When she pushed back, she said he grabbed her by the throat, held her against the kitchen counter, and began to strangle her. Her older sister ran in and tried to pull him off. He threw a potato at the younger daughter, striking her in the face. >> Perfect. Yeah, and then we'll get you guys all that for your dog, just to get you guys >> And he won't bite you. He's just protective. He's He's not like mad because of my dad. >> Okay, perfect. Deputies could see the evidence on her body. There were visible red marks on her neck consistent with strangulation, blood in and around her nose, red marks on her face and cheek. The older sister corroborated every detail. >> Just so I can get the marks and everything that's on your neck to be visible, the one that's on your face right here, okay? >> And then I think I just okay my finger and then I was pushing him off cuz it's like all like swollen through here. >> Okay. And this is not your blood? >> No, I think it's my dad's. >> Okay. You You don't remember bleeding or anything? >> This one might be mine. My nose started bleeding when he head-butted me, but it wasn't bad. >> Okay. All right. So, what I'm going to do is just go ahead and put your hands right here by your side, okay? It's going to be a lot, okay? So, I'm sorry. >> What made this case different was who the father was. Timothy Means, known in the UFC as "The Dirty Bird", is a veteran mixed martial artist and, at the time, a high school wrestling coach. >> All right, so Yeah, we have confirmed charges of strangulation. Battery on a Is it if it's parent to his daughter? >> Since they're dealing with a UFC fighter, deputies develop a tactical plan to approach the house and make contact with Means. >> So, then we can put you over here. So, I'll come Two of us here and then two can One can bypass and at least come this direction. So, you see him heading out, we have one over there. >> Yeah. So, those are the two other options if we could possibly go that way. >> Deputies set up a perimeter around the residence and used PA announcements to call him out. >> It's going to be blocked. You guys can't get through. >> This is the Bernalillo County Sheriff's Office. Timothy, come out of the house with your hands up, open and empty. Means agreed to speak with deputies. >> Uh so, do you know why we were called here? >> Uh my daughter's here. Just on the >> Okay. So, tell me what happened tonight like between you and your daughters. >> Um They got a ride from from the high school to central office. I asked how she got over there. She said that mom picked her up. Uh prior to that, I had I had called her when she was Before that, I called her when she was at uh central office. I asked how she got over there. She said to her and I was like, "Why didn't you tell us that that you were going to leave the high school early and and you go to central office have someone give you a ride?" Well, uh she said that they had to go drop her mom off or his mom off at um at her house. Then they drove off and then the car left. And I said uh "So, his mom his mom picked you up from the school and then took you to school?" I said that's a lot to That's a lot to That slipped out of my mind. That's a lot a lot to slip and not tell us what's going on. And then there's been a few things last last last few days. And then I brought up uh prom that happened or whatever and I told her, "Hey, uh you're constantly asking You're You're constantly taking stuff uh non-stop. It's like you know, you come here. I asked you to I asked you to tell us what's up, tell us where you're going. And uh I said I hope we we you get to prom. And and that's why I guess you said you didn't help me get to prom. So you got all pissed off. She's like, "But you help pay for everything and I had to get a dress. I had to get a dress from my friend. You didn't buy me a dress." And it was it was just petty and I told her no sugar you're constantly coming here asking me stuff. I'm buying your makeup. You went to the other day. I got you your makeup. But you guys aren't even cleaning the kitchen and stuff. You don't even clean off the counters. Everything's filthy. And then if they do if they do clean the counters I told her that I said you guys are leaving these streaks all over everything. The the dish rags aren't even clean. And she starts flipping out. Me and my She said me and her are always doing stuff. You're not giving us no credit. I said no you're literally taking you a year to clean the kitchen right. I kept having to take all the dishes out of the out of the um not the dishwasher not the dishwasher that was clogged cuz they kept throwing food a bunch They throw the the dishes in the sink just rinse out the I did this for a time. They rinse out the dishes and they wouldn't clean out the food out of the dishes and they just cram it down the sink. Um this is where we're arguing about tonight. Well in in my phone I told her uh we were talking going back and forth about the uh his mom picking her up. I said that's that's a lot going on for you not to tell us what's up. I said that's not cool. Um I said hey your phones need to be turned in at 8:30 tonight. I said until further notice until you start including us in your in in the plans because we're we're your parents. I'm your I'm your dad and then every time you do something that involves me or you need to ask me for money, you know? And then she started flipping out telling me that you help pay for everything but I'd have been the boyfriend. Yes, sir. Okay. And then uh I told her I said we helped you get to prom. I said what do you mean we're not there? She said you're not ever there. You're just staying in your room. What have you done? I said I started business on the on the property now down at the bottom here. We're cleaning out the the fire the fire mitigation. I started a business here and you I asked you guys for help the last three Sundays. You don't want to help. And then I I brought it up to her last week or the week before. She tells me you didn't ask me on that day. I said well I brought it up every week. That was last week when when that when that part happened. And so I went down I said she said prove it for the kitchen. I said, "Okay." We went down to the kitchen and we went down there and I started pointing out stuff that was still dirty. Uh refrigerator's dirty, not wiped not not wiped down, the table's filthy. And then, uh >> [clears throat] >> she uh she I I started proving my point and she started to get all pissed off playing the Oh, I uh we're always busy. We're at school. We're completely busy with the with with with sportses. I said, "You guys you stay after school." Because she said, uh Tuesday, Thursday they got to practice early. I said, "I've never seen you let you out of a practice at like, "What other time you get out?" >> Yeah. >> And she says, "Uh I'm getting out at 5:30." And I'm like, "That's not early. That's when practice ends." And she said, "No, it can end at 5:30, 5:15, 6:00, 6:30." >> So, it just kept going on >> kept going on and on and then, uh >> When did it get physical? >> Uh she got in my face. Uh I I walked over to her cuz she told me, "You don't do nothing." I said, "Bullshit. I'm constantly there and then you pull this shit." >> Okay. >> I said, "I've changed everything. I I've I changed it You guys want to wear the little bitty ass shorts all the time. I ask you to cover up or or put on some longer shorts. It's wintertime outside. This this is what I'm about. So, it's wintertime outside and then, you want to wear the last thing that you can be sick. And then, you guys don't want to go to school. You want to show up late all the time. You want me to give you the Starbucks all the above." Well, she was like slapping her hands in my face, clapping her hands in my face. >> It's like right in my face or Yeah. >> Yeah, like right in my face I'm clapping my clapping her hands. While leaning I lean forward I lean forward the side of my like my face face on the side of her face telling her like, "That's bull like you need to give me some respect. Like that's not fair." And uh she started she started punching me in the face. Like hitting me like 10 straight times. I was like, She's like, "You head butted me. You hit me in the head." I was like, "I didn't touch you." And she hit me again. She hit me and busted me like 20 times busting my nose up pretty good. And then, uh told her, "That's the last time you do that [ __ ] That's the last time you disrespect me like that. That's not fair." And then, uh she would hit me again. I kind of restrained her up on the on the on the uh um counter top where the there's like a little spot right there where the uh you open it and it has all the like toasters and [ __ ] >> I got you. >> I I I was I like pushed her up on that and she started swinging at me or whatever. And then, uh she just kept biting the started getting involved. That's when she got real real mad is when I started telling her stuff. And I said, "That's not fair." I said, "You had my phone or you had my credit card all day." You've uh I gave you a cell phone. I should buy that puppy home. And I said, "You didn't work with your dog. Come home, work with your dog." She's like, "Well, I'm going to go get um applications." I said, "It's 6:00 at night. You don't need application now. Come on, work work with the dog. You brought the dog home, lied to us on that. I've been feeding it. I've been babysitting it. It's been chewing up everything." And then when I took the phones, they just flipped they they flipped. And then uh um She said that she text me, "Oh, you didn't like the you didn't like my answer or you didn't like my question?" And I said, "I didn't like the way you the way you were responding to me." Cuz she said uh um it was an early day we got out. And I said, "When is it an early day?" And I'm back I'm going backtracking a little bit. I said, "When is it an early day?" >> So, did at all did you other than restraining her, did you hit her? >> restrained her. She was punching me in the head. >> Okay. >> And then I pushed her back and tried to restrain her. >> once hit her? >> No, I didn't hit >> You didn't throw anything at her? You didn't put your hand around her neck? >> Um I I had my I pushed her back with my hand, yeah. >> And it was on her neck? >> Uh no, it was like on it was like I was trying to put it on her chest, but you know, she's a girl. >> Okay. >> So, I tried to keep it kind of high. >> Well, okay, bro. I'm going to be honest with you, bro. Like, be straight with me because I see the bruises and everything on her. So, where did you really >> No, I didn't hit her. She was like smacking herself like talking [ __ ] She was like telling saying how she's tough and calling me a uh yeah. And she's done that before. I said, "You're not going to call me that [ __ ] no more. That's not fair." >> Where did she hit you? >> Um she hit me in the face with my toes like right in the nose. I got on my side of my eyebrow. >> one of the cuts on your nose. >> Um in my nose and then uh side of my other side of my face. Uh left side I got my eyebrow. She hit me like like 15 times. >> Okay. But at no point you ever >> No, I never I never I I I pushed her off me. >> When you pushed her off and you were restraining her, where were your hands? >> Uh I was trying to keep them high above her chest. >> You're trying to, but where did they go? >> Um I did it so happen so fast, but I was getting getting involved. And then I made a comment about uh You used to stick up for her, but you'll be in there talking [ __ ] about doing the dishes and dusting and you guys will be calling each other uh specifically we call she can just talk a bunch of [ __ ] and uh I try to be disrespectful man. I try to come in home and don't get an ass whooping money and when I say something I say the word I make a suggestion and she'll be having her friends come stay the night or whatever from from across the state or whatever. And she'll tell me she hears my suggestions but she ain't going to hear she she hears my suggestions but she's not going to take them. >> I got you. >> All right, that's not fair. >> I mean yeah, I can imagine you know I don't have kids both so I can't really like relate to you know the whether they're not how it is growing up with them you know but I got you bro. Okay. Do you need to see a medical? >> Uh yes sir. I think I have my nose checked out. She she punched me in the head pretty good. >> Yeah, okay. >> But uh be uh >> I'll get you checked out. Do you want to go to step out? >> I I can step >> You can step out and just stay right here by the sheriff's, okay? >> He denied hitting his daughter. He said the only physical contact was his attempt to restrain her from hitting him and that he tried to keep his hands above her chest. When asked where exactly his hands were, he said it all happened too fast. Deputies then questioned Means' wife who had just been detained. She was never arrested. >> Hey, how's it going? I'm Deputy Kennedy with the Berkeley County Sheriff's Office. What was your name? >> Brenda. >> Brenda, okay. So I believe my partner Mirandized you, correct? >> Yes. >> Do you want to speak with us? >> Sure. >> Yes. Yeah, it's a yes or no I'm sorry. I know as much as it is okay so um What happened tonight? What's going on? >> I showed up and I guess him and got into it. >> Okay. Did you see anything hear anything? What happened like when you walked in? >> Um he was in the family room and he was walking outside crying and I'm like what happened and they got into it. They both have a temper. Um and then I was crying, so >> Okay. Okay. And that was it. And then has this happened before? >> Um they have fights and stuff. Like she'll get in his face, he'll get in her face, and >> Has it ever got physical between them both? >> Um a little bit. Not like punching, but but >> Yeah. >> Just like restraining and stuff. >> Restraining each other and everything like that. Okay. All right. Um you're a stepmom, correct? >> Stepmom. >> Okay. How long have you been in their lives? >> Um we got full custody of them in 2015 uh 16. >> Okay. So, they don't see bio mom at all? >> No. >> Okay. Well, so I can kind of get an idea. Um who's grandma to them? >> Um their biological grandma uh passed away, and they don't see his mom. She's not in their life. So, my mom is like >> Is grandma to them? >> Yeah. >> Okay. Cuz they mentioned grandma. That's where they wanted to go. So, I'm just trying to figure out like who it was just before we do anything. Okay? Um did correct? Say anything that happened to you? >> That hap- that happened. Um she said that he hit her. >> Okay. Did she say how? Or just that? >> Um no. >> Okay. That was it? >> Yeah. >> Okay. And what did he say when you got home? >> Um he said that he was in her face and that she said he headbutted her. And then that he hit her or she hit him 20 times and then >> That he headbutted her or she headbutted him? >> She He was in her face and then she said that he uh He said that she said um that he headbutted her. He was like, "I didn't headbutt her." and then he said that she hit him like 20 times. >> Okay. Hold on. >> She left with the boyfriend today and didn't tell us. And I told her she didn't need to to communicate. So, he told her to turn her phone in at 8:30 and then she just got pissed off about that. >> her phone there? >> Yeah. >> Okay. And that's how you found out? >> You were here for that or you weren't? >> I wasn't here. No. But >> got here after everything. Okay. All right. Um perfect. Sounds good. Give me a second and I'll let you go in the other room. All right. >> His wife told deputies she was not home when the altercation occurred and only found out afterward. She did confirm that physical confrontations between Means and his daughter had happened before. >> Little better? Yeah, there's an actual like chair in there, so we'll just walk up that way to the open door. All right. Yeah, I wanted the light you could sit in. Right in here, brother. And then we'll get you a chair. Uh give me a minute. I'll come and talk to you here in a bit, okay? >> Yes, sir. >> Based on the statements, the visible injuries, and the totality of the investigation, deputies arrested Timothy Means and transported him to the Metropolitan Detention Center. However, the charges were later dismissed when the prosecutor stated a witness failed to show up at the preliminary hearing. Some say the outcome should have been harsher, while others say it was blown out of proportion. In the comments, let us know what you think. All suspects are innocent until proven guilty.
