Do you guys have any Do you guys want to pursue any charges for the cheese stick right now? No, but do you guys want to pursue any charges against her? Okay. Can I uh who's the Is there a manager or boss? Can you spell your name? >> Yeah, of course. >> All right, she's going to You have a D and D? Hello, how are you doing? >> Can you run me a heart rate on this park vehicle? Can I erase that? Hello. I got to be in New Jersey. Whiskey >> Yeah, my I lost my book and my bicycle. So, I have I have the employees informed. They have no complaints. They did witness her to take a cheesesteak, eat it and did not pay for it. It's $4. They didn't They do not want to pursue any charges for the cheesesteak. So, we're just sending her to the hospital and then go go down to All right. She's in the car. She's in the hospital. >> Okay. >> So, I just spoke to the manager. I just spoke to the manager. She said she was inside causing a disturbance, threatening the staff. >> Okay. >> Not I'm crazy. Just She uh tried to take a cheesesteak and she did take a a cheesesteak cheesesteak ate it, did not pay for it. $4. They do not want to pursue any charges for that. Cheesesteak is $40. >> $4 $4 >> A $4 >> So, they just sent her to the hospital and then uh >> Got you. Good enough. So, we'll just document that. Uh we'll do a new incident uh obviously and we'll refer to the first one. Just put that Yeah. Well, for this one here, we're going to do ours. I I know that uh Midnight's had a couple here. They'll explain to you what we got here. >> She's got a history of schizophrenia. She's just not understanding she can't trespass into buildings and consume products without paying for them. She's not cooperative. She makes up different names for herself, makes up addresses for herself. >> So, here's the biggest thing. She was just released from headquarters. Yes. just arrested her for an incident that happened at 7-Eleven. We warned her not to go back to 7-Eleven or repeat her behavior. So, instead of going to 7-Eleven, she came here, went in here, caused the same threatening behavior. So, for someone who just got arrested and got released, that's what we're requesting. What's that? No, no, no. She's not combative. She's not combative, but we're going to have somebody ride on board with okay with you guys. He'll hop on board. So, you guys are going to follow you behind. Meaning she knew who she was, she knew where she was, she knew the date and time. So, for us, that means she is alert and oriented. >> Okay. >> If if sometime this day, if she decides to start answering questions inappropriately, and we clear her once again like we did this morning after crisis tees her, and she does the same thing, are you going to keep bringing her back? >> We will if we have to. >> I mean, because it sounds like she's stealing, but you guys are bringing her in for >> We already charged her. At some point, if she's going to continue the same behavior, you guys are going to keep bringing her here because something is clearly not mentally clicking for her. >> Okay. All right. >> Just want to >> That's fine. >> Sit down. >> Just want to but but you know, it'll be like her stealing, and >> Keep Keep giving her court dates is not fixing anything. >> It's not fixing It's not. So, she's As soon as we uncuff her, she's not going to do that, so that's why. But, she's probably going to try to leave. Where's the exit? It's Bathroom is this way. If you want to go to the bathroom, you go to the bathroom and we'll medicate and go to bed. >> You don't know where the bathroom is? Why you want to go to the bathroom this way? >> I want to piss. I got to go to the piss. >> And I'm telling you where the bathroom is. Let's take a walk. 5 and 2 and 50. >> Yeah, um Nick with the hospital camera. DDA claim. >> The investigatory stop was justified. Officers had reasonable articulable suspicion under Terry versus Ohio. Deena was a confirmed repeat trespasser at a location from which she had been formally excluded. The identification demand is where it breaks. New Jersey has no stop and identify statute. State versus Dangerfield holds that officers may request a name during a Terry stop, but cannot compel it without an arrest. When officers warned Deena she would be arrested for not giving her name, that threat had no legal basis at that point. Common tactic, legally wrong. The bag search is the most serious Fourth Amendment problem in this footage. No arrest had been made. Deena refused consent on camera, explicitly, multiple times. Three doctrines justify a warrantless search: consent, search incident to arrest, or exigent circumstances. Consent was denied. No arrest had occurred. A stolen cheese stick is not an exigent circumstance. None of them apply. Chimel versus California requires an actual arrest before a search incident to that arrest can occur. The bag was searched before any formal arrest. That gap is what a suppression motion is built on. Deena gave officers cleaner arrest footing when she threatened to punch the officer on camera. Under New Jersey statute section 2C12-1, that verbal threat is simple assault. Her resistance during ambulance loading may support a criminal mischief charge under New Jersey statute section 2C17-3. Whether the damage was purposeful or incidental to restraint is a factual question, not a clear case. The physical force holds up under Graham versus Connor. Active resistance, a verbal assault threat, prolonged evasion, the handcuffing and arm control are within the reasonable range. The strongest decision came last. Commitment over prosecution. New Jersey Statutes section 30:4-27.6 authorizes involuntary transport when there is reason to believe a person is mentally ill and poses a substantial danger to themselves, others, or property. Dina met every element. Schizophrenia history, four police contacts in 12 hours, cleared by that same hospital that morning, and cycling back within hours. The EMS briefing was organized and accurate. That handoff was done right. Officers receive a B-. The commitment call was correct, and the EMS briefing reflected real competence. The Fourth Amendment problem, warrantless bag search over explicit refusal of consent before any formal arrest, is what brings the grade down. Dina receives a B. She correctly refused the bag search on camera. Legitimate Fourth Amendment assertion, stated clearly. The assault threat and the watch damage added criminal exposure she did not need. The department receives an A-. Routing a repeat mental health crisis caller towards psychiatric evaluation rather than jail reflects sound policy. Deduction. No mental health co-responder was deployed across 12 hours and four calls for the same person. Three lessons. First, know your actual authority. Threatening arrest for non-identification in a state with no stop and identify statute is a civil rights liability. Second, sequence matters. Arrest first, search incident to that arrest second. Reversing the order, searching over explicit refusal before any arrest, produces a suppression problem with no clean resolution. Third, the criminal justice system was the wrong tool from the start. Four encounters, one person in psychiatric crisis, zero outcomes that changed anything. The commitment pathway was not a last resort. It was always the answer.
