Three charges and a use of force sequence that has more legal exposure than the arrest itself. The real issue here is not whether Lewis had a right to [music] be angry. I ain't resist or disrespect or none of that. You just did all that for no reason. I'll be back tomorrow with my mom. I'm going to show you something. I got bail money. >> Hold on. You're in a good resting position. >> The pivot point comes when officers issue a verbal trespass warning and Lewis refuses to leave. At that moment, Florida statute 877.03, disorderly conduct, was already on shaky ground because Florida courts require an overt act beyond loud speech. But Florida statute 810.08 trespass in a structure or conveyance clicked into place the second he said he was not going anywhere. The statute does not require violence. It requires a warning and a refusal. Still, the counterargument has weight. Lewis was a lawful ticketed passenger who had cleared TSA screening. His presence in the airside area was authorized until the warning was issued. That context does not cancel the trespass charge, but it shapes how a judge or jury reads his intent. >> I'm good. I'm good. You good? I'm good. I'm >> How's your breathing? You're talking to me. You're breathing. You're good. All right. >> You understand? We're concerned. I'm concerned about you. We're all concerned about you. I'm good, bro. >> All right. >> Yeah. >> Just keep talking to us. All right. I'm being serious cuz I want to know that you're breathing well. So, you keep talking to us. >> No, I'm good. I'll just tell him stop pushing me from that side. >> No, but just polite talking so we >> I'm stuck right here. Be good. I'm Nothing wrong with me. >> Right. Just polite talking so we know you're breathing good. Okay. >> I'm good. >> All right. >> Okay. Let me put the social. Okay. >> Just go ahead. Go ahead. Let me work. >> I want y'all to hurt me. I want y'all to kick the door. >> I'm going to kick the door. I'm gonna bang my head. I'm going to You You don't know what just happened. They just let somebody steal my property. I'm a a black leader. I'm on Google. I helped get people out of jail and somebody stole my [ __ ] and I said something to them. They let my [ __ ] walk away because of whatever reason it was and told me they can't do nothing. I I take care of my grandmother. My grandma live in Tallahassy, Florida. I sent my grandma money. I pay people bills off my phone. I need my phone. They didn't want to rent the cameras back. So, I said, "I'm not [ __ ] moving." I sat down and they just hog tied me. So, they they just got unified to get me out of there. But, but but TSA let somebody steal my cell phone. So this I I have no issues with any of y'all. This didn't start with y'all. He was charged with disorderly conduct, trespassing in an occupied structure or conveyance, and resisting arrest. Share your thoughts in the comments below, and don't forget to like and subscribe. The use of force in this encounter is where the legal exposure compounds. Graham versus Connor sets the standard. Force must be judged from the perspective of a reasonable officer on the scene, not with hindsight. Three factors apply. severity of the crime, immediacy of threat, and degree of resistance. The crimes here were misdemeanors. Lewis was not armed, did not swing at anyone, and stated repeatedly he was not resisting. He went passive, sitting on the floor, which is obstruction without violence under Florida statute 843.02, but it is not a threat profile that supports aggressive physical escalation. The neck contact at approximately 12 minutes 17 seconds is the single most legally consequential moment in this footage. Lewis protested it repeatedly and with specificity. Under Florida Department of Law Enforcement training standards, neck contact outside a formally trained karate technique is categorically prohibited. If video confirms contact, that is a policy violation and potentially a fourth amendment excessive force claim under section 1983 of title 42 of the United States code. While the spit mask application is standard protocol once a subject threatens to spit, which Lewis did explicitly, his disclosure of asthma during transport creates a distinct duty to monitor. Officers conducted a verbal respiratory check, which is the right move. But the duration of spit mask use with a disclosed pulmonary condition is a liability question that no department wants answered in a deposition. On the verbal conduct, City of Houston versus Hill established that profanity and criticism directed at law enforcement is protected speech under the First Amendment. Lewis was loud, profane, and relentless. None of that is a crime. The disorderly conduct charge will rest entirely on the physical act of sitting down and refusing to move and whether a Florida court classifies that as the required overt breach of peace. The officers in this encounter held their legal authority correctly on the trespass and resisting charges. They deescalated verbally for an extended period before using any physical force. What weakens their position is the neck contact. the delayed supervisory response and the failure to give Lewis specific timely information about what the phone investigation was actually doing. Lewis knew his rights in a general sense. He knew not to physically assault anyone. He complied with handcuffing and he consistently distinguished his passive refusal from active violence. What cost him was the decision to stay after the trespass warning and the invehicle conduct that gave officers justification to escalate restraint. His strongest legal argument lives in the force application, not in the arrest itself. Three things to take away from this encounter. First, when a law enforcement officer issues a formal trespass order, that is not a suggestion. The moment you refuse, Florida statute 810.08 is complete. Your grievance may be legitimate. Your remedy is through the legal system, not through staying put. Second, if you are physically restrained and experience pain, name it clearly, calmly, and on camera. Lewis did this effectively with the wrist and neck complaints. That specificity captured on body cam becomes evidence. Screaming generally is noise describing precisely is a record. Third, institutions like TSA operate under federal oversight and a passenger who believes theft occurred at a checkpoint has formal complaint channels through the Transportation Security Administration independent of the local police response. Demanding that airport police solve a TSA problem in real time is asking the wrong agency to answer for the wrong failure.
