Now, you are under arrest. So, you can either do I just told you. >> I DIDN'T OBSTRUCT NOTHING. >> OKAY, so either we can do this willingly or we can do this a different WAY. >> TO TOUCH ME CUZ there's not a crime being committed, sir. >> I just told you. >> camera. No, I did not obstruct nothing. >> I'M NOT OKAY WITH YOU TOUCHING MY BODY, DUDE. I'M MUSLIM. STOP TOUCHING ME. >> On January 17th, 2026, officers traced a stolen vehicle to a residential property and arrested the suspect on two counts, possession of a stolen motor vehicle and obstruction of justice. A database return showing a vehicle is stolen is enough for probable cause. The Supreme Court made this clear in Maryland versus Pringle proximity and control over contraband supports a reasonable inference of knowing possession. Her saying it's not stolen did not erase that inference. >> Hey, what's your name? >> L- Lala, what what happened? >> What What's your name? >> Lala, what what happened? >> Lala, what's your real name? >> Lala, but what happened? Emilio, hold on. Hold on. Hey. All right, nobody's here. The cops are here. Um the owner of the house would you to call him. >> Her name's Joe? >> Yes. Can you please call him really quick on the phone? >> No, I I'm trying to find some stuff out right now. >> Okay. Well, he's on the phone. He said if you could call him really quick. >> Yeah, I'll That'll wait. I'm trying to find out who you are first. >> Well, y- That's not important. And there's no crime being committed here. Not right now. >> Right here, right now. >> Where? >> Right here at this property. >> Not here. I'm the only one here. >> Okay, whose truck is that? >> What do you mean? That's my friend's. >> Whose? >> Ignacio. >> Ignacio who? >> Yeah. >> Is Ignacio here? >> No, he's from the church. Why? >> Cuz it's stolen, so there's a crime. >> truck is not stolen. That truck is not stolen. That truck is not stolen, mijo. >> Well, somebody's going to have to show me proof then cuz it's coming back as stolen. >> I promise you that's not stolen. >> Well, it is. >> It's not. It's not stolen. >> It's in the system as stolen. >> Go ahead and take it then, but it's not stolen. I promise you it's not stolen and I'll call the owner. >> Okay, if the owner can come I'm going to tell you right now I'll I'll go get a warrant. I'll go get a warrant, but you're going to go to jail, too. >> I didn't do nothing. It's your choice. It's your choice. We can go in there and tell her to come out and then hook her and hook her and and take her, and then we'll be done, or I can get a warrant and you're going to jail, too. Choice is yours. I'm going to count to five. 1 2 So So you can give us permission to just go get her. >> No, but I can't just get I know if I give it to you right now, >> I thought you changed. A new year, new you. You said new year, new you. Okay. Well, let's put her in custody. Okay. Well, turn around. You're under arrest. >> [laughter] >> Yeah, that's how it works. You're outside. We don't need the warrant. Sergio, you okay? >> Yeah. >> So we got your permission to go in there and get her. Okay. I think that was a smart choice. If we're going to have to get a warrant, I was going to have to detain you until we get the warrant and everything. So as a as a property holder, you're giving us permission to go inside. So we just need to talk to her, but Okay. Sergio, before I go in, we got your permission to go in. Lala, Walnut Police Department. Right here. Come this way. Come this way. >> You're under arrest. >> For what? >> I'm telling you right now you're under arrest. >> For what though? >> Put the stuff down. >> But for what? What am I under arrest for? >> One, for obstruction. >> No, not obstruction. >> And two, for possession of stolen property. >> He's on the phone. The owner's on the phone, right here. >> Oh, well, he's not here. Sorry. >> Oh, yeah, HE IS NOT. I haven't done anything. >> THIS WAY. NO, NO. >> YOU'RE STEPPING THIS WAY. >> I WILL STEP THAT WAY. >> LET'S GO. >> NO, [ __ ] YOU, ELLIOT ARE YOU [ __ ] >> LET'S GO. >> FOR WHAT? >> I'm telling you right now. >> TELL ME FOR WHAT? >> OKAY, I can either go in there and grab you and we'll take you out. >> Listen, YOU CAN'T JUST GRAB SOMEBODY. Well, I'm telling you right now >> You're a man though. You're a man. >> Okay, you're under arrest. SO, LET'S GO. >> FOR WHAT? >> PUT your hands behind YOUR BACK. >> FOR WHAT? For what though? So, can you stop this on her? You sabes No, de ella. Y no y el el número. Sorry. No, ya ya no tienes a Claro. Tú prestaste el carro a ella. Claro, el carro de es de usero, es de del pastor. Ajá. Pero prestaste para ella puede llevar Ajá. >> Okay, he has videos and pictures of the >> Before entering the property, officers obtained verbal consent from Sergio, the subject's brother. Consent is a recognized exception to the Fourth Amendment's warrant requirement under Schneckloth versus Bustamonte. No warrant needed if someone with authority over the premises agrees to let you in. The problem is how that consent was obtained. Officers told Sergio, "Consent now or face arrest and a warrant." Courts assess voluntariness from the totality of circumstances, and explicit threats of criminal prosecution sitting in the record is exactly the kind of pressure that can make consent look coerced. Even if the consent holds up, there's a threshold question here. Payton versus New York bars warrantless, non-consensual entries into a home to affect a felony arrest. The moment Lawless stepped out the door into the driveway, Payton's protection weakened considerably. She was no longer inside her home. She also [clears throat] insisted she was God's child, and the officers were not anointed. Whatever one thinks of that on a personal level, it is legally irrelevant. Religious belief, sincerely held, does not transform a lawful arrest into an unlawful one. When she physically resisted handcuffing, pulling away, refusing to place her hands behind her back, she added a second charge on top of the stolen vehicle count. Resisting arrest is a standalone offense in virtually every US jurisdiction. She turned one problem into two. The use of force used here, soft empty hand control, handcuffing sits at the lower end of the continuum. Graham versus Connor requires courts to assess force from the perspective of a reasonable officer on the scene. The crime was a felony. The subject was actively resisting, and officers never escalated beyond what the situation required. Two separate religious item disputes arose during the arrest. When officers removed her rosary and attempted to touch her hijab during the search incident to arrest, she screamed that it was illegal. The search itself was authorized under Chimel versus California. Lawful arrest justifies a search of the person. The religious attire question is more nuanced. Federal courts and Department of Justice guidance both recognize that where operationally feasible, agencies should try to accommodate requests about religious head coverings. The operative word is feasible. In a field arrest with an actively resisting subject, that bar is harder to meet. The ownership chain confirmed what the database suggested. The truck belonged to Pastor Luis Jaramillo. It was loaned out and never returned. Ignacio, who was in the process of buying it for $1,000, had not yet completed the transfer. The title still read the pastor's name. Probable cause was solid. Lala earns a D. She may have had a viable defense on the knowledge element of stolen property. Whether she actually knew the truck was stolen is a question for a jury. Instead, she physically resisted, compounded her exposure, and walked out of that driveway facing more charges than she came in with. The lesson here is not subtle. Verbal resistance accomplishes nothing once probable cause exists. Courts decide ownership disputes, not driveways. Physical resistance adds charges. And if you have a real defense, the place to make it is in front of a judge, not in handcuffs on your front lawn.
