Chamblee, Georgia, June 2023. A missing Amazon delivery becomes a criminal case built almost entirely on video evidence and mistakes. Officers spend close to half an hour talking with the suspect at his own front door before any handcuffs come out. >> Who stole that little girl's couch? >> No, I stole the couch. It's not a >> It's a five-on-one. You can't even keep up. I SAID THAT OTHER ORIGINAL BUT IT WAS ALWAYS THERE AND IT WAS LOCKED. >> Can you check to see if that's one of your tenants here? >> And this was in there and she's like >> is a tenant, can you ask her to come downstairs, please? >> Oh. That it was in that storage unit? >> No, we said it was straight out of this unit. We think that we believe that he he he even comes in at night sometimes. So, but yeah, just give me that. Cuz your storage unit I had my play game and you had like Tide Pods and stuff like that. Actually some of the laundry detergent. >> All right, can you have the victim of the couch come down so I can see who it is? So, the couch is the Amazon >> Amazon locker room where the increase and that's where the couch came up missing from. We got a hold of the outside company Luxer and they sent us the video from their system and that shows who took the couch. >> So, they have their video in the building? >> Yes. >> Yeah, they got a right here from >> They have a camera right here. >> I'll just wait for them to talk to the manager. He's familiar with the manager. I I go to Real Tacos as well and he works there. >> him also. >> Yeah. >> I don't know his position but I know he works there. I just spoke with my >> You normally see him when you go in for greetings. So, like I like to go there cuz they got the outside patio. >> It's pretty clearly him. It's definitely clearly him. >> I said good eight out of 10 it's him. >> I just spoke with my I'm the service manager. My name's Billy. Just let you know. Um I just spoke with my service manager. We put in a work order. The gentleman with that stole the couch lives in 14. We put in >> The manager for real tacos that >> They have a corporate account here. >> staying in the couch who lives in a corporate unit here. We put in a work order for a water leak dripping from the ceiling in 13. That [snorts] gives me access to go into 14 to look for the water leak. We're going to see if there's tools, um, a monitor and you said orange and silver luggage. >> Yeah. >> Anything else distinctive from what else Nothing like Um, just so you >> to take a picture while you're in there if you need to. >> Well, they Okay. So, um, I don't want to go by myself so I'm going to have the leasing agent go with me to help me look for the leak. Okay? >> Okay. >> How would he get into How would he get into the storage unit? Is it like a key card or how does it work? >> Um, they're hard keys that we give >> It's not the Amazon store. >> Oh, that is any of the residence fobs gives them access cuz it's a community area. So, his door key will get him into there. >> What else? What else? >> So, would you have like a key card or hard key? >> Key card. All right, key card is fine. >> So, you can have access to the storage unit and the title is taking. >> Um, we can get it on the spot. Yeah, cuz we all have these. This is the little fobs that'll get him in. Um, I would just need to get the time stamped. >> Yeah, I guess the only other thing is talk to him and make sure somebody like sell him the couch or something like took my money to get >> We would just have to I'd get the time stamped and then look at it. >> I'm going to talk to him. He said he was going to come down here to talk to you. How are you, sir? Yeah, I told him to come here. I told him to come here. Um, we're going to see >> Yeah, um, miss, she said yeah. >> I need her to come down here so you can talk to her. Oh, okay. Can you give me her phone number? And then whenever you get a chance, could you play the video for my supervisor, please? Um, they were able to track down who took it. I just want to make contact and >> Are you alone or are you by yourself? >> Yeah, yeah, yeah. Just see what he says. Um, if he's going to admit to it, I'm sorry. Here you go, take the couch, give it back to the victim. And we'll just kind of go from there. >> Give me one second, man. >> Did he give you the victim's number? >> Did what? >> Did he give you the victim's number? >> OKAY. >> ALL RIGHT, CAN I get that victim's phone number for the girl with the couch? >> Yes. Um, her number is >> All right. And then that gentleman, um Do you know where he went? He went TO BREAK THE SOUND. >> OH, the consultant. I think he went up with the maintenance to go check the guy's apartment before you guys go up there. >> Oh, okay. So, I'll wait till they come back then. Huh? He already just went up there. So, I guess they'll be up there to advise us if he's there >> Hello. >> or if he's at work. Cuz the guy, um, is the the I don't know if he's the permanent manager here. >> Yeah, he's he's doing the water leak check right now. >> Yeah, doing the water check. And then, um, if he's not there, then he works at Real Tacos. Just make contact and go from there. But I'm going to call the victim real quick just to confirm. And she supposedly wants to press charges about her couch. >> Wait, so I I didn't even catch it the first time. What happened What happened with the couch? >> So He stole a package. And it it so happened to have a couch in it. She >> couch? >> A couch. Listen, we just showed up for this job. >> a bean bag? >> No, it's in the luggage town. >> You got to put it together. >> You know it's like a way like how Wayfair comes? It's in a box. Yeah. >> It's still heavy. >> Yeah. >> It's a small couch. Well, it looked like his size. >> Yeah, it like it was about as tall as him, and the guy is pretty tall. I don't know, like normally when I go he's like the person that greets you when you first come in the door. He'd be a little mean to be like a greeter. >> Yeah. >> Yeah, not very friendly. >> And he's a thief, apparently. >> Allegedly. We don't know if he did it by accident yet. We're going to talk to him. >> Why do you How do you know he did it? >> They got him on video. >> Oh, really? They showed you? >> Yeah. Yeah. >> And he works at Del Taco? >> Real Taco. >> Real Taco. >> I think I'm going to let you >> Back to the couch thing. I did see >> I love that he already got a ticket. >> I saw a crackhead. And he was skinny, and he wasn't that big like tall or anything. And then got on his bike with the refrigerator. >> So he bike, damn. You probably should have gave him a car. >> I didn't. >> He probably going He probably going to be famous. >> Police contacted the victim who declined to press charges, but wanted an investigation. >> Hello. This is Officer Asbury with Chamblee Police Department. They advised me someone had um stole your couch. They showed me the video. Yeah, they showed me the video. Um So they were saying When were you expecting the package? Let's start there. About what time? I know it was like And it was already missing at that time? And what time did it arrive June 2nd? 12:35 And what color was that couch? Now, do you have a picture of it? Yeah, they sent me the video, but on your end where you purchased it, do you have like a picture that you can send me? Yes, ma'am. And then, um do you have your driver's license on your phone here? All right, what's your last name? And do you want us to retrieve the bag, or were you trying to press charges? What did you want to do? >> [music] >> Do you want your property, or Okay. And you do not And you do not want to press charges? All righty, ma'am. Do you want a report, or >> [music] >> No problem. Give me 1 second, OKAY? HEY, dispatch radio. Can you give me a separate case number for stolen couch? All right. Um you got something to write with, or do you want me to just text it to you? >> You can text it to me. >> All right, I'll text you your case number, okay, ma'am? All right, bye-bye. So, she doesn't want to press charges. >> Does Does want her couch back? >> She said she did, but now that they found out found out it's already set up, she was like she doesn't want it cuz it's been used now. >> Was she okay with it or was she not? >> Huh? >> Was she okay with it or what? She's the one that snitched. >> What? >> It ain't it's a property crime. She can press charges if she has any. >> Well, she said she Yeah, that's what she wants. She was like she wants her money back from Amazon cuz she asked to get a case number for the purposes of getting it back since he's used it now. I don't know. Technically, yes. >> Because if she purchased it then >> Yeah, but now she's going to get her money back from Amazon cuz I got proof it was stolen. She declined pressing charges and she she doesn't want it back now because he's used it. Okay. Okay. All right. So, was he in there? >> Yes. >> All right. All right, we're going to go. Are you know you know What unit is he? What unit again? >> I have no idea. >> What unit again? You better not. What unit? >> Hello, how are you doing today, sir? >> Fine, how can I help you? >> So, we're here to talk to you about that Amazon package. >> What happened? >> The Amazon package. You're unfamiliar? >> No. >> They got you on video, sir. >> Me? >> Yes, sir. >> When? >> Let me see what day. >> [screaming] >> June 2nd. Are you You do live in 14 C, right? >> I live where? >> In 14 >> I don't live here. >> Then I can't get a manager. >> It's two managers here. The other manager living here, but I'm not living here. >> Oh, he's the other manager. >> I'm the gym manager. >> The other manager is our guy. Oh, he's the assistant manager. >> Yes. So, he's going to be the gym right now because I moved to another location. He's coming. Well, that's what he's going to say. >> Okay. >> Okay, the only >> So, you can get your assistant manager down here. >> Yes, okay. He's over there. He's look like me, but he got beard and the same size. >> Yeah. >> When Okay. We don't have access to over there. >> Hm? >> We don't have access over there. >> They got him on video. >> I know. They have the keys to go over there. >> Say that one more time. >> the keys because they live in the apartments. >> Yeah, yeah, yeah. He lives there, 14 >> Yeah, he lives in there. >> not and he's trying to you know, avoid the conversation, but could you tell him to please come down? >> He's going to say I'm me. Sorry. >> No, don't worry. I understand. Don't worry. >> I thought that I was supposed to look a little younger. >> Yeah. >> Yeah. Listen, man. I'm like, he was supposed to be a little younger. So, maybe looks are deceiving on that video. >> And it came out on the phone. >> All right. >> Okay, but when is he coming back to work? >> Huh? >> When is he coming back? >> He's off today. >> All right. When does he come back? >> Uh, tomorrow. >> When does he come back? >> Um, could you text him and let him know? So, they already went in there. He's in the in the unit. He's just not answering the door for us. We already know he stole it cuz they already took pictures of it in his house. So, he can come talk to us or we can just go about the process of swearing out a warrant for him. >> going to work tomorrow at 5:00. They have a pictures. He's >> They got a video. >> video >> And then they took pictures with it being in his house. So, tell text him and tell him to go ahead and come downstairs and talk to me. Or I'm going to go ahead and just swear out a warrant against him. And he can talk to the judge instead. I'm a little bit more understanding. >> Yeah, no, no, no. Let me Let me He just has to come back and just come down fix everything. You give me I'll call the phone. And is any way I can call you guys and call him and fix it? I don't know. >> Look, this is not really on you. >> I just trying to be >> Yeah, we're just trying to quickly and he you. >> Nothing on you to bring him down. But, we will probably be showing up to his tier tomorrow. In front of all these nice people. >> And we don't want to do this at your business, but if he doesn't come down, we don't have a choice to. So, he can come down or we'll see him tomorrow at 5:00. It's his choice. It's going to happen though. >> Can I call you later and you can come in talk to him because you can get >> I get off in about 2 hours. So, unless it happens in the next 2 hours. >> She's on She said like a 4:00 Yeah. Okay. You can contact the gaming >> And then you just call the Champlain non-emergency line and ask for me and we'll come out. >> What is the What is the number for? >> Oh, non-emergency. Y'all know the non-emergency line? >> Yes, 7 Okay, I got it. >> You're so sweet. I'm Officer Asberry. >> Okay. My name is Diego. >> All right, sir. We'll write it up for you. >> I'm going to call you in 2 hours and let's see what happen with him. >> All right. >> I'm going to call him first, okay? >> All right. >> We appreciate the help. >> THANK YOU. >> I DID LIKE THAT. HOW LONG YOU GOT TO WORK HERE? >> WHY YOU GOT IT UP? CAN you go ahead and email it to Miss Keys? >> That's what That's what you used to tell me because I know We have delivery package for Amazon and always leave it here inside. >> And we will bring it to you. >> Yeah, but sometimes we have to wait I I check my account and they say they leave it in the in the office and I and I ask the keys and we go over there and pick up the packages and go inside. So, the last time I I remember was me picking picking up two packages. >> Okay, that doesn't matter. >> That doesn't matter. >> It's not his. It's not his. >> I know. It's not his. I know. But, he has to come and explain what happened. >> Yes, so >> But, in the beginning I was afraid because I remember >> Oh, no, it's not you. OKAY, I'M >> I WAS CHECKING my cameras that day because that day I I working and he doesn't have a on that day. >> No, he was clearly he wasn't working. He was just off and cuz he didn't pick up anything else from there. He was looking around to steal something. Cuz we have him on video. He's looking in the fridges, you know, we have fridges in there. He looked in the fridges, he didn't get anything out of it. So, clearly he's been doing this habitually. >> Because sometimes when there's a lot of packages and I pick up all of them. >> of that on the video. Start it from the beginning. I didn't catch that part. >> And you have my video when he's walking outside? >> Oh, there you go. You weren't going to ANSWER THE DOORBELL? IT WAS LOCKED. I WAS KNOCKING pretty hard. >> Yeah, I was today morning we are off. So, >> Okay. So, I'm just here to get your side. You can tell me whatever. >> Um yeah, he called me. He told me about something about a package. I mean, all I know as far as packages personally, I've had one package ordered. And then I go I come here all the time. He He knows I come here and next door all the time and pick up packages for me. >> Okay, when's the last time you obtained a package? >> Um maybe like a week ago. Probably like Probably like a week or over a week possibly. >> Okay. >> Say 10 days, 7 days. Every now and then I come and I check make sure we don't have a package. But personally, like a personal package myself, >> So, you're saying about the 7th was the last time? >> I wouldn't be able to give you a reason or a date to be honest with you. >> Can you close that down? >> Possibly in about a week. >> So, 7 days would have been the 7th cuz today's the 14th. Okay, what package did you get? >> Uh I had a TV package that I ordered a couch. >> Okay. Do you have your receipt? >> Uh I don't and that's because I just changed my phone. I was in a relationship and we had a family plan and it was linked to my Apple ID. And I guess since we couldn't recover my Apple ID, T-Mobile went ahead and gave me a new ID. >> Okay. >> Where'd you order from? >> Amazon. >> So, can you log into your Amazon account? >> Uh not not not able to as well to to that. >> But you should be able to still on your Amazon account just cuz you're locked out of your Apple ID doesn't mean you can't get in your Amazon. >> Yeah, I'm not sure. I'll try to log in as well and it will it will whatever. You still have the packages that the the package that the >> I got my social security card. >> Do you mind if we go there? Hey, can you get out of >> Before we go over there, do you have an ID or your name on your card? >> yeah. >> Yeah, unfortunately we got to get a little salty wet, BUT >> SALTY >> NO, I'M TALKING ABOUT YOU. WE GET WET ALL THE TIME. >> IS THERE ANY WAY I CAN KNOW what's missing or what's going on or >> So, I don't know exactly what the package is, but supposedly someone called up to the leasing office and advised about an Amazon package. >> All right, I'll probably go to the office I mean >> to the right here. >> For whatever apparent reason, I don't know why Amazon tends to drop all our packages off here. When we order business-wise, it says we you know, B100 for example. >> Mhm. >> Um like I said, I told you I I I think I ordered like two or three things. >> For your unit or for the business? >> Well, the unit I I go in almost not not a daily, but when we order like I I tend to remember okay, we had ordered something up 4 days ago. Let me go check see if they arrived or I've been having something going on with the general manager as well a real tight one, so um but not too long ago we had a pet and the pet store our pet store, so we ordered a well, I ordered a couch. >> AND WHAT KIND OF PET YOU HAVE? >> IT'S A regular It was one of THE SECURITY COUCHES. >> NO, I'M TALKING ABOUT THE PET. >> OH, it was a it was a micro bully a micro bully American pitbull. >> Oh, I bet that thing was pretty. What color was it? >> It was a blue and white. Well, it wasn't really mine. It was my cousin's, but I was taking care of it for a while till he came back. >> I like micro bullies. They're just too expensive. >> Yeah. >> People be out here making up numbers. >> Yeah, I had to make him a service dog because apparently there was an issue with her. He went with his uh medication. Um but yeah, I ordered a I mean I ordered a package like a week about a week ago, but I remember I ordered it probably 10 days prior to that. And those are big uh big package box, and nothing I looked like I usually look for the for the for the address or whatever, and it said the address said I got it right now. I ordered it. >> Okay. Can you stand with your neck? Okay. >> Yeah, I wasn't able to I literally got this phone out of people upstairs. I had to sit down on the floor cuz they were apparently not able to look at my messages, my phone calls, and >> And so you forgot your password to your Amazon, too? >> So, my Apple ID pretty much is linked to everything. The same password I have on the Apple ID is the same password I pretty much 10 times everything. Until I became GM here and I created a business account, and then I have a new Apple ID that they had opened for me. So, all my passwords are now the same. For example, my password would be tacos. >> No, don't tell us your password, though. >> Um so, like all my previous stuff that I had, I don't have access to anymore. >> Apple couldn't get you into your stuff? >> Well, I haven't gone to Apple. >> Oh, okay. >> I was dealing with T-Mobile because I was trying to do change my number. It wasn't really a big issue. Yes. >> Don't fall, MAN. >> YOU KNOW I TRIED TO put my after market You know what I'm saying? This and that and that's all it was. You know I got to put it over there. And then I got I got the the two more playing while I'm about to be falling there. So watch this watch this. It's like you got like two devices and my woman had ordered a bed as well. So >> I'm fine. >> Hopefully you don't have a problem out here. So So if I'm not mistaken, this is what it looks like. Uh one of them is to the bed and one of them IS TO >> SO HOW WAS YOURS? >> AND IF ANYTHING >> HOW DID YOU KNOW THIS one was yours? >> Say it again. >> How did you know this one was yours? >> By looking at the the ticket that was on there. >> What ticket? >> I don't even know what box it is. >> I don't see one. >> This one don't have one either. >> It would be on the bottom too. I probably set it on those old boxes. Did you tear that off? >> I didn't tear it off. Oh. >> When it shipped, they needed shipped to someone who had a receipt that tore or ripped. >> I haven't. Tear up with a box. There's another box as well. As you can see it don't have it. >> THIS IS THE ONE RIGHT HERE. THIS IS 40 Dude, you dumb. Dude, look here. You forgot to rip one. >> No, I didn't rip I didn't rip one. >> You already got you on video, right? >> I mean, I didn't I didn't steal anything purposely or anything. Like, I didn't I I have a job. I make 80k a year. I don't have to steal a freaking box. I paid for it if I got told to whatever I have to do. I I didn't literally I'll show you the receipts to the phone. >> the viewers. >> Uh I'm not I don't think it's the same one. What is it? >> Yeah, this one's 14. This one. >> On my phone. >> Let's look at it. >> It's too quickly. I mean, I don't I don't know. I don't have no reason to steal. Literally, I work right here. Everybody knows me here. I have no reason. I go every day to that to that package room. >> couch just so happened to be the exact couch that you ordered on Amazon? >> Yeah, ordered a gray couch from Amazon. >> Well, not a gray couch. This happens to be the exact couch that you ordered from Amazon. So, when you open it up, you're like, "Yeah, this is definitely what I ordered." >> I mean, yeah. I know I ordered a gray couch. I mean, it's small. It was I'm I'm I'm literally at work 16 hours a day. You can look at my clock against that. I don't I literally everything I do, I'm almost never here. When I'm here, I try to do clean. I sweep. I I try to do everything. I go right back to work. I come here. I take a shower. I do my report for the night. I don't finish my job till like 4:00 in the morning. I can show you my emails where I do my reports. I I I finish at 4:00 a.m. And we close at 12:30, 1:00 when I finally get home. I can show you my receipts to my phone thing. If this apparently if I grabbed the wrong box, if I got to pay for it, I'll pay for it. It don't matter. I'll pay double. I don't I don't >> But, you you brought the box up here? >> Yeah, I brought I went downstairs. I looked I looked. I saw that it was it was a furniture piece. I looked and I saw 14 whatever. I'm 14 >> When did you get that box? >> Probably like over a week ago. About a week ago or a week ago. >> I recommend you get access to your Amazon account, okay? >> Okay. That's fine. I mean, if you can contact the individual and I can pay for it if this is what I would have ordered anything. I'm more than willing to. Like, I don't I have no problem with that. >> Who's that? >> You what? >> All right, do me a favor. You got any weapons on you right now? >> Hold on. You guys got to read me my rights. >> Do you have any weapons on you right now? All right, go ahead and turn around and put your hands behind your back. You're not under arrest right now. I'm just going to put you in handcuffs, okay? >> Can I show you my phone receipt thing? >> Hang tight. Hang tight. Hello, what's this for? >> I'm on probation and everything. >> Oh. >> What are you on probation for? >> 10 years for robbery. >> Okay. >> For what? For armed robbery? >> Uh no, well it was it was reduced to a robbery and then aggravated assault. >> So, you on probation for what? >> I'm on probation. I've been out >> What are you on probation for? >> For those charges. >> It's It literally says 14 >> I I'm mistaken. You probably overlooked it. Like I literally I swear to God. I have no reason to lie to you guys. I don't I don't get in no trouble. You can I've been out of prison for 4 years. I don't get in no trouble at all. Y'all can I can literally grab the T-Mobile bag in my closet. Can you let me speak with an individual and I can pay them the cash or whatever? This I have no reason for anything. >> All right. And it was what county? >> I was in that county. >> You said all right? Yes, sir. You did. I'm about to take you downstairs real quick. >> That's crazy. Can I make one phone call, please? Just one. >> I'm going to bring your phone with you. Where your phone at? >> Oh, my phone is >> Oh, yeah. So, you're good. >> No, hold on. >> Do you want to grab a wallet? Do you have a wallet on you? >> I don't have a wallet. >> All right, so you got a wallet and >> You know what I got a wallet for? Money exchange. >> Traffic. >> Oh my God. Holy [ __ ] >> We're going to head on downstairs. You got a wallet and a cell phone, right? >> Can I grab a cigarette? >> I I'm going to as I was walking past. >> Can I grab a cigarette, please? >> How you going to light that? >> With about lighter right there? >> Huh? Lighter right there? >> No. >> Do you want to light your cigarette, because >> Can I grab my lighter then? >> Huh? >> I'll grab him too, so >> Oh, okay. Thank you. You so sweet. Appreciate you. >> Can I grab THE LIGHTER THEN? >> THEY WON'T LET YOU TAKE IT IN THE CAB ANYWAY. >> YOU CAN'T TAKE IT IN THE NO. SO, I'LL GIVE YOU THE SAME foot off. How do you lock this door? >> How do you lock this door? >> I would keep it locked. >> Yeah, you can just use the snap lock. Lock the door. You said they don't lock. >> They don't lock? >> a 20-slip? I mean, I have a key, but it doesn't We don't We never lock it. Can we just You should leave it open. >> Oh, I would feel better if we secured it. >> It's just okay. Can we get you a key to lock it? >> No, I don't want nobody to take it. >> any way we can resolve this situation? >> Yeah, you going to have to show up to court with whatever Amazon paperwork showing that you bought a um a couch, that exact couch. 78 days ago. Twist it? >> Scan and twist. >> I'll scan and twist. So, it's a fake lock. Okay. Hang tight. I'm going to let you get a little opportunity. I promise you. >> You know what the situation is? >> I did not. >> You have your right to >> Huh? Oh yeah, yeah, we can go ahead. >> And just so you're reminded, it's called Mary Beth Rhodes. >> He said he didn't need me cuz uh >> William? >> William Scott went and told him what was going on. Oh, and I got a video. No, my car's right there. Put it in there. Put it in there. I'm going to see him at that location, please, man. Where how will we get to the front office? Yeah, y'all two stay together, all right. >> I don't want to lose my job. I don't want to lose my job. >> Let me see this real quick. >> What are we going to do? >> Put your hands behind your back. You're under arrest. Where are your temple? Jesus. I was trying to take all of that off of you real quick. >> Do you want to hold on to your phone? >> Mhm. Want me to get it to the car? >> It's fine. >> It's a safety risk for you to make a phone call right now. Just give me a second. I'll let you make a call. Promise you before we go inside. And it can't be long. Don't be over here drawing it out now. >> Yes. Just want to let somebody know so they can come and pick it up. >> All right. The only thing you got in your pocket was your cell phone and your food. >> No. >> You can hold it real quick so I can put it in THE ZIP BAG. >> ALL RIGHT. >> GOOD NIGHT, EVERYONE. GO AHEAD. ALL RIGHT. GO AHEAD AND HAVE A SEAT for me, sir. Come on, sir. >> I have a vehicle accident at 1200 hours on the 16th of December on the highway 5. I'll be in a blue Jeep compact SUV and a black Nissan sedan. Complains of pain. The carrier is going TO ARRIVE. >> 10-4. >> LET ME GIVE YOU THIS. >> 10-4. >> I ALREADY EXPLAINED TO YOU. >> HAVE TO GO TO court and show up with whatever Amazon receipt. If you could have showed it to me, then I probably could have taken into account. You got too many coincidences going on. You ordered the exact same couch, supposedly. So, again, sir, you're just going to have to show up to court whatever documentation cuz you can't provide it to me right now. >> What I'm What I'm saying What I'm trying to say to you though like don't don't You see that the package even it says 14 I guess that's a 14 in All right? I'm on 14th like I literally like out of being busy, out of whatever, like probably like I didn't even see the >> but you just so happened to order the exact same couch. I I understand maybe >> What I What I said I I didn't I ordered a gray couch. It was a It was a gray small a small couch like literally like >> So, now you don't know what couch you ordered? >> I I don't know exactly what couch. I know we got >> Okay, sir. All right, hang tight, sir. When you go to trial, you can show it TO THEM, OKAY? >> CAN YOU TURN THE LOGIN SO I CAN SHOW YOU OR WHATEVER? >> 85, THE RADIO, CAN YOU SHOW ME en route to the cab? Beginning mileage 719 71095. And I'll have a white male. >> A person can walk away, decline to answer, or close the door. So, this conversation isn't automatically a legal seizure. That's the consensual encounter doctrine from Florida versus Bostic, decided in 1991, where social pressure alone isn't detention. Everything changes the moment handcuffs go on, turning this into a Fourth Amendment seizure needing probable cause or a warrant. Officers chose the warrant route since Georgia generally requires a warrant for a misdemeanor an officer didn't personally see happen. Stealing a couch of this particular size almost certainly stays a misdemeanor rather than becoming a felony under Georgia law. Georgia's theft statute is short. Unlawfully taking someone else's property while intending to keep it counts as theft by taking. The dollar amount decides everything since property worth $1,500 or less keeps the whole charge at misdemeanor level. Cross that $1,500 line and the same exact act suddenly becomes a felony carrying real significant prison time. No Miranda warning shows up anywhere in this footage and that omission is definitely not sloppy police work here either. Miranda only applies once someone is both in custody and being actively interrogated and neither condition exists here just yet. He remains free to stop talking or shut the door. So nothing said before the cuffs needed any warning at all. After the arrest, questions shift toward weapons, a wallet, and a phone which is safety work, not interrogation of any kind. Searching his pockets on the spot needs no separate warrant since a lawful arrest allows a search incident to arrest straight from Chimel versus California. The shakier ground is inside the apartment where officers go through shipping boxes without a clearly recorded verbal consent on camera. Him pointing out the boxes himself implies consent, but implied consent is much thinner than a clearly recorded spoken yes. That's likely the one piece of this whole case a defense attorney would challenge first if it went to court. A prior robbery conviction and active probation both surface after the charges filed raising the stakes considerably higher than before. A new arrest while on felony probation can trigger a separate revocation hearing completely apart from the theft case itself. One stolen couch quietly turns into two completely separate legal fights both running against him at the exact same time. Grading the officers here, strong process since three independent sources of evidence get lined up before anyone touches him or moves in. They still went and secured a proper warrant instead of skipping straight to an arrest based on video alone in this case. The soft spot is that apartment search, plus an interview that ran roughly twice as long as it needed to. Grading the suspect here cooperative, polite, and never physically resistant throughout the entire encounter, which counts in his favor at the end. His story keeps shifting though. He can't produce a receipt, and a torn shipping label works heavily against him in the end. Here's the lesson if you're ever in his position. Talking more doesn't help once officers already have you on video. Every extra sentence you add just becomes one more detail investigators can later check against the evidence they already have. Here's the lesson for the other side. A voluntary interview stays voluntary right up until the moment it suddenly isn't. The moment restraint begins, the legal standard changes completely, and the department's paperwork has to reflect that shift right away. One simple habit fixes the biggest weakness in this whole case. Say the consent out loud and get it on camera. Don't just assume consent because someone happens to be standing next to a box and pointing it out to officers. The real story here was never the couch itself. It was one torn label and a shifting story from the start. That combination turned a 5-minute mix-up into an arrest with consequences reaching well past a simple piece of furniture.
