Deputies in Flagler County stopped 27-year-old Kaylee Poe after allegedly observing multiple traffic violations. The traffic stop led to a DUI investigation and arrest. Authorities later alleged she attempted to conceal Xanax during the booking process, resulting in additional charges. This body camera footage captures the events as they unfolded. >> Hello, I'm Deputy Medina with Flagler County Sheriff's Office, okay? The reason for the stop today is not only did I watch you drive the wrong direction on Palm Coast Parkway. You went eastbound in a westbound lane, okay? It's a one-way lane. You went eastbound in that lane, okay? You pulled out of the apartment complex, which I watched you turn around in. You pulled back out. You came back out. You failed to yield to oncoming traffic. One, two, you also did not stop uh prior to entering a public roadway from a private roadway. Does that make sense? Is there any Can you roll this down, please? I know it's just your child. What Just roll that down for me. Okay. >> Um I'm not from here. >> Okay, well, there's big red signs that say do not enter or wrong way or there's one-way signs. They're all over, okay? With that being said, you've committed multiple traffic infractions. When I initiated my traffic stop, you stopped in the very middle of the of the intersection. Do you understand that? Do you understand how dangerous that was for not only your passenger, but the child in the backseat of the vehicle for stopping in the direct intersection prior to me even initiating my traffic stop. Does that make sense? Before I even initiated my traffic stop, before I put turned my lights on and my sirens on, you were in the middle of the intersection. You had stopped in the middle of the intersection. You ran the red light and continued to sit in the middle of the intersection. Okay. With that being said, step out of the vehicle for me. >> I'm not going to run away. Can I get my phone out of my pocket? >> Yep, you can take your seat belt off. >> So, why am I stepping out of the vehicle? >> You stepping out of the vehicle for our safety, for your safety, because I believe at this point you might be intoxicated. You are not listening to any of my instructions. You ran past the You ran past the red light. You didn't stop. You continued forward, and you cannot answer simple instructions. So, I need you to step out of the vehicle. >> [crying] >> Okay, step back here for me. Is your driver's license in the car? Okay, is there registration or anything to the vehicle? Yep, that's fine. >> Yeah, there Yeah, it's registration >> Can you just stay up here with her? All right, let's hop back here. Is the vehicle >> My driver's license is in my purse. >> Can she get it for me? >> Um Yeah, she can get it. >> Okay. Let's step back here. Car smells like marijuana. Back here. You can lean your body butt up against my car, cuz you look like you're having a hard time keeping your balance. Okay. I It's okay. I get it's cold, all right? The only reason I'm so frustrated with you right now is not only did you put multiple citizens in danger, you put your passenger and that child in danger. Okay? I hadn't even lit you up with my lights, and you were you'd run the red light, and you were sitting in the middle of the intersection. >> about this intersection? >> This one right here. >> This one? >> You ran the red light, and you were sitting in the middle of the intersection. >> You had your lights on? >> That was before I even had my lights on. You can watch the actual video of it from my dash cam. Okay? Is there a reason why you might be having such a hard time following traffic laws tonight? >> Yes, I'm coming from Orlando. >> Okay. >> And we're trying to figure out what we're doing, cuz okay, we're supposed to be dropping her son off. >> Okay. >> And I thought that we were going to Savannah >> Okay. >> to meet up with um the her baby father's mom. >> Okay. >> I thought that she was going to meet us there. >> In Savannah? >> But I guess in Savannah. They're coming She live The father lives in South Carolina, somewhere in South Carolina. >> Okay. >> And so like it was just a big misunderstanding and so it was like a mix-up plan. >> Okay. >> And >> So do you live in Orlando? >> Yes. >> Okay. So you live in Orlando. What's with the West Virginia temp tag? >> Uh this is my family friend's car. >> Okay. >> Yes. >> Okay, and they live in West Virginia. How did it get here? >> Uh it got here What do you mean as in like >> Like it's from West Virginia. How did it get here to Florida? >> house in Deland as well. >> bag is it in? There's like four of them over there. >> What? >> They're black. >> They're black. >> The big one? >> No, um >> Cuz there's the big one that she just looked in and then the smaller one that was there. >> The rectangle small one. >> The one with the makeup in it? >> The rect- It's Yes, there's makeup in it. It's a rectangle Steve Madden. >> Okay. >> No, I'm sorry. Not Steve Madden, Marc Jacobs. >> Okay. With that being said So you're coming from Orlando. You have West Virginia temporary tags on the vehicle. Is the vehicle registered to you or is it registered to your friend or or family member? >> It's registered to a family member. >> Your family member, okay. Uh and they're letting you use this >> Um he's a friend of the family. >> Okay, and he gave you access to this vehicle. He lives in Deland. You're using it to take your friend to Savannah. >> He lives in Deland. Well, he lives in West Virginia, but he goes in Deland cuz he has a car auction. And like a buy here pay here and he goes to the auction >> that real quick and bring it here? If you want a purse, it's right here. Yeah, you can zip it up. >> He has a buying a pager in Deland and in West Virginia and he bought a house in Deland and he comes down to Deland to buy cars from the auction. >> Okay. Okay. Alrighty, is there any reason you guys are in Palm Coast right now? >> Yeah, cuz we're trying we're going up to drop off the shipment. >> Okay. Do you have a medical marijuana card? Cuz I can smell it coming from your vehicle. It's very strong, there's no doubting it, okay? You don't have a medical card? Okay, have you smoked in the vehicle, had it in the vehicle, anything of that nature? >> I don't smoke weed. I don't I smoke cigarettes. >> You smoke cigarettes? Okay, have you had anything to drink tonight? >> No, I didn't have anything to drink tonight. I'll take a breathalyzer test right now. >> Okay, cuz the your mannerisms, you you having a hard time standing, you're driving the wrong way on the road, a lot of a lot of cues are pointing to you being possibly intoxicated or under the influence of something. Does that make sense? >> Um I I'm just >> Okay. Here, I'm going to take this real quickly. All right, hang tight here for me, okay? Can you stand by so I can see if he's home? Hey. Can you check uh She's saying she hasn't had anything to drink. I'm not smelling anything. The car reeks of weed and she's slurring, her eyes are bloodshot, she's driving the wrong way on the road, she's not listening to instructions. >> Okay. >> Can you do your your evaluation to see if there's anything there? >> do my evaluation on the side of the road. >> Okay. All right. >> I can't do that. You have to You have to be 10-15 at the jail. I can't do my evaluation >> I'm going to uh I'm going to toss this car. >> Okay. >> Could you help me with that? >> Yep. I think we're going to have to get that. You want to take her to one of our stations? >> It's hard to tell. I can't tell if she's cold or if she's under the influence of something. >> You do your investigation. You run this through field. You do your investigation. and we make our decisions based on totality. >> They're trying to get to Savannah, Georgia. >> To Savannah? Yeah, we're from Tampa. From Tampa. So, how long have you guys been driving? Not for long cuz >> Is there a reason why she might be so tired? Is I'm sorry. Can you say that one more time? >> Yeah, I told her she was going to keep going to um Savannah. But I said, "Hey, let's go to Atlanta cuz that's closer." So, I think that's why she said turn around instead. >> So, she turned around? >> I was paying attention to the video. >> All right. Do you have a medical marijuana card? >> Um I don't. I think I might have lost it. >> Okay. All righty. At this time, I believe that you might be under the influence of something. Would you please submit to field sobriety exercises just so I can determine whether or not you're safe to drive. Okay. What I'm going to have you do is I'm going to have you stand right over here for me. Okay, you see right here at this spot? There's no issue. You agree that the ground's flat. There's no issue. Okay. Can you stand with your feet together, hands at your side like so? All right. With that being said, please do not move until you say that you understand. Okay. Do you have any issues with your legs, balance, any medical issues that I should know about? Okay. Do you wear contacts? Do you wear glasses, anything of that nature? Do you have a fake limb, anything like that? Okay. Can you light it up real quick, please? All righty. Do you see the tip of my pen here? Can you touch the tip of my pen with your finger? >> Yes. >> Okay. All righty. What I'm going to have you do is I'm going to follow the tip of pen with your eyes and your eyes only. Do not move your head. Do you understand? >> Yes. >> All righty, how long have you been driving tonight? >> Orlando >> First, do you mind >> I got 12. >> Danny, would you No, no, right here for a second. >> Cuz we're 15 minutes away from the land and the land is about an hour away from Orlando, so probably close to 2 hours. >> Give me a second. One second. Meeting for discussion. You mute. All right. See what's going on with her and see if there's a valid license in the car. No, the passenger. >> Passenger? >> Passenger. I don't know. We don't know. In case cuz either way she's not driving. >> Oh, yeah, yeah, yeah. >> Well, we'll determine that after we conduct the field sobriety exercises and see if he can drive, okay? Clearly, I haven't seen you sway. I don't think there's an issue. We'll We'll go about it after we finish this and we'll go from there, okay? >> Okay. >> So >> I'm pretty sure I have to deal with them. >> This is one of our cars, our old ones. Cuz when I lit it >> of our auction cars. >> When I lit it, it said Flagler on the It was like the the old Like here, light it sideways. I'm telling you it's It's one of our old cars. Cuz I saw it when she drove past me and my lights hit it. It was the same markings that we have. >> Huh. That's like a dealer flipping the car. >> Whose car was it? >> Check it out. >> Yeah, I don't know. >> What was the final count? >> Okay. >> Do you have any questions? >> All right. Um so, here's the deal, okay? Deputy Medina has already explained it to you. Uh we're doing a a DUI investigation, okay? All right. Now is your time to be honest. Have you consumed any alcohol tonight? Okay, have you consumed any narcotics? Marijuana, ecstasy, heroin, cocaine, prune juice, I don't know, anything at all. Do you take prescription medication? No? Okay. All right. So, I'm going to check your eyes, okay? Do you have any head trauma? Have you ever been told you have a TBI? You would know cuz that would be explained to you. It's a huge sign. So, you've never been told you had a TBI? Okay. All right. Have you ever been told by an eye doctor or an optometrist that you have what's called resting nystagmus? No? All right. Do me a favor. Stand with your feet together like this. Perfect. Nope, together like this. All right. Take your hands out of your pocket, put them down by your side, all right? Do you see my pretty blue light? All right. I'm going to move this around. Follow it with your eyes and your eyes only. Don't move your head, okay? Do you feel it? >> Do you see it so far? >> Yes. >> All right. I'm going to write this down first. No resting nystagmus. Equal pupil size. Follow my head. Equal pupil size. >> I can go up, okay? One more time. Okay, stay right there. All right, this light is going to go around in a series of circles, okay? All right, it's going to come close to your nose. I want you to let your eyes cross naturally, okay? All right, I'm not going to touch you. Don't touch me. All right? All right. One more time. Okay. All right, you can relax. Uh Uh Can we go over there? It's a little bit flatter. >> Okay. >> Yeah. Um All right. Uh give me one second. I'll grab tape. Okay. So, that's not what that is. >> Tag it out on the side. >> It's not a plate. All right. We're going to go across the street, okay? >> All right. Let's go across the street. >> You go ahead. >> Go ahead. >> Thank you. >> All right. >> All right. We're going to line you up this way. All right. Are you comfortable in those socks you're wearing? >> Um not really. >> Can you walk in them? >> Yeah, yeah. I can walk in them. >> Okay. All right. Deputy Medina is going to give you a set of instructions. Are you able to walk up a flight of stairs? >> Yeah. >> Okay. All right. Do you have any lower lower leg injuries like artificial limb, false leg, anything like that? >> No. >> Okay. You got a real leg? You got two real legs? >> Yeah. >> Perfect. Okay. >> All right. >> So, we're going to have you stand down there. >> Do you see this center line here? >> Do you agree that this line is relatively straight? >> The yellow one? >> Yeah. Relatively. Like I said, we're not perfect. We don't have to be perfect for that or anything, okay? Do you agree that this is as level as we can get the ground? >> That one on the ground? >> Level as we can get the ground. We're not making you do it up there on the hill. That's why we brought you over here. It's a little downhill, but slightly. Okay. All right. >> Okay. All right. With that being said, you're going to place your left foot on the line, okay? You're going to place your right foot on the line ahead of your left foot with your with the heel of your right foot against the toe of your left foot. Okay. Place your arms down at your sides. Maintain this position until I have completed the instructions. Do not start to walk until I've told you to do so. Do you understand these instructions so far? >> Yes, ma'am. >> Do you have any questions about these instructions so far? >> No. >> Okay. When I tell you to start, take nine heel-to-toe steps in the line on the line. Turn and take nine heel-to-toe steps down the line. When you turn, keep your front Keep the front lead foot on the line and turn by taking a series of small steps with the other foot like so. So, you're going to have your left foot on the line, right foot like here. Deputy Harmon is going to explain that to you. So, you see that you see how he's doing it? >> starting position like this, the light. Your arms will be down by your side. Put your arms down, okay? All right. You're going to take nine heel-to-toe steps down this yellow line, counting out loud, looking down at your feet. Keep your arms down by your side, okay? It'll be one, two, three, four, five, and so forth, until you get to your ninth step. Once you get to your ninth step, leave your lead foot planted on the ground, take a series of small steps to turn around, and then nine heel-to-toe steps back down the yellow line, okay? One, two, three, four, five, and so forth, until you get to nine. Once you start the exercise, do not stop, look down at your feet, keep your arms down by your side, and count your steps out loud. Does that make sense? >> Yeah. >> Do you have any questions? >> Uh, no. >> All right. Whenever you're ready to begin, you may begin. >> I count? >> Yes, ma'am. You count out loud each step. >> Okay. One, two, three, four, five, Oh, I'm sorry. Seven. Six, seven, eight, nine, and nine, turn around. Can I try on some shoes on? >> What's that? >> Can I try on these shoes on? >> I asked you if you're comfortable in your shoes. >> Yeah. >> Don't stop the exercise. You got to I can't help you for that's why I asked you if you had any questions. You got to continue on. >> Yeah. All right. So, my ninth foot turned around. This is my ninth foot. >> Okay. >> I'm ready again. >> Okay. >> One, two, three, 4 5 6 7 8 All righty, turn around for us. All righty, with that being said, we're going to >> want a handshake, whatever? >> Yeah, I I have my um I saw something about it. >> Okay. >> I'll review it and go over it from there, but >> I got to learn a shorthand. What I'm getting ready to do. >> write on your thing. >> Oh, I don't care. It will come off. >> All righty, we're going to do that same position again, okay, with your feet together and your hands at your sides, right? Can you take your hands out of your pockets for us? I know it's cold, I'm sorry, but just feet together, hands at your side, like so, like Debbie Harmon's doing, okay? Do you not start Do you not start until I tell you to do so. Do you understand the instructions so far? >> Yes, ma'am. >> Okay. When I tell you to start, raise either leg your Either leg with the foot approximately 6 in off the ground, keeping your foot parallel to the ground, okay? You can use either leg, right or left. >> Either side. >> So, like here Can you give an example? >> Yeah, so when she tells you to do so, you're going to raise either leg of your choice. You're going to have your foot parallel to the ground, approximately 6 in. Okay? You're going to look down at your raised foot, like that. Look down at your raised foot and count out loud in this manner, 1,001, 1,002, 1,003, 1,004, 1,005, and so forth until we tell you to stop. So, you're going to keep counting until we tell you to You're going to look down at your raised foot with it 6 in off the ground, arms down by your side, and keeping both legs straight. You keep counting until I say to stop. >> Okay. >> All right, does that make sense? >> Yes. >> Do you understand? >> Which foot are you going to raise? >> Uh My right >> My foot. >> Your right foot, okay. >> All right. All right, you may begin. >> 1,001 1,002, 1,003, 1,004, 1,005, 1,006, 1,007, 1,008, 1,009, 1,010, 1,011, 1,012, 1,013, 1,014, 1,015. >> All right, you can stop. All righty, we're going to walk back over to the patrol car once it's safe, okay? I'm going to get back over there up here. >> Okay. >> Okay, after this car, okay? We're going to walk right back over to the front of my patrol car, okay? All right, let's head that way. Yep, right over here. Stand right here, okay? One. All righty. They're both up. Oh, no, one's there. My guy's in this car. You can lean your butt up against here. I know it's cold. Just give me a second. You're okay. It's cold for us, too, I promise. Just give us a sec. No, you can Just don't sit all the way on the car, so you can lean on it. All right, just give us a second, okay? Hey, what did What did it come back to? What did it come back to? >> Yeah, Ronald Fleming. >> Is that right? >> Ronald Fleming is. >> Yeah. >> All right, ma'am. You're being placed under arrest for driving under the influence, okay? All right. >> What? >> Mhm. Based on everything that we observed, your driving pattern, you're under the influence of something. Okay? You're driving the wrong way down the street with a baby in the car. Let me know. Did you search her? It's off. It's off. >> Do you have anything on you that you stick close to you? Do you have any money at all? >> All right, here's the deal, okay? I ask this question of everybody, it's not just towards you. I promise you that, okay? Is there anything on you or inside of you that is illegal? Drugs, knives, hand grenades, pistols? Okay. Cuz here's the thing, when you get down to the jail, you're going to go through a body scanner x-ray machine. If they find it once you go in the jail, it's a felony. Right now we're dealing with a misdemeanor. So, if you tell us now, we can take care of it. No? Okay. Yeah. >> Do you have your cell phone on you? >> No, I'm never in traffic. >> Hey, what uh >> What are you from? >> Oh, oh, Pasadena. Hey, okay. So, I'm going to read you something real quick, okay? Cuz I have to ask you a couple questions. You have the right to remain silent, anything you say may be used as evidence against you. You have the right to talk to an attorney, have him or her with you now or at any time during questioning. If you cannot afford an attorney, one will be appointed to represent you. Any time you wish to stop talking or have an attorney present, all questioning will be stopped at your request. Do you understand? Do you understand that? You don't under- Okay, so I want to ask you a couple questions that may or may not be incriminating to you. This isn't saying you're under arrest right now. This is just saying I want to ask you some questions. Does that make sense? >> Yeah, yeah. >> Okay, are you okay? Do you understand your rights? Do you need me to read them again? >> No, no, I I'm okay. >> Okay, I I just need a verbal yes or no that you understand them or you don't understand them. Okay. All right, and with that being said, are you okay with Okay with me asking you a couple questions? >> I have no problem. >> Okay. So, the bag, the the big one, the white or the lighter colored one, whose bag is that? >> I got that from Walmart today? >> Yeah, and I left my things in her car at Walmart. I went to Walmart. I left stuff like we went to Walmart twice. So, my things were in her vehicle for a while. >> Okay, do you know where they were at in the vehicle? >> Um probably in the front or in the back. I don't know. She was moving stuff around. Um >> Okay. >> I just asked her like for a favor to drop me off like at my daddy's cuz I don't have a car right now. >> Okay. >> Um I don't know. Like I've known her for like a few months. She lives like in Orlando. I live in Tampa. >> So, what what's in the bag that you know? What did you put in the bag? >> I I just got that from Walmart. So, >> You just got it. >> It should be like a sketchbook. It should be crayons. >> Okay. >> Um Um and that's it. I do have a Xanax prescription. >> So, should there be Xanax in that bag? >> Um if it's in my bottle. >> Huh? >> If it's in a bottle, then yes. But, if it's not in my bottle, then no. Um I take Adderall. >> Okay. >> That's my prescription. So, I've had >> All those bottles have the prescription bottle there. You'll get there. >> Okay, yeah. I've had a psychiatrist for 2 years. I I'm just like infuriated because >> It's not her car. No, you're good. So, with that being said, I know you told these deputies that the weed is yours. We're not worried about a little bit of weed. So, what what THC just cuz I haven't really looked through it, what THC products do you have in that bag? >> It's my boyfriend's. Um, they should have like these weed cuz I literally like I rushed out, I took the little lunch box cuz I know I had a lunch box and my boyfriend like stays with me, so >> So, your boyfriend put THC products in your child's >> No, it's my lunch box. >> Okay. Okay, so your boyfriend put the THC products in your box knowing that you were taking your child to his house. >> He didn't know that it was weed in there. I don't know. Cuz he literally told me before he's like, "Hey, like you can't drive with that stuff if it doesn't have a weed license." But, that's his bag. >> Okay, so with that being said So, where are the THC pens from? >> That's my boyfriend. >> Okay. So, you said you just got this bag. >> Yeah. >> You just got these bags. Your boyfriend These are your boyfriend's pens, not >> I don't know if they're her pens or my >> You just told me that your boyfriend they're your boyfriend's. So, why do you have possession of them? >> I don't know because I'm staying like my stuff is in the car. I told you that they were your boyfriend's and I never gotten in trouble in my life. I just asked for a favor. Like I clearly >> So, so you've already told me that the THC products in the bag are your boyfriend's and that they're in your lunch box. Did you bring them for her? Like did Is it his that you brought for her? Okay. Okay. She doesn't drink alcohol, but Okay, but she's an intoxicated driving your child. She's under the influence of some kind of You guys were driving the wrong way on the road. >> I feel you not to worry about that. Okay, so we went to Walmart. We stopped at the apartments. >> Yep. >> She stopped the car and she took the bag of pizza, right? So I told her, "Hey, don't drive me in." And then I was like, "Hey, she told me she has a house in Deland. It's a land. That's empty." So I was like, "Hey, like >> So you're going to go from Tampa to Palm Coast and back to Deland. >> No, no, no. I was going to go to Deland because she has a house there. I was like, "We should >> Okay. >> Because not because I assumed anything was wrong, but because um it's not tomorrow. Um actually Um you guys can just drive tomorrow. And that was like at the party. So I was like, >> So so the issue that we're having right now is the THC products that are in your bag. You claim the bag is your bag. >> It's It was in the car. >> I I get No, I get you're saying that she could have had possession of Okay, that's not >> It's a white, but it's a white >> But what what what what I'm trying to figure out is where it came from in the first place. You're saying that she probably got it, but you're also saying that it's your boyfriend's. So you see where the story is not really matching up there and >> Um I understand you >> Okay, but you don't have a medical marijuana card. >> I'm allowed to get one. >> You're allowed to get one, but you don't have one. You already told me you don't have one. >> So I don't know if it's Okay. >> So what's [crying] happening is you keep lying to me. Okay? He wasn't crying. Okay, I I get that, but you've lied to me multiple times already about the products in the bag, okay? >> you I'm not lying. I'm I'm just explaining that my boyfriend >> Can you stand up for a second? So she says the the THC products are her boyfriend's. That she she says, "Oh, they're her boyfriend's. She thought she that he put them in her bag cuz he didn't know they were leaving today. But she says, "I don't know. It could be hers." So, I'm going to go up there and interview her real quick, right? And be like, "Hey, >> If no one's going to get ownership of the suitcase >> She's going to go Cuz she keeps lying to me about whose it is. Hey, I'm going to read you something real quick, okay? All right. You have the right to remain silent. Anything you say may be used as evidence against you. You have the right to talk to an attorney, have him or her with you. You can now at any time during questioning. If you cannot afford an attorney, one will be appointed to represent you. If at any time you wish to stop talking or having an attorney present, all questioning will be stopped at your request. Do you understand these rights? Okay, with these rights in mind, you mind answering a couple questions for me so I can figure out what's going on here? I need a verbal yes or no to see you understand the rights. Okay. With that being said, the THC products in the car, the those there's a joint and there's a couple THC pens that were found in her bag. Okay, do you know anything about those? >> Yeah, they're her boyfriend's. >> They're her boyfriend's? Is there a reason why she might have them? >> Um she had them. He gave them to her. >> Okay. Do you use them? You don't use them. So, you've never touched them. You had no knowledge of them being in the bag or didn't have knowledge of them being in the bag. >> Um I wasn't I didn't know she brought them, but then she had them. >> Okay, so you didn't know that she had brought them. Was she using them at any point in the trip that you guys were coming up here? >> I probably didn't notice them. Like I don't know. >> You don't remember seeing her use them at any point. Okay. So, you knew that she had them. You're aware that that they're hers. But you've never touched them. You didn't use them. You wish you had them in your bag. Did she tell you you she had them? Did she like to say, "Oh, my boyfriend he did this." Like, what what happened for you to find out that those were hers? >> She just told me that I cuz I I want her to be happy cuz he doesn't treat her good. >> Okay. >> And she was like, "Well, I use him cuz he takes me to a distance with me." >> So, he has the car and she uses him for the car. Perfect. I appreciate you. Thank you. And she's gone. She keeps lying to me and she says she hasn't used any of the products. She keeps lying about it. About the THC. So, she's gone. All right. All righty. Hey, can you can we Are you okay with Deputy Harmon grabbing your child for a second? He's going to freak out. Okay, are you able to set him somewhere? See, Deputy Harmon is really good with kids, so just Yeah, I'll take it. Just hold on to him for 2 seconds. Her not. She's getting the hatch. The weed. How much is it? >> It's just a roach. >> No, it's not worth it. It's not enough. Just hold on for for 2 seconds. I'll put it in the other stuff. Where did you Which bag did you find it in? Was it in the colorful bag or the other bag? >> It was in this bag this one. >> The the darker one. All right. >> a clown. You have a clown. Where's your bunny at? I gave you a bunny. >> Yeah, she's up there. But >> Ma'am, do you have somebody coming in or I know it might take hours, but is there somebody that could be on their way cuz I'd be more than happy to sit with your son over here at the substation or wherever it is secure at night? >> It's my aunt. I can call her. She'll be here in an hour. The reason why I brought him is cuz he likes to >> Okay, that's fine. Do you mind just stepping out for us real quick? >> You said your auntie's coming? Okay. All right, just hop out of the vehicle for us. That's okay. I just need you to step out and put him down for a second, okay? Yeah, no, that's okay. He's going to sit right there for a second. >> Sorry about that. >> I'll grab it. I'll grab it. >> Okay, we just need you to set him down for a second, okay? It's okay. I can see. Yeah, you need >> Just put your hands on the back of the All right, you're being placed under arrest. You're being placed under arrest for the THC pens. You keep lying to me about it. All right. Whether or not she put it in your bag, she's claiming that you have gotten it from your boyfriend, which is accurate to the to the story you told me that you got it from your boyfriend that he put it in there. You ended up telling me that she that she might have put it in there, but then you continuously kept telling me that the boy your boyfriend put it in there for you. Yes, I would love for you to explain. I I would love for you to explain. >> I have never been asked about anything and I've never been pulled over or arrested. Do you know anything about that? So, I'm just listing whoever I can think of cuz I don't know why she got pulled over. I was really just with my kids. >> Okay. >> They're the only people I can think of. >> So, what we're going to do is we're going to walk up to the other uh Harmon, are you this one? No, we're going to put her in Harmon. We're going to walk up here. >> What is it? >> even been pulled over. I don't know >> Okay. Walk this way for me. >> I'm sorry for >> Okay. You're okay. Let's go over here. All right. What I'm going to do is I'm going to have you lean up against this car, Harmon, right here. Just like lean your chest up and spread your feet for me. You don't have anything on it, clearly. I'm just going to shake this out of her. Do you have anything in your pockets that I need to know about? Anything that's going to stick out or poke me? Okay, do you have anything in you on you, anything that could be considered contraband or anything of that nature in your shoes? You got some pretty tall boots, right? Okay. All right. Are there anything in your boots? Let me see the other side. Just lift your foot for me. Don't go backwards like Okay. Lean your chest here. No, you're okay. That's why I had you lean your chest here. Spread your feet, Harmon. Just spread your feet, Harmon. And then you have to stop. >> All right. >> You can turn it off. What I was trying to explain to her is that she was asking me what it was. I'm just trying to make you understand that we have a car which is not mine. >> Which car is it that you're driving? >> Yeah, I'm allowed to get my mom's car. I take um you know how kids have food stamps. So that's all I was trying to explain to him. Cuz I'm trying to walk and I'm just like I don't know. It's either in the gray car or the blue car. I don't know which one. I don't know. You don't know what it is. I don't know what it is but I do like I'm authorized to drive. >> But you don't know. >> No, cuz I don't smoke marijuana. >> Okay, but that doesn't matter, okay? >> Yeah. >> Okay, that is your bag. So can you grab your bag? There are some big bags in the big bags of the DXC, okay? >> Was it my black bag or the blue lunch bag? >> It was in the blue lunch box that was in the >> Okay, so that was in the blue at the house. So I use that I use that lunch box. He uses that lunch box. He has told me before so many times you will get in trouble if you drive with this. I didn't know he put it in there cuz he usually says >> So you were warned that you would get in trouble and that's not a particular law. >> I was trying to I didn't think it was in there cuz that's why I was driving at the house and I literally I just like thought the backpack like I just was going to get my Nana cuz he got asked to break like his hand cuz his mom was in the I don't even understand I don't know I I've never been in this situation. I care >> They have a clean record. He might have another marijuana he might have this he might have that but you got to be you got to understand in our predicament, okay? Our perspective. I want to believe you. I wish I could believe you but what you're telling me may make sense make sense to you but it doesn't to me. >> Yeah. >> Okay? Because if you are being warned that you may have something that you're not supposed to have in your possession after you leave. Mind you, you were warned. In general, as well as What is in that box? Like, what that much box? Why is it so important? But he's not here, so why did you take it? >> So, everything's out of here, okay, right? So, if I need all this cuz our family knows he has this card. >> Yeah, but do you >> That's the question. I think that's what Deputy Maes is explaining. >> Okay, so what I've what I've gathered so far, okay, hear me out. You're saying that I'm I'm not frustrated with you, okay? What we're trying to do is we're trying to get down to the bottom of what's going on. You're good. What's going on >> You okay with all of this? >> Yeah, we're fine. >> It It seems like I'm lying. I'm just frustrated. I'm pissed off. I don't know why >> I would see why you're pissed off because your friend is driving inebriated with your 2-year-old in the car. She wasn't just swerving. You guys were driving into oncoming traffic. Regardless of that, the issue that we were coming across here is that you're lying to us, okay? This could be easily settled, all right? You have the THC pens in your possession in your bag. You've told me already that they they are your boyfriend's, right? We've already Hear me Let me Let me walk you through it. Let me walk you through it. Okay, you've told me already that the THC the THC pens are your boyfriend's because Who hit it? Oh, the baby hit Torres's. He hit your uh >> Is that you? >> Yeah. Oh, hold on. What's >> That's not us. >> Okay. >> You keep on spiraling more and more. >> this >> understandable. Okay? Look at me as a law enforcement, right? Okay. >> So, I'm 24 >> Let's say let's say open carrying was illegal in Augusta It's not anymore, but let's say it is. Okay? I I out of uniform, I'm not a cop, I'm not a deputy, but I have this gun displayed right now. Okay? Someone approaches me, an officer approaches me, stops me, and is now detaining me because I have this public carry that I'm not supposed to have, right? Okay? >> How old are you? >> I'm 24. >> 24? And I tell the officer, "Listen, I understand, you know, I'm not supposed to have this. I get it, but it's not mine. It's my father's." >> Yeah, I don't >> It doesn't matter, okay? No matter who you're saying truly owns that product or item, >> It's on me. >> you still have it with you. >> It's on me. >> Okay? And so, to you, you may disagree, this may not make sense. To us, there's a backpack, it's your backpack, it's in the car with you. The actual owner you're claiming >> It's on my backpack. >> is is nowhere here. >> It's in my backpack. It's mine. It's like I have the white backpack. >> No, the vapes the those THC pens were inside of the blue lunch box that I guess you have been warned before that there might be stuff of that sort in there. >> I don't know. The blue lunch box is not in my backpack. It was in the car and I put it in the backpack cuz I was going to get my stuff. It's easy to take it with me. >> So, the blue lunch box that you originally said was >> No, no, it's it's in >> And you're saying it's no longer yours? >> No, no, I'm saying it's not in the backpack. >> Regardless, it's >> You're the You just told us that See, and that's another lie you just caught yourself in because you just told us that you put the lunch box in the backpack. >> I'm I'm not I'm not I'm not here to attack you in any way. >> No, we're trying to figure out where this is at and why it's there. >> Okay, look, understand that lunch box, okay? Let's say it wasn't in the backpack which you found with me initially, it wasn't. It doesn't matter. You own that lunch box. >> But it's not It's with me and it's my dad's. >> This this is your car that This car that definitely you need to pull over. Let's take you completely out of the picture. Let's use your friend's car. I get it. You're pissed right now, but you're sitting right here in handcuffs. You've got your 2-year-old. The whole situation is very scary. Hold on. You good for a second? The hash? Hey, so what we're going to do, turn around for me. I'm going to take these off, okay? I'm going to explain to you. All right. Turn around. Okay. Lean up against the car. What is your first name? What What's your first name? Liz, okay? I don't know what you told us, Deputy. Okay? I don't know. I wasn't there when you spoke to him. Okay? Here's the deal, okay? You could be going to jail tonight over some stupid THC. It's a felony. All right? But what we're not going to do is separate you from that baby. So what Deputy Medina is going to do is she's going to forward charges to the State Attorney's Office for what we would have taken you to jail for. So basically, the charges go to the State Attorney's Office. If they decide to file on you, then you'll be contacted. Make sure you get her the appropriate contact information. Mailing address, phone number, and all that, okay? If you don't go to court and take care of your business, you're going to have a warrant. It's a felony warrant. Okay. But you need to understand that you need to pick better friends. >> Good person. >> You're driving the wrong way down the street with that baby in the car. I'll be honest with you. I don't care about I don't care about what you're doing. I care about that innocent baby right there that is beautiful. >> And in and in my license I do have glasses in it so it's hard for me to see at night. >> Okay. >> I was paying attention to my baby. I wasn't focusing on what she was doing. So, I honestly have no idea where you saw her do that. >> You got it. But, here here's >> video, okay. >> I don't You don't have medical marijuana card. You should not have weed. >> No. >> Okay? You don't weed garden and it's all goes away. It stays in this prescription can. Do not have a THC All right? Stephanie Medina is going to take the handcuffs off of you and then you're going to give her all your appropriate contact information. And then we'll figure out if you want to be taken to a hospital or not. >> No, I just want my baby boy >> Okay. >> Hold on. Turn around. >> Do you have any blood Do you have any blood on you? >> No. I can't tell. >> Cash? Cash app? Do you have a card you can tap it? >> Roll your hand. Like roll it. Roll your hand out like >> Okay. I'll give you that all day. All right? I cannot stress this enough to you. You That child is the reason you're not going to jail. >> That's the reason. It's my whole life right here. >> There were three people right here that are all parents and I do not want to separate a family and a child. Okay? >> Can I have my phone? >> You're going to have to wait. >> And I >> Exactly. I don't know what what has been said, but I caught you in a lie. She's caught you in a lie. Honesty would be the the very next thing that would get you out of not getting your ass kicked. >> Can I just get >> Can you just get her the hot air in there? Can you just make sure she you get 14 on her so we can get to the jail? >> I got it. >> She's out of the car. >> Oh, yeah. >> You already have her in contact information. >> She should already >> Phone number is at mail and at >> 864 >> What is it? >> 864 437 12 Just make sure we got a good mailing address too. All right, I'll see you guys. Yep, I got you. >> By the end of the encounter, Kaylie Pooh was arrested on a DUI charge.
