Hey, I'm going to call my boss and my boss is going to update because >> No, no, no, no, no. MY BOSS call the boss. >> They don't want to tell me how they find their >> It was the two of them. Where's the other one? It wasn't. Where's the other one? Where's the other one? >> The detention of both subjects rests on the Supreme Court's ruling in Terry versus Ohio from 1968, which authorizes brief investigative stops on reasonable suspicion, specific articulable facts, not instinct, that criminal activity is underway. Reasonable suspicion here was not a single observation, a bank fraud alert, a disguise inconsistent with the photo on the ID, and confirmed prior visits to multiple branches by the same associate. None of those facts alone was sufficient. Together, they cleared the bar. Probable cause operates under a different standard. The Supreme Court's 1983 ruling in Illinois versus Gates holds that no single fact must carry the full burden. The totality of the circumstances simply has to make criminal activity more probable than not. The pat down is authorized by Terry, but scope matters. Outer clothing only, weapons only. It does not open the door to a search for documents, currency, or anything tied to the underlying financial fraud. Evidence discovered beyond that scope must satisfy the plain view doctrine to survive a suppression motion immediately apparent as criminal evidence observed without additional manipulation of the subject's person or property. The Supreme Court's ruling in Burkmer versus McCarti from 1984 draws a clear line Miranda warnings attached to custodial interrogation, not to a non-coercive investigative detention. A [clears throat] brief interview inside a bank lobby does not cross that threshold. Every statement made before a formal arrest is therefore admissible without a prior rights adisement. Investigative detention and custody are two distinct legal conditions and conflating them is one of the most common misconceptions in any analysis of police encounters. Separating two subjects before questioning is not a formality. It is evidentiary. Independent statements taken before suspects can align their accounts are substantially stronger evidence than anything gathered after both parties know what the other has already told police. Florida statute section 843.02 02 obstruction without violence applies the moment someone opposes an officer's lawful duty, even verbally. Coaching a subject midquesting and continuing after three explicit arrest warnings, satisfies the statute. Adult arrestes are legally distinct from juveniles under Florida law, and officers carry no duty to disclose charges or custody status to relatives. That silence is not cruelty. It protects the investigation and the defendant's right to counsel. Florida statute section 8, 17.034, 034. The Florida Communications Fraud Act criminalizes any systematic ongoing scheme to defraud. Three branches, same method, new location each time. Every visit is a separate overt act within the same organized scheme. Two statutes run parallel to it. Section 8 17.568 covers the fraudulent use of another person's identification without consent. Section 8 12.014 014 defines grand theft at the secondderee level for property between 20,000 and $100,000. Aggregated across all documented branch visits and run consecutively, these three statutes carry a combined maximum exposure of 90 years in Florida state prison. That is the statutory ceiling when organized fraud compounds across multiple counts. A prior conviction forecloses first offender treatment entirely. The July 2024 probation violation coming within 20 months of the earlier sentence establishes that prior disposition failed to interrupt the scheme. Probation is not a realistic outcome. The recruited participant carries independent criminal exposure under the identity theft statute. Florida law does not exempt the person at the counter because someone else arranged the transaction. Her vulnerability is a sentencing factor, not a defense to the underlying charge. The responding officers earn an A minus. Reasonable suspicion was assembled from a pattern of facts exactly as Terry and Illinois versus Gates require. Subject separation was immediate and the frisk stayed within its authorized scope. A single procedural gap in the interview framework held this below a full A. The primary suspect earns an F. Multibranch scheme. Vulnerable instrument recruited and provided with a disguise. Identical conduct repeated within 20 months of a prior sentence. No mitigating factor appears in this record. The recruited woman earns a D+. Presenting false identification at a bank counter is a felony regardless of who placed the wig on her head. Her cander with officers after the disguise came off is the only legally sound decision visible in her portion of this case. The interfering sister earns a D. She entered an active interview space and coached a subject midquesting, satisfying Florida's obstruction statute before she finished her first sentence. Three arrest warnings followed. She avoided handcuffs through officer restraint alone. Recruitment does not create immunity. The law attaches at the moment of the act, not at the moment someone else issued the instructions. Walking to that counter in a disguise was the felony. Nothing that came before or after changes that. When the person arranging a financial transaction provides a physical disguise to wear inside the bank, that is the signal. Not subtle. The moment to refuse and ask what is actually being asked is before the car ever reaches the curb. A lenient sentence without meaningful supervision does not close a scheme. The probation violation confirmed what this footage already made plain. The court's earlier mercy gave the operation 20 more months of runway. Entering an active investigation to coach a suspect is not a protected act of family loyalty. It is obstruction. The only reason no arrest followed is officer discretion, which is a choice, not a right the family possessed.
