But why am I in jail? I've never done that. >> You are under arrest for assault. Put your phone on top of the car. >> Turn around. Put your hands behind your back. >> Don't Don't touch me. DON'T stop touching me. Stop. Please. Please. Please. Please. On August 4th, 2023, Fairfield police in Ohio arrested a woman outside a bar for allegedly punching a bartender in the face twice. Multiple witnesses, visible injury. The arrest had legal footing. Ohio Revised Code section 2903.13 defines assault as knowingly causing physical harm to another person. A split bleeding lip from two punches clears that threshold easily. Under Illinois versus Gates, consistent eyewitness accounts establish probable cause. What's going on, guys? You're on 96. >> What happened? >> Now you're in trouble. >> I'm in trouble. >> What happened? >> Not me. Not me. I'm just talking to her. >> Okay. Anybody I need with you real quick? >> Yeah. >> How long you guys been here? >> Uh, I just came out to rescue her. I offered her a ride. >> You guys are friends or >> uh I been here since about >> I just met you. You guys met? >> Yes. >> Yeah. I just came out and I told her I said, "Do you want to ride? What happened? >> Yeah, I was in here hanging out with her. We were having a good time. >> But you just met her tonight, though. >> No, she works with my coworker. >> Okay. All right. She just said she met you tonight. That's why I asked her. >> No, she works with my coworker. We've been together before. >> Okay. >> And I was in here. I was I had a confrontation with her. It led to a confrontation with a bartender. >> Okay. >> And the next thing I >> confrontation like what do you mean? >> I said something to her and the the bartender, one of her friends. >> One of her friends. >> And no, one of the bartenders friends >> and one of the customers get involved and they like they >> You guys were just verbally arguing. You too. >> They pick me up and they they throw me out. Like they pick me up and they throw me out of the bar. >> Okay. See if you can find your ID for me real quick. >> Family. >> Do you have it with you or not? >> I do. >> Okay. See if you can find it real quick. >> Tyler getting beat up again. >> Man, smokes busted him in his mouth twice. She was trying He was trying to carry her out. She socked him in his mouth twice. Fattened his lip. And she got out here and as I pulled up, she was arguing with everybody on. So I told her to leave like three times. And she's like, "No, get away from him. Like, I work here. You need to leave before the cops come." One in a white shirt. She wouldn't leave. So, I grabbed her around her arms like this and picked her up and took her to the parking lot. And as I let her down, she lost her balance and fell. So, it kind of looked like I threw her. But regardless, she punched him in the face right >> they started fighting with each other right there. Started fighting with each other. >> When he took her out, she just berserk it. She tried to fight the owner. Julie's in here, too. She tried to fight her. She's like, "Wait till you come outside." Blah, blah, blah. And then I come running. Julie's like, "Will you take care of that outside?" So, I'm like, "Oh, I'm already on it." So, I walk out here. She's She's over there arguing with him. So, I grabbed her around the orange and put her in the parking lot. >> Damn. So early, too. >> I just pulled up, dude. I just got here. >> I uh >> I don't know. I just came out and was offering her a ride back to her vehicle. I just met her. She uh apparently there was confrontation inside the bar, but when I came out, she said some guy shuffed her is what she said, but then the guy took off. >> Her >> You don't know her though? >> No. >> No. Uh she works with my fiance. So >> I live in Dayton. I just came down here to meet him and his co-workers and I just met her. >> I was going to ask if I'm allowed to go back in now since you guys have her under control. >> Yeah. Just one second. Did you see her get into an altercation with somebody or you just walked out? >> Um, when I walked out, she was yelling at the guy and the guy got in his car and spit off. So, I didn't see what she had. >> Maybe the people on the patio did, but I did not. >> Who's the guy? >> I have no idea. >> I don't know. I came out and she was like, and that was all I know. >> Okay. She is not involved, correct? According to everyone else? >> Yeah, sure. She's with him. >> I was going to say, am I allowed to go back in? I was >> I don't think you're Are you allowed back in? Yeah. I just >> Are you just met her tonight? >> Yes. >> She's saying you work with her. >> No, my fiance works with her. I drove down here from Dayton and just met her. And did you know you were meeting her or >> No, he he is my party's in there and there was an altercation. She came out and I guess there was a another altercation with a guy. When I came out, she was on the phone trying to get a ride and the guy spit off. I didn't see what happened. So >> that's why I was like, "Uh, I was just >> We're not in any trouble. We were just trying to >> No, no, no. I understand that. I was just >> we're trying to figure out what the what the story is here. >> Well, you have to have these people on the patio cuz I came out and the guy was already pulling. >> What were you two on? >> Uh because my fianceé works with her and I had read some text messages that I felt were inappropriate and boundaries crossing and some lady said something to her. She then said something to the lady and then they told her she needed to leave the bar. She came out the bar and I don't know what happened out here. So then I came out and something happened and I said I will take you where you need to go. I was offering her a ride. I guess there was a little bit argument between you or like not >> Yes. But not the aggressive like I'm >> Did you just find the text messages like as you were sitting there? >> Yes. >> So you're not trespass. I came out to give her a ride back home. They wanted her. They said you're fine. >> I I was just going to ask them. They >> girl in the pink dress. >> Okay. Am I at least allowed to ask? Can you guys also come out? He has in a neon either green or orange shirt. >> What's his name? >> It's Bill. He has a cat on >> I was almost waiting for you guys to have her gone before he came out cuz he's concerned about her. That's why I had a problem cuz the messages >> I got 27 Robert. >> Okay. So, you're being detained. You're not free to leave. But I'm going to wait the other side of the story for >> an investigation of an assault. >> Anything? >> Okay. I'm not saying you've done anything, but give us a minute to figure out what's going on. We just got here 2 minutes ago. Okay. >> Give us a second and we'll figure it out. Not saying you're in any trouble, but we're going to figure stuff out. >> Let us figure out what's going on. Okay. >> What is do you have besides your own? >> I I don't know. I was here and then the next door I'm going to be thrown across the parking lot. Did you swing or hit? Try to hit the floor. >> No, I didn't. I was just sitting there. >> Okay, hang out. >> Why am I here? >> The girl in the dress, her fiance's still in there. >> They won't let me back in to get you, so you need to come out >> so we can leave. >> Um, some guy just came in to get you. in a neon green shirt. >> I told him your name. So, pay your tab. >> Love you lot. >> So, you don't know her at all. You just >> No, I literally that's the first time I've ever laid eyes on her and hot. >> Well, the problem is I drove down here from Dayton and this these are his co-workers. The owner was here which they played it cool and then when the owner left I was walking through the window and then he like felt up on her. And I was like, and then I already had his tone cuz he gave it to me. He's like, "Here." Cuz I called him and called. I called him for like 2 hours. That's why I came down here. I'm like, "What's going on?" And then she wanted to do a shot. And I was like, "Fine. I just got here. I'll do a shot." So I did a shot and I was like, "Oh, her lips are so soft." Oh, well, well, there's something nice that said something. She caught what I was saying to him. And she's like, "First of all, I've asked him where you were and she's obviously." So then she doesn't leave and another pedestrian in the bar said something and the direction of aggression turned to the pedestrian and that's where it went and they told her she need she come out and I don't know what happened on here because I was too busy holding him back like no I'm your wife not her >> leave the beer there trash we're leaving your beer in the jail >> because she was out here fighting with someone >> not me she wasn't I tried to take her home and nobody said she was going to jail. >> Don't say that cuz it just >> you don't need to go over there. >> Sir, is she here? >> Who? No, she's not in there. Don't walk up on me like that. >> I just told you not to. >> Is she in? >> She's not in there, bro. We just told you that. Okay, back up a little bit. She's standing right there. Back up. >> Where is she at? We don't need a hero right now. Back up. Okay. >> I'm not looking for a hero. I just want to say >> she's not in there. You're not talking to nobody, bro. >> She's on the phone with her husband. She's on the phone with her husband. >> Well, where is she on the phone? >> If you don't believe me, but we're leaving. >> Look. Come on. Look. Look. Hey. >> Right there. Look. >> Got time for this. >> So, have we talked to everybody over here? What are we doing? Yeah. Uh, I think Tyler wants charges. >> Okay. For solar. >> Oh, no. I'm perfectly fine with going back to court. Okay. Is he easier? >> Yeah, he's got his lips on. >> Jess, say hi, Bill. She thinks you're in the compound. She's getting the pain. >> She's okay. >> Just stay over there for a second. >> Don't come over here. >> Okay. Don't come over here yet. >> You're not involved. You need to walk away before you get yourself in trouble. >> Man, I don't give a about trouble, man. Don't matter to me. Do you need a ride? Can we do anything for you? What? >> You're not involved. Go over to your fiance or your wife, whatever she is. >> Can we do anything? >> You understand what I'm saying? >> I don't give a about what you're saying, dude. You want to take me to jail? Take me to jail. I don't give a I drove her here. >> Okay. Well, she >> and I'll drive her back if she can. >> That's all I'm asking. Let's go back over here. >> Bill, just go home. >> Come back over here. >> Your your bag. You can't have it back there. I'll set it right over here. >> Okay. Well, you ain't got to tell me what the to do, man. Don't matter to me. >> I mean, you want to take me to jail, take me to jail. I won't give you. >> I could give a less. Okay. her a ride. I could care less, Bill. She didn't want a ride. >> I'm just saying. I don't give >> myself. >> I don't care, man. I don't give a >> But you should. >> I have >> I brought her here. I would like to take her back if I can. Well, you're not cuz she's going to jail. So, for you great. I'm glad you got your goddamn authority over it. You know, you is what I got to say. >> Because he's a he's trying to take me to jail. Take me. >> No, I'm giving you one more chance. One more chance. One more chance. >> Crazy. >> Turn around. >> You have You don't have children. You have >> I don't give a [ __ ] man. >> I have Thanks. Thanks, Bill. Good job. When all you had to do is get >> I don't care, man. This guy. >> She wasn't getting a >> Can I Do you guys need his wallet or can I have that? Do you have his ID >> or you can take his ID? >> We'll take it if he's got it on him. >> So I don't have other And where is he going? So I know >> he probably won't go to jail if he can settle down. >> I'm not doing [ __ ] You're not doing anything. But you're talking to an officer. >> Shut up. >> You're very disrespectful. She's not in trouble. >> Who is he to you? Is this your husband? >> This my 20 years. >> Okay. >> That's his coworker. But she got in a fight with the guy. >> She got in a fight. >> I don't care. She didn't do anything. >> There was a guy out here that >> sometimes you talk yourself in the jail and sometimes just hear a lip real quick and see. >> So you guys are just walking her out for >> Yeah. I was So she was threatening multiple people inside. The other bartender, one of the customers and the owner. She was threatening all them talking about coming out here to fight blah blah blah. refused to leave after me, the owner, and the other bartender told her to leave. So, I picked her up and car started carrying her out. About halfway or about halfway to the door, she turned and started swinging on me. >> Okay. >> All right. Fair enough. >> A guy put his hands on her. Yes. >> She's a goddamn girl, man. >> She's aing girl. >> Jesus Christ. >> Whatever. >> Whatever. Go home, man. But if he settles down, he'll just get a summon. But if he wants to whatever summons me, whatever the you want to do, I don't care. Take me to jail. I don't give a [ __ ] >> You shut up. >> Don't matter to me. >> Oh, hold on. Spread your feet. >> I get So now >> all you have to do is walk away, dude. >> Listen, man. That's stupid. >> It is stupid. So we're going to release him, but we're going to take him back to our police department, do the paperwork. Um >> and I can pick him up from there. >> Yeah. And that way we can knock hers out too at the same time. >> Yeah. To get him away from here. >> Yes. And hopefully maybe going inside the facility kind >> seeing her then. He's more concerned about her and I don't know why. Right. But where's the police station? I'm not from here. >> So, um, >> what's the station? I can just be >> 5230 Pleasant Avenue, Fairfield Police Department. >> Okay. Thank you. >> And she's going she's going to jail for her assault. Um, >> on who? >> The bouncer. She or the bartender. She She punched the bartender. >> That wasn't her. That was her coworker. >> No, that was her. >> Uh, >> is there video of this? >> There's multiple witnesses. I don't say it. >> It was Ashley. She told me about it 45 minutes ago. >> Okay. She she there was there was stuff between a coworker and stuff like that and then the bartender ended up getting punched. >> Well, let's watch the video before we take a group of friends word for it because this she's never hit anybody. I've been with her for 8 years. >> I'm We have multiple witnesses. Okay. It's >> um we don't have to watch the video like and uh so she she's going to go back to our police department for paperwork and >> so I am I am going to have to get an attorney to get this video pulled because now we got to go to court and everything else >> because of that's what you want to do. You go right ahead. He said, she said they [clears throat] not he said, she said. It's multiple people saying they saw. Okay. I DIDN'T DO anything wrong. >> I don't know what's happening. Please. >> Will you quit? You're a grown woman. See that? >> No. I want Craig. I didn't I didn't do anything wrong. >> I want Craig. I want >> I want Greg. Sit down. I want Greg. I want No, no, no, no, no. I did this wrong. I didn't do anything wrong. I didn't do anything wrong. >> 10:00 on a Friday. Jesus. >> I don't know what happened. >> This mother is what happened. >> You give him one second. I'm going to go get his piece of paper, give it to you. It's just coordinating stuff. >> The bar had surveillance cameras. Officers left without securing that footage or documenting a request to preserve it. Under Brady versus Maryland, that duty exists. If the footage is gone, the defense gets a spoilation argument for free. The witnesses were bar employees whose coworker was the alleged victim. Not disqualifying, but a jury will hear about that. Video would have removed the question entirely. Without it, the prosecution is weaker than it needed to be. When officers moved to handcuff the subject, she went limp, dropped to the ground, and physically pulled away. Ohio Revised Code section 2921.33 covers exactly that. Resisting a lawful arrest, recklessly or by force, is a separate criminal charge. The body cam captured all of it in real time. The resisting arrest count does not need witnesses. The footage is the evidence. She walked into a single misdemeanor and left facing two charges. During the struggle, she said, "I want a lawyer. That matters, but only for future questioning. Miranda versus Arizona prohibits custodial interrogation without counsel. It does not stop an arrest already in progress. A bystander named Bill repeatedly approached officers despite being told to back away, use profanity, and invited arrest. The speech is constitutionally protected. City of Houston versus Hill, 1987. The repeated physical approach is the problem. Ohio's disorderly conduct statute section 2917.11 covers conduct that recklessly interferes with public order after a warning to desist. Bill received multiple warnings and ignored them. Officers [snorts] offered a summon that was proportional and correct. Officers receive a B. Probable cause was solid. Witness interviews were efficient and force during the struggle was commensurate with the resistance encountered under Graham versus Connor. The surveillance video failure was avoidable. It drops the grade. The female subject receives a C++. Physical resistance during handcuffing turned one misdemeanor into two charges. Believing an arrest is unjust does not make resistance legal. Ohio courts do not recognize that as a defense. Bill receives a C minus. Inviting arrest while an officer manages an active scene is not advocacy. He got a summon he did not earn. Bar staff receive an A minus clear accounts. Small deduction for physically removing the subject before police arrived. Three takeaways. One, when a crime occurs on premises with cameras, request or subpoena the footage before leaving. Witness testimony gets you probable cause. Video wins the trial. Two, invoking the right to counsel stops future interrogation, not the arrest itself. Three, physical resistance to a lawful arrest is a separate criminal offense, regardless of whether the underlying arrest is justified. The legal remedy is a motion to dismiss in court, not a struggle in a parking lot. Let us know if there is an interaction or legal topic you would like us to cover in the comments.
