December 2nd, 2025. A tractor supply parking lot in Florida. A vendor selling beef. A customer demanding a refund. And an officer caught between a civil dispute and a real regulatory gap. >> You call us. >> Okay. What's going on? >> Just one at a time. >> One at a time. >> I bought this meat a while ago. >> Okay. >> This meat is not regular US meat. >> Okay. It is something that is unedible. It was if you don't like it, bring it back. I brought it back. You don't want to give me my money back. And he says it's only guaranteed for freezer burn. Not guaranteed if you like it or not. Against freezer burn, that's all. Which I never seen that before. And I do not see any signs posted about him being legally able to sell this food at this location at all. I don't see any kind of statue or or any type of paperwork saying that listen me >> it has been approved. You have a license by the >> Was any of that here when you first pardon me? >> Was any of that here when you first bought it? >> Yes. >> Pardon me. Was any of that here when you first bought it? Yes, sir. >> Oh, yeah. All of it. >> No. No. The stuff you're saying is not here now. >> Yeah. Yeah. No, it's not. I I don't I don't recall I don't recall it being here or not being >> He took it home with him. It's actually >> But all I'm saying is he has no license to sell here. >> Okay. There's no >> boxes. Do you have any boxes? >> So, it comes inspected hand. >> I will gladly give you one of these steaks. >> You can tell me what you think. >> I'm not beef steak variety package. It's USDA second and pass. >> I can't talk to both of you at the same time. I'll say it one last time. on the other side. >> So the beef all the only ingredient we're actually one of the only companies out here that do all natural. So the only ingredient in there is beef. We don't do all the other stuff with all >> It doesn't tell me anything. It looks like a ton steak right here. >> Individually wrapped. Does it tell you what it is? >> No, it says on the box. >> Comes in a box. >> Okay. >> You have the boxes at home. >> Pardon me. >> You have the box? >> No, I don't have the box at home. >> You probably threw them away. So, do you have any >> I want my money back. That's all I want. >> Do you have any type of >> back? So, we need to come out here once a year with Tractor Supply. So, I'm going to message Tractor Supply ahead of time and get okay with the manager here instead of the store manager and everything. And we come out here once a year. We usually sell once a year with Tractor Supply. >> No, he sells this more than once a year. I want to see their license, their vendor license. >> Do you have any license with you? I don't physically have it on me, but um >> Well, then we should have come over here. Come over here. >> So, what is it you would like? You said you wanted your money back. >> Okay. That's going to be between you two. >> Yeah. >> I can't force him to give your money back. >> I've been telling that's not there's nothing I can do. >> Well, you know what? There's nothing I can do to tell everybody a real bad place cuz it's not people that they're selling. It's horse meat. He knows it. I know it. I don't know how much you think it's supposed to. >> You see anything on these package that says it's USA? >> How did How did they come? How did they come whenever you bought? >> They come in a box. >> No. No. I saw I saw the boxes. >> They came in a box. >> I saw those boxes. >> And that's it. That was the only thing that said that. >> Did it come like that when you bought them? >> Yes. >> Yes. It came like that. It said it was. But when you taste the meat, you will know it's not cow. >> When did you have the meat? When I ate them. >> When When was that? >> When I ate it. >> When You bought these steaks a year ago? >> No, I bought them a half a year ago and I've had them in between. >> Okay. 6 months. So, you had more than what? >> No, I probably have three of them. >> Well, that's more than one. >> Okay. What are we trying to do here? No. >> What What What are you What is your part in this? >> I say I'm calling you to say this man is not selling property. He doesn't have a vendor's license. He doesn't have an a an FDA type of of accommodation. He doesn't have anything from the state from the agricultural department. And you're here arguing with me that I did something wrong. I'm not arguing with you. >> All I'm saying is look, give me my money back. >> Okay, that's up to him if he wants to give you your money back. >> Right. And it's my my thing of standing here and arguing that if you're not going to help me, then hey, you know what? Might as well go home. >> Yeah. You're really not doing nothing, are you? >> What would you like me to do? >> What I'd like you to do is by the law, the man guaranteed something. >> Where is the guarantee at? >> Okay. He says, "Oh, I guarantee." But you know what? When I asked him, he says, "I don't like guarantees against freezer burn." >> Who buys a [ __ ] piece of meat that's guaranteed against freezer burn? >> I'm not sure, but there's some in that cool. >> This What? What? What do you want to know about this? No, this is the money. This is the meat you bought, correct? >> Yeah. So, what do you want to know? Is this freezer burn? >> I'm not asking I don't really ask any questions. >> All I want is my money back and I'll go home. >> Are you going to give him his money? >> No, he can't give me my money back. So, I'm going to stay here and you know what? If I honestly >> Well, then fine. Then it's your business. You live with these people. >> I'm a you know that this is bought up in Canada. It's horse meat. >> It's horse meat. Okay. From Canada. It's sold down here. They say it's beef. It's not. They cannot come up with an FDA rating. Okay. >> Okay. They cannot come up with a a a Florida state license. They can't come up with nothing. A vendor's license. So, I believe at that point that this man is committing fraud. And by committing fraud, he owes me my money back. I brought the steak back. Okay. I'm not fishing about here. It's not like I'm taking something, not paying for it. >> Okay. Here it is. And I have it back. That's all it is. >> Okay. At this not going to get figured out right now cuz he said he can't give you money. >> Well, you know what? He can say anything. He can say he's Jesus Christ for all I know. You know, >> and you know what do I believe? I'm sure if you check and shake him down, he's got 250 bucks in his pocket because like me, you know what he did to me? He told me, "I'll give you a deal. I'll let you have it for 220 if you paid me cash." >> And I was a stupid idiot thinking, "Okay, I paid him cash." So, you know what? >> We're not We're not doing that. We're not doing that. We're not We're not sitting here arguing back and forth. >> Okay, then you might as well go home. >> Okay, that's fine. >> I see you. I'm staying here. Have a good night. Uh, let me hear me. >> Let me go see if they want him trespassing. I'll be right back. >> No, you wanted to stay there. You wanted to stay there for a second. >> You want to stay there, right? >> You want to stay there? >> Yeah. >> Okay, let me see if you can do that. The Tractor Supply wants you gone for now. >> Pardon me? >> They don't want you They don't want you like actually trespass. They just want you off the property for now. >> Who says that? >> Richard, the manager and Tractor Supply. Okay. So, if I parked across the street, walk over here, I'm cool. >> If you're not illegally parked, >> where is this guy's parking lot? I would like to have that guy come out and tell me that I'm not allowed to stand in his line. >> I don't have to tell him that. >> Well, then would you please do that for me? Would you have the owner of that? >> Why? So, you can get in a confrontation with him >> like you're doing with what you said. >> So, let me let me ask you something. Since I've since I've got gotten here, I've not been able to complete one full sentence with you. >> To have an adult to have an adult conversation. >> Have an adult conversation. >> Okay. Any logical person? >> Yes. >> Buys me. You say 6 months ago. >> Even if it is 6 months, three of them are cooked and you bring back part of them and you want a full ref. >> I bring back 90% of it. 90% of it I brought back. So they said >> if I went to Publix and I had a piece of meat or a piece of fruit and I go to Publix and I go to the front desk says, "Hey, this was bad." They said, "Well, Mr. Spino, here we'll give you a rebate. Go out and pick something else." >> You're right. Publix will do that. >> Yeah, [clears throat] >> that's part of having the freedom to shop where you want. >> Okay. Now, the next thing I got to ask you is >> where is his license? >> Where is his vendor license? >> Would you like me to answer? >> Yes, I would. license, USDA. >> I'm going to give you one last chance. If you ask me a question, I will answer. >> Okay. >> If you don't want to let me answer, then I will gladly leave and let you go. >> Well, you do what you got to do. >> Okay. He's got I've had this discussion with him back there. He's got the license. He does not have a city permit to sell, and I've told him he cannot sell. >> So, >> you haven't given me a chance to tell you that he does not have he does not have a permit to sell, which he's been instructed to get. He cannot sell till further notice until he gets them. Okay. >> Yeah, >> he's been advised that. Tractor Supply has been advised of that as well. He has permission to be on this property from Tractor Supply. He does not have a a permit to sell what he's selling. >> Okay. So, he doesn't have a permit. He doesn't have a a Florida agricultural license. He doesn't have an FPA or whatever that one is. >> Okay. Since you're knowledge about the guns, I bet you you're right. You're right. You're right. You're right. I apologize. None of this this paperwork that he needs. Okay. And you're telling me I am wrong that this man says, "Hey, you have to leave this area. I want that man to come out here and tell me I have to do that. I have the right to confront my accuser." And he's not here. But I do have the the thing that say that, hey, the guy says you got to go off of this property. If this man said that and you said you talk to him, no problem him coming out and telling me that. >> Okay. He doesn't have to do it. >> Well, I don't have to, you know, just because you told me that this man said that this is his property, I can say, you know what, this is my property over here. >> But we know it's not your property. >> Why? How do you know that? So why are we getting to the why are we acting like children over you? >> Because it's $240 that aing con man tried to beat me and you're trying to pacify him and say he's a good man. What the wrong acting like adults? >> I told you what you did done wrong. >> Since you did that wrong, what are you going to do to punish him? Have you called the the uh Have you called Have you called the Department of Agriculture >> to punish him? >> Have you called the >> Do you want me to? >> Yes. >> That's who you're supposed to call. >> Is that your job? >> No. >> That's not your job to see if this guy is legal here. What the wrong with you? >> Your complaint is about the right is wrong with you when you can't say that I got investigated. I have to buy this from you buy this from us. >> You know what you you're going to say? You know what? We're going to arrest you. Fine. Can I explain something? >> Because you know what? He's got his little beeping recorder on. You have yours on. I did nothing wrong. All I'm asking. No, you can't say a thing. So, I'm [ __ ] you know, because you're a pond, man. >> Come on. Come on over here. You can tell me. >> I'll be right back. You got to hear. >> Yeah. Okay. >> He does not have a permit. You know it, Mike. We're not doing nothing about it. >> Okay. I I did something about I told him he couldn't sell. >> What you got? >> So, right now, what I'd rather have is just everybody leave. Get off the property. You leave. Get off the property. You're not trespassing. You're not in there. Shut it down right now. I wonder where I'm back if you have. All right. One second. My man is okay if I come back. Yeah, we'll have to uh go through that. >> Hold on. That's my secretary right now. >> I want this guy written on citations right now. >> No vendor's license. >> No, license. No agricultural. >> What? What statute is that? >> Well, no. You What? Wait, wait, wait. Do you understand? You're the cop here. Yes. >> You're supposed to know this stuff. >> Okay. But you said you know. >> Yeah. >> No, I didn't say I know. You said you. >> No, I said I want him to be written up. >> So >> I want him to be written up. Are you going to write this guy up for infraction? >> So >> no permit. >> Yeah. No permit to be here. >> If you keep you keep interrupting me, then no. I'm leaving and so are you. >> You can't leave. I don't really need to go. >> Well, I can't leave until I'm not leaving until you work the You haven't done nothing for me. You guys do nothing. >> You think I'm the agitator cuz I speak loudly. >> No. >> Okay. So, I'm the agitator. The criminal here can go away because I'm so nice. I'm only silly, you know, meat that, you know, people don't even like to eat. Okay? >> You know, I'm the bad guy here. But I want this guy inside. >> I want it. >> This is for me. >> What? >> It's yours. No, it's yours because I'm returning it to him. >> I am returning the meat to him. >> Okay, >> we understand it. Did I make something wrong with you? >> That doesn't I guess I mean he's returning the money right now. >> Well, then I'm going to stay here till he returns me. >> He wants you gone. >> Well, he's got to let this guy >> I'm trying to get my >> Okay, we'll be here till both of you leave. >> And if either one of you refuse to leave and whether it's him or you, we'll go we'll go to jail for trespass off. >> No, that's not how this works. >> Backed up. I need >> Oh, this is really >> Yeah, I have to take everything off. That's >> I will follow you no matter where you go. >> No, that's not that's not happening. I can't. >> That's not happening. >> You cannot tell me I can't follow. >> I get a restraining order. >> Yes, I can. You can get a restraining order. >> That's called stalking. Yes, I can. >> That's not stalking. If you knew the Florida law, >> then you can arrest me for stalking. >> Well, right now we have trespass after war. >> Well, then you can get me for trespassing without a warrant. I will leave. >> Turn around. >> Okay. >> Put your ples together. >> Get that out of your hand. >> Stop. Stop. think it's going to do. I got to move my time. >> It's getting too. >> Yeah, it's going to get so simple. >> Yeah, that's great. >> You been drinking? You're s you drinking? >> Is that what you [ __ ] me now? You going to make up charges? >> No, I was just asking. >> I'm making up charges. Is that what you're doing, [ __ ] >> Florida food vendor licensing runs on two layers. A state license under Florida statute section 500.032 and a local business tax receipt under section 205.053. The vendor held the first. The city permit was missing. The horsemeat claim had no evidence the federal meat inspection act codified at title 21 of the United States code section 600 and following requires USDA review of all commercially distributed beef that inspected and passed label was federal certification not a taste opinion. A refund dispute is civil law enforcement cannot compel a seller to return money absent a criminal violation and proving fraud requires intentional misrepresentation of a material fact. A missing city permit does not come close to that threshold. Profanity at an officer is protected speech and city of Houston versus Hill makes that unambiguous verbal challenges to law enforcement cannot be criminalized absent direct incitement to lawless action. What that case does not protect is the refusal to leave private property after a lawful warning. Florida statute section 8 10.09 09 subsection 2 paragraph B elevates trespass to a first-degree misdemeanor when an offender refuses to depart after notice. Notice given refusal documented both on camera before the arrest. The threat to follow the officer raised Florida statute section 784.048 stalking requires willful malicious and repeated following and one statement in one argument does not meet the repeated element. The officer cited the statute and correctly proceeded under trespass. Trespass after warning under section 8 10.09 subsection 2, paragraph B, carries one year in county jail and a $1,000 fine under section 775.08 2 and 775.083. This case ended in diversion, no conviction, no jail. The officer gets a B+, confirmed the permit gap, stopped the sale, held his legal position on the refund throughout, and documented probable cause before the arrest. The customer gets a D, identified a real problem, watched the officer act on it, and still refused to leave. Civil channels, a Department of Agriculture complaint, or small claims court exist for exactly what this customer needed, and police cannot enforce a refund. Staying on private property after a lawful warning is not making a point. it is committing a crime.
