And there's a there's a gun in the vehicle, too. >> Just sitting there next to >> in the center console. All right. >> That's an issue. >> Okay. Find your back. You're going to be placed under arrest. >> What? >> Child, man. 86 on three CCH on him. On November 30, 2025, in Delaware County, Ohio, a family walked into a Meyer store less than 2 minutes before closing. Two adults ended up facing multiple charges. Two kids sat in a cold car and a loaded gun was in the open center console. The real issue here is not [music] the stolen seasoning or the skip scanned items. It is what a parent voluntarily handed officers the moment he opened his mouth unprompted with children right there in the vehicle. >> What vehicle are you guys in? >> That one. All right, cool. We need to talk to you. >> Well, we got two children in the car. >> Yeah, >> it's freezing out here. You already take two children in the store with you. >> I'm sorry. We was rushing. We're having our Thanksgiving dinner tonight and we were trying to rush because we got here at literally 11:58. >> Listen, man. We still came back in. It just ran back out there. >> Like we And there's a there's a gun in the vehicle, too. >> Just sitting there >> in the center console. All right. >> That's an issue. >> Okay. >> Are you an ID on you? >> Yeah, I know. >> Any any other guns on you? >> No. >> Mind if I pat you down? Go ahead. It's not us. >> What is going on? >> What is going on? Like my sister about to pour your >> Yo, shut up. Stop it. >> I need to make this [ __ ] work. Okay. >> Pour the cheese so I can put the heat on. >> Would you stop? Start the car up. Let it warmed up. Start up your first. Whose kids are those? Are those your kids? Hers. Okay. container. Right there heat. >> We'll put the heat on for you guys. Okay. >> Oh, I didn't know. >> There you go, boss. Well, you know, accidents happen, man. You don't know. They crawl around. They might play with >> Yeah. No, let Bro, you didn't get to have Thanksgiving. >> No, look, man. I'm not I'm just being honest. accident happened. It's just unsafe. >> We coming back to picking my son up. He went to his grandmother's. So, like we literally we live in a hotel. >> Good. >> And we was trying to have Thanksgiving dinner. So, we came here from London, Ohio. I made it here by 11:58. And so, we ran to the door and we knew that what she had to try to get to cook You have like the trespass forms already. >> Trespass forms to do. They were already trespassed from the store before you gave me. >> But you don't need to trespass them again, right? >> Trespass again. We do trespass them every time they violate it. >> All right. But we want charges for trespass. >> I think so. Just give me a second on that. Okay. >> Actually, go ahead. Do that with the other officers while I'm doing other things. Hey, they're done. Trespass them again. Okay. >> I got a little bit of meat there. >> Stand there for me. Okay. >> I put the can. I didn't want to litter in front of his grandmother's house, so I just When When is When is that from? >> When did I open it? >> Yeah. Yeah. He wasn't I I I drank it at the time. I didn't want to throw it on. >> Okay. >> So, I just tossed it right there. >> Okay. No other weapons in the car or anything. >> What's going to happen? >> I was the last one to show up. I had no >> dude. I was out here. He's checking you guys right now and then we're going to go from there. Okay. >> Okay. I just >> Sorry, bro. on my way. >> Yeah, I know. Oh, that >> did she get her date? >> Was it this pink one right here in the orange? Was it pink or orange? >> No, it's um >> Oh, right here in the middle. Yeah. Yeah. >> Yeah. >> Just nicotine. That's one of the mods, right? Yeah, I never >> I never made up to do those, >> man. The first time I tried to hit that [ __ ] it I kind of got so much smoke. >> Turn around for me. Put your hand back under us. >> Endangerment, man. your rights. Okay. You have the right to make anything you say will be record. >> Hold on. Turn around for me. Put on your back. You're going to be placed under arrest for children coming out as well. Hey, can we be a lawyer and the right to turn out a 411? >> All right. So, for these children, do we have family close by that's going to take control of these kids? >> We're going to work through that. Okay. You know what I'm saying? >> I'm going walk you to the front of my car. Okay. >> I I'll touch you. I'll let you do that here in a second. Okay. >> Walk over here. Okay. We're going to walk over here. Okay. >> Hello. I'm talking I can't think of mama. Where's she at? Yes, sir. >> All right, I got to do a full search on you. You have anything on you? >> All right, widen your stance for me just a little bit further, please. >> Hey, officer Saw, you mind taking this for me? >> Yeah, >> we'll get we'll get you guys warmed up in a second. Okay, >> anything stuck in your bra at all? Lift your arms up for me just a little bit. >> Just widen your stance. Stay right here for me. >> All right. Officer Grwood, you mind opening the back for me? >> Yeah. Walk over here for me, please. Walk over here for me, please. >> Over here. >> Memorandum. >> Yep. >> All right, ma'am. Look, I'm going to ask you a quick question. Just be honest with me, okay? Did you guys pay for all those items? >> What? >> Did you guys pay for all those items in your cart? >> In the cart? >> Yeah. >> In the cart? >> Yes. Do you have a receipt for everything that's in there? >> I didn't bring it up. My husband did. >> Okay, I'll ask him. >> Have a seat for anything. >> Is there anything in your purse or anything? Nothing I'm going to find that's not paid for. Now, if you honest now, we're going to find out anyway. So, >> I only that's in there that I didn't pay for seasoning. >> Seasoning. Okay. All right. I appreciate it. Thank you. Okay. >> Okay. >> Then, uh it's also going to be trespass as well. You guys were already trespassed for me. Not from this one, but from a previous one. >> Okay. I'll work I'll work through that. Okay. >> Okay. I know I tied you down just for weapons. Is there anything on you that's going to hurt sick or stab me in drugs or anything on you? >> Is that your child? The the boy? >> Yeah. Okay. >> Do you want him to go with her mom or do you want him to go with his mom? >> No, go with his mom. Is he cool to go with her mom? >> Yes. Okay. >> My cruiser for me. >> Take your feet apart. I take my babies too. >> I know be mind though, bro. I got I don't got really [ __ ] >> I hear him. This is trash. Is that torch light or is that like >> Yeah. Okay. >> Wow. >> Is there anything in that vehicle that you need? My phone. >> Where's that at? You just Google. Okay. Nothing in your shorts or anything with that? Uh, no. No. >> Carpenter, he's been Miranda already. >> Yeah. >> All right, man. Look, I got to ask you a couple questions. Okay. >> It's all on camera inside. All right. Did you pay for everything that's in that card? >> Not the wipes. >> Okay. So, you did you skip skip some stuff? >> Okay. Um, do you have a receipt in the bag so we can go back and see? Okay. So, I'm going to go check and we'll go from there. Okay. All right. >> So, what's the village go to court? Downtown or >> it's going to be Delaware? We're in Delaware County right now. Have a seat right here. >> Okay. Have you take off your shoes for me? >> Hey, we're going to Delaware County. Ohio Revised Code section 2923.16 subsection B prohibits knowingly transporting a loaded firearm accessible to any passenger. An open center console reachable by anyone in the car is not a gray area. Under that statute, it is a fourthderee felony. Still, Ohio enacted constitutional carry under Senate Bill 215 in 2022, allowing qualifying adults to carry without a permit. That argument does not hold here. Subsection B of section 2923.16 was left intact. Constitutional carry removed the permit, not the transport restriction. Got to touch on the back of my car here. >> Yeah, we'll we'll get there. Yeah. >> Can you loosen these? >> Yeah. >> [ __ ] >> Which one is it? >> Both of them. >> Both of them. >> That's how tight these are. All right. spend over at the waist a little bit so I can >> So we got to wait till Monday. >> Hold on. >> This going to hurt just a split second. >> Oh [ __ ] >> Is that one better? >> I know. It's still digging in my rib. >> There you go. >> I'm telling you. >> All right, one more time. I got to do this one, right? >> Just bend over at the waist. >> Mhm. Hold on. They won't tighten up on you. Here you go. Yep. Here. Have a seat for me. This is This is really bad. >> Everything that we own the other side so I can buckle up. >> Everything we own is in the [ __ ] hotel room staying at >> at the airport. >> Okay. >> Everything you own in that pull your car. >> I should. So, if you guys are good with it, I'm thinking is we'll take them back and start cooking and all the carts and stuff. If you guys want to try to figure out the death stuff and then go inside and figure all this, >> Ideally, we can get the kids release the family, not taking them to services. >> Right. >> So, okay. >> No, I mean, if it's paid for, it's paid for. Whatever you guys pay for, I'll bring back out. But the stuff that's not paid for, so that's got to go back. Okay. So, I I heard you talking. >> Um, I got to find out if it's paid for. If it's not paid for, then it's got to go back. Okay. >> Uh, so I see a receipt somewhere. >> Yeah, that's what that's what I'm looking for. I'm looking for the receipt. >> Cuz if it look, if it's paid for, you guys can keep it. If it's not paid for, >> it's not paid for. >> You get it? >> Um, I got to give me a minute. I got to go back to my bag and let me take care of this and I'll get you one. Okay. >> Are you guys able to pull receipts up? I'm not seeing a receipt in here anywhere. >> No receipt. >> She did admit to she did admit to stealing the seasoning in her purse. >> Okay. >> All right, man. Where's that receipt at? >> Um, I think it was in the cart. >> In the cart. I didn't see one in there. Okay. >> And one in the bags. >> Okay. How much uh how much stuff do you skip? >> There's like two items. >> Two items. Okay. And then she's got the seasoning in her purse that she took. Uh >> I don't know if you knew about that. >> Okay. Um Okay, that's all I had, man. We're going to try to figure this out. I know it's not much, but my charges for it. Okay. >> Just be another charge added on. All right. >> Okay. Dude, were you up here earlier today? Cuz I got this receipt from today. Did you buy gloves or something? >> What was that? >> Meer. Is that not you? >> No. >> Okay. >> Where? >> It was on the ground. I said no. It was blown around. I'm trying to I'm not trying to charge you. I don't need to charge you, man. I'm trying to get I'm trying to be accurate here for you. I'm not trying to add a bunch of stuff. >> They got this [ __ ] on each. >> Yeah, that's we're trying to work on. I just want to come talk to you first. Okay. >> I don't know. He just took everything out pocket. I don't remember. It could have been in my pocket. >> Okay. All right. I I'll see what I can find out for you. >> All right. >> You need All right. >> You getting her information? >> Yeah, I'm getting her information. Grandma's coming to get all four of them. >> All right. Perfect. >> Um >> she's coming from canal, so it'll be in a minute. >> Okay. And then I'll >> All right. I'm just I'm just working on the steps right now. I'm working on the step part right now. So >> she just trespassed them also on um they were just trespassed October 29th at 11:07 p.m. >> Okay. Was that just a store trespassing them or do you have officers out there? >> Um pardon. I think it was just this door. I don't know whether or not the store was in there. Yeah. And their AP, I believe it was, but yeah, I don't know if there was an officer there. >> Okay. All right. All right. She's going to talk to you. Okay. She's going to let you guys know you guys are trespassing by her as well. Okay. >> She's going to let you all know. >> Everybody. >> Yeah. >> Gas stations, everything. the rest of my life. >> Nope. >> What did I do? >> We didn't even do nothing. >> Okay. Your your name? >> Okay. So, obviously just let you guys know that you're no longer allowed on my property. That's all property. anywhere. Gas stations, stores, any stores we own, any property that we own, even if we have not built on it yet. >> No longer allowed on there >> like ever. >> Ever. >> Nope. So, you'll have your s signature and the date. >> What if I don't sign it? >> No, it still counts. >> Still counts, man. I got two officers standing right here. They're going to make you sign it. >> I can't make you sign it, but it still counts. It's all on It's all on video. >> And look, I tell you, my real good what they do, so they'll know if you come back in here. >> How did these [ __ ] make you ban from Meyer, bro? >> I'mma be 30 years old like, damn, I really want some fresh vegetables and I'm not going to be able to come to Myers, bro. >> You're goofy, bro. I don't really care. My smell like ass. >> Take Myers away from me. >> Now you know how you said Mars is very good at what they do. What if I go bold, cut some of my leg off so I get shorter, bleach my skin? >> I think they'll let you go if you put that much effort into that. >> Just cuz I want some fresh vegetables. You know how goopy is that? >> Stink record. >> I'm never going to be able to have that chocolate cake they had in there. >> All right, just let you know you've trespassed off all my property. >> It's any property that we own, whether it's built on or out. >> Will you please send that to her? >> That must be favoritism or something cuz you work real cuz you work. You got to sign the top line at the bottom >> which >> they'll be in the same card also. >> Can't give you another name. >> Why? Well, >> if you choke on it, then it's on me. >> I can share with them. >> Thank you. >> Miranda versus Arizona established that once in custody, statements must follow a proper rights advisement. Officers delivered Miranda on camera before any theft questioning. After Miranda, the male subject admitted to skip scanning two items at selfch checkckout. That admission is presumptively admissible, voluntary, and on the record. Ohio Revised Code section 2913.02 defines theft as knowingly obtaining property by deception or stealth. Misscanning items is theft by deception. Ohio law sets no minimum dollar threshold. Meyer chose to pursue charges and officers followed through. The female companion admitted to concealing seasoning in her purse, but her statement came before Miranda. That is a potential suppression issue and the one real legal break in an otherwise clean evidence record. Ohio Revised Code section 2911.21 governs criminal trespass. The subjects had been trespassed from a meyer on October 29th, 2025. The notice served on scene was refused, unsigned. Ohio courts do not require a signature. Two officers witnessed it on camera. Ohio Revised Code section 2919.22 prohibits creating a substantial risk to a child by violating a duty of care. A loaded, unsecured firearm within reach of minors meets that threshold. The statute requires substantial risk, not actual harm. That said, a defense could argue voluntary disclosure showed cooperation, not a pattern. Courts consider that at sentencing, not as a defense to the charge. The lead officer adjusted handcuffs when asked, put heat on for the kids, and arranged release to grandmother rather than social services. The male subject talked himself into every charge. The firearm, the marijuana, the skip scan admission, all unprompted or volunteered after Miranda. Lesson one. In Ohio, there is no proactive duty to disclose a weapon. Saying it unprompted gave officers probable cause they did not yet have. Lesson two, Miranda is your decision point. Answering questions after being advised of your right to stay silent is a waiver. Lesson three, a prior trespass notice does not expire. Returning to that property, even months later, is a criminal offense in Ohio. This started with a family trying to get Thanksgiving dinner together and ended with two adults in handcuffs and a loaded gun in an evidence log.
