On July 18th, 2024, Flaggler County deputies arrested two suspects at a Palm Coast encampment one night after surveillance caught them walking over $850 in groceries out of a Wind Dixie without paying. >> Actually, it was two separate people, right? So, the same one brings out both shopping carts. However, the other shopping cart was shopped by a different person at a band on Iowa. They at 7:00 a man comes up to one of my cashiers and says, "Hey, have you found CMA EDT card?" And starts pulling him away from the front end to look around for it. And while he's looking around, he finds the shopping cart that he was going going through and it was on aisle one. Is the tester still here that was speaking to the gentleman? >> Yes. He just wanted to know if he's right. I want you to give us a good description of the male. Yeah, he was the kind of taller, bigger uh black guy with white shirt. Okay. >> He uh had these white pants and they were kind of inside out like his pockets around here, but he was just a big uh 6 foot. >> Yeah. He I think he was a little bit taller than I was. So, probably around 6'. Yeah. >> Okay. He talked to you at all. >> Yeah. No. So, he he came in and he was going to come into my register, but then he was like looking through his pockets like he forgot something and then he ended up leaving. >> Yeah. No, you're good. >> Came back in. I was like, "Oh, I think I lost my EBT card." And then he's like, "Oh, I can't seem to find it." And then >> I was like, "Okay, well, let me He did give me a name that he's like, "Oh, if you found the EBT card, can you let me know?" So, I did have a name written down and a phone number. I don't know if that's his name or not, but I do have a name written down. Service. It was like John. He said it was John Simes. Simes like he said it was S I M E S. He's trespassed for this. >> Oh, yeah. But that's not who he's describing. So >> that's not that's the name. >> So this is what he gave me and that's the phone number he had me write down. >> We haven't seen him since 2 years ago. >> I'd be curious if he has John's EBT card that he was going to use. So he spoke to you, said this is my name, this my phone number. >> Yeah, that's what he had me write down when he said he could have found his card. >> And where were you at? Uh, well, I was on one of my registers and then I was kind of walking up in the front and then he came back in through this door like looking and then we kind of met up here and we were talking about >> and then I brought him over here to write down the information that he asked for right there. So, >> did you see him originally enter? >> Uh, I never saw him enter. I just saw him come to my register because I saw the the woman that I saw, she came in earlier. When she came in the second time, she kind of like walked that way probably to look for the car and then she saw it over here and then as soon as I left to go to my register, that's when she kind of came and took it. >> We're thinking he panicked and bailed and then she came and said no gra and went that way cuz he left the car down that way. >> I don't think he was going to steal. I think she said just grab it. >> I think he was going to try the EPC. 6:2419 p.m. she leaves the store with the cart, does not pay. At 6:252, she puts the items in the car and at it the car remains there till 653 with her in it. And then he moves it to one lane over and next to >> he moved it or she moved it. >> There's a different male in the car driving the whole time, >> right? And I don't get >> So there's potentially three of them. Yeah. >> Driver never gets out. >> Gets out, but the camera cuts off. >> Never comes in the car or in the store. >> Never comes in the store. Comes in view to where at least I can get a description over. >> So then at 6:24 she left with the first car. >> Um at >> Yeah. And the driver's blocked by the trees with the cameras. Wrong spot. [music] At 6:59 uh 21 p.m. she gets out of the car, talks to the black male behind um the white SUV that's out there, and then at 7:00 uh 7:00 18, both of them uh come back into the store within like 10 foot gap between the two. >> The black male and the female. >> Yeah. >> She grabs the car and then he leaves. >> I didn't get that far. That's when you guys come in, so I don't know where she went. Well, I'm sorry. I know what she did. I don't know where he went when he comes in. >> It's a good thing we were delayed. We got you all time to investigate. >> Yeah. I mean, I was pissed. So, I can only imagine. >> She knew the store. I mean, I'm not sure if I recognize her per se. There's thousand people a day here. But she was walking around like she knew exactly where she wanted. Sounded almost planned out. Got a getaway driver and everything. The other pricing thing is grabbing the uh the pods are pretty cheap too, aren't they? Pretty expensive. Grab the rock from those phone chargers and stuff. >> Yeah. >> Oh, she hit those, too. >> Yeah. So, that um honestly, this that first cart is probably a solid $375. >> I mean, you got two things of like Fabuloso. You got Tide Pods. Oh, so she definitely knew what she 20 minutes and she filled the cart. >> Yeah. specific items too, like not even if you watch her, you can tell she belonged to the exact spot. >> And she stayed in the car for about 25 minutes and then they moved the car over one lane next to the white SUV and that's eventually when the guy comes out and they talk and then they both come in at the same time. >> Yeah, I found the board sitting all the way down at the end by by the last register. So I was like, "Well, that's weird. What is that car just sitting here for?" So I took it and I brought it up here cuz you know that's where we put our car. >> So it was by the register. It was past register six on the other where nobody is going. >> Well, they were both being cautious cuz they both went out the exit and they both went all the way around in the parking lot to get to the vehicle. >> You can tell they were both trying to be very cautious at the same time. >> So, both cars. >> I don't I didn't get that far. I can get all that information. >> Hey, sheriff's office. Step out of the tent. >> Uh-uh. Show me your hands. >> Step out. >> I ain't got no clothes on. >> Huh? >> I ain't got no clothes on. >> Okay, put the clothes on. Thank you. >> Who else is in there with you? >> It's him and uh >> I was playing te in a sec. >> When you guys come back here, just step right up there for me. >> Step up there for me. >> What did you just put up under there? >> What did you just put up under there? We'll we'll take care of the face. Just come here. >> What did you just put up under there? >> What? >> I put this on my fingers. >> All right. Well, you just put something up under that shirt or whatever. >> Come out here. No. No. The shirt over there. Come over here. Step out of there. What did you just put up under that red shirt? >> I didn't. I put his ring on cuz I want him to put it on so I know that he ring. Oh, listen. >> One of you guys, can you come around and check under this red shirt that she threw something under Where's your pants at? Right there. All right, we'll grab it for you. We got to check it first. All right, you might come over here real quick. >> Right under that red shirt in the blanket. She tucked up something up under there. It's >> like right in the corner and right where that red shirt was. Huh? >> Yeah, she lifted it and tucked it up under either there or in that corner fold of the blanket. She's saying she was putting a ring on, but I don't know about that. It looked like she tucked it up under the blanket. All right, just move the blanket, too. No, like the other part. No, closer to you where where the end of your asp. Yeah, pull that towards you. Towards you. Marijuana. What is it? Huh? Can't say. Huh? What is it? >> What is it? >> Chocolate, man. >> Letter. >> Yeah. Where's your shirt? >> Did you grab his pants for me, Michelle? Which ones? Which ones are his pants? >> Yeah. >> Which pants you want? It's >> a probation violation for the child abuse thing or >> No, like what you originally got arrested for. >> You're on probation. >> It's I don't know. We don't know the violation reason. >> Do you know who the investigating officer is? >> Yeah. >> Go there. >> Yeah. He'll stand by. No problem with you. Don't you want to walk over there with her? Mike, he's going to get you some She's going to get you some shorts, brother. >> Over here. >> You're saying it's right behind that orange bucket. >> These are all wet. These are all >> there. You can see those real quick. He's just going to check to make sure there's nothing in them. Okay. >> Wash your hands and show them. >> Yes. Can you uh whenever he's done with that, can you step back over here for a minute? All right. Look, I got to talk to you about something. Okay. So, part of the reason we're here is that uh I'm assuming that's part of it. All right. >> Food bank, >> huh? >> Food bank. >> Food bank. Okay. Well, you're on video uh last night at Wind Dixie, stealing from there. Well, pushing this shopping cart full of stuff out. All right. So, just listen to me real quick. All right. The only reason I'm bringing you this cuz you're not free to go. Okay. Say the right man remain silent. Anything you say can will be used against you in the court of law. You have the right to talk to a lawyer. Have him or her present with you while you being questioned. If you cannot afford to have a lawyer, won't be appointed to represent you before any questioning. If you wish, you can decide any time to exercise these rights. >> Can we try to get it back to Wind Dixie? >> H >> I don't even know >> because I mean this is all the stuff is in the cart. That's you and Willie. So we got this today and then we ran Willie. Willie obviously has a VOP warrant and then we come here and we find you two. So where is this stuff like the Tide laundry detergent and >> I don't know where did it disappear? Were you stealing from someone else? Did they give you a list to go in and take? >> No, I I don't know. >> Um I don't I grabbed the buggy. I told to grab the buggy. I grabbed the buggy. You >> told grab the buggy? Who told you to grab the buggy? >> Who was the other guy with you? Cuz there's two males, right? >> No. >> Was it just one? Just me. >> Just you and Will. >> Who gave you a ride up there? >> Weird bikes. >> No, you're in a car. >> They got you in a car. Black car. And I have the tag. >> No, I don't. >> You know who it is. >> I don't I don't know her though. >> Come on. >> Don't say bikes. Like, look, we've already done a lot of this before we got here. So, let's knock off kind of the nonsense, okay? Like, you're not going to be arrested right now. I guarantee that right now, okay? Because the investigating deputy, they're off. They work night shift. Okay? So, right now, you are not going to be arrested coming with us. Okay. But it's going to be up to the investigating deputy on what how they proceed from here. Have you been arrested before for shoplifting? >> No, I'm just on probation as well. >> You're on probation? >> Yeah. And if I get in trouble, then they said I'll never get my misdemeanor or a felony. >> Felony. >> All right. Well, the problem with that is take back what I just said. I didn't realize you're on probation. Okay. That might change things a little bit. What did he do? Where is that necklace at? >> Oh, it's in my purse. >> It's in your purse. >> Yeah, my accus. >> So, this is you. You were there last night and that's Willie? >> Yeah. I mean, you already said it was. You got >> I didn't realize you're on. You're on felony or misdemeanor. You said >> do you know where any of this stuff is that we could try to get back to Windexi? >> I really don't. I have no idea. >> Did you guys sell it by any chance? Any mouth? Nothing? I have no idea. >> I know what's common is that people kind of give shopping lists and then you go and you boost it and you give it to them and they give you money for it. >> Is that what happened? >> I don't know. >> Well, I mean, I would expect I would expect $800 worth of stuff to be laying around here. >> Yeah. >> Right. >> I I wouldn't even $800 worth of stuff, but it's mostly food. >> Okay. Where's all that at, you know? >> No. >> Is that part of it? >> No, that's food bank. >> At legit food bank? Yeah. See a sticker? >> Yeah. Do you have a history of shoplifting? >> No. >> Never been arrested for it. >> No. >> I only been in trouble one time ever and it was um for my kids. >> So you all just did this cuz you were hungry. You need something? Was that >> hungry? Yeah. We need We need to be able to, you know, have hygiene for ourselves. Get something to eat. >> Did you Did you consume those stuff you took last yesterday already? >> The food part. >> Okay. What' you do the other one? >> That I don't know. I I stay right here. Is it inside the tent? >> No, this is where I hang out. Like I mostly always intent. I don't come out unless I'm going there and stuff. >> Someone gives them a list. So go pick it up. >> They give them money for it. >> Did you sell anything to anybody yesterday? >> I don't do anything. >> That's what >> I don't even know any people anybody around here. >> I know, but that doesn't make sense is what you're saying. That's like if the shopping cart is saying it's like $800 worth of stuff. So where would it go? I understand the food and stuff, but like the the laundry detergs that are in there, >> they have to be somewhere if they're staying with you unless you stole it from someone else. >> I just I just grab stuff like I just grabbed the the buggy. >> So, you're saying Willie gave you told you to push grab the buggy and you just pushed the buggy out. Do you have a receipt for the stuff? >> No. >> Did you pay for it? >> I know he paid for some of it cuz he had his food stamp card. >> So, you did pay for some of it at one day. >> Yeah, I know he paid for some of it cuz he had his food. Who paid for it? >> Willie didn't. All right, let me go pull the report and see if I can read it real quick. So, are you good just hanging out? Pre50. I didn't realize she was on probation. Kind of changes things a little bit. If you're on probation, you're not supposed to be out committing new crimes. Hey, she's on probation, too. Okay. >> So, she might need to go. >> No, he says like peace. Can you just go hang out with her, Deputy Blake? Thank you. I'm gonna try to pull a report from last night. >> Hey, did he calm down yet or no? >> He's on probation, too. [music] >> Are you guys uh you doing resistance? $500 bond. >> Really? Listen to me. Hey, >> listen to me. Sit up. >> Can you hear me? She said it was her and Lily. So, >> go calm down. >> All right. So, I just read the report since it was a night shift's case. All right. So, it looks like you pushed one card out. You met him in the parking lot. You guys loaded everything in the black trunk, the car, the the the trunk of the black car, and then you guys said something and then both of you guys went back in the store. the other car that he had been pushing around. They said that they had moved it. So, you went around looking for it. You found it, looked inside of it, saw everything that was still in there, and then you stole you walked out with that one while he said he lost his EBT card and gave the name John Sims or some [ __ ] like that. So, it's two different cart fulls of stuff. It's not even just one. >> Yeah. Do you have anything to say? I mean, I >> I'm about to go ahead and pull that face. >> Okay, I got you. All right, do me a favor. Just put your hands behind your back for me, Eric. >> Oh, man. You want to say that? No, no cigarettes on her. No, >> no cigarette. No ball. >> Um, if you want, Deputy Blake can grab that for you, but that's up to her. >> I'll get your cigarette. You've been cool with me. I'll get your cigarette. >> We'll reopen our other case. Don't worry. >> I'll let her go. >> You want to just watch her and I'll grab her cigarette. >> Trying to find the case. I got >> Where they at? >> Right there on the other side. There's like >> I don't know what that is. >> Chocolate. The lighter was on the blanket. >> Which one? >> I don't know. >> He saw it when he >> adult male and adult female are going to be 10:15 on that. And I'm going to need two additional VOP case numbers in the notes. Do you have uh Are those your slides? Can you put those crocs on? Mhm. >> All right, let's walk out that way a little bit so we can get away from all those mosquitoes. You want your seat belt on? >> No. >> I'm pretty sure grandma's going to have her clean up back there. That's why I was telling her that. >> Oh, yeah. >> Yeah. Wanda, I can't remember her name. >> Luckily, we're a little closer to the jail at least. So, it's not too far of a drive. >> Well, last time it was 81 in circle, so it wasn't far either. >> You getting near back there? You all right? >> Oh, I'm fine. I'm just sweating. Sweat is itchy. We're almost there. >> Yeah, I was not going to let my hands go and wipe off my face. >> Yeah. Yeah. >> About how tall are you? >> I'm 5'6. >> Uncomfortable question, but about how much do you weigh? >> So uncomfortable. Um I'm like 175. >> Okay. >> Trust me, it looks better than being 120. >> Yeah, that's true. Why you I got gastritis really bad and I lost a bunch of weight and I got down to like 123 and it looks disgusting. >> Yeah. Yeah. >> Cuz I'm naturally big bones. So looking real skinny does not look good on me. >> Yeah, I hear you on that. What's your phone number? >> 36. That's so unsanitary. >> Huh? >> I keep wiping my face on the gun the thing. I think that's so unsanitary. >> Yeah, I I don't know. A lot of people have been back there. >> That's the thing. I'm saying it's so unsanitary cuz I don't even know. But the sweat on my face is itches. So how long were you working on? >> Uh Mandex's not too long. Um I'd say probably 5 months or so. >> Long enough to get like an idea what it's about. >> Stupid stuff out there. Really? Cuz there's nothing out there. Nothing at all. I was so happy when they built a Dollar General cuz it used to be when you, you know, you went to Walmart, you did your shopping and the way back it's like, you know what, if you forgot it, hell with it cuz you ain't going back. >> Yeah, it sucks they only have one Walmart for all of Flagler County though. >> I only see this I don't see it big enough to have another one really cuz >> it's really small. Like here is really small. >> That's fair. But I feel like Mondex could use like a um you know like those neighborhood Walmarts. It doesn't have to be like the big one, but I mean living on Dollar General cuz that's the only thing that's out there and you work night shift, you're you're screwed. There's nothing out there. >> True that. >> Past like 10:00. You know what I mean? Or just make Walmart 24 hours again. >> Yeah. I lived out there for the hurricanes. It was great. >> Yeah. Yeah. >> They kicked [snorts] us out of the school one time. They said we had to leave. And then I went back to Mondex and the roads were so flooded. And I was like, where am I supposed to go? I'm looking at the roads. I'm looking at my kids. So I'm like, "Well, kids are going through one of them." So I asked my kids, I said, "Which ones look easier?" And we picked the same one. And so we went to drive through it. The water's coming into the doors. And my kids are tapping the car going, "Go Rosie, go Rosie, go." Cuz the car was a was a old um [snorts] um old Buick. >> Yeah. >> And my car actually went through the water a good way. A whole like a whole street. And the crazy thing is my my dad's property wasn't flooded and he had a pond. I was like, "What the hell is this shit?" >> Oh, yeah. >> Yeah. He had a really good um property over there. >> He's famous in law enforcement, man. That's why I asked you how long he worked out there. >> Yeah. >> H >> he he only had one leg. He was um he's actually really respectful when you when you talk to him. >> Deputies arrived on a confirmed violation of probation warrant for Willie London Jr. under Terry versus Ohio. A live warrant clears every threshold for lawful contact. The stop was legally sound from the first word. London's move at the store. Fake name pulled a cashier away from the register to search for a card that never existed is not background context. Florida statute section 843.02 covers obstructing lawful detention authority through deception. That is a separate chargeable offense. The combined card total cleared $750. Florida statutes section 812.015 015 draws the felony line there above it. Thirdderee felony up to 5 years state prison, not county jail. Florida's principal statute section 777.011 makes Sophia equally liable as the primary actor. Pushing the cart while London ran the distraction is firstdegree participation. Secondary role does not mean secondary penalty. When the officer told Sophia she was not free to go, custody attached. Miranda versus Arizona requires advisement before custodial interrogation and Burkimer versus McCarti confirmed this standard applies in field contacts, not just booking rooms. The officer had the sequence right. Sophia received her Miranda warnings and kept talking. Under Burgess versus Thumpkins, continued voluntary talking after advisement can constitute an implied waiver, but no explicit waiver was documented here. That gap survives as a suppression argument at the pre-trial stage. London denied knowing the driver surveillance shows him loading stolen goods into. He claimed they took bicycles. He gave the cashier the name John SS which matched nothing. Every false statement made to investigators is admissible at trial as evidence of consciousness of guilt. At 16 minutes 33 seconds, London said he was pulling the fifth. The officer acknowledged it and moved straight to handcuffing. Once a suspect invokes the right to silence. Questioning stops entirely. No follow-up, no grace period. That compliance protects the prosecution's post invocation record. The deputy receives a B+. Miranda timing was precise and the fifth amendment invocation was honored without hesitation. The deduction he told Sophia she would not be arrested right now, then walked that back when he learned she was on probation. Legally justified, still a voluntariness problem at suppression. London receives a D. surveillance captured the entire plan and his statements directly contradict that footage. His one correct decision was invoking the fifth and stopping there which prevents additional admissions from entering the record. Sophia receives a C minus. On active felony probation, a principal under Florida's charging statute received Miranda warnings and kept talking, saying she only grabbed the card on London's instruction describes her role under the law. It does not reduce it. Both were on active probation. Florida statutes section 948.06 allows the court to impose the remainder of the original sentence consecutive to the new charge when a new felony is committed under supervision. London's exposure across all three charges runs into years. Three things. Miranda is a doorway, not a wall. It protects you only if you stop talking after you receive it. Sophia received her advisement and kept going. Every statement after that point is in the case file. Silence carries no legal penalty. London's distraction play was performed inside a building covered by the store's own cameras. It did not create cover. It created an obstruction charge stacked directly on top of the theft. Active probation does not pause. Every offense committed while under supervision is two offenses at once. The new crime and the violation that reopens the prior sentence. Both defendants knew those terms when they accepted probation instead of prison. Let us know if there is an interaction or legal topic that you would like us to discuss in the comments below.
