Had she been drinking and she drink I'm saying like so you saying last night 7:00 like hey man I can't come in right >> you've been drinking right like just hanging out right drinking I talk to him >> after. Okay. Did she start drinking then, too? >> I haven't saw her, man. >> Okay. I'm feeling I haven't saw her. >> No, [clears throat] man. Like I mean so and that's the thing is that you know somebody somebody's done something to her and I don't think it's you but I like I want to make sure whoever it is like you know we take care of her make sure I don't do this kind of stuff again you feel the same way. >> Yeah. Yeah. And I'm asking like what's going on? What's going on? You ain't saying nothing. >> I got [clears throat] you. I'm going to get them to run you back home. Okay. Uh I'm going to keep her phone uh and I'll get it back to her and stuff like that. Okay. Um but she she's going to be in the hospital for a little bit. Like I said, uh I don't What's wrong with her, man? Uh I don't to be honest with you, man. I'm not a doctor. I don't know. She She looks pretty rough. >> The first legal issue is the entry into Jarvis's home. Deputies entered without a warrant. The basis was consent. Jarvis said, "Yeah." And let them in. Under [clears throat] Schneckloff versus Mustamonte, consent to search must be voluntary and free of coercion or deception. Here's the problem. The deputy said, quote, "I ain't trying to search nothing than walk through the home." That statement made before entry creates a fourth amendment suppression argument. A defense attorney reads that line as an affirmative misrepresentation of intent. Whether a court agrees depends on circuit precedent, but the voluntary nature of Jarvis's consent rests on a narrower foundation than it needed to. One sentence changed the legal calculus of that entire entry. The second issue is custody. Deputies told Jarvis he was not under arrest repeatedly. Then they asked him to ride in a patrol car to the police department. Those two facts sit in tension. The question Miranda asks is not whether handcuffs were used. Thompson versus Kioane sets the standard. Would a reasonable person in that position have felt free to refuse and leave? A person sitting in the back of a patrol car headed to a police station is not objectively free to leave. That is the custody line. If a court finds that transport crossed into custody, every statement Jarvis made at the police department before he invoked his right to counsel faces suppression. Miranda warnings cost nothing when given early. They cost everything when omitted and later challenged. Detective Nick's rapport building approach was sound. He referenced his own divorce to reduce Jarvis's defensiveness. A recognized technique that produced real admissions, the timeline of last contact, the missed work night, the fact that Amanda's phone was at his house. Then Jarvis said it. I don't even want to talk no more, man. Y'all can get me a little lawyer or whatever. Under Edwards versus Arizona, once a suspect invokes the right to counsel, all questioning must stop. Full stop. The detective did exactly that. That response immediate. No argument, no one more question was constitutionally required. It preserved the integrity of everything gathered up to that point. Getting it right matters because getting it wrong after a clear invocation is the kind of error that collapses a prosecution. Before transport, the deputy conducted a patown. Terry versus Ohio authorizes a frisk when there is reasonable articulable suspicion that a subject is armed and dangerous. a victim with severe burns, an unknown asalent, and a subject with an inconsistent account that clears the Terry threshold. Detective Nick retained the victim's phone, which had been at Jarvis's residence. A warrant is required before searching its contents. Riley versus California established that in 2014, retaining the phone as evidence is lawful. Reading its messages without a warrant is not. The conduct documented here, severe thermal burns across the victim's head, shoulders, and stomach. Inflicted with boiling water or oil constitutes aggravated battery in virtually every American jurisdiction. The prosecution would not charge simple battery. The injury is too severe. In most states, aggravated battery causing great bodily harm is a secondderee felony carrying 2 to 15 years in state prison. Several jurisdictions carry a separate enhanced charge for assault with a costic substance. Those counts can run consecutively. Visible permanent disfigurement removes most of the prosecutorial discretion that would otherwise support probation for a firsttime offender. Active prison time is the realistic baseline here, not a suspended sentence. The medical documentation from the emergency room will drive that outcome. Three things stand out. First, the right to remain silent is most protective at the start of an encounter, not after 7 minutes of statements. Jarvis invoked at the right moment but absorbed preventable exposure in the time before it. Second, I ain't trying to search nothing is not a legal limit on what officers can see in plain view once they are inside. Saying yes to a person entering your home is not the same as consenting to a search. Know the difference before you open the door. Third, if an officer says you are not under arrest but asks you to ride to the police station in a patrol car, ask whether you are free to leave. If the answer is unclear, say nothing until it is.
