Hold on. This situation just went from a routine roadside stop to a serious child safety investigation. A bystander says they had to physically remove a week-old baby from the back of a dangerously hot car while the mother appeared completely unresponsive. At this point, the officers aren't just trying to figure out what happened. They're trying to make sure that baby is safe first. >> And she wasn't waking up, so we pulled the car and he went and got the baby. He was crying and she was weaning her out of it. So, he took the baby out feeding the baby, but um yeah, she's definitely not very You can take it from here, but we didn't want to >> Yeah, no, for sure. It's a pink phone right behind you. Get it. Reach back. Give me that phone. All right, good. >> Do you know a phone number off the top of your head? Mom's phone number, step in number. >> All right, we don't try and take custody of the children ourselves. We'll try and get a family member to come out here, but I I need FHP to respond and they're on the way. >> All right. >> Yeah, I'm glad you guys came just to like make sure that the baby's okay. >> All right, we'll take it. Bro, what are you doing? >> I can't get her out. We can hold her unless you want to hold her. I I need some milk. We don't have any out here. I'll call my mom. Okay. She has one in the She has one in the car. I'm not the best at it. >> All right. >> I can hold three of these. >> You can sit right there. I'm just here to help you out. I'm asking you a question. Who do we call? >> What's uh Is the car seat Is the car seat straight and tight and safe? So, we're going to We're going to put her back in the car >> Yeah. >> Let's sit down. Let's sit down. >> car >> Sit down in the car. >> All right. I'm moving. I'm like, "What you going to do with >> Hey. Hey. Hey. Hey. >> Calm me down. >> Relax. Relax. Okay. Sit down. You can try. >> Get in the car. >> What's your cell? >> You who are you to hurt her? That's her? Okay. I have a few questions for you, so I'm going to roll the window back up. What she told us >> I can ask her again. >> Make sure you ask her in front of us. child services I understand, but you're not her legal guardian. So, we need to at least have her give authorization for me to You know what I mean? Okay. >> for the night at least >> Yeah. >> Right? So, I need him to step out while you have your little camera and have her telling you that because technically the child is hers, right? Um but we always like to put the child with a family member before we try and get her into the custody of the Right? >> I grew up with my little cousin. My uncle's house. >> she live? >> Mermaid >> In Mermaid? You don't know her house? >> I don't know where her house >> Who is Who is he? Is he with you? >> Yeah, that's my boyfriend. >> So, you don't know where her house is? >> Uh I know she lives in Miramar, but I don't know her exact address. >> Miramar address? So, she says she still lives there? He says he's family. So, you're okay? Is your cousin here? Are you you okay with your child going with her, with your cousin? Yes? Okay. >> I love you. I'm fine. >> What's your baby's name? >> What's the baby's name? Malachi Malachi Angel Colazo >> I don't even know how to spell that first name. >> So, here here's the thing. She's under arrest, all right? I'm Sergeant Correa. >> All right. >> Officer Dunn Fire Rescue Captain >> Alvarez >> Alvarez, okay? Uh so, at this point, she's under arrest for DUI, battery on a law enforcement officer. Obviously, she's extremely intoxicated. >> Yeah, I see that. >> She was passed out here drunk in her car, and a good Samaritan came here. She had her feet hanging out the window, and the hazard lights on on the car. On the side of the highway. So, they came, they turned the key off, and the baby was in the back seat screaming and crying. So, luckily, some good Samaritans stayed here, and they fed the baby a bottle, and they waited for us to get here. >> No. >> Luckily, we got that. And like, it could have been even worse. Like, especially someone's not paying attention, rambling in the back of the >> They could have took the baby and kidnapped the baby and >> They could have kidnapped the baby. Anything. She was out. You guys are Do you have children? >> I have two. I have a 23-year-old, and I have a 6-year-old. >> So, you at least know how to take care of a child for the night or something. >> Yes. >> Um this whole thing is extremely documented. We're all on body worn cameras. The biggest thing is, would you mind >> I'll talk to her just a moment. >> Thank you, sir. The thing is, we want to get the child with the next closest family member that we possibly can. Like I explained before >> Baby's in good hands. I promise you. >> But uh Child Protective Services is definitely going to be getting in touch with you. You know, the cell phone number you gave, that's make sure you answer. Okay. They might even be calling you tonight. >> Okay. >> Okay. It's very possible. Um the address that you gave on your driver's license, most current address, that's where we're going tonight. >> Yes. >> Okay. Just confirm that you got that. >> Yeah. And I didn't have it's Miami Lakes, but it's considered like a borderline of Broward. >> But, it's the address on your license, right? So, I guess we'll just call him and tell him what's going How's her father? >> My my uncle is is over 50. He's actually >> And then comes the human side of the story. A relative says the family has been trying to help her with alcohol addiction for years, including previous rehabilitation attempts. That doesn't erase what allegedly happened today, but it gives investigators another piece of the puzzle. Addiction can explain destructive behavior, but legally, it doesn't automatically excuse putting a child in danger. >> She's had like two heart surgeries already. We've been trying to get her help. She's been >> I I saw her For what? Alcohol abuse or drugs or what? >> Alcohol, you name it. We've been trying and trying with her for many, many years. She has a lot of mental problems. >> And the guy, the the father, you got no idea who he is? >> father. >> All right, so >> We've been trying to help her, you know, it's hard. >> Yeah. >> You know, people with addiction is it's like they they get really >> know what she's addicted to? >> Alcohol. >> Do you know she does other drugs? >> No, she doesn't do any type of drugs. I know that the alcohol she's had that issue since she was like a teenager. >> Okay. >> We've been trying to get her help. He's been trying to get her help. It's hard. It's hard to help someone with you know, with an alcohol addiction. >> This is the final legal pressure point. The officer formally requests a breath test and explains the consequences of refusing. She refuses. In DUI cases, that refusal can create additional legal consequences and may be admissible in court depending on the applicable law and circumstances. So, after a chaotic roadside incident involving a newborn, the case now has another potentially important piece of evidence or more accurately evidence about the refusal itself. And the biggest question remains, what happens next for the baby? >> I was actually I'm actually with attorney officer. You know, I'm going through a divorce cuz my ex-husband My ex-husband is a >> Okay. >> So, I had to, you know, remove myself from that situation. >> Do one last thing before they leave. Um, you know, give me 1 second just go to your car so I can talk to you for 1 second. Thank you. All right, Emily. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. >> No. >> No? Okay. If you refuse to take the test I requested of you, your driving privilege will be suspended for one period of 1 year for a first refusal or 18 months if your driving privilege has been previously suspended for refusing to submit to a lawful test of your breath, urine, or alcohol, or blood. Additionally, if you refuse to take the test I requested of you and if your driving privilege has been previously suspended for refusal to submit to a lawful test of your breath, urine, or blood, you will be committing a misdemeanor in addition to any other penalties which may be imposed by law. Refusal to submit to the test I have requested is admissible in evidence in any criminal proceeding. Do you still refuse to submit to the test? >> Yes, I refuse. >> Okay. >> May I please use the restroom? >> There's a bathroom in there.
