On March 19th, 2023, marine law enforcement in Monroe County, Florida, responded to multiple complaints of harassment, underage drinking, and threats at a Keys Waterfront neighborhood. Officers had probable cause before the boat docked. Witnesses described a visibly intoxicated operator, minors drinking, and a prior confrontation at Sunset Grill. The vessel boarding was lawful without a warrant. Florida statutes section 327.70 grants marine law enforcement explicit authority to stop and inspect any vessel in state waters. The Supreme Court reinforced this in United States versus Villante Marquez in 1983 reduced privacy expectations on navigable waterways give officers broader authority than on land. >> That's what I'm trying to find out about right now. >> So there was a whole group of kids. It was about like seven of them. Six or seven. >> Okay. Uh the guy driving the boat was really drunk here. >> Okay. >> They were taking their own alcohol, but that most of them were minors. >> They were underage drinking. >> Okay. >> Uh they started giving us problems. >> Okay. >> And so uh instead of us intervening cuz they were just not they were giving us all a hard time, we called the cops on them, but then they all went on their boat and the guy was apparently under the influence driving the boat. >> Were they all males? >> Um it was pretty much all males and one female I saw. >> Okay. And can you kind of like roughly guess how old they were? Um, I would say like the main guy was probably like about my age, 24. >> Okay. >> And then the other kids I like 18, 19. >> Okay. >> Yeah. It was weird. We didn't see a mailbox. I saw this one said 971, but I wasn't sure if it was y'alls or theirs. So, I got the address from John. Nice to meet you. >> Right there. >> Oh, okay. >> This right here. I live here. And the owner of this house, they live in Miami. >> Yes, ma'am. >> Your son is here. >> Okay. Lewis, right? >> Yeah. >> His father's killed. >> Well, they just caused a huge scene at sunset >> just now. >> Just earlier. Yeah. That's why we're here. They're getting trespassed. >> Good. >> They threatened he threatened to come over, >> but just he did the same thing to them on the phone >> to the police. >> Well, no, too. Sun someone at sunset. >> Okay. >> So, he's not right. >> He's not right. He's really not. And so my mic called his father Jerry in Miami and said, "Lucy's here with your daughter and her niece and Louis is threatened to come over and her up." He gave me the finger. His friends moved me. He said all sorts of horrible things to me. And I was on the phone with Mike and he's like and he opened the window said go ahead. I'll caller I know who I am. You should Google me. Yeah. >> And I said, "Listen, I'm not calling the sheriff, but that will be my next phone call. I'm calling your dad." >> And then and so my night said, "You need to do something. You need to get down here and get a call from Lucas because he is a Lucy's afraid and so are her children." >> Yeah. >> And we shouldn't have to be. This is where we live. >> Yeah. No, >> I ask you a question. I'm not a resident of this state, but >> where I live could >> I don't I don't deal with assault too much. >> Okay. >> Could she get an order of protection? >> I 100% believe so. Yeah. >> There you go. >> That's >> I'm I'm I think so. I think so. I I don't deal with that. >> Yeah. >> But I I think she can do like a risk protection order. Yeah, we have Oh, no. We definitely have that. And then and then if they get >> Oh yeah. Yeah. I think it even has to do with the distance too. >> Yeah. >> Yeah. >> Oh my gosh. That because we are here by ourselves. No man. >> Yeah. >> And um you know I know he has a gun. >> Uh my daughter has seen a gun in his car and he probably doesn't have >> Yeah. Well, he's 18 so he can't is it I mean if it's a pistol he can't have he can't have it. >> Okay. You have to be 21 to own a pistol unless it's given to you. And even at that rate, you can't carry it on you unless you have a concealed weapons license. >> So, I don't know. But apparently, he carries a gun in his car. >> I don't know if you would have a right to search search. >> Well, his car is >> No, he has a Mercedes, correct? >> Oh, yeah. Yeah. >> Right. And he doesn't. >> So, >> and for him to talk to me like that, >> Were they here last? They were Were they here today? Are they here now? >> They were here this morning. I heard him yelling at somebody on his front porch this morning when I went out for my walk >> house across the canal. They were last week they had three nice girls and they constantly harassed that constantly harass. >> Well, they're they they caused a huge scene at Sunset Grill. >> You were there today? >> Yeah, they uh apparently he has a fake ID. He was drinking alcohol. Everyone he was with was drinking alcohol. They're intoxicated. So, what I'm what I'm worried about or not worried about what I'm wondering is there's one vehicle in the driveway, correct? >> Yes, sir. >> Is that like the only vehicle they have here? >> Well, he did have his fancy Mercedes, but when Mike called his father up in Miami, >> he's got a Mustang >> and a Mercedes. >> Okay. >> So, the big fancy car is gone. And this is his father's business car, the HOV. >> Okay. And so I think his father said, "You're in trouble. Lucy called you. We're taking away your fancy car. You're going to have to drive." >> So that's what he's driving. So he's definitely still on the boat. >> Yeah, >> for sure. >> Isn't the boat off there? >> No. >> Then they took the boat. >> Yeah, cuz they were they took the boat to Sunset Grill and they left, but we were figuring they'd be back by now. >> Oh, >> yeah. >> Uh they threatened a few people. Um they were under the influence. They flicked off the cops. Um, it caused a huge scene. >> Yeah, something's going to get done. >> Have returned on the vessel. We're unable to board it right now. >> Come on. Look. The same guy that arrested me. Look. >> Hey, park the boat. We'll talk. >> What are they going to do to me now? What? >> Yeah. Yeah. Come on. It's all on camera. You see, you didn't put yours away. Saw it on camera. >> Come on. >> Scared you. >> Why you Yes. Hey, you are going to jail. Yes, you're right. You said I'm going to jail. >> You are absolutely. COME ON. >> I'M GOING TO JAIL. LOOK. >> YES. I AM JORDAN HILLYARD. YOU ARE GOING TO JAIL. COME ON. TALK TO MY DAD. TALK TO MY DAD. >> GO THROW IT. >> TALK TO YOUR DAD. >> I DARE YOU TO THROW THAT. >> Trust me. They're taking me to jail. They're taking me to jail. Grab that. >> No, I'm going to surrender. I'M GOING TO JAIL. >> If when you can throw it, throw it. Let me the boat. Let me the boat. Let me do Hey, man. Hey, brother. >> Hey, John. >> I came back. >> No, we're not touching the rope. Put it up. You guys got a dog. Let's go. >> 791. >> 793. They're saying that puppy are taking me to jail. >> That's my AVL location. >> Yes, they are. He just said he's TAKING ME TO JAIL. >> 9740. I'll make 105 Coast Guard. >> Sounds like it's going to be landbased at this time. >> I'm narrating for the camera, bro. Nobody gives >> 940. >> I think he's actually coming back. >> Maybe. I don't know. >> Don't need one. Don't need one. >> We don't need one. We don't need one. >> Subjects are back on scene. >> We don't need one. >> At the address provided, 973 lane thing is in the past two days. You think I WANT TO DEAL WITH THIS? I have anxiety because I got diagnosed with paranoia, bro. >> Everybody in this neighborhood called Everybody. >> You brought this in on yourself. You brought it on yourself. You fled FROM LAW ENFORCEMENT WHEN THEY GOT HERE. and get off and you're going to jail. >> Yeah. Hey, listen. You're on your TikTok. You >> You're a child. GET OFF THE BOAT. >> WHAT? TIK TOK, DUDE. I'M GOING TO JAIL. THEY'RE TAKING ME TO JAIL. My child, >> man. Hey, let me say something to the rest of y'all. Y'all three, >> what did I do? >> Cooperate, man. I've already been in a house. >> I'm just saying cooperate or you will all go to jail, okay? Because this guy is going to get you all in trouble. You feel me? You feel me? >> This guy's going to get you all in trouble. >> Hey, let him get closer and then I might take the rope. The way he's acting. >> You see what I'm saying? >> Thank you for cooperating. >> No, nothing like that. Do you mind if I >> Come on, Doc. >> Okay. Can I talk? >> Doc, that's what I want you to do. I want you to do this. >> You can't do two things. >> You can do many things at once, bro. >> Exactly. >> Exactly. Shut up. He's a grown ass man. He's not a child. >> I know he's a nice man. I've talked to him before plenty of times. >> And now he's telling me he's taking me to jail. And that's >> took me I don't want to listen, bro. I I respect you. >> Look, look at them. They're literally taking me to jail right now. Call. They're taking me to jail. >> I'm parking the boat. Well, they're taking me to jail right now for literally no reason. No problem. No one's told me to leave. >> That's fine. I didn't understand. As I'm saying, as of right now, >> as of right now, >> y'all are not in any trouble pertaining to this. I don't know what else you did if you did anything. Okay? >> Unless you've done something with these deputies. I can't speak for that. What I'm talking about is right this second right here fleeing and looting. Okay. >> If the three of y'all decide to make a beat to the jail and try to save your friend, that's everybody's going to jail. Okay. Now, there's no judge there. There's no nobody there that can get that dude out of jail. Okay. Now, you want to do your part and help out or whatever, that's fine. What I'm saying is if you go to that jail, don't be following us. Don't be doing nothing stupid. Okay? Because the way I just seen him act, I'm gonna be honest with y'all. I don't know how y'all are gonna act. Y'all are very cool. I think y'all are being really awesome. Don't freaking go to jail. Okay, we clear. >> Clear. All right. Can I put them on? >> Sure. >> Thank you, bro. Appreciate it. So nice of you. >> Can I get a shirt, please? >> Can you just ask my friends for a shirt on the boat? >> Yeah, bro. For real. Like I have a good night, bro. Really? I respect I literally just got scared and I came back, bro. I came back out of respect for you guys. I could have really just stayed out there, called Uber and and you know, been a real about it. And I came out of respect. I came out of respect, bro, cuz I've seen this guy before. I came out of respect. There's nothing on this boat that on that boat that used to take me far. Look, you're still going to take me, bro. What the is this, bro? Can you stop? Get in my touch. I don't want the >> Yeah, you don't get a tr. >> The fleeing charge required proof that Hillard knew officers were signaling him to stop. his defense, he left the marina before receiving any direct order. That is a legitimate factual dispute, but courts apply a totality of circumstances analysis under Illinois versus Gates. And the totality here pointed one direction. He was present. He saw officers. He left by boat. Once back at the dock and under arrest, officers conducted a patown search. Chiml versus California from 1969 authorizes a search incident to lawful arrest with no additional justification required. Nothing significant was found, but the authority was sound. Hillard complained repeatedly that his handcuffs were cutting off circulation. He could not fit a finger between the cuff and his wrist. Graham versus Connor. The 1989 Supreme Court decision governing all use of force claims applies to restraints as well. The standard is objective reasonleness. Officers are trained to double lock cuffs and verify fit. The on camera check was incomplete. That gap matters. The BUI investigation triggered Florida's implied consent statute. Section 327.352. Operating a vessel in Florida waters means you have already consented to a breath or blood test when an officer has probable cause. Hillard initially refused, then agreed after asking whether testing above 0.02% would be a felony. It would not. The officer clarified the threshold, read the advisement twice at Hillard's request, and Hillard consented. A properly administered implied consent advisement followed by voluntary consent makes the resulting test fully admissible. The sequence was handled correctly. Hillard cursed at officers, dared one to strike him, and live stream the arrest. All of it is constitutionally protected. The Supreme Court held in city of Houston versus Hill in 1987 that profanity directed at officers is generally first amendment speech. The exception is the fighting words doctrine from Chaplinsky versus New Hampshire speech. loses protection only when directed at a specific person and likely to produce an immediate breach of the peace. Hillard's outbursts did not clearly meet that bar. The disorderly conduct charge is the weakest of the three. No single statement crossed the line. What the prosecution would lean on is the cumulative pattern fleeing by vessel, returning and escalating combined with the documented prior conduct at Sunset Grill. Courts do not evaluate moments in isolation. >> You're being here. No, it's Dude, my >> Dude, this is this is looser than I >> have to be like this. No, it's usually like this. >> Lean back. Lean back. >> What am I going to jump for? Tell me. Explain. >> I've already explained it multiple times. >> What? Explain. >> Lean back. >> Explain. >> Lean back or what? Explain. >> Lean back and look to the left. >> Explain. Lean back. >> Explain. And look to the left. I'm literally listening to you. You're not explaining. You're being mad aggressive for no reason. You haven't explained. >> What did you multiple times? What do you do? >> Even though explain to me what I'm just here, so calm down. >> I left because I got scared. I didn't know what the was going on. You guys >> by by pussing at us and headbutt the window. That's not going to solve anything, man. >> I've been through a lot, bro. >> I I appreciate that. So we >> understand. I don't mean no disrespect to nobody here, dude. >> Because I've been disrespected plenty times, especially by him right there. >> Hey, what what's he going to jail for? What's he doing? >> I didn't trespassing. >> I wasn't trespassing. The owner of Sunset literally told me >> he told me I could ask for a new waitress and stay. >> So So here's the deal, man. I didn't trespass of a property. If the owner of the property asked you to leave, >> he didn't ask me to leave. He said I could stay. What happened was I got there and asked him what? >> They got called and >> they got called and when >> you took off. >> I didn't take off. When the cops got there, they said, "All right." They said, "All right, we're leaving." All right. They said, "You're good to go. Just leave." That's it. And we left. My friends are witnesses. My friends are witnesses. They asked us to leave and we left. It's all on video, brother. >> Here's the here's the deal with that. Okay. You could call the owner of Sunset Grill right now. >> He told me I could even stand out, dude. I' I've listened to your talk. You say you want to respect, but but dude, you got to respect me. Listen listen. >> The second that the handcuffs go on, okay? You've got to go through the process. You've been arrested for, right? It sucks, but guess what? You're going to get through this, right? All right. So, here's what we're going to do. >> I don't even think I'm going to be in there, bro. >> As fast as they can book you in, then you can get back, right? Isn't that the process? >> But why? Why? The cops literally it's on video. Ask my friends, they're witnesses. They they told us >> I got called over here. >> They walked over to the boat and I was already on the boat when I saw the cops there. I before they even told me that I had to leave, I was already leaving on the boat. >> Okay, we can solve all this. >> Brother, with the most respect, I never got kicked out of Sun. I talked to the owner, John, and he said, "You want a new waitress? That's fine. You can stay. Not yet. >> Call the owner from Sunset Grill. All right. >> YOUR HANDS ON YOUR MOUTH. WHY? APPLY YOUR HANDS IN MY MOUTH. >> WHAT? WHAT? You're going to what? >> Sue you. >> You're going to shoot us all. >> I said on camera. I said I'm going to sue you all. >> Why are you making such a thing? Like just like on to go back. Just like on that scene, your mouth got you in more trouble than what you were actually going to be charged with. But that night you were going to be let go with a criminal citation, man. You kept running them out just like you are right now. But you guys told me you would talk to me and look at what you guys did. Look, look where I'm going now. >> You think that's they tried >> and I came back to talk to you guys. I could have really pleaded and looted if I wanted to and I didn't. I came back to talk to you guys. My dad told me that I wasn't going to go to jail. He told me that he had talked to you guys that I to come back home. I came back home to be respectful. Bro, >> I don't really know who you are. We just went in a warrant, dude. It didn't matter. It's either the warrant would have dropped or you're going to jail tonight. It is what it is. >> I'm telling you, you run your mouth and say, >> "You understand I have anxiety and listen, you run your mouth and say in the past, brothers, >> bro, literally targeted, bro. >> 942." >> Did you see everybody outside? You think everybody was clapping and cheering for no reason, man. You made a name for yourself. You put a target on your back with people. You guys, no, we didn't. >> Yes, you did. >> No, we didn't. >> I didn't even know you lived here at 973 Aratillo until this week. Every single neighbor on this street has the underage drinking, the smoking fun, the threatening drinking right now. >> I don't care if you drink or not. That's not what we're here for. But I'm telling you, 2-year-old, >> you' be willing to do SSDs? >> A what? >> DUI investigation. Would you be willing to do SSDs? >> I don't have to do it. >> You just said you're not you haven't drink. >> I haven't. But why do I have to do it? >> You don't have to do it. Would you be willing to? >> No, I won't. >> Okay. >> I don't have to. >> I know my That's why you're behind the cop, right? >> And that's why you're right. >> That's why you're getting right, right? So, just like we talked about, y'all are nothing's changed as far as that goes. I do need I do need some statements if y'all be willing to give them. It's up to you. You've put it on camera already, but if you can put it on writing, it'd be helpful. It'd be helpful for your case, so that'd be great. Um, we're about to get on that boat. Okay. We're not going to take the boat. We're going to get on the boat. Is there anything on there we need to know about? I'm giving you all the opportunity. >> Huh? >> Okay. All right. Who all who all is over 21? 21 or over? >> I'm 22. >> How old? 21. And you're under. Okay. All right. So, we got a couple over. >> He's got some stuff on there. He tell us about his stuff right now. It's stuff we get on there and find it ourselves. It's everybody. >> He got any powder any I >> No, that's good. You understand? It's everybody's stuff. If we go find it now. >> All right. So, y'all don't know about anything. >> Y'all take that, too. You know if he's got something on tell me he's got something. >> You don't know anything. That's all I need. >> What are you trying to do? Trying to catch him on a second. >> Here. >> Here. >> I tried that. >> Watch this. You got two people light. Shoot them into the net. That's too big. So, got to measure it. My freaking flashlight's going out. That's not good. Huh? >> One. There's two right here. >> Mango's 10, right? >> Yeah. >> There going to be another one right here in the net. It's going to be short. >> Right by your foot. >> Oh, yeah. Mangro. Never mind. There's another one right there. It ain't a mangrove. Let Cory tell you what it is. I don't know. This one here. >> What's that for? >> That's a mangrove. >> It is mangro. Just a little one. >> All right. So, he's going to be illegal. >> This one will be fine. Yeah. >> That's little for uh unless lanes are 8 in. Yeah. >> Hey, do you have a flashlight? >> I'm sorry. I'm sorry. >> There's a dead lane down there and then a lane by your foot. >> This just Cory. >> Okay. All that's left you got on that one right there. >> That little one. That one. That one. >> You measured it. That That's a mango. mangrove. >> Yeah. I haven't measured that one cuz that's a land, right? >> Yep. 8 in or >> So, the mangro is going to be fine. >> This one is >> That's all right. Everything else is legal. All right. >> It's legal. >> Yeah. Everything else. >> How many shorts you got? >> They're right here. >> Oh, I just threw a legal mangrove in there. >> Did you throw a legal mango? >> I did. I'm sorry. That big one yet? No. Another big one. Can I see it real quick? I don't know. This is legal. >> Oh my god, I'm so scared. I'm shaking. >> That's why I step right back down as soon as you turn around. >> Because I'm in handcuffs and you guys are cops. Shut up. Swear to God. If you weren't a cop, bro. I'm not even going to speak anymore. >> Yeah, go ahead. Say big. >> Oh my god. Everything Everything you think he is against? You think I'm stupid? Listen, >> but I didn't because you can't even fit a finger in this. Cutting my circulation the whole way. Look at this. >> You're not supposed to fit a finger. >> Yes, you are, dude. >> No, you're not. >> Stand up. Let me check. Stand up. >> No. Stand up. I don't want your hands. >> Partial of a finger. >> I don't like touching. >> Okay. Well, I got to make sure the cups are good. So, stand up. No. Stand up. >> Must have been a long drive. >> Oh my god. You were not >> you will take the test. Correct. >> After you answer my question. >> Okay. >> If I test over 0.02, what's the charge? >> It's not how this works. If will you take the test? >> You're operating a vessel. Okay. I believe you're under the influence based on how you've been acting. Okay? You're belligerent. You're crying. Your eyes were glassy earlier. Okay. That's why I'm having you take the test. Will you take the test? Okay, that's a yes. Do you understand what I read to you? >> You need me to read it again? >> Okay, let's read it again. 25. >> Do you understand what I have read to you? >> Yes or no? >> Yes. >> Okay. >> Do you still refuse to submit the test? Yes or no? >> If I test over 0.02 is a felony charge. Oh, do it. Just answer my question. You keep asking me questions. Answer the questions. I'm not refusing. I haven't said that. I'm not refusing. I'm asking one last question. Is it a felony if I test over 0.02? Yes or no? >> No, it's not a felony. >> All right. Give me the breathalyzer. Holy. You make everything so hard, dog. >> You want me to cut this camera? The vessel inspection added a third charge, possession of an undersized lane snapper under Florida statute section 379.2271. The legal minimum is 8 in. The fish came up short. This charge requires no intent. Possession alone is sufficient for the violation. Hillard was charged with fleeing by vessel, disorderly conduct, and possession of an undersized snapper. He was sentenced to 36 months of probation. No incarceration, but three years of probation for an 18-year-old means travel restrictions, supervision, and zero margin on any future law enforcement contact. The officer team earns a B. They managed the dock approach well, handled the passengers professionally, and administered implied consent correctly, including rereading the advisement on request. The deductions, an incomplete handcuff verification on camera, and a disorderly conduct charge that rests on constitutionally thin ground. Standing alone, Hillard earns a C++. He eventually complied, did not physically resist once cuffed, and knew enough to ask the right questions about the breathalyzer threshold. His verbal conduct did the damage. An officer told him directly that his mouth converted a likely citation into a criminal arrest. The cooperating passengers earned an A minus. They followed instructions, stayed calm, and did not interfere. Their composure kept a volatile scene contained. Credit where it is due. Three lessons. First, implied consent on the water is not optional. Florida statutes section 3 27.352 applies the moment you take the helm of a vessel in state waters. Refusing a breathalyzer does not make the problem go away. Refusal is admissible at trial as evidence of guilt, and officers retain independent grounds to build their case. Second, the right to remain silent applies on the water the same as on land. Hillard's extended verbal performance gave officers documented indicators of impairment, direct support for the disorderly conduct charge, and footage his own attorney would have to work around. Silence is not guilt, it is strategy. Third, marine law enforcement does not need a warrant to board your vessel in Florida waters. The fourth amendment protections that apply to your home and your car do not transfer to a recreational boat on navigable waterways. Knowing that difference before you leave the dock is not optional. And a fourth point that often gets overlooked. Fishery violations travel with you. The undersized snapper charge had nothing to do with the BUI or the confrontation at Sunset Grill. It was found during a routine inspection that officers were legally entitled to conduct. One bad decision brought the whole boat under scrutiny. The larger pattern here is straightforward. Hillard arrived at this encounter with options and left with a conviction. Every escalation, the departure by boat, the live stream, the taunting, narrowed those options one by one. The law did not do that to him. His choices did. Let us know if there is an interaction or legal topic that you would like us to discuss in the comments below.
