Um >> so I'm going to talk you into the uh starting position and uh and give you some instructions. Okay. Um I know it's kind of snowy here, but get semi straight line here. Now, we're on a little bit of a hill here. So, what I'm going to have you do is I want you to take your right foot, put your right foot on the line. Do that for me. Okay. Right foot on the line. Take your left foot and put your left foot uh touching heel to toe onto that line. Okay. Put your hands down at your side. Not in your pockets. Just down at your side. Okay. Can you put your hand your uh feet touching heel to toe like this? Heel to toe. Put your hands down your side. Down side. Put them like touching your sides there. Okay. I want you to stay in that position while I uh and don't move from that position while I give you instructions for the test here. So, what I'm going to have you do is when I tell you to begin, I'm going to have you take nine heel totoe steps along the line. It's going to look something like uh keeping your hands down at your side and and looking down at your feet. It's going to look something like this. One, two, three, until you get to nine. Then I'm going to have you take a series of small steps around your front foot and then take nine heel to toe steps back. One, two, three, until you get to nine. Okay, that whole time I want you to keep your hands down at your side. Uh look look down at the at your feet and once you start the test, don't stop until uh you completed the test. Do you understand the instructions? Yes. >> Okay, go ahead and begin. Heat. Heat. Heat. 420. >> Okay. Relax. Okay. Can be your right or your left. U,, you're going to pick it up. this case, I'm lifting up my right foot. You can do either one. You're going to point your toe so the bottom of your foot is about 6 in off the ground. Put your hands down your side. Look at your toe. And you're going to count out loud like this. 1,00 1,002 1,00 3 1,004 and so on and so forth. Okay? Until I tell you to stop. Okay? Do you understand? Yes. All right? I'll tell you to begin here in uh here in a little bit. Hold on a sec. Uh, what's your highest um degree education? How how much education have you had? Did you graduate high school, college, bachelors? Okay. So, you know your alphabet and your numbers and everything like that. Okay. I just want you to say um the alphabet E through P um without seeing it. Just E through P. The alphabet. >> E F G H I J K L O P. >> Okay. Can you count backwards from 69 to 54? 60 65 64 60 62 61 60 55 87 56 5 Okay, not many people ask that question. Yeah, it's not a normal should ask. Yeah. >> Okay. Um, on a scale like 1 to 10 or like 0 to 10, zero being not intoxicated at all to like 10 being like the most intoxicated you ever been, where would you say you are now? >> Oh, there's a lot of drinking that I've done. >> Yeah. >> But, uh, where am I at right now? Uh, if this is just being strictly honest, I don't think, uh, should I be on the road? I could take an hour or two and we'll be off. This happened because somebody slammed their [ __ ] brakes on in front of me >> and I and that's how I got but uh I could take an hour or two and just you know honestly that's what I that's exactly where I could be. I need to go see my parents. you get and uh and I would really appreciate if this doesn't turn into >> Yeah, hang tight right there. Okay, guys. Three. >> A three. Okay, I got you. So, I want you to go seal your lips around this and do nice steady blow like you're like you're blowing up an air a balloon. Keep going. Keep going. Keep going. Keep going. Uh, it's not getting enough flow. You want to try just like you're blowing up a a balloon. Yeah, you're just not blowing into it. Okay. All right. So, go ahead and turn around. Put your hands behind your back. All right. You going to be cool with me? No, I'm good. Put your hands in the front here. Okay. I'll let you make some coals. I appreciate that. Okay. Yeah. So, right now you're under arrest for, you know, driving under the influence. Okay, I am going to hang out here. I got to clear some stuff out of the back of my vehicle. Okay, it's all fine cuz I only got 108 54. you know anybody locally that can help you with the truck? It's on the roadway right now, but so it's not in the roadway. I mean, we could probably tape it and leave it as is, but don't want to do that right away. my first time being. So, let me have that. There's still some stuff we got to do. >> Okay. I I can actually take your phone in the back of the truck with you cuz what's going to happen now? We're going to go to Satana post and I have to >> I have to run you through the data master. >> You want me to shut your truck off? >> Yes. Lock it. Turn these things. >> Yes. Can I do that? >> I will. I'll do it. >> He He'll shut it down. >> And the the deal is you don't have any uh go. Why don't you walk back to >> um since you don't have any priors, you'll basically be known as uh >> after we go through everything else here, you'll be known as >> your bail will be what's called own recgnissance. Um so once they get you to >> once we get you get you to Wildwood pre-trial, they'll you'll have police. >> I do. Let me um let me uh >> that way nobody calls it. >> Let me put them in the back here. I'll get your police team. I'll just place some on there. >> I should have some uh pink tape maybe in my door here. If not in the passenger side, I got some in the driver. Hold on. I got to make just uh check you and make sure you don't have anything that um can't go into a secure facility. That's just part of your go have a seat. I got your uh And your phone I think should be in your pocket. I think I put it in this pocket right here. Reach it. Let me get it. Got it. >> Okay. >> Is that my wallet? >> Yeah, I put your wallet back in there. You uh see the buckle right there. here. Lean back. Lean back. Lean back. I'm going along. >> Okay, there. There was a There was another >> There you go. >> The truck The truck's locked up. >> I turned it off. Locked up. The tow rope is on the passenger front side, so there's nothing sitting on the bed anybody can take. It is over the white line, so it's not in the road, but you're going to have to get it taken care of as soon as possible. So, I'll let you make the arrangements on that. Okay. But with it clear and snow winter time, you're going to want that thing out of here. Yeah. >> Okay. All right. Here we have the keys. Okay. All right. Nor take it right in the garage there, but step on out. So, just watch your step. Just come up on here on the sidewalk. And head that direction. He's going to let you in. Thank you. Have a seat on that bench right over there. Okay. So, this is um it's called advisement of your legal requirement to provide breath samples. So, uh, you are under arrest for operating a motor vehicle, aircraft, or watercraft while under the influence. The law requires you provided sufficient breath samples to accurately measure the alcohol level in your breath. Failure to provide sufficient breath samples is a crime that will result in mandatory jail time, a mandatory fine, and loss of your driving privileges. Additionally, failure to provide sufficient breath samples can be used as evidence against you in a criminal prosecution as well as any civil lawsuit. Failure to provide sufficient breath samples to accurately measure the alcohol level in your breath is a crime separate and distinct from the crime of operating while under the influence. Neither your right to speak with a lawyer nor your right to remain silent. Gives you the right to refuse to provide sufficient breath samples. So on this it's got um two blocks here. It says uh having had the above uh two >> blocks. I got two different blocks you got to look at. Uh having had the above checked advisement read to me, I will provide sufficient breath samples to actually measure the alcohol level in my breath. Or having had the above checked advisement read to me, I will not provide sufficient breath samples to actually measure the alcohol level in my breath. I understand the law requires me to provide the samples and that my refusal to do so will result in serious adverse consequences to me. So based on the questions, are you going to provide? Can I read that? >> Yeah, you can read it. Uh let me check the applicable portion for you. Yep. The check part is what is the applicable part. I'm just going to have you since you're handcuffed to the front. So, if you're going to provide a sample, just check that you're going to sign and uh put the date and time. And the time is you can put 2:00 2 p.m. It's the 11th >> 15th 15th. Okay. Sorry. >> No, no, no, no worries. Yeah, you can have a seat. Just make sure you understand it. Um uh >> I don't want to be rushed into something that just the whole rest of my life up. >> Uh do you want a few minutes to >> Yeah, I'd like >> to talk to try to You got your phone on your right? >> I have my phone. >> Okay. Uh, let me see if there's a place where you can speak freely. What's in here? Um, do you have um do you want to do you have an idea who you're going to talk to or? >> No, I just I I have to do a little phone research. >> Okay. >> What where I'm at and I'm just cuz I don't have any legal advice and I'm worried about any of that [ __ ] right there. >> Okay. >> If it's going to interfere with the rest of my life. Does that make sense? Yeah. Um, do you want to try to look somebody up first or? >> Yeah, let me >> Okay. >> Yeah. Why don't you have a a seat in there? I can't completely close the door, but I'll give you some >> privacy. Let me Let me Thank you. Thank you. >> Okay. Going off record for turning
