All right. So you you were detained for suspicion of theft. Okay. They described a heavy set female getting into a black fort. Okay. That's why you were detained once you know it wasn't you. You were taken out of handcuffs. I appreciate you cooperating and I'm sorry the inconvenience. Um all this property that's on the back of your truck is not yours. Correct. >> No. >> Okay. Uh you said you don't know her? >> No. >> Okay. She's not a family member. None of that. Okay. Do you know that she went into these stores and stole this stuff? >> Hell no. >> Okay. Uh, this vehicle you said is a rental? >> Yeah. >> Okay. And you you've rented it? >> No, my um baby daddy rented it for me, but I got driver license. He checked it. >> Okay. All right. Miss >> the store manager who reported this witnessed the conduct herself. confirmed no purchase was made and identified the vehicle. That is what the Fourth Amendment requires before a detention begins. Specific, articulable facts, not a hunch. Terry versus Ohio permits a brief stop when those facts point to criminal activity. Both occupants fit the initial description. The passenger was processed separately, ruled out, and released with an explanation. That sequence is correct. The property recovery avoided the Fourth Amendment entirely. The officer identified stolen items through the suspect's cooperation and got verbal consent from both occupants before retrieving anything. Schneckloth versus Bamonte permits exactly that. No search issue. The pre-warning admissions are the most legally vulnerable evidence in this case. The suspect was handcuffed in the backseat of a patrol car when the officer asked what she took and where it was before Miranda was read. Miranda versus Arizona requires warnings before custodial interrogation. Burkimer versus McCarti holds roadside stops are generally non-custodial, but that presumption does not survive handcuffs in a patrol car back seat. A reasonable person in that position does not feel free to leave. Oregon versus gives prosecutors a path. A voluntary post Miranda statement can survive even if an earlier unworn statement was obtained without Miranda. Whether the post-warning waiver here was knowing and voluntary is a question for a suppression hearing. Florida statute section 837.05. 055 makes providing false information during a lawful detention a standalone misdemeanor. The officer stated this on camera before the suspect gave the false name. She gave it anyway. Three counts of petite theft under Florida statute section 8 12.014 theft of property valued under $750 per store. Every element is met. Witness taking no purchase recorded and the suspect confirmed each item on camera after Miranda was read. The officer stated the felony threshold was $1,000. Florida law sets it at $750. Total recovered was $800.50 over the felony line. Three misdemeanor counts were filed instead. That one charging decision cut her statutory exposure by years. Petite theft up to 60 days per count. False information up to one year. Florida's recidivism enhancement two prior theft convictions trigger a thirdderee felony regardless of value was available and unused. She served 86 days county jail. Officer Ramirez earns a B+. Detention was grounded. Property retrieval was consentbased and clean. The passenger was handled correctly. The grade stops there because the premiranda interview conducted while the suspect was cuffed in a patrol car creates a suppression argument a competent defense attorney would not ignore. Jasmine Hill earns a C. She cooperated once the investigation moved forward and did not resist. She also stole from three stores in the same afternoon. then gave the officer a false name, adding a separate charge she could not undo, even after correcting the record. Handcuffed in the backseat of a patrol car is custody in every practical sense. Answering questions there is a choice. Invoking the right to silence costs nothing. Cannot be used against you in court and removes the risk of confirming elements the state still has to prove on its own. Providing a false name during a lawful detention is a separate crime in Florida, unrelated to the original stop. Cooperating on the first offense does not undo it. The warning was given on camera. Knowing it and proceeding anyway is what turns a recoverable situation into a worse one. Let us know if there is an interaction or legal topic that you would like us to discuss in the comments below.
