September 27th, 2024. Ohio domestic call. A physical confrontation between two sisters and their mother's boyfriend has already produced a kitchen knife. Two arrests follow. BILLS. [screaming] >> I can't hear you when this is going on. Sorry. >> I can't do nothing when anybody's screaming. That's just the way it's going to be. If people are going to scream, people are going to start going in the back of cars. Okay. >> Does that work? >> Yep. >> Who else here? Mind that glory. >> Who else here besides these you four? This is it. Okay, wait till I get somebody else here. We'll separate everybody. >> Okay, YOU NEED TO CARE THOUGH. >> OH MY GOD. LIKE, BRO, YOU'RE SO DISRESPECTFUL. You don't care. >> You came at your MOM WITH A KNIFE. >> YOU CAME AT HER WITH A KNIFE. YOU CAME OUT WITH A KNIFE. YOU CAME AT HER WITH A KNIFE. You guys need to learn. YOU NEED TO LEARN RESPECT FOR YOUR MOM. YOU GUYS, YOU CAME OUT AND STARTED TALKING [ __ ] OUT OF NO REASON. MOM, SHE PAID ALL MCDONALD'S. WE'RE ALIVE RIGHT NOW. SHE PAID THE BILL FOR EVERYBODY. SHE CAME OUT ALIVE. YEAH. YOU START TALKING [ __ ] ABOUT ME AND SAY SHE'S DOING DRUGS, BRO. WE WERE ABOUT TO ASK FOR EVERYTHING FOR BOTH OF YOU. ASK YOUR BROTHER. HE IS LYING, BRO. I PROMISE YOU. I PROMISE. THAT'S MY BEST FRIEND. HE WOULD NOT LIE. [screaming] >> HE WOULD NOT LIE. OKAY. SO, REGARDLESS OF ME, WHY WOULD YOU COME AT YOUR She's a piece of [ __ ] SHE PAYS ALL YOUR BILLS. >> BUT SHE COULD A MAN [screaming] PUT HIS HAND ON YOU AND HE HAD TO BE THAT'S NOT MINE. Y'ALL CAME AT ME. I TRIED TO DEFEND HER. [screaming] I LOVE HER. THAT'S MY WOMAN. I'M GOING TO MARRY HER. IT'S JUST [ __ ] BRO. YOU JUST YOU JUST HIT ME LIKE SCREAMING ON MY FACE. NO. LOOK [screaming] AT LOOK AT HER. LOOK AT HER. YOU I'M TRYING TO HAVE A CONVERSATION. >> WHY DID YOU TELL YOUR MOM SHE PIECE OF [ __ ] >> IT'S NOT BETWEEN YOU. SHE'S MY WOMAN. IT'S BETWEEN ALL OF US NOW. YES, we will BE. I CAN GET MARRIED RIGHT NOW. I'M about to charge all three of you with disturbing the base. >> I bust my ass to pay the bill to this house here. >> All three of you. It's a four-letter word. Stop. >> While I go off tomorrow, I don't want anybody yell each other. If I hear any yelling, we'll come back here and rush all of you. He's going to collect your information. Don't talk to him. Just don't talk to each other. Just give your information coming. Good lord. >> Yeah. >> What is going on? >> Okay, so my daughters, they're just both of them, their ADHD, so they have a low tantrum stamp. So the incident started basically my daughter, the youngest one, my Yeah. My other daughter was downstairs in her room. There was an incident that happened at school. Maria had called me around something. Something happened at school. a fight broke out or whatever and I told her I wasn't going to wake her sister up and she started saying when I get home I'm going to you know destroy stuff I and literally I just hung the phone up and she finished out school and stuff and when she got home she went downstairs immediately to her sister and started talking to us >> we're good for >> and so when she got home I've been doing laundry okay so I'm downstairs well since then she starts in on me >> she ride the bus or yeah what grade is she in >> she's in ninth grade >> okay >> so she started in on me called me telling me I'm a piece of [ __ ] mom because I didn't want to listen to her. So I told her, "I'm done. I'm tired. I don't care. Call me whatever you want. I'm a I'm a no good mom," which I am. I I work my ass off. I go to work every day. I I'm going to school. There's a lot of [ __ ] I do want to clean house. >> I'm just telling you like it's it's And here's the thing. So my daughter, she just kept going and going and going and going and going. My son went, "Okay." And so I came in here and I sat down and I just looked at her in her face and told her, "I'm tired. I don't care. You could call me a a bad mom, whatever you want to call me. I'm done. I'm doing the best I can as a single parent working at McDonald's as a manager. >> I get up every day and I go to work. This guy we have been dating. He has moved in here. >> Yeah. >> How long has he been here? >> Um he's been here for what about a month and a half, two months now. >> Okay. >> Okay. So, he does pay bills. He He's a good man. Okay. He does help me out. The girls don't like him because I have been single for years. I've been by myself doing this. Okay. And this is what they've done to me as you see. And I've dealt with it as a mother all by myself. So then my other daughter came upstairs and started in Yeah. The other one started in saying all kinds of [ __ ] to me. That's when he came out and sat down right there. And that's when she my oldest one got in his face and said, "Why are you up here? You don't need to be up here." He didn't hit him. I can promise you that. I would tell you I'm not that kind of a mother. >> She smacked the living [ __ ] out of him and she kept saying it. The other one went and grabbed a kitchen knife. I got the kitchen knife away from her after the scuffle right here. And >> so the youngest one grabbed the knife. >> Yes. >> And where was that at? >> I put it back into the kitchen. >> Okay. Where where did she have it at? Like >> in here? >> Was she doing anything with it? Was she just holding >> It's kind of like they were You see that? See what they were doing out there to each other? All that back and forth. >> Yeah. >> All that back and forth was in here. >> While she was holding >> Yeah. She kind of was more, how can I say this? Why Aaliyah was kind of at him. Mariah was kind of in the back and I was kind of trying to get Mariah with the knife to get her under control. >> Mariah's younger. >> Yes. So that's the reason why I grabbed the knife and was trying to get her under control with everything. >> Okay. What What happened? >> Just started with my mom and my sister. I wanted to try to diffuse it. It didn't go that way. I got upset with my mom as well, yell at her. She came, he sat down, triggered me cuz I felt like it was just between my mom, me and Mariah. And I asked him, "What are you doing?" That's when I start screaming. He starts screaming, spits flying in my face. I'm getting more and more upset. So, I put my hands on him. I wanted him out of my face. I didn't feel like this was his conversation to be in. I understand he's with my mom. I get I respect all that, but at the end of the day, it it never ends good when he gets into it. That's why I wanted it to be between me and my mom and my sister. We've lived he just he ain't even been here a year, >> you know? He just moved here. >> Are you Are you mom's boyfriend or >> Yeah, I've been paying the bills for about 2 months now. >> Okay. Dude, we'll just put it as ever since he moved in and everybody's >> with the [ __ ] >> Everybody's personal opinion besides those two, my grandma as well and the truck over there feel like it I don't we don't know. It's just it's just horrible. It's never been like this at all until he came in and everything just went downhill. >> So, was she like smacking bare-handed? Was she punching? Was she scratching? Like what was >> um I know she smacked him. I heard that pretty loud. She smacked him in the face pretty good and she was hitting his back and stuff, but at the same time they were all yelling at each other and here I am in the middle of it. >> Right. I mean, I notic when I got here, you weren't doing nothing and everybody else was just blowing their heads off. >> They uh get away with a lot before because of the discipline cuz it's just her. She works at McDonald's. She raised them all. She had to run debt and credit cards just to be able to pay for everything. I came in, I changed that. I've got her out of debt. She's almost completely out of debt. I paid all the bills. I paid for her schooling, paid for her dress, paid for her hair, paid for every single thing I could. I don't do anything to anyone. And they were talking to her like telling her she was a piece of [ __ ] She can't do anything. It's their fault. It's her fault that they're where they're at. We're in a lovely neighborhood. It's a nice house. They both got food and play table. And then this is this has been a repetitive thing. The main thing was the conversation started with the youngest her about some type of school. one of those schools, something like that. It's super basic. But once, and I stayed out of it for the most part, but once she start hearing them call her names, tell her she's a piece of [ __ ] telling her she's a drug addict and stuff like that. She's been doing this her whole life. She's 40 years old. She did this by herself. All right. I recognize her. I met her through the other individual, her son, and that's how I met her. And we fall in love. I've been with her. I do everything for her. anything she needs. I try to take care of her. She falls asleep crying through all the stress. They don't know all the [ __ ] that she has to go through. All they know is they're 14. They're young. They're This is all they got. They want It's hard to earn [ __ ] and they just don't understand that. >> No, I trying to been trying to look charges. I'm not Look, if you want to press charges, I understand. Like, I'm not going to be mad. Like, it is what it It just it just it it has to be respect. That's all it was. It's just >> It is respect. All I'm asking >> It's too loud already. >> What? Oh, we were talking. You just talking to us. >> I was talking to him. >> I'm sorry. >> Yeah. Just Just give me a second. >> I just do what I do what I need to do as a parent. As you can see, I take care of the house. I go to work. I come home. I pay the bills. I do ask them if they're okay, but in their eyes, they say that I'm not there mentally. And I'm like, how how is that true? They have locks on their door. Yeah. I let them have their space, you know, and if I feel like I need to get in, I have all the keys to the all the doors in here. I will go if I need to. >> She never said anything to you what she's going to do with the knife or anything. She just went and grabbed it. >> Yeah. She just went and grabbed it. >> Can you show me the knife? >> That's the one she grabbed. >> Yes. >> Okay. Was she holding any sort of way? Was she like that's the way she's holding it? >> Yeah. kind of got to do is to figure out if this is a domestic violence situation or if this is an assault or if this is a menacing or if this, you know, I got to I got to weigh what all this is cuz now I'm here and now I'm getting told all this and now it's something I have to look into. I can't just like walk away and just let it go right here. They're both sitting right here, standing right here talking to her. And so after they start, I'm not going to listen to my woman, the woman that I love, and I bust my ass to pay my bills, get chewed out like that. So all I do is come over here, sit right back down, and as soon as I sit down, the oldest starts attacking me. Didn't even give me a chance to [ __ ] think. And so now her mom's getting up, and then I don't know what happened to the youngest at the time, I'm getting punched in the face and [ __ ] like that. I keep going cuz I >> So you sat Wait, so you sat down? >> Yes, I sat down. When she was sat down, when the two people were right here, as soon as I sat down, the 19-year-old lunged for me. >> Now, did she smack you open hand? Did she punch you in the face? >> Smack me open hand and punch me in the face. I'm pretty sure if we go out there in bright light, you can see [ __ ] right now. My left eye feels swollen. My left cheek. >> Did you say anything at all before she did that or she just sat there? She just >> All I did was sit down. >> She starts coming at me. I don't know where the young one went. The young one comes back in with the knife. So now she's hitting me. The 14-y old Mariah. >> Where did she go with the knife? >> She came at me with a knife right here. Why? The whole interaction was right here. Then we moved over here and she's still trying to have the knife and uh Aaliyah's punching me. And all the mom's doing is trying to stop the knife. So I'm getting all theing punches while she's focusing on the knife. They did not calm down for any bit until you got shot. >> Did you get touched with that knife at all? No, because we stopped the knife from getting touched. But she definitely lunged at me with the knife. This is this is what I wanted to ask you. Is she not wanting to wanting me to press charges? I don't know what to do in this situation. I've never been in a situ. I just want him to respect her mom and not hit me. Like I sleep here. I have nowhere else to go. >> Well, at this at this point, it may not matter. If I can articulate that as domestic violence, then it doesn't matter what you want. Doesn't matter what she wants. Doesn't matter what anybody wants. This matters with the state once, which is me. >> All right, let's go. Then where >> where was the situation at? Like where in the house? >> It started downstairs like right there by like the washer and dryer and then came up. My mom was sitting right here and Mariah was standing like by the box. >> And I come I try to grab her by the arm. She's like, "No, no, no." And then like my mom's kind of like like laughing and like trying to like be funny in her face like, "Oh, it's whatever. I don't really care." And I'm like, "You should care. Like you should care that Mary's act like this. You should want to change that." whatever. And then I started I started getting more upset. So that's when I started yelling at her like, "You shook here." And things like that and whatnot. I don't want to be here. Your whole household don't want to live here. yada yada yada. And then out of out of nowhere, he came and sat over there and I was like, "Now, why are you sitting over here? This is not between you." Oh. So then he hops up, gets to screaming, yelling, spits flying in my face and that triggered me. So that's when I started to put my hands on him and punch him in the face and whatnot. And then he was like, "Oh, I eat this. I eat this. I eat this." I was like, "All right, okay. So it's it's the point for you to get away from me and get out of my face." >> Regarding the physical part between you and him. You said he was sitting on the couch. >> No, he was sitting like he was sitting like right on the edge there >> like this, but right there. >> Okay. Then he started yelling back at you. >> No, he came in like this with like an angry face like he wanted to say something. So I was like, "Why are you sitting here? This is not a conversation for you." >> Did you just hit him in the face? Did you slap her or punch him or both? >> Both. >> How many times do you think? >> About five, maybe. She did have a knife. She did. >> Yeah, that's the part I want to zoom in on. >> Yeah, I just remember she did have a knife screaming like with it in her hand and I'm like we're trying to grab it from her. >> Do you know what she's planning on doing with that knife? Don't lie to me. >> This happened before. I just don't want her to go to jail. >> I know. I know this has happened before. >> Um I stopped her last time. They was in the kitchen. I don't know what started that. I was just downstairs and I just heard like her screaming and I come upstairs and she had the knife in her hand real close to his face. So I'm like I grabbed a knife by the blade cuz like I don't want her to do nothing. She like like she'll say she won't regret it but I know like she will. So she talked about stabbing him before >> like before that incident. >> Before today, >> I guess. Yeah. >> Mom, are you okay if I talk to her by myself or you want to come in with me? >> I can come in with you. >> Okay. >> I get downstairs and I just start going off because like I'm so tired of this [ __ ] Like it's the same [ __ ] every day. It's the same [ __ ] You come home, you complain. You don't like, bro, you don't ask us if we're okay. You sit here and you act like you're such a perfect mom. You're not. I promise you you're not. Yes, you try. Yes, you put your all into it, but you like you're not there for us. You never have been. You don't wipe my tears. You don't sit here and knock on my door and ask if I'm okay. I sit in that damn room 24 hours aing day and she don't sit there and be like, the only time she knocks is, "Oh, do you have your alarm set for school?" I'm going to be so blunt and so honest like I'm so sick of this [ __ ] Like, I'm so tired. I'm 14 years old. I should not be having to go through none of this. None of this. We're sitting over here and he starts to stand up. He goes to start shoving her like don't like I'm not going to let you shove my sister. Like I don't care. And then that's when she starts putting her hands on her because he put his hand on her first and >> I sat here and I went in the kitchen and I grabbed a knife >> and I sat here and I they tried to grab it from me. Like they was trying to move my hands and grab it from me cuz I don't even play that. Like about my sister I don't do that. And he's sitting here like and we're just all going off and she's just like she's like punching the out of him because she like he won't back up and he won't move and he's like y'all are a piece of [ __ ] All y'all do is all y'all do is complain. All y'all do is want money and it's not even about money. Like I just want to be hurt. Like you feel me? Like you ever just want to be hurt by somebody like that [ __ ] >> This is why I'm talking to you now cuz I feel like I'm doing all right. >> Yeah. Like I just want to be by somebody. Like I'm tired as like I don't want to feel like this. I don't at all. And I'm 14, bro. Like, this [ __ ] is not easy as like this [ __ ] is not >> I did grab that knife. What was I putting that night? >> His mother ass. I wanted to. I REALLY DID WANT TO. Did he? No, he didn't. I'm so done with this. I am so done with this stupid ass [ __ ] This [ __ ] is tiring. Don't nobody know what the we go through in this damn house behind these curtains. I'm 14 years old. She moved him in after I told her that I GOT SEXY ASSAULTED AND SHE DON'T GIVE NO after I sat here I opened up to her. She don't give no at all. She don't care to be a mom. She already stated that she wants her life to be over and done with with us. And it she's so happy. She go, you know what she does at work? She goes to work AND SHE'S LIKE, I can't wait for it to be all about me. I can't wait till these kids get out my house. I can't wait. And I can't wait for you. I promise you. I can't wait. >> All right. For right now, I'm going to have you come sit in my car. Okay. >> Mhm. >> I don't I want to go out there calmly. I don't want to I don't want to yell. I don't want to throw fits. As long as you're cool, I'll leave handcuffs off of you. But why don't you go sit in that car for now? >> Okay. >> Okay. I'm going to walk you out there myself. >> So, am I getting arrested? >> I don't know yet, but obviously we have some concerns here. >> And it's not just you. It's multiple people. to stand with her, watch her cuz she's HAVING SOME ISSUES. I mean, you heard what she said to me. That's very concerning. And then the other part is the other daughter is admitting to hitting him without any sort of cause at all, which is also concerning. If he can, if my sergeant thinks that's just assault and he don't want to pursue charges, then that's fine. At the very least, the youngest is going to need to go to the hospital to get some mental evaluation or something because she's homicidal. That's just where I'm at at this point. Okay. So, I'm going to let you know what's going on cuz you're a mom and you deserve to know. I'll just be honest with you. He is going to be my victim of all this. Okay. So, the oldest one's going to go for domestic violence and assault M1 as long as she hasn't had me prior before. So, she's going to go to county jail. The younger one is going to get charged with felonious assault. She's going to go to JDC. They will hold her for that. And I would I want to be completely flat out and honest with you. I don't want to go hiding stuff and then being like surprise, right? I want you to know exactly what I'm doing. I want you to know exactly why. I don't know how long JDC will hold her. So, technically, it's a felony, too, for felonious assault. So, it may be a while. I don't know. If it was domestic violence, they wouldn't hold her at all. >> Okay. >> But the older one, they are going to hold her because she's an adult. How many people out here are going to cause us issues or cause you issues? Most of them. Yeah. >> I'm the I'm the fault. As soon as it's going to be me, I'm this. I'm that. I'm trying to get out of hurricane. We got walk to my car for a second. They're both gone. They're both gone. All right. Listen to me. Both of you are getting arrested. No, [screaming] no, no, no, no. Listen. I've explained to both of you very well what I'm doing. I have not been mean. I've not thrown anybody in handcuffs. I've not done anything that's rude or that would be like forceful. Correct. >> No. >> Right. Both of you committed a crime today. So, you're both going to have to go. You're going to get charged with domestic violence. You're going to get charged with felonious assault. You're going to have to go to county jail because you're an adult. You're going to have to go to JDC. I don't know how long they'll keep you at JDC. I know you your court date will be Monday. >> So, what the hell am I getting charged with for >> felonious assault? >> What the is that? attempted felonious assault because you told me you wanted to use that knife against him. >> But I didn't use him again. But I didn't use it against him. >> But you wanted to and you had it. >> That's a crime. >> So just hang tight for me. >> The controlling statute is Ohio Revised Code section 2935.032 mandatory arrest in domestic violence situations. Once an officer has probable cause, arrest is not optional. The victim's refusal to cooperate carries zero legal weight. The domestic violence charge requires the victim to qualify as a household member under section 2919.2 to 5. The boyfriend has lived in the home roughly 6 weeks. Ohio courts apply that definition broadly. It holds. The 19-year-old claims self-defense. Ohio's statute requires the force used to be proportionate to the threat. Five strikes open hand and closed fist against a single alleged shove fails that test. Her own mother, the only eyewitness to the full sequence, told police the shove never happened. The most legally exposed moment in this footage is the private interview with the younger daughter, placed alone near a police vehicle, questioned about the knife no Miranda warnings issued. That interview produced the confession the prosecution needs most. Miranda versus Arizona requires warnings before custodial interrogation. In JD B versus North Carolina, the Supreme Court held that age is constitutionally relevant to whether a person was in custody at all. A 14-year-old near a patrol vehicle questioned alone. Courts do not easily call that voluntary. The admission she made that she intended to use the knife is the prosecution's strongest evidence. Without Miranda warnings before that interview, it is a suppression motion waiting to be filed before trial begins. The domestic violence conviction carries a consequence that runs beyond any sentence. Under the [snorts] Lenberg amendment, any domestic violence conviction misdemeanor, included permanently strips federal firearms rights. No expungement pathway exists at the federal level. Aaliyah disclosed during her interview that this is not the younger daughter's first knife incident, a prior episode, a prior verbal threat to the same victim. Under Ohio's juvenile delinquency framework, that pattern is not background noise. It shapes the disposition. The assault statute at section 2903.13 requires knowing causation of physical harm. Five strikes admitted by her own account satisfy every element. Two misdemeanor, one counts running consecutively put the ceiling at 360 days, county jail, and $2,000. The younger daughter's charge runs under section 2903.11 physical harm by means of a deadly weapon. A kitchen knife held blade forward satisfies the deadly weapon element. Because no contact occurred, the attempt statute reduces the charge from a felony 2 to a felony 3. The case processes as a delinquency adjudication in juvenile court. A felony 3 equivalent exposes her to Ohio Department of Youth Services commitment mandatory minimum one year, maximum to age 21. Admitted intent and prior conduct are what courts weigh most at disposition. Firsttime misdemeanor defendants in Ohio typically resolve on a suspended sentence and supervised probation. For the younger daughter, given documented prior weapon incidents, and admitted intent on record, structured residential placement is the more realistic outcome. The officer earns an A minus. Scene control without force, mandatory arrest correctly applied over the victim's objection, transparent pre-arrest communication with the mother, all of it correct. The deduction is the unprotected juvenile interview that created a suppression challenge on the most serious charge. The 19-year-old receives a C minus, an adult who struck a man sharing her residence five times with a self-defense claim her own mother destroyed on camera and a federal firearms ban now permanently attached to her record. The younger daughter receives a D. Retrieving a weapon and advancing with admitted intent is attempted felonious assault in Ohio. The juvenile system weighs age and context at disposition. The grade reflects the conduct. Once police have probable cause in a domestic call, prosecution belongs to the state, not the victim, not the family. Ohio's mandatory arrest statute removes that choice by design. Calling law enforcement triggers a process that cannot be walked back. The confession here is the most valuable evidence in the case and the most fragile. Miranda warnings issued before the private interview would have locked it in. Without them, the defense has a constitutional argument that could gut the charge before trial. A disclosure of prior victimization by a juvenile directly to a responding officer triggers Ohio's mandatory reporting statute at section 2151.421. A mental health referral and a mandatory report are not the same obligation. Both must happen.
