Ma'am, turn the car off for me, let me see your keys. Cuz I don't think you are who you say you are. I think that you are the registered owner. So, turn the car off and hand me your keys. I'm going to let you know right now, if you take off from me, I'm going to chase you and force you off the road cuz I have that authority based on a charge. Turn the car off and hand me your keys. Well, here's the deal. Driver's license photo of registered owner of this vehicle who's wanted matches your face. The tattoo description in the warrant matches what I'm seeing on your body right now. The name that you're giving me, first of all, from your mother you gave me the wrong date of birth the first time, okay? And uh that woman is considerably older than you. So, what's the point of trying to put your mother in the mix of all this? >> WELL, >> GET OUT OF THE CAR! GET OUT OF THE CAR! Get out of the car! Get out! Unlock! Get out of the car! >> A routine seatbelt stop had turned into something much bigger. The woman behind the wheel insisted police had the wrong person, but as Sergeant Smith checked her story, the photograph, physical description, and information she provided began pointing in the opposite direction. Then he gave her one very specific warning, do not drive away. >> I'm going to be trying to pull this vehicle over. Driver's not wearing a seatbelt. She's probably 10-30 for assault. That's why it's on file. >> Okay, then. >> Blue Nissan Quest 7 Edward King 5097. Hot file says assault in first degree. No, let's not do this. Let's pull over like we're supposed to, miss. >> Get out of the >> Don't worry, man. My name is Sergeant Smith. We're being audio and video recorded. Are you Miss Timmons? Okay. So, the reason that I'm stopping you is in reference to no seat belt. Who are you, man, if you're not the registered owner? Okay. How do you know Miss Timmons? Okay. All right. Do me a favor, pull up here to the right underneath the 140 sign and we'll finish right there, man. We'll find out who she is in a minute. >> The vehicle was registered to a woman police believed had an outstanding warrant connected to a first-degree assault allegation. But, the driver said she wasn't that woman at all. She claimed the registered owner was her daughter. >> Can you roll it down further, man? So, like I said, my name is Sergeant Smith. We're being audio and video recorded. Reason I'm stopping you is because you're not wearing a safety belt. Do you have your driver's license or registration? >> No, sir. >> All right. >> I just dropped my daughter off. >> Okay. Would that be Miss Timmons? >> Yes. >> Where'd you drop her off at, man? >> Um by the school. >> Cuz she's a wanted fugitive for a violent felony. Assault in the first degree, aggravated assault. >> Okay. >> So, I'm going to advise you now and I'll let you know on camera. If you're providing her with transportation or place to stay, that's a crime punishable by imprisonment in the state penitentiary. So, you're required to turn her over. No, ma'am. The warrant is outstanding. What's your last name, miss? Can you spell it for me? >> My last name? >> Yes, ma'am. Hines? What's your first name, ma'am? What's your date of birth? Where do you live, ma'am? All right. And that's a house, correct? All right. Where's your daughter now, ma'am? Where'd you drop her off at? At the We're, ma'am? Okay. Does she have her child with her? All right. Just hang tight, ma'am. I'm going to run your information, okay? So, what it looks like is that your daughter has a Baltimore City Sheriff's warrant for assault in the first degree. So, when this is done, is that your grandchild she has? >> Yes. >> All right. What we're going to try and do because here's the issue. If we end up getting your daughter and there's no one to take the child, then the child would end up having to go to CPS. So, the easiest thing, since it's your grandchild, is when we're done here is for us to simply go over there. All right, I'll call the Sheriff's office, make sure that the warrant is still open, and then that way you can take Is it a little boy or a little girl? That's correct, because when I ran the tag on this vehicle after I saw you with no seatbelt on, you and your daughter have some resemblance, and I wanted to make sure you didn't drive away from me if you were wanted for a violent felony. All right, hang tight. Ma'am. I like all manner of meat, ma'am. Are you 10-8? I'm going to send you photo. I want you to go to that playground on Rogers Avenue and look for this woman. I pulled the car over with her mother in it. Uh the female, they obviously look alike. She said she dropped her daughter off at the playground, which is who you're looking for. If she's there, it appears she's 10-30 for assault in the first degree. So, I'm going to send you a picture of this woman. Just swing by there, and if you see her, she should be with a child. Go ahead and hang tight with her. I'm going to finish up with the mother. And then hopefully we're going to drive over there so she can take her granddaughter in the event that we're going to lock her daughter up. Yeah, the one there between um Park Heights and uh Rice Town. Yes, it is. All right, I'm going to go ahead and send you the photo. All right, bye-bye. Make sure this woman I'm going to ask who she says she is, which is a possibility that she's not, but let's make sure she ain't. I don't believe that's that woman at all. I do believe that would be her daughter. So silly. >> Smith now had a simple problem to solve. Was the driver really the wanted woman's mother, or was the wanted woman sitting directly in front of him? The identification check was about to answer that question. >> What's your date of birth, miss? What do you have with your name on it, miss? Anything? Ma'am, turn the car off and hand me the keys. >> Why? >> Cuz I don't think you are who you say you are. I think that you are the registered owner. So, turn the car off and hand me the keys. I'm going to let you know right now if you take off from me, I'm going to chase you and force you off the road cuz I have that authority based on the charge. Turn the car off and hand me the keys. >> I'm going to swear out a warrant. >> You can do that. Hold on. >> I'm not. >> F34 10-11 to my location. >> 34 >> 10-11 >> All right, he's in trouble for the registered >> Yes, ma'am. You're fine, ma'am. You're welcome to go ahead and record and do as you please, ma'am. I already told you who I am and that this is being audio and video recorded. So, you have no photo identification, correct? Well, here's the deal. Driver's license photo of registered owner of this vehicle who's wanted matches your face. The tattoo description in the warrant matches what I'm seeing on your body right now. The name that you're giving me, first of all, for your mother you gave me the wrong date of birth the first time, okay? And uh that woman is considerably older than you. So, what's the point of trying to put your mother in the mix of all this? >> Well, you told me to explain the situation. Ma'am, hold on. >> Oh, yeah. >> 09, I'm going to be following this vehicle. Driver's wanted for assault in the first degree. She just pulled off Northern State Parkway. We're going to be traveling eastbound on Northern State Parkway. It's going to be a blue Nissan Quest, 7 Edward King 5097. Yep, registered owner's driving it. She's 10-30 for first degree assault. See if we can block her in. >> She had already been warned exactly what would happen if she drove away. Now, Smith was following the Nissan while other units moved into position ahead of it. >> Crossing over Woodcrest, still on Northern State Parkway. It's a blue Nissan Quest van, 7 Edward King 5097. She's traveling roughly the speed limit. She's not stopping. Still eastbound on Northern State Parkway. If units can get up here, we can block her in. Traffic's heavy. All right, units coming up. Get around me, get in front of her, box her in. Get around her and box her in. Still eastbound on Northern. Get in front of her and gradually slow down, and we're going to go ahead and execute a rolling road block. There we go. There we go. >> GET OUT OF THE CAR. GET OUT OF THE CAR. Get out of the car. >> Get out. >> GET OUT OF THE CAR. Get out of the car. Get the [ __ ] out of the car. Get out of the car. Hit the brakes. Get the [ __ ] out of the Put your [ __ ] >> All right, she's got She's all right. >> Put your hands up. >> What is this for? Oh yeah, man. You broke me. Oh yeah. Y'all is paying for all this. Y'all is paying. Cuz I don't know what you doing on this phone. So. Whatever. Whatever. Excuse me. Excuse me. I'm on the ground. >> Is that your blood on the curb? >> That's my blood. >> Excuse me. >> I'm good. I'm fine. >> Ma'am, so now in addition to your warrant, you're also under arrest for fleeing and eluding >> Oh no, I'm not. No, I'm not. No, I'm not. You are. So you Everybody seen what you did on the road, too. And I was in front. Hold on. Nope. Man, they got the state. A cop already seen what was going on and watched y'all what y'all did. Right as I know. So they could have cut me off right there. >> Is that your blood? >> Yeah, it's Oh yeah. Good. I got to go to the hospital. >> Don't worry about it. >> I'm going to the hospital. >> Then you're going to jail. >> No, I'm not. No, I'm not. You going to jail. No, I'm not. No, I'm not. Excuse me. I need a medic. >> Ma'am, we got a medic on the way. Stand by. >> Right now. So y'all caused the accident, all this. Broke my window. Why the [ __ ] Y'ALL GOT GUNS LIKE Y'ALL GOT TO murder 20 people? You did that. And you assaulted me. Man. Where the female? I'm not going to [ __ ] >> Three parking lines on the ground. >> My back hurt. I ain't on no booking. The [ __ ] even what you ain't even run my freaking you already speeding down road this one is a school. >> You grab my bag. I'll put it in the car. >> Anyway, so Joe we're going to have a medic take a look at her. She's going to go to Sinai. She's going to get >> Okay, I want to let you know she's a sheriff's warning for felony assault. >> We'll verify >> Baltimore City. >> Yeah, and then we're also going to notify >> the form we're going to have fleeing and eluding. Fleeing and eluding and yeah, all that. >> That's fine. >> What are you doing? >> Lovely, lovely. Are there kids in the car? >> NO. I REMEMBER YOU. Excuse me, get off of me. >> Ma'am, calm down. >> Ain't you the one get No, I'M NOT. GET OFF of me. Excuse me, they Let CAN I GET UP? >> Uh not till we figure out what's going on. >> Yeah, because you're officers. I think you lost a little weight, but I think I talked to you one time and when my my son was in this hospital. >> Mhm. >> Excuse me. >> Ma'am, how much drugs or alcohol have you had to take today? >> None. How many drugs or alcohol have y'all took? Cuz the way how y'all acting is >> She's got She's getting a blast off. >> Yeah. >> Of course. Okay. >> We're going to finish the paperwork on the >> All right. So, here's what's going to happen gentlemen so everyone's on the same page here, okay? >> to the hospital. >> Yes, and then you're going to booking cuz you have >> That happened. >> So, our crime camera's going to come out. He's going to have the handle the level two. Okay, he's going to survey the scene. I mean, I don't know what witnesses you're going to find in the middle of the median, but he'll come out here and do his thing. All right, he's going to review all the body worn camera footage. He's going to have to take photos and so forth. So, I'm going to have one of you stay here with this vehicle because we have he has to photograph it in place. Then we're also going to photograph that door right there. Um >> And the my front of my car, my neck, my back. Y'all caused injury. Matter of fact, I'M WET BEFORE ALL THIS. >> HAVE YOU READ HER Miranda rights? >> We're not going to worry about that. >> All right. You have the American right to you. We understand your complaint. >> Nobody's questioning her, so that's not an issue. >> Ms. Timmons, you have the absolute right to remain silent. If you give up the absolute right to remain silent, anything you say can and >> what did you call me? >> will be used against you in a court of law. You have the absolute right to consult with an attorney before answering any of our questions. >> What was the charge again? >> during questioning, and if you cannot afford an attorney, one will be appointed for free. Do you understand that? >> Where is my keys? >> Uh your keys are going with your vehicle to impound. >> I'm not going to booking. >> Yes, ma'am. You're going to the women's side. You have a warrant for assault in the first degree. >> No, I don't. >> Yes, ma'am. Sheriff's office is faxing it. >> Are you sure? >> Yes, ma'am. They're faxing it. >> Oh, okay. >> So, stopped this vehicle for a moving violation, ran the tags as it was driving. Registered owner who's operating is wanted for a violent felony. When I got her stopped initially, she stopped for me. She started telling me, "No, I'm really the mother and everything, but I don't have my license." So, I went to verify with the photos to make sure that it really wasn't the mother. >> Right. >> When I confronted her with that reality, what do you call it, she took off. We ended up getting her stopped here with a rolling roadblock. She wouldn't exit, tried to ram the cars, ended up having her window broken, and got pulled out. She's 10-30 for assault in the first degree from the sheriff's office for a prior violent felony, and then she's getting 11 traffic citations for fleeing and eluding, running red lights, and all the other assorted foolishness. >> Mhm. >> She has minor cuts on her wrist and ankle from her broken glass. So, she's going to be going to the hospital more than likely unless she decides the medic is enough. She keeps going back and forth. She's clearly impaired, but we're not going to be able to charge her with it cuz she won't submit to any tests. But in any event, Crowd Kramer's coming up here to do the level the uh level two use of force. DeBerzy's going to go to Mercy cuz when he broke the window with his baton, he cut himself on some glass. We have the warrant being faxed down to bookings from the sheriff's office. And then I'm going to go ahead and write the incident report and a vehicle pursuit. >> Okay. So, the use of force was done by who? >> Use of force was by DeBerzy and several of the other officers. They're going to have to go through the video footage to see who exactly did what cuz it took four people to swarm her and pull her out. More likely Gallanos, Thomas, DeBerzy, and probably Smith. >> Okay. >> we'll take a look at It's The only reason it's a level two is because she cut herself on her own safety glass. >> Right. Okay. >> So, but I mean she didn't get hit or anything like that. And it would have been a level one anyway cuz she got a gun pointed at her cuz obviously. But in any event, once Crowd Kramer gets up here and gets the photos that he needs, there shouldn't be any issues. We'll clear this scene up. We'll have her vehicle impounded. And then we'll get it done. >> Were you here for it? >> I was here, but I didn't use force. >> You witnessed? >> I witnessed. I did not use force. Otherwise, I would have notified you. >> Okay. >> Yes. >> All right. >> Unless >> I I got you. >> Okay. >> It's okay. It's I got to clear myself, too, you know what I mean? Like I got to make sure I can I don't have to do anything additional. >> No, but this is a this is a good felony arrest. I'll be interested to see what her underlying charge is for cuz they only say it's the first degree assault. They don't specify. So, I'll be interested to see what the uh whether it's a cutting or what it is, but she's a very unpleasant individual. So. And her If if you want to uh at first we were concerned there might be dead babies in the car like that woman in the county. If you want to, I'm not saying you should, feel free to stick your head in that vehicle and smell the odor and then look in the cooler in the trunk, which is full of rotten It was It's full of what? >> Rotten food. There's rotten food in our trunk. >> You cleared it though, right? You made sure there was no >> We made sure there was no way to identify >> in the vehicle. >> No, that's good. >> That's good. I don't I don't need to hear I don't need rotten my nose. Thank you. >> I told I told everyone are you going to be on 9 to mile, sir? >> Yes. >> Okay, we can go over some road call. Everyone did a really great job. Did the road at road block, got her stopped, you know, gave her the chance, she wouldn't do it, broke the window, removed her with the minimum force. It was really good. And there was no vehicle accident or anything. >> Right. Okay. Sounds good. >> After the arrest, officers requested medical attention for both the woman and an officer. Sergeant Smith later explained that the officer had cut himself on glass while breaking the vehicle's window during the extraction. Police also said the outstanding warrant involved a first-degree assault allegation. Smith told other officers that additional allegations from this incident included fleeing and eluding, along with multiple traffic violations. The footage also captures officers discussing another potential assault allegation connected to the confrontation at the roadblock. Those statements describe what police believe they had at the scene. They do not, by themselves, establish what charges were ultimately prosecuted or how the case was resolved. One of the easiest things to miss here is that the pursuit itself wasn't really the beginning of the story. The decisive part happened several minutes earlier. At first, the driver wasn't simply refusing to identify herself. She was giving police an alternative explanation. She claimed the wanted registered owner was her daughter, and that she was the woman's mother. That temporarily forced Smith to investigate two possibilities. Either he had stopped the mother of the wanted woman, or the person named in the warrant was sitting directly in front of him and giving him somebody else's identity. That distinction matters because Smith didn't immediately treat his suspicion as certainty. He checked the information. And when he returned to the vehicle, he explained what had changed. According to him, the registered owner's driver's license photograph matched the driver. The physical description matched. He specifically referenced a tattoo. He also pointed to problems with the date of birth she'd supplied and the apparent age difference between her and the woman she claimed to be. Then comes another important detail. Before she drives away, Smith explicitly tells her not to do it. That makes the next sequence much easier to understand. Maryland's fleeing or eluding law does not require a Hollywood-style chase at extreme speed. The statute prohibits a driver from willfully failing to stop after the required signal from police. And listen to Smith's own radio description during this pursuit. At one point, he says she's traveling roughly the speed limit. The problem is that she isn't stopping. That's why the other units eventually move ahead of the Nissan and create a rolling roadblock instead of simply allowing the situation to continue indefinitely. There's also an important distinction concerning the injured officer. The footage establishes that an officer needed medical attention. But later, Smith explains that the officer cut himself on glass while using his baton to break the vehicle window. So, the footage supports saying an officer was injured during the arrest. It does not support turning that into a claim that the woman personally cut or struck him. Finally, officers at the scene discuss several additional allegations, including fleeing and eluding and a possible assault arising from what they describe as an attempt to ram another vehicle during the extraction. Those statements explain what police believed had happened. But an officer discussing a potential charge at the scene is not the same thing as a conviction. And the body cam alone cannot tell us the final disposition of every allegation. What the footage does establish is the sequence that produced the arrest. A minor traffic stop exposed an identity problem. The identity check pointed toward an outstanding warrant. The officer confronted the driver and explicitly warned her not to leave. She drove away anyway. And from that moment forward, what had begun as a seatbelt stop became an entirely different encounter.
