Okay. >> What model phone is this? An iPhone. What? >> 15. >> 15. >> You guys going to pay to get my extensions fixed? >> Like when you get hair tight? No. I like you and your partner's badge numbers. >> Yeah, I can do that for you. The other male that was out there on scene with us. >> Yep. >> Okay. >> You just twist the other one. Okay. And then how do your extensions come out? Are they clipins or tape? >> They're not. their tape. >> Can I just do it? >> Yeah, you do. >> You can help. >> Stop. >> You pull. >> I will. I will do it. I think this is a little ridiculous for me only being here for four or five hours. >> I'm stupid. >> You don't hear me? >> I will do it. Stop. I don't have a day to be out here. >> I don't want your help. >> Okay. Well, it's either I help or I cut them off. >> Yeah, totally. Just be a [ __ ] about it. That's why you signed up for this job. I'm suing this [ __ ] police department. >> Just to differentiate this is county we're at right now. >> All right. Well, >> I'm saying I haven't been rude. So, >> yeah. Well, your female officers are >> No, these these we different agencies right here. >> Technically, you supposed to do this? >> Yeah. So, >> really? >> Yep. So, >> I had no idea. >> Yeah, >> I went there a bad showers as well. >> Yeah. Well, I feel you ripping out my hair. So, um but it's not your head. So, you can't feel whether you're ripping the hair out or not. >> You can rip my shirt. Yeah. >> So he gets >> how this [ __ ] squishy fish like I was doing 20 minutes ago. >> All I'm asking is if you're willing to take the breath test. >> No. >> I need a yes or no. I'll do it now. >> All right. Just a big deep breath. A long steady exhale. You want to see two lines. Try to keep them as high as you can. Okay. Okay. >> Go ahead. Anytime. Keep going. Going going. Go ahead. Good. Perfect. So, you're under the legal limit. >> Yes. Under. >> Mhm. >> So, I should be arrested right now. So, the next thing I'm going to do is I'm going to ask for a sample of your blood. If I'm the limit, then I should be released, right? >> I'm transparent, so I'll tell you exactly why things are going the way they're going. So, the level impairment that I'm seeing on you does not match the alcohol impairment that I see. So, what that means is I believe that there's drugs or something else in your system that is causing the impairment. So, this is still misdemeanor. It's not a felony or anything. Emily was charged with felony DWI as a persistent offender. Court records show she was ordered to complete a 120day treatment program and was placed on 5 years of supervised probation.
