They're they're not going to be happy with that cuz the the customers don't want to have that. They don't need the drama. What's her name? >> My name is >> uh my name is Phillip. >> Phillip. And what is her name? >> Hey, where's the other bottle of wine? Not the one that broke. Not the one that broke. Bottle of wine inside on the >> Oh, you did? >> Okay. Thank you. Excuse me, sir. Or is it just the wine? >> I honestly I didn't know. I can go check the cameras and see if she did. >> Yeah, we'll go check the camera. >> As I've seen, she only grabs that one. [music] This one she does have that brown bag with her the whole time. So I'm not pretty sure anything in that brown bag she probably already had. Okay, that was her eating the first slice of pizza. She grabbed the wine bottle. She got looks like two bottles of wine. The bottle of wine and the slice of pizza. She walked out and then I said something to her about it when I noticed she walked out with it. Right. She came back in. Yeah. So I put the wine back after confronting her about it. Okay. So she had left it like counter. Well no she left it outside. She had it on the table out there for it and she told me yes. I came back here. I checked the camera as soon as she walked out with it. I walked back out there [music] grabbed it off the table and walked back inside with it. And then I told her I was like man I'm not selling you alcohol. [music] I was like already stoned [music] like getting in my face and grabbing stuff from behind me. Okay, perfect. I know normally you guys make us like put the request in online. All right. >> All right. >> I'll have either myself or one of my colleagues bring it in. >> So, Phillip, she called you here because why? >> So, are you trying to make me change my story? >> No, I'm trying to get the story. >> All right. She called me because you needed a ride. >> Oh, to give you a ride. >> You're a veteran, sir? >> Well, yeah, of [snorts] course. >> What branch? >> I served in the Army and then the Air Force. >> All right. Good. Thank you for your service. >> I'm a Navy veteran myself. >> All right. >> Did 5 years. >> The issue we have is we're just trying to get to the reason why she was acting out the way she is. Cuz that's odd. >> She was She's a forgotten. Is that What's your name? >> I just got a message. Come pick me up at racetrack. Okay. >> And I got here 2 minutes too late. I mean, clearly she had already doesn't know what the hell it is. >> Stealing stuff or was she You just think she's made bad choices. >> Go fill him up with the names. >> What What's his name? >> Phillip for real. Okay. So, he's not Kevin Scott. What's that guy? Is that not the guy? >> Kevin Scott. No, he's his name is still accent real quick. >> Hey, what's your first name? >> I am not. He's a sergeant, too. Now he's he's up there. He was in the training division. He's all over the place. >> I think he's pretty just about everything. >> Oh, yeah. Yeah. He's he's really pretty sharp guy. >> Yeah. >> Yeah. The problem is is when things like this happen, that makes them want to trespass people, get them out of here because the the customers don't want to deal with that. You know, you're bringing your little kid in here to get some uh frozen yogurt. You don't want to deal with somebody that's drunk or disorderly. >> Brother, is there anything for me? cuz I don't want to watch you watch you guys do all this [ __ ] >> Well, hang on. You're not free to go yet there, Phil. Okay, until we we make sure you're free to go. Okay, so just hang tight with me here. When that deputy over there who's doing this investigation says you're free to go, >> okay, who's the like shift commander or who's the >> shift commander? Stand by with him. I'll go figure out without I'll give you a definitive answer. >> Thank you. I just want to go. >> Have we identified him? >> He has his name. So, >> let's run him. Make sure he's not wanted. >> All right. >> Uh, let me get a pair of gloves before you do that, just in case he goes wild again and I have to intervene. >> Sit there like a lady. >> Relax. Relax. Okay. She's going to patch you down really quick. Okay. >> I'm not going inside. Do you have anything? No, we're not doing this. I'm sorry, but you guys are not No, you didn't tell me. Real quick. I don't worry about >> Let me talk to you real quick. Okay. First of all, take this off me, please, because no one read me my rights before they put me in. >> So, you got to wait. It's ping. We're pending investigation right now. Okay. Yeah. Absolutely. So, listen. Let us get everything together and then we'll explain it to you. No. No. It's not underrest. You didn't read me. >> Yes. You're right. You're underrest. I'm not trying to be Okay. Okay. I'm not the roadside lawyer either. Listen. Listen to me. I'm telling Listen. Pay attention. >> What is Is there You're under arrest. We're not asking any questions. You are under arrest. >> No one read me why. No one told me why. >> We haven't asked any questions. >> Okay. We're invest You said I'm under arrest. You haven't asked me. They're still investigating. >> All right. So, we're going to check you for weapons. Let her know. >> No. No. Hold on. That cuz I Well, exactly. That's why I'm willing if you guys be more angry. >> We're not anything like that. Okay. We're just making sure everything's going to be safe. >> I am not any contra on you. >> No. >> No. But what >> are you just drunk? >> I am not drunk. I want >> Why you acting out like that? >> All right. Jessica, let's get through one step at a time. Okay. Nobody's laughing or something. Nobody's laughing. >> It's not I'm not laughing, but I'm You guys are >> ma'am. Listen, let her do [laughter] my life. You guys are like not you. No one. >> So, we're not asking you any incriminating information right now. We need to do a pat search and then we're going to explain everything to you. We're going to read Miranda. So listen to my partner. Let her search any questions. Do >> you have any contra any questions? >> All right. I don't hear you, Miranda. Right. You're okay. >> No, that doesn't make any sense. I I don't know what I'm going to shake your bra. Okay. Okay. Just need there. No. Nothing in there. >> No. Turn around so I get the next real quick. This crime. >> Yeah. Yeah. We're not trying to hold you up here. You got any plans for tonight? >> Brother, I got to call somebody to get around. >> Yeah, at least it's not raining. I guess >> it was pouring earlier. We had face down in the mud. >> Yeah, I know. She's She's not right. >> Yeah, I got here late. She walk out with some money. What are you doing? >> Was it the barefoot wine over there? Yeah. >> How much are those? >> I don't know. >> Just Yeah. It just >> Okay. Have a seat in the car. >> No, please. >> You're going to send my partner's going to talk to you. He's going to read you Miranda and then we're going to go from there. You're going to have a seat. Have a seat. >> Hold on. Hold on. Please pause. I have to pause. This is >> I'm really freaking out so we can talk to you. >> We can You can sit and then we'll talk to you. Okay. >> What do I say? >> Guys, you're supposed to teach me. I'm not trying >> You guys I'M NOT TRYING. YOU GUYS ARE SUPPOSED TO I DON'T >> I DON'T WHAT IF I'VE never read the right >> Can you grab our cuffs, >> PLEASE? OH MY GOD. DON'T DO THAT. Don't do that. >> Don't sit in the car. >> I DON'T KNOW. >> There you go. Turn >> turn your feet. >> Turn your feet and then let me put the seat belt on. >> Leave her without a seat belt. Put her in there. >> Yeah. >> All right. You're free to go. We're going to do an FIC, which is field card. feel that your card is simply identification. I'm going to take your picture. Okay. >> No, let me Yes. Whatever. Let's go, please. >> And then you're going to be on your butt. And my FIC is just going to identify who you are and the circumstances you're here picking up your friend that was looks like. >> Is there any way her clothing or any of that stuff can come with me? Because it's really gave you guys a search that there's no evidence in there. Nothing is prosecutable. Please. Oh my god. Jesus >> Christ, dude. >> There's nothing in her back. >> No. She has a lot of makeup. You want me to ask Lincoln before he goes if he wants to take? >> Yeah. Listen to me. You have a lot of makeup and a lot of like clothing and stuff. Do you want that to go with Phillip so that way he doesn't go down to the jail with you? Cuz they're going to cuz they can't accept all that. I I'm asking you one question. Yes or no? Do you want it to go to Phillip before he leaves? Cuz he's about to leave. Would you like your belongings to go to Phillip? Yes or no. He needs to know. If you don't give me an answer, then then it's not going to go with him. Then the gel might throw some stuff out because of like makeup, all that stuff is it's not going to be able to go in the gel. So, yes or no? She's not talking. >> That's okay. >> She's not She's not responding to me. >> Yeah, it probably wasn't the best decision to do that, but it it seems like she was already impaired, so >> go with her. So, got to go with her. >> Yeah, cuz she doesn't want to answer any questions. Gosh, >> she's not giving us any information about the pool. You're free to go. Appreciate your cooperation. I'm sorry. >> I'm sorry. I got to see this and just >> Well, you know, the good thing is she's not hurt. She's just making bad choices. >> I can uh What time you guys released at least 8 hours tomorrow morning? >> Just confirming. >> Yeah. >> Okay. She's not answering any questions, so lovely. Yeah. >> She got one bottle of prescription and she hasn't been arrested here. If she's ever been arrested, >> probable cause existed before deputies arrived. Florida statutes section 901.15 permits a warrantless arrest where probable cause is established here through the clerk's firsthand account and store surveillance confirming the theft. Illinois versus Gates says probable cause is assessed on the totality of circumstances. A clerk who checked his own cameras and watched the subject walk out without paying is not a tip. That is direct observation. She resisted handcuffing from the start. Graham versus Connor evaluates force from the officer's perspective at the moment of the decision, not in hindsight. Arm restraint and a taser warning that was never deployed is proportionate to active physical resistance. She argued throughout that her rights had not been read. Miranda versus Arizona attaches to custodial interrogation, not to the arrest itself. Deputies said clearly they were not asking any incriminating questions. They were right. An officer can arrest, cuff, and transport someone without reading Miranda as long as no interrogation takes place. The rights come before questioning, not before handcuffs. The bag search was lawful. Chiml versus California allows a search incident to arrest, extending to the person and anything within immediate control. The bag was hers. The arrest was valid. No warrant needed. Inside, multiple identity documents, different names, different social security numbers. Florida statutes. Section 817.568 makes possession of another person's identifying information a felony. No proof of use required. Possession alone is the offense. Four or fewer identity sets is a single thirdderee felony. 5 years Florida State Prison, not county jail. The misdemeanor counts, petite theft under section 812.014 and resisting under section 843.0-2 are absorbed. The felony controls. Florida's first offender act allows withheld adjudication on a firsttime thirdderee felony. No formal conviction if probation is completed. Whether that applies depends on whether those documents belong to real victims. If they do, the case looks very different. The pat down before transport was lawful under Terry versus Ohio. A subject who fought officers during handcuffing gives deputies clear, articulable suspicion to justify a safety search. Assigning a female deputy to conduct it was procedurally correct. Deputies graded a B. Probable cause was sound. Force was proportionate. Miranda was handled correctly. The search sequence was clean. The deduction, two comments telling a subject to sit like a lady after she had already corrected them. A professionalism gap, not a legal violation. Miranda attaches to interrogation, not arrest. Invoking it before any question is asked changes nothing about whether the arrest is lawful, and it does not stop a search incident to arrest. Resisting arrest added a standalone charge and extended the scene long enough for a thorough search. The identity documents were found because the contact lasted long enough to find them. Fighting an arrest rarely shortens it. A bag in someone's possession at the moment of arrest is searchable without a warrant. No protected zone exists around personal belongings once a lawful arrest begins. In this case, what was in the bag define the entire outcome?
