At first, this looks like a simple roadside assist, but that changes almost immediately. A car stopped in the middle of the road, hazard lights flashing, and a passenger desperately waving down police. Officers now have two concerns. Is someone having a medical emergency, and is the driver capable of safely operating that vehicle? >> I don't know how much she had to drink, but I know she was drinking a little bit. At least what? >> I just got the fire department and ambulance on the way, okay? What's your name? >> My name is Ashley. >> Your name is Ashley? What's your name? >> Gabriel. >> Gabriel? You guys friends or >> We're friends. >> So, you're here to make sure she's all right? Car's in park? We're just going to turn it off right now. Don't worry about that. Where are you guys coming from? >> Um, we're on our way to Taco Box. >> Okay. From What's going to It's going to ding cuz the door's open. Going to Taco Box from where? The dorms? I don't know how to get to you. How'd you guys get here? Were you at the Taco Box on El Toro or the one on Sonora? >> I'm sorry? >> How'd you guys get >> The one right here. >> So, you were at the dorms over there and then you took How'd you guys get in here? >> We came from the mountain. >> Okay. So, you work over at the dorms and you go up to the mountain? Where were you guys at before that? >> The dorms. >> Okay. Were you with her when she was drinking the alcohol? >> I was trying to get HER UP, SO SHE'S SHE'S okay right now. >> Okay. >> Oh my gosh, get her right now. Hey. You need some water? You need some water? >> What's that? You need a ladder? Oh, yeah. Gabrielle, you all right? >> I need some water. Here. I can't feel. Can't feel where? Just hold still, Gabrielle. You awake now? >> Just going to take your seat belt off for me real quick, okay? We're going to have the medics check you out. Want to come over to the sidewalk. >> Okay. Now, she needs to sit down and rest for a minute. >> Yeah, we're going to have her sit on the sidewalk, okay? I just want to have her rest somewhere until we turn the car on, okay? >> It's super comfortable to be able to rest. >> Want to go over to the sidewalk over here, Gabrielle. So you don't get hit. Get over here. You guys just get some part of your head. Just sit right here, okay? Cool. It's going to end the road. Where were you guys coming from? >> We were coming from our friends. >> Friends? Okay. How much did you have to drink tonight? >> Just a little bit. >> What's a little bit? A little bit to me is probably different than a little bit. >> We only had a little bit, but we smoked weed. >> Okay. How long ago? >> Probably like an hour or two. >> An hour or two. Okay. So she did you you guys were at your friends'. She mentioned something about the mountains. Is that where you guys were at? >> It seemed like it. Yeah, it's as far. >> Okay. Where were you guys headed to right now? >> Our home. >> Your home? Back to Where's that? >> Uh the bar. >> Is this your car or >> No. >> I don't think you should be questioning her as she just woke up from a She's >> Okay, I've been doing this job for 15 years, okay? I think I know what I can and cannot do. Give your wallet. How old are you? >> I want to talk to a lawyer. >> That's fine. Is she under 21? >> Mhm. >> Okay. >> Please do not arrest me. >> Well, we'll have the fire department here. They're going to check you out, okay? >> Okay. >> Okay. Are you sure that we don't need need might not have anything else in it? >> Mhm. >> Okay. Cuz they need in case that you had they need they need for the medical side. >> Okay. >> In case any medical drug interactions or anything like that, okay? So, it's best that you fully honest with them, at least, okay? >> Mhm. >> Hey Gabriella. How's it going? I'm Officer Montes with the Police Department. Hey, so the reason why I'm talking to you right now, okay, is because obviously based off what my sergeant saw right now and talking to you talking to the passenger seat your friend, I'm assuming your friend. >> Mhm. >> Okay. Um we have reason to believe that, you know, you're driving under the influence, right? >> Mhm. >> Okay. So, um I understand, you know, I know it's a little scary stuff like that, but you know, we just got to, you know, we got to do our part, you know, and stuff and do our job, right? Um with that being said, okay, Gabriella, is this your car? >> Mhm. >> Yeah, this is your car? Okay, you live far from here? Would it be all right if I conduct what's called as a standard field sobriety test, okay? It's a series of tests, okay? Uh a little finger test, a little um walk and turn test, a little stand on one foot test, that kind of deal. Um if that's okay with you, all right, we can go ahead and do that, mark it out, see if I've uh determine whether or not you've been impaired driving this vehicle or not, okay? It's completely up to you, okay? So, if I say no, you can just say yes, all right? All right. There are other consequences if you say no, but obviously, you know, that is completely up to you, though. All right, so with that being said, would you like to do that or would you like to >> What are the other consequences? >> Well, I mean, if you refuse to do a that that just gives us you know basically probable cause to believe that you know you've been driving under the influence and you're refusing to take the test and then we have to arrest you and all that stuff. >> Okay, I'll do the sobriety test. >> You want to do the sobriety test? Okay. So the first test that I'm going to have you do or that I'm going to conduct, okay, is called the nystagmus test, okay? I just need you to follow some of my finger with your eyes, okay? Does that make sense? >> Mhm. >> All right. Okay. So Is that too bright, right? No, not at all? Okay, so just give me one second while I adjust this real quick. And okay. Just stay still. Do not move your head, okay? >> Mhm. >> All right. Do not move your head, okay? Just follow it with your eyes, all right? Okay, good. All right. >> Okay, how long will this take? >> I know, just give give me a second, okay? >> Please. >> I know, I know, I know. >> This is like going on >> Yeah, I told you this is going to be a long Okay. don't feel up to it. >> Okay, that's it. >> Please. >> Okay, you can stop whenever you like. I told you that. >> stop. >> Okay. >> And how long do these tests take? >> I I can't give you an exact time frame. Just know that there is three tests. >> I just don't feel well and the light's like shining in my eyes. >> I I know, that's why I have it. Trust me, the the beam of the light is is is really low, okay? It's it's it's not directly on your eyes, okay? >> already hurt. >> I I know. Okay, but we got to do the It's either yes or no I can continue the tests, okay? Yes? Okay, keep your hands by your side, okay? >> Can I just take a break for a little bit? >> No, there's no breaks. It's either we do it or we don't. >> Can't I take like a little break, please? >> No, we can't. I'm sorry. >> I just don't want to pass out again. >> Gabrielle, I need I need to know now. I need to know if you're going to complete these tests or not, all right? It's either yes or no. You can't get out of these tests. >> What do I do if I don't take them? Do I go home and like >> Not necessarily, okay? Not necessarily. Are you able to take the tests, yes or no? >> No. >> Okay, that's it. Can we continue with the tests? >> We're going to keep going? >> Okay, keep your hands by your side, please. This last one, I need you to do this one here. Go on this side right here. Look at my finger. Okay. >> I'm going to pass out. >> Okay. If you If you don't want to do the tests, you don't have to. >> What if I pass out? What happens? >> Okay, we're going to Obviously, I'll catch you and I'll lay you down. >> Can you bring that ambulance, please? >> I'll see Gabrielle. >> And this is where the encounter becomes a real pressure cooker. Gabrielle keeps asking what happens if she refuses, says she doesn't feel well, and appears worried she could pass out again. But hesitation during a DUI investigation can create even more suspicion for officers. So, what would you do in this situation? Continue the test while feeling sick or refuse and deal with the consequences? >> What if I do pass out, though? >> I'll catch you. And I'll call the ambulance again. Okay, stand in this stance. Do not move. Okay? You're going to take a small series of steps on your ninth step and then you're going to do the same thing going back for- going backwards, okay? 1 2 3 all the way until you get to nine. Do you understand? I told you not to get out of your stance. Do you know what you're doing? You do know what you're doing? You understand the test? >> I think so. >> You think so? Do you need me to actually do it again? You do? Foot on the line. Right foot over it. Hands by your side. Hands by your side, please. >> Can I take a deep breath? >> No, you're not. Okay. Like I said, three series of I'm going to take three steps. You're going to take nine, okay? Are you paying attention? Gabrielle. You are? Are you able to do this test? You are? So, can you please be in the the stance I told you to be in? Gabrielle. I need you to stand up straight for me, please. And I think I forgot to mention is that I'm going to need you to count out loud, okay? Count out loud. Keep your hands by your side. All right. And don't don't Keep your Keep your your stance straight. Right there. Your Are you right foot or your left foot? Are you ready to begin? Do not move until I tell you to do so, okay? Are you ready to begin? Are you ready to begin? Yes? I need a verbal yes. >> Yes. >> Okay. Then, on you. >> How many times? Nine? >> No. Go back again. We're going to do the test over again. But, it was supposed to be nine steps. I told you I demonstrated three just just a demonstration. There was nine steps, okay? So, the last test what I'm going to have you do is go ahead and keep your feet together and hands by your side. Okay. Keep your feet together and hands by your side. Whichever leg you would like to choose, okay, your strong leg, whichever right leg, left leg, whichever leg you want, you're going to lift it up 6 to 8 in off the ground, keep it parallel, okay? Toes pointed forward, and then you're going to count 1,001, 1,002, 1,003, 1,004, so on and so forth until I tell you to stop. Do you understand? Hey, Gabriella. When I ask you do you understand, I need you to fully comprehend what I'm asking you, right? So, I asked you if you um understanding the one leg stance test, okay? Do you want me to demonstrate it again? >> I just stand on one leg, right? >> Okay, you're going to stand on one leg. Okay, whichever leg you want, keep your hands by your side, please. Cuz I'm going to have you try to do so. All right. You're going to keep one foot 6 to 8 in above the ground, okay? And then you're going to count with your with your toes pointed forward, and you're going to count 1,001, 1,002, 1,003 until I tell you to stop. Do you understand? >> Yes. >> You do understand? Okay. Go ahead, on you. Begin. >> Okay, I'm just going to stand. 1,001, 1,002 1,003, 1,004 1,005, 1,006 1,007, 1,008 1,009, 1,010 >> Look at this, huh? Do me a favor, though, yeah? Will you do me a favor, okay, Gabrielle? Face that way real quick. Just so I can pat you down and make sure you don't have any weapons. Face that way. >> I don't know. >> Take everything out of your pockets, Gabrielle. You have a chain or anything in your mouth? You're going to get arrested, okay? All right. You're going to get arrested for driving on the I want you to watch your step right here, okay? It's driving under the influence, okay? Based off these tests that I just conducted right now, I deem that you are not impaired or you're not um you are you're too impaired to drive right now. Okay? Do you have anything in your pockets, hon? >> No. >> And that's the final turning point. After the officers observed her condition, heard the statements about drinking and smoking, and watched her struggle through the sobriety tests, Gabrielle was placed under arrest on suspicion of DUI. What began as officers checking on a car stopped in the middle of the road had now turned into a full DUI investigation with the evidence gathered from every decision made along the way.
