On June 4th, 2025 in Little Silver, New Jersey, officers responded to a CVS shoplifting call and found themselves managing two separate legal situations. One subject detained outside, one sitting in a parked car she may or may not have been connected to. The store manager personally watched a woman concealed merchandise and move toward a white vehicle in the lot. That direct eyewitness account is a reliable citizen tip sufficient for reasonable articulable suspicion under Terry versus Ohio. The initial stop was constitutional. What ran through the next hour was a harder question. How long can police hold someone without arresting them while they wait on video evidence that might never come? >> You're okay. >> No, she didn't come in the car with you. >> No, I came from the bathroom. >> You came from using the bathroom? >> Yeah. >> Just took a [ __ ] >> Took a [ __ ] >> Yeah. >> Where at? >> Right there. >> Yeah. >> What happened? >> Huh? What's wrong? >> Oh, I don't know. I just got here. >> Oh, what happened? >> Okay. All the merchandise in the back. Okay. CVS manager just called and said she watched her dump all this in the car. So, I'm going to go check the video and if you're lying, you're going to get arrested, too. >> Okay. >> Okay. Okay. >> You have a license? >> Yeah. >> Can I have that, please? >> I'm not driving. >> Huh? >> I'm not driving. >> You're in the car, aren't you? >> Yeah, I'm sitting here. >> Okay. >> Is your license good? >> M. Yeah, it should be. >> Is it suspended? >> I don't think so. >> You don't think so? It might be though. No, it should be. >> So, you taking a [ __ ] You never got out of the car, though, >> huh? >> You never got out of the car, though. Uh, >> you can you can ask the lady. She's right here. >> Okay. >> You don't believe me? Ask her. The lady right here. Ax is right there. >> Yeah, I know where she is. >> All right. Ask her. I was taking her [ __ ] >> No, that's right. What you guys doing all the way down here? >> Just driving around. >> Driving around? >> Mhm. >> Do you know where you're at? >> Yeah. Jersey? >> Yeah, I know. New Jersey is a big state. You know what's down there? >> Yeah. No, >> I'm not sure right now. It >> is a big state. >> Yeah. Ever been arrested before? >> Yeah. I mean, everybody got arrested before. >> That's not true. Not everybody. >> Oh, >> what you been arrested for? >> Minor stuff. >> Minor stuff. Like what? >> Grand fighting. >> Grandson's not minor. >> I mean minor. >> What's the most recent? How long ago? M I was arrested recently for um by the state troopers. They thought I had a warrant in Jersey. >> New York or Jersey? >> Jersey. >> They thought I had a warrant in Jersey and they made me go 3 hours away. >> Uh-huh. >> To say I didn't have a warrant. >> Really? >> So the state troopers arrested me. They tore my car. >> Uhhuh. >> Then >> cuz you had a warrant. Not they didn't. >> Yeah. Yeah. Cuz I had a warrant. Cuz they thought I had a warrant. I told them I don't have a warrant. >> The people came to pick me up. So I had to dropped two hours away. When I get there and they say, "Oh, we don't see." >> So that was like a yellow. >> Really? You got a warrant for that? >> Right. They saw me. I could have said I could. >> I mean, if you were arrested and not not having a warrant, you know what? I It was state troopers. >> They charge you something with something else on top of that or >> they charge you with something else on top of that? >> No, they just have a warrant. >> It was a warrant. It was a I was speeding. So the state trooper gave me a ticket for speeding. >> Okay. Yeah. >> He said I had a warrant in the system. So when I got there, he had me for like 3 hours tow my car. >> I got you. >> So I had to go all the way back where I got arrested from >> originally get my car. >> They towed your car just for speeding >> cuz I had a warrant. >> They don't tow your car if you're >> I was on highway. >> Oh, like a turnpike or something like that. I got you. >> I was on Gotcha. >> So where uh where in New York are you from? I'm >> from Brooklyn. >> From Brooklyn. Mhm. So you came all the way down here just to take a dump? >> No, this is a casino. >> Casino where at? There's no casinos around here. >> Little city. >> Okay. Pretty far from the parkway though. >> I know. You >> might not in your pockets. >> What you got? >> I appreciate it. >> Oh my god. What she um what she did? >> Like I said, I just got here. So I'm just here to >> So you don't know what she >> sit and hang out? I have no idea. I'm just here as backup. >> You You don't know what you did? >> No. I was taking a [ __ ] >> I really just came out the school. >> Oh, you weren't in the car when she came back. >> No. >> No. >> I was just taking a [ __ ] >> Car was empty. You weren't in the car. >> No, I was just taking a [ __ ] >> Did you see her walk away? >> No, I just seen when y'all came. >> Oh, okay. >> I literally You could look at the camera. I was just sitting there taking a [ __ ] Grant Larson the the only theft you have on your record? >> I don't have no record. I haven't been arrested in like 10 years. Oh, I see. I >> don't have a record. >> Well, if you just if they thought you just had a warrant, chances are you probably been arrested a couple years, but the case got thrown out. So, it's not really >> You have any anything shoplifting related or anything like that? >> Um, no. I don't have no She got a what? You're >> from New York, but you got a Maryland license. >> What's that about? Is he in New York suspended? >> I was living in Maryland. >> When you got it? >> They arresting her. >> I have no I just got here. You know as much as I do. Yeah. >> Why you think they arrested me? >> I don't know. I hear y commotion. I'm trying to figure out what's going on. >> Oh, is that her yelling? >> Yeah. >> Oh, okay. What's her name? >> Hm. >> What's her name? >> Whatever she told. >> All right. I respect that. >> Hey, we're just living in a Maryland deal. Huh? >> Talking about dispatch 101. >> I I don't know. >> I have no idea. >> All right. I cut down there and I got check all around this jersey. >> Yeah. You even know where that is? You've been here before? Not as neighbor. No. H >> not neighbor. No. >> Not in this neighborhood. It's a small neighborhood. Small town. >> Is it your car or her car? >> My car. >> Your car. >> Your car. >> The white car. the white Land Rover or the white super. >> I'll just I can just wait. I'm hungry. >> It'll be a few minutes. >> Oh, that's all right. I got to cross the street. >> Sorry. >> That's okay. >> So, you don't know what's in the in the back there? >> Huh? >> You don't know what's in the back? >> In the back? What? >> Back of your trunk? >> Yeah. My my stuff. >> Your stuff? Mind if I take a look? >> Yeah, I'm fine if you take a look. Okay. >> I didn't do nothing wrong. >> I know. Oh, that's what you did. >> Just came out using the bathroom. >> All right. What's up, Ashley? >> What you call me? >> What? >> What you call me? >> Ashley. >> Oh, how you doing? >> That's your name, right? >> No. >> No. Why is she telling me that's your name? >> That's my nickname. Okay. Call me as my street name. >> All right. >> What's up? >> I That's what I'm trying to figure out. I was just taking a [ __ ] I was just trying to figure that out. >> Where were you at? >> I was using radio. >> You were in there? >> Right here. Taking a [ __ ] Just >> you. All right. How'd she get here? >> Came in. >> You came here together? >> Okay. She's telling me she came in an Uber. >> She didn't come in an Uber. >> She's scared. >> Why am I scared? Don't be anybody. Everybody scared of the cops. >> Am I scared? >> Everybody scared. >> Is he scared? We're not scared. >> You're not scared right now, but >> No. >> No. So, what's up? >> I don't know. >> Did you go in the store with her or not? >> No, I didn't go in no store. All right. >> I'm positive. I didn't go in no store. I just want to take this [ __ ] You can ask the lady. You can play the cameras back. I didn't go in no store at all. I went to that store. Whatever. >> So, I'm going to go confirm that with you. I believe you. I got no reason not to believe you. I don't believe a word your sister's saying. Maybe she even is your sister. Is she your sister legit? >> That's my sister. >> Okay. What's her name? What's her first name? >> Well, she told us her name. >> She won't She won't tell us. I just need to know her first name so I can talk to her. >> What's her first name? >> She got ID. >> She says she doesn't have ID on her. No. >> I don't know what she told us. >> She's just lying to us. >> She's scared. That's >> She's lying. Then why? >> Yeah, because she's scared. She don't want to go to jail. So she >> Okay. Well, then if she's got nothing to worry about, then why is she lying? And why does she want to go to jail? Just cuz we're talking to somebody doesn't mean they're going to go to jail, right? >> Yeah. But >> yeah, you know, like you know, right 50% 80% of the time, you know, >> well, if you're doing something wrong, then maybe it might go, you know, but if you're not doing nothing wrong, >> right? >> Yeah. >> So that same thing, right? You go into the store, you do your business in there, you come back out here, your sister's walking off this way, right, when I roll up on her, right? Where was she going? >> Which of you asked me where >> I'm asking you, do you did you know where she was going? No, I I literally went to take to use the bathroom for us. I don't When I came back, I just seen y'all right here. I don't know where she went. >> Okay. So, she came back to your car. You think she put something in your car? We don't know if she put a gun in your car. >> No, she ain't put my car is locked, but she couldn't have got in my car. >> You sure about that? >> I'm positive the doors was when I soon as I leave out the car, it locked automatically. >> So, she didn't put anything in here. I didn't have a weapon. >> There are, let's see, 1 2 3 4 5 >> Oh, you can check. >> Six, seven, eight cameras. >> Eight cameras right in here. Check check check the camera. >> Okay. So, if I look at the camera and the camera tells me she put something in your car, >> would you consent to me looking in there to see what she put in there? >> No. >> No. >> But you can check. But I I promise you the camera's not going to show that cuz my door is locked. >> If the cameras tell me that, >> which I'm going to go look at the camera right now. >> Mhm. >> If the cameras show me that, are you going to let me look in the car? >> No. >> No. Okay. >> Cuz I didn't do anything wrong. >> I'm not saying it's not fault. >> I'm not saying you didn't. I'm not saying it's poor. But if she if she did something and put something in your car, guess where that falls back onto you, whether you here or not, cuz you're sitting in a car right now. >> Clear that traffic control 31 anywhere. >> She puts a gun in a car or she puts whatever in a car. That's on you. >> Oh, >> it is. That's the way it works. Unfortunately, that's the way it works. >> You can check the cameras. >> All right. Yeah, I'm I'm going. >> Yeah, you can move without working. Heat. Heat. So you telling me on a day like today you're going down to AC >> this nice ass weather. >> Go to the beach. It's the perfect day for it, right? >> Nah, it's too nice to have to be in a casino. >> Drive all the way down there. >> There's lots of stuff to do. >> They got casinos closer to New York than >> lots. PA's got some >> I don't like PA is Heat. Heat. 51 negative. >> Where is it? 10 11 North Carolina Victor Bravo Fox 2390 North Carolina. Let me know what it comes back to who the RO is, please. Where? I didn't see him going under the door. >> What's up? >> I didn't see him going under this little camera. They're still talking. >> Say that's your car. >> You say I'm not sure. >> No. Is this your car? Like you own it or you rent it? Which one? >> 2022 Genesis to that same individual. >> So, what she said, >> hes North Carolina place. >> Yeah, this is >> registered in New York. >> No, it's not registered. I can show you my >> No, I got the inspection in New York, but it's registered now. >> You got You got a lot going on. >> I can show you the registration. >> You got a lot going on. It's in North Carolina, but I just got it here inspected in New York. >> You living in New York now? >> I'm back and forth. >> Yeah. >> Military or something? >> No. >> Mhm. >> Isn't sure everything? >> I don't care about that. We're getting a video right now. We know what the video is going to tell us. You know what the video is going to tell us, right? I explained something to you, right? Mhm. By you bringing her here, but she came in this mysterious Uber according to her, which I know I know it isn't true. You know that's not true, right? And we're going to be straight. I'm going to play this straight with you. >> I already told you about >> I know you did. I know. We're going to play this fully straight. The human straight with me. And she's telling me all these stories. Next thing she's going to tell me she got teleported here by aliens. All right. But listen, if you brought her down here and you had knowledge of or we can prove that you had knowledge that she was going to commit some crimes when she was down here, you could catch a charge for that. I don't want to do that. You've been nice to this officer. You've been nice to me, right? even straight with us. All right. I need you to answer three questions for me real quick. All right. Not a Miranda. So, okay. >> Number one, what is her name? First name. All I want to know is her first name. All I want her first name is, what her street name is. That's all I need to know. >> Abigail. >> Abigail. Okay. Number two. Do you know where her ID is? Is it in a car? >> No, it's not. That's why I shouldn't have it on. >> Shouldn't have it on there. Okay. Number three. I'm going to go through this again. I went through it with you once already. Right. We're pulling his video right now. The other officers in her pulling video. And he comes back out here and he tells me that the video shows her putting some stuff in the back of your car. Whether you were in a car or not. All right. Here's what's got to happen with that. If you give us consent to search the car, you get to leave with your car today. If you do not give us consent, search the car. Your car gets impounded. We got to get a search warrant which we'll have plenty of probable cause for based upon the video evidence. Okay. Cuz like I said, you know, there's cameras everywhere. All right. So, will you consent to us to search your car? >> Totally up to you. >> Now, you said if you get the camera or what? >> So, we're looking at the camera footage right now. Another officer in the store is looking at all these cameras. All right. It was reported to us that your friend's sister, if you're legit sister or your or your friends, that's your legit sister. All right. >> Stand by. I'm not secure. >> I'm not secure. >> All right. So, he's watching video right now. You can tell me what's on the video right now. Okay. So, the two things that we can do is ask for consent to search the car or we have to impound a car and we'll apply for a search warrant with the judge, which we can probably get because the video is going to show it. All right. That's totally up to you. >> You think about it. All right. >> I'll be back with you in like 30 seconds. >> Go for 51. >> Yeah. This receipt that she has, this was from 116 and she's she not even in the building at this time. So she found it somewhere and she walked out with dub soap and candy and that's it from what we see so far. All right. I'm thinking >> I mean you got two options. >> I know it's really it comes down to So she she looking on the camera right here. H >> So we don't show that she got she got something on. Maybe she has items on. >> Does she have ID on her? I don't know. >> Items items. >> I don't know. >> Oh yeah. >> Wait. I've been here with you the whole time. Right. >> So she had Walgreens. This Walgreens. >> No. CVS. >> Oh the CVS. >> Mhm. >> Oh. >> So if she didn't if the camera don't show she took nothing, then she'd be able to go, right? I mean, I don't know what evidence they got. >> No, I'm saying like in general, if they play the camera and she don't have anything, she's able to walk away, right? >> Yeah. If if there's no if there's no probable cause, if we don't find anything that leads us to believe that she took items that she did not pay for, she'll be pretty good. >> Oh, okay. >> But if the camera shows that she did walk out with stuff in in her bag, >> which is the story that I'm hearing, that's that's what it sounds like, >> and that stuff happens to be in the back of your car. But if she so she walked out the store, right? Say she had something right here. She walked out the store with it and the camera don't show my car and say she had the items on her right here, but she didn't come to my car. No reason to be in my car. >> Well, once again, I don't know if she still had that bag. If she left the store, she got she got it. I didn't see it. So, I don't know. Maybe maybe the bag's empty now, >> but it shows that she left with a bunch of items and now all of a sudden the bag's empty and the camera shows that she came back to this car. >> Okay. I mean, there's only so many places around here you can dump a bunch of items and she took them. >> Yes. >> Maybe it was the Uber that uh dropped her off. Maybe she put everything in there. >> The Uber took you, right? >> That's probably what it was. >> There ain't no way nobody's paying for an Uber when you're down here with her. Come on. >> It cost me $50 to go like 10 minutes down the road around here at Uber. >> Coming from New York, it's probably like 100 150 at least. whom Abigail is her street name is not her real name, right? >> Huh? >> I think it's her real name. >> Street. Oh, >> okay. That's your sister you grew up with, right? So by blood or >> no like >> not by blood like >> 15. >> Not by blood. >> Yeah. >> So you know her real name. You just don't want to you don't want to indict it. >> But you know her real name. >> I didn't go to school or nothing. >> But you know her real name. >> No that's that's her real name. >> No that's what you call her. >> That's what everybody headquarters. You mark the guards. >> She probably don't want to tell you. I respect it. I respect it. >> If I was in your situation, I probably wouldn't give up the name of it. >> But like, got to try, right? I got to try. >> We got to try. >> Would we be in the way if we pulled out? >> No, just hit that car right there. >> I don't plan to. >> If you go straight back all the way into the spot, then you could probably come out a little bit easier. You get them ready for >> I do. >> Thank you. >> Yeah. She said she stole all the stuff and you did it, too. Oh, >> what? >> Yeah, she said. That's what you're telling me. I'm telling you. >> I ain't >> She's wearing handcuffs, not you. >> I ain't going to see what the video show. >> No, she's telling me otherwise. So, >> I'm just tell I'm just going to tell you otherwise. >> Yeah, she told me that that both of you. Both of you did everything. >> You see, I told you. >> I know. I know. >> I said what I told I was taking a [ __ ] the whole time over here. I told her I was taking a [ __ ] the whole time. I didn't go any >> You probably lying. You think she really said that? >> H think she really said that. >> I've been here with you the whole time. How am I supposed to do video? She was utilizing the bathroom, taking a dump. >> Okay. >> Where's the door at? >> Right here. You accident, too. >> Yeah, I was in there. I was taking a [ __ ] >> Yeah. Yeah. Listen, I don't You have to go to the bathroom. You have to go to the bathroom. Yeah, I'll show you. >> See, I told you. >> I didn't tell you. >> When you guys leave New York behind you, >> you just left it. >> Yeah. >> Yeah. You stop anywhere else? >> No. >> Nowhere else today? No. >> No other CVS's? >> No. >> No other Walgreens? No other stores? >> No. Only to make a [ __ ] >> Okay. >> Yeah, I do. >> That's all. This is the only place you stopped. >> Yes. >> You know, we got like cameras all around town, right? >> Yes. I thought you got cameras everywhere. >> Not just those cameras. Once I really like this place. >> Uh-huh. >> Okay. You guys You guys didn't hit any other stores, did you? Yeah. All right. Try not to go to L City. They have a 41 So you going to let us go to his car? >> No, because she the camera don't He said it. The camera don't show that she was in there. That's what he said. >> Who said that? >> The guy that that's your chief, the captain >> said if the camera show that she stole something and she put something in my car. >> Huh? >> Well, I get that. I said yes. The camera shows that she stole something. He said she never came in my car. >> Okay. You didn't No, he said you He said you were taking a [ __ ] I didn't I didn't hear nothing about them saying she didn't come back to the car. >> He made it clear. He said if she came to your car and it shows cuz she could have put a gun in here or whatever other items cuz he kept saying that. >> I will I consent for I said yes. I said my doors was locked. She never was in my car. >> I know for a fact she couldn't have got my car. >> And he said the camera showed she stole something but she never got in my car. >> I didn't know that. >> He did say that. So that means she still got the basic back door. >> Huh? Right out the back door. Heavy transport one precinct 2112. >> What's that? >> Give me the >> What's that? Yeah, she's getting towards the shoplifting. >> No, like the precinct. >> What's that? >> The precinct. >> Yeah, I'm going to tell you the same thing. I told her that before I'm not saying you did anything, so don't get me wrong. When I told her, I said, "Before you decide to go shoplift for a CVS, make sure the police station isn't right next door." That's how we got here so quick. >> Might want to scout your locations a little bit better. All right. Um, can we talk about all the stuff that's in the back of the car that we can see through the window? >> No. >> Okay. >> That's my stuff. >> That's all your stuff? >> Yeah. I've been in my phone. A lot of stuff. >> All this stuff is in your car. >> That don't have nothing to do with this right here. Like that's not that not what it was about. Ain't going to make it about that. >> All that stuff in the trunk is yours. All that stuff is yours. >> Come on. >> People People buy a lot of stuff at a time. Yes. >> People buy a lot of stuff at a time. >> No. You know what? I've seen a lot of people steal a bunch of stuff at one time from a bunch of different stores. >> They do it all the time. I know it. You got to go sell it to my Davis up queens of Brooklyn or whatever. >> No. Where do you sell it at? >> I like to smell good. >> You like to smell good? >> Yes. >> With men's body. I got >> to have a family now. >> You're not being straight. >> I am. Let me Let me tell you. We We met We They We had a deal. We agreed on the deal. I didn't lie about nothing. So, you know, like >> Yeah. All right. Um Why do you have a New York City Police Department tag on this car? >> A police department tag? >> Yeah. There's an evidence tag on this car. >> What? >> Yeah. There's Yeah. I'm not You're not right here. >> I'm going to show you. Yeah. >> That's because my car was towed was impound. >> It was impounded for what? I I it was sitting where it was supposed to be. >> Mhm. >> So they told me. >> Okay. >> So I had to pay for I probably never just took it off. >> Yeah. >> There's nothing wrong with my car. My car, you know, >> your car's legit. >> Yes. >> Just PS and stuff. >> No, my car is legit, right? >> Everything come back in my day. I got insurance. I got registration. >> You got a loan on it or pay for it? >> I'm financing it. >> You financing it? How much you owe on it? >> Why? >> I just want to know. >> Why? You want one of these or something? >> I'm going to take it. >> You want to take I'm going to take it. >> Where are you going to take it? >> I'm going to take it. Got a search warrant on it if you don't want to search it. >> Why? You You can't take it and search it. Why? You said she You said the camera showed that she going to come in my car. So, why would you want to? >> I didn't say that. >> Yes, you did say that. I didn't say that. >> No. No. I said the camera showed her walking out the store with a bunch of stuff. >> Hey, what else you said? >> It's on It's on the video, right? >> All right. So, what you said? What you ask me? >> You said if Let me Let me Let me repeat. >> I know exactly what I said. If the video shows We're waiting on arrested video, but she I got her right now. That's why she's under arrest for walking out of the store with all that stuff. >> And you said And you said if it shows her >> I didn't get that piece of I'm telling you. You ask me what she got arrested for. That's what I'm telling you. >> Okay. >> That's what I'm telling you. >> All right. That's what she told me. >> Taking my car for >> What's that? >> Are you saying you're saying the camera If the camera >> If the camera shows me that I'm going to take your car? >> If the camera showed that she came and dug everything in your car, all the stuff that's in the back. If she did. >> But why would you why would you take my car if I agreed to let you search it? You see, now you're >> No. See if you agree to let me search it. If you if you >> I did. I did agree. But >> yeah, but you I know I was telling you >> with the agreement. >> Mhm. >> You want to take Let's look. What you want to do? >> Take all the stuff. >> Okay. But >> take all the stuff. We take all the stuff. You leave with your part. >> Okay. That's like you said if the camera show stuff in there. >> Yeah. My same page cuz like switch it up a little bit. >> No, no, no. We're on the same page. >> No. I'm answering the original I'm answering answering your first question. What you get arrested for? That's what I'm telling you. >> All right. So, let's get the rest of this video. >> He then came back and said he don't show up. >> I'm telling like maybe you heard I did not hear that. But >> I swear he said that. >> I I believe what he's saying. >> He said he he said it don't show up on your phone. He said that. So, let me ask you something. I I I will tell you the the camera they checked is that one over there. It's for CVS. >> So they didn't check those. >> But if you see they're checking them right now. >> If you see a camera, right? I mean if you see her coming out the store and the camera showing also they didn't check like back here camera. They just check. >> It takes us longer to check those cameras. >> Okay. >> So they're checking those. >> All they saw they arrested her based off the fact that she walked out the store with all the all the [ __ ] >> So that's why I'm like why would they show the whole thing? Heat. Heat. Watch. So, what else you guys going to do? Get something Dunkin Donuts. >> You didn't stop nowhere else. No other stores between here and Brooklyn. >> Dunkin Donuts and [ __ ] >> That's it. So, only two places. >> Where you at? >> Huh? >> Why you back at? >> I know. I'm just saying usually people, you know, when they shoplift, take, you know, hit stuff up like that and take all that junk all at the same time. They usually hit multiple spots at once. So, like you guys be on a on a circuit right now. You know, this could be like your first stop. Could be like your third or fourth. I don't know. >> No. Heat. Heat. Heat. Heat. Heat. Heat. So, why did y'all stop my car? Why was Why was y'all looking at my car? >> Cuz the call we originally got said that this was the car she got in. >> The people in the store told you she got >> I don't know who who recorded it originally. >> Uh, she got in the car when she got stopped. That's >> that's that's the report we got. But >> she got came from this car that she either that she either got in or got out of this car. But what that what the car about do anything if she's over here with I don't know like where does the car do I can say anybody got out of the car but if the person is not in the car >> well at the time that we came up here >> yeah she was said the report we got was either she got out of the car or she got into the car or she dropped all the items in the car I don't know it was one of the two at that point car was using the commission of a crime >> because what somebody said >> h what somebody doesn't report it but she said she >> but I mean you told me that she came in the car with you so >> she had come in the car but I'm just saying like the story is not making sense to me cuz y'all got to report that she got out of a white car but she's Oh, she wasn't even out by the car. Like, if if he still ain't see the the camera, the video showing her putting stuff in the car, there's no way the report came in that she got out the white car cuz you would You can't even The video would show that. They They a look at the video. >> She got they they looked at the video inside the store when she walked out with the bag full or whatever she had. I don't know what she had, but she had something. >> So, they looked at the video and then said that they went to this car. >> No, that's what he said right now. That's why he said I came from Yeah. came to my car and not from my window and jump. Like why? She's over here >> cuz like I said, the report came in that she either got out of this car or she got into this car. >> One of the other. >> But when you pulled up, she was over here. >> I pulled up how many minutes after they were talking to her, right? >> Like I was probably the last one that showed up over here. >> Okay. >> So like between you and me, I only got half the story. Well, if I wasn't in the car, would you >> if you weren't in the car? Nobody's in the car. >> Wait, you just going to leave it? You going to abandon it? >> Yeah, I would have just took her >> h took her. >> Took her. >> Well, yeah, cuz she I guess she had whatever she had on her. This just This is what I'm getting from it. I guess she still had something in the bag. >> So, because I was here, that's why y'all came to my phone. cuz the report came in that she got out of >> No, because I was sitting in the car saying like Well, I wasn't never in a car. Nobody was in the car and she was just >> Well, no. We still be sitting on the car. Just I wouldn't be sitting here talking to you. We just be sitting here looking at the car checking the video and then if it shows that she came back to the car, we took >> Mhm. >> So, unfortunately, you just happen to be sitting in it right now. Why would we have a New York end time? >> What you say you got to for not not paying the parking ticket? >> No, we never got told for that. You sure what that is? >> Says New York City Police Department. >> Oh, I know what that was. I know what that was. I know what that was. I It didn't get It didn't get sold. They drove off of it and gave it back to me. I know that. That was a while ago. >> PD drove off of it. Yeah. >> What do you mean they drove over? >> They arrested me cuz I was in the car. >> Ah, so are you saying kind of similar to what's going on right now? >> No, no, they didn't. No, no, no. They didn't. They came back to me the same day. >> Same day. >> Yeah. They wanted to check my car and I didn't let them check my car. So, they was like, "All right, everybody in the car going to the pre." So, we got to the precinct. They >> But they towed it. >> They didn't tow it. They they drove it to the precinct and then when they released me, they gave me my car. So, they're fighting with me. >> All right, bro. They delivered it for you. Like as soon as you were done with at the at the precinct, you car was there waiting for you? >> Yeah, that was nice of them. >> It was nice. >> We didn't find nothing in my car. It was nothing. >> Oh, they searched the whole thing. >> Yeah. I didn't want >> I get what you're saying. They took it. They got a warrant to search it. They searched it. They didn't find a warrant. They just do what they want. You know that you didn't have a >> warrant. New York and New Jersey everybody. >> That's what it was. That's I'm like Yeah, that's what that was. That was a while ago. >> So technically it was impounded but they gave it back right away. >> I mean I guess they you know that was it wasn't Yeah. They thought it was something in my car but they went to my car. >> Was that was that a shoplifting thing too? >> No. >> No. Completely unrelated. >> Oh really? >> Yeah. >> But like you said you haven't been locked up in like what 10 years? >> Yeah 10 years. >> So that was 10 years. 10 years ago that happened. >> No. No. No. That didn't happen 10 years ago. >> I told you they took everybody in my car cuz they wanted to search my car cuz I had sex. >> They was they took Yeah. That's why they took my car. >> So you've been arrested. >> Yeah. But I wasn't charged with nothing. It wasn't like I did a crime or nothing. >> So I don't really call that arrest because >> No. See, but there's a difference between arrest and being charged. Like if you don't go to court and deal with that's that's whatever. Did you get put in handcuffs? >> Yeah. All right. That's arrest. But >> you got arrested. You got charged with something. Maybe the charges didn't stick. But like you got charged with something. >> Yeah. They do. >> Yeah. >> I see. I see. >> That's sticking from it. I like that. I like I like I like how you play with the language. You're just like That's nice. >> It was >> I like that. Technically, you're not wrong. You know, >> yeah, they got to do anything. I told them no. I'm like, "No, you can't search. >> It's not going to It's not going to show up. I go look up your name. It's not going to show up." >> I look, >> you know, we can still see that though, right? >> Like if you get arrested for something sticking, right? >> Yeah. You Oh, you got finger credit, too. >> Everybody get fingerprinted. That's not true. We don't fingerprint everybody. What? >> Well, ain't that a part of the rules? >> No. It's civil crime. We just give you like a ticket and take you handcuff. You're getting fingerprint. >> No, not true. >> Really? >> Not true. >> If I arrest somebody for like driving drunk, you don't get fingerprinted. >> Really? I thought you get fingerprinted anything. >> Not in Jersey. A little bit different. >> What you get fingerprint? >> Something that's an individual crime. So like New York is a misdemeanor. All right. You don't get fingerprinted for a misdemeanor, right? >> Yeah, you do. You get fingerprint for anything. Yeah. >> Yes. If you get your handcuffs and you Yes. Even if you get a DAT, you're getting fingerprinted. >> What's a DAT? >> Like a the um death penalty. Like you get released. >> They they take you they they take you and fingerprint you. >> Yeah. Yeah. We don't we don't do that around here. >> New York's different, bro. Yeah. Jersey different. >> That's true. Are you telling me you won't let me in the car unless it shows in video that she came back to the car. That's the only way. >> Yeah. Why? That's the only reason I need to let you in. >> That's it. >> Like, do you think she can put something in here? >> I told you. >> So, why would you taking a [ __ ] Cuz I don't have to. If if you >> No, you're right. You don't have to. There's no reason for >> I mean, it would solve a lot of problems though cuz if there's nothing in there that you didn't take, >> if the camera wasn't shoplifted, >> if the camera showed you >> and you showed it to me right now, >> if the camera show that she put something in here, >> yes, I will allow you to treat. No problem. The camera doesn't show that. And I want to see the camera show cuz I I can't see. >> I mean, I I can tell you right now that we're not going to clear the camera. >> I just >> cuz that's that's part of evidence. >> Yeah. But then how So where do we meet at then? >> I can say anything. I could call right now and say, "Oh, this guy's robbing this lady and and he went in a black car." >> Anybody can say anything. You know what I'm saying? Like >> but being honest honestly like I'm giving you honesty. If it shows that you have the same I want you to be honest with me, too. I know it don't show up because I was in the store. My car was locked. There's no way she could have put something in the car. And if she would have put something in the car, she would have been in the car. She wanted to stand right there where y where they stopped at. >> Unless she dropped it and then walked off cuz she didn't want people to think that she came to back to the car. You know what I'm saying? Cuz at that point >> cuz like 2 seconds after we got the call, we were here cuz like the police station's right behind this building. >> That was that would have been too fast. Y'all would have called in the car. But you know what I'm saying? It's the math like >> timeline. I got it. >> Like 2 seconds. Mhm. >> She must have flew and landed in in the car for 2 seconds. >> She could be quick. >> I don't know. >> If she was quick, she would have car and she was that quick. >> 2 seconds. >> No, got the evidence and run off. You know, that's what I would do. >> But whatever she stole, right? >> Realistically, whatever she took. >> It sounds like whatever she took matches whatever was in the truck. >> It doesn't match that. That's not >> what you're doing. >> That don't that'll match that. Whatever she took, the camera's going to show exactly what she took. Right or wrong. It's got to show what she took, right? >> Yeah. I don't know what cameras they see it on. I mean, they >> are you not being like for real cop? >> Turn the cop over real quick. >> There there's one camera that looks down the aisle. You're not going to be able to see exactly what she took, but you're going to see her taking >> You're going to see you're going to see her keep exactly. So, >> you can tell if she took a lot of stuff. You can tell she took two items. You can tell from the camera cuz the camera's going to show. So, you even when she's leaving out the store, you're going to see how much stuff she had. So if she if it match what she have on her be for real, you know, like it's going to show real. >> Maryland. >> Where do you stay at? >> New York. >> New York. >> Mhm. >> All right. Maryland. >> Maryland. North Carolina. You Raven fan? >> Hell yeah. >> Better be. Hell yeah. >> That's where it's at. >> Hell yeah. >> All right. >> Listen, Ashley, I appreciate you uh somewhat answering what I'm asking you. I know what's going on. We both know what's up. Okay. I got nothing else to hold you on. >> All right. I've been straight with you. You've been straight with me. >> You know, I wish you'd tell me a little bit more, but I know you got to do what you got to do for you. Yes. >> All right. Now, with that being said, I got no video of her going in the car here. Okay. So, I can't search your car. Can't do it. I know what's up with the stuff in the back. You know what's up. He knows what's up. We're going to leave it at that. Okay. What what's going to happen is we know who you are. We know who We'll find out who she is after we fingerprint her. We're going to put a bullet. Now, if anybody's seen you seen you guys in the car involved in any kind of shoplifting stuff, so somebody might show up somewhere looking for you. All right. But that's where we're at today. You beat you beat the system today. She didn't. You did. All right. Um, completely off the record, has nothing to do with our interaction at all, but I want to try to give you a little bit of guidance with her. Right. Has she gotten locked up before? >> Oh, >> you don't know? No. >> Okay. >> All right. Because depending on the way it works in Jersey, you ever get locked up in Jersey? >> Yeah. >> Okay. So, you know how it works. You get your score depending on whether or not you go to jail or not, right? So, that's what we got to do with her. I'm kind of going to lean with if she really doesn't have any kind of late violent history, she's going to get released from here. Do you want to hang out? Wait for her. And I'm not like trying to I'm not trying to trick you into hanging out. All right. I'm just being legit so she's not stuck down here. Like if it's your girl, it's your girl. >> She call me. >> Okay. All right. You got all her stuff. >> Mhm. >> Here you go. >> Thank you. >> All right. Back and forth. Where's your car at? >> No, you don't have a car. >> How did you get here? How did you get here? Uber. Somebody else. What's that? Your sister's card. What's your sister's name? What's your name? >> I just don't know what her name is. What's your name? What's your name? You know what happened? I know what happened. >> What's your sister's name? >> It's Ashley. >> Ashley. What's your sister's last name? >> What? This is my sister. >> What's your sister's last name? Simple question. >> What's your name? >> What is your sister's last name? >> Real simple question. >> What is your sister's last name? >> I'm telling you, you know, you know my name. Like I don't I don't >> I'm asking I'm asking you what your sister's license. >> This is This is your credit card. >> This is This is a lot. Give me a credit card, please. I'm >> I'm not giving away your card. Give me a card, please. What are you doing? >> Give me this card, please. >> It's not your fault. We know it's not. >> This is what >> we know it's not your card. >> Why are you telling me that? >> Let me see the card. Then why won't you let me see the name on the back of the car? >> Because she hit to Eva. >> Just let me see the name. >> Well, no. Right. Let me see. >> It's on boot or nothing. >> What? >> What? Like go and obviously like >> because we're trying to figure out what just went down at CVS. I know you bought some soap, but what else can you put in this? >> It's just soap. There's nothing. >> There's nothing else. That's right. >> It's soap. >> And where's your car? >> I don't got no car. Where? >> There's one, two, three, four, five cameras here. >> Five cameras. >> This is soap. You bought soap. You bought soap and five cameras. >> A bunch of other stuff and you didn't buy it. >> No, what? >> And there's eight cameras in CVS. >> Okay. Why don't you put yourself down on the ground? You got anything on you at all right now? Needles, knives, guns, hand grenades, anything good? >> Okay, let's walk over to this park. We'll walk over. Put your stuff on the motor, please. Let's go. Put right here on this. All right. Put your money down. Put your credit card down or your sister's credit card down. What the f it is? Put your stuff down. >> Put your stuff in hand right now. Put your stuff down. Put it out of your pockets on here. Empty your pockets on your back. >> Empty your pockets. Uber. >> Empty your pockets right here. >> Empty your pockets up there. Put everything right up here. Put it Just put that under your phone. Put that under your phone. Do you have anything else on you? No. >> Okay. You're not under arrest right now, but you're being detained. So, this just get handcuffed. Put it back in a back in the police car and we'll be back with you in a few minutes out. You're wearing a sweatuit. I'm good. Turn around. Turn around. Put your hands behind your back. >> Put your hands behind your back. >> Put your hands behind your back. Put your hands. Put your hands behind something right from CVS. If not, right? >> We're not saying anything. >> We're not saying something in the car. It's very easy. We're just going to pull the case. We're going to watch it. And now in mom's county we can charge you just like that. >> For what? For camera what? For them. I'm not spilling no. >> Turn around. >> Turn around. >> Turn around. Just turn around. Put your hands behind your back. >> I'll stay right here. I'm >> No, you're going to turn around. Hands behind your back. Put your hands behind your back. Okay, turn around. >> Otherwise, you can just grab an obstruction charge. Easy enough. >> It's very simple. Come on. Turn around. Turn around. You are detained. You are detained. You are detained right now. >> You're not getting arrested right now. You're being detained and that's why you're okay. Turn around. >> I'm making a mad turn around. Turn around. You're making turn around. >> I'm not going to pause. I'm staying. What? >> What the manager doing? Who cares what the manager is doing? >> Why are you worried about what the manager's doing? >> Because I want to know what happened. I want to know what happened. >> You want to know what happened, too? >> You're not going to. >> You have no idea on your own. >> What? >> You have no identification on your own right now. >> You have identification of your car over there. >> What car? I don't car over there. You just put all that stuff in. What do I call white? >> Okay, listen. Listen, it's so simple. Just watch the video. Just go over here. Come on over here. Go this way. >> So, I'm breaking. >> Just take the car. I want to stay. I want to stay. Listen to me. >> It's It's man hot in there. It's very hot in there. >> The air conditioning on No, I'm good. >> Just get in the car. >> Get in the car. >> I'm good. >> You're going to catch an obstruction charge. I'm telling you. >> Sit in the car while we got 30 seconds. >> I'm here to tell you what you're going to get charged with obstruction. Okay. >> All right. So, chill seat in the back. Get in the car. So, so this thing at this point this just just [ __ ] with what he's saying. Okay. So, get get in the car. You're making it difficult to get in the car. Just get in the car. >> Get in the car. I'm going to go out the precinct. Go ahead. Have a seat. >> Come on. Get in. >> Have a seat. Said she ran that one of them ran in there. I didn't see something in the bathroom. I didn't see anything in the bathroom. 50 garbage cans and everything like that. There's all toilet paper and stuff, but one ran. >> Yeah. Went in there. You want to ask me if they were good. I don't know if they watch. Which which one? The one carrying the camo bag or a different one? >> The black girl. >> Well, there's there's more than one. >> Okay. Well, I don't know. I didn't She did. >> Did she have a bag? Does she have a bag? >> She had a ponytail. >> No, she had a ponytail. She had >> No, I didn't see her. No, I didn't. She did not have a bag. >> The bag would have been like a large camouflage bag. >> Like a pretty good size. You see it? >> Yeah. I didn't see your bag. >> It's like It's like the size. No, no, we have the bag. But I'm saying I I want to know which one came in. Uh, it's like the size of a flag. >> No, it was a young girl with the ponytail. >> With a ponytail? >> Oh, all right. >> In the bathroom, who? >> Nothing. >> No. I gave him the the the thing where he went in the garbage, >> but she I didn't even see her. They told me somebody's in the bathroom. >> I was over there and I saw somebody at the corner of my eye running in the bathroom, but I didn't see who it is. And Greg was out here sleeping. >> Did they Did they know exactly where the bathroom was or like they had to ask? >> I don't know. Yeah. Like did they say like, "Oh, where's the >> No, >> they didn't ask. They just knew." >> They They just knew like where to go. >> Yeah. All right. >> But I'm looking. >> All right. Thank you. >> [music] >> Get in the car. >> You want to go to the priest? Come on. It's hot. >> I know it's hot. >> It's not hot in there. >> It's not hot in the car, though. The air conditioning on. You can feel it from here. Have a seat. >> Come on. Is that hot? >> It is hot. Go sit in the car. >> Come on. Sit in the car. Let's go. >> No. Okay. You're going to catch an obstruction charge, too. >> Right there. Who? Who? Manager right there. What the manager? Can I go speak to the manager? >> You don't need to speak to manager's one who called us. >> All right. So, what are you saying? >> We have to go talk to him. That's why you need to sit in the car. >> You got to talk to him. >> Just get in the car. >> We are going to talk to him. Get in the car and let's sort this out. >> Air conditioner's on. I'll turn it up higher so nicely in the car. 98. >> If he or if yes or no. Let's go. I can't talk to him until you sit in the car. >> Go sit in the car. >> I know you're watching your friend over there. Come on. Go sit down. >> I don't know what you thought. We my friend looking at over here over there. What's your mind? >> I No, I can't. I just came over here. I just came over here. >> You by yourself? >> You come with anybody else magically appear here? Did you here? Did you you just teleport? Yes, I got you. Uber. >> Uber. What kind of Uber did you get here in? I got it over. >> Okay. But like what kind of car was it? >> Why you want to know? Cuz we're going to check video. >> We're going to check the video. >> There's cameras all over the car. >> There's cameras everywhere. All right. So, if you tell me what kind of car you came in in an Uber, it'll make it easier for me to track your movements and find out what happened. >> So, what kind of Uber did you show? >> I don't know who you talking about. I don't know what car you talking about. I don't know what you told. >> Okay. >> I'm kind of >> What kind of Uber did you get here in? >> A a black Uber. >> A black Uber. That's really really general. >> Yeah. >> Okay. Listen, I think that we're being very patient right now. I need you to sit in the car. Okay. >> I'm I can't stand. I I get I I start getting like >> You're going to play a game now. You got to go to the hospital, right? Cuz you're getting upset now. Just kidding. >> That's what I'm saying. That's what I'm That's >> what you're going to play right now. >> I thought it is a game. Definitely. >> So, wait. Close the door. >> We can't talk to the manager until you talk to the manager until you sit in the car. If you sit in the car, it'll make our job a lot easier. Okay. >> There's a lot of room back there. There's probably more room back there than >> It's not hot. The air conditioner's on. >> I just stuck my hand in here. It's fine. It's cool. Let's go. Get in the car. >> Get in the car. The trick right now. >> There's no trick. There's no trick. >> We're not disputing this. Come on. We're done. >> Get in the car. We're done. You get in the car or we're going to put you in a car. It's the way it is. What are the manager doing? Can you speak to the manager? Speak to the manager. >> You put yourself in a car right now. Put you in a car. Then then cameras around. >> Yes, there's cameras around. >> We We have cameras on, too. Okay. >> Y'all cannot touch me. >> We We >> I'm getting detained. I'm getting detained. >> You are detained right now. Sit in the back of the car. >> I'm not going to sit in the in the in the back car. I I start getting I don't like >> Where's the key fob for your car over here? >> What key? Like, what are you talking about? >> Where's the key for your car? >> I don't know what you're talking about. Why are you making this difficult? >> I know we got to talk about who called. >> Do you think Do you think the manager just made it up and called us? >> Who caused that? >> Who caused what? >> Yeah. What? What? Who calls that? Who caused what? >> I just told you the manager called the police. >> Say what? >> That you just shoplifted from the store. >> Shop the receipt right there. >> From CVS. >> The receipt right there though. >> Yeah, the receipt's there for some of the things. Yeah, exactly. >> Yeah. He said he came out with a huge bag of stuff. >> So, until I can see a video. Okay. And if he's lying, >> he is lying. >> If he's lying, then guess what? He's going to have a problem if he's lying. >> He is lying. >> Okay. >> What? So, where? So, where where's that 2.5? >> I need to go talk to him. >> I gave 2.5. >> 2.5. What? >> Y'all came. He He came in the be right here. He said, "Hey, did I jump? Did I do that?" No. He came out to you right there. >> The manager did. >> No, I'm not talking. I'm talking about the the cops. The cops and said, "What? What? What does that have to do? What does that have to do with why we're here? We're here because the manager called saying that you shoplifted, gave your description and said that you walked to that white car there and all all the merchandise that's right in the backseat of that car." He said, "You dump back there." Okay. >> He's the [ __ ] lion. >> Okay. Well, he's right there. He right there. Go. Go. He right there. I have to go talk to him. But I'm not going to talk to him until you're sitting in that car and secured. >> Exactly. Look, look. See? Look. See? Speak to him. Speak to him. >> Can I Can you wash her for a second? >> Yeah. Speak to him. Yeah. Speak to him. Ain't no dog no bag. I got to see all this on video now. First of all, she went through the ACL and she paid for the soap and candy. >> She had a receipt for something, but I haven't looked at it yet. But she has no receipt for the soap and candy because it was not even transaction at that time. >> Okay. So, let's go see what she You have her on video. >> Do you have her on video um taking things and walking out? Do you want me to? >> Well, she's going to round the corner >> cuz there's a bunch of stuff in the trunk. I don't know if it's all from here or not. >> No, no, it's probably from somewhere else, but Oh, did I mess up? I totally did. >> Yeah, it's >> I'm videotaping her the wrong way. >> All right. Yeah, just go pull it up on video real quick cuz we have to We're going to keep her detained until we actually physically see it. >> Do you want to go back out that way or >> Yeah, I'll go that way. Ain't no dumb no bag. I should have [ __ ] no [ __ ] bag. Like come on. Who [ __ ] white car is that? >> If I b I would >> You don't know whose white car that is? >> Yeah. >> Okay. >> You know [ __ ] bags and stuff. I should do that. >> See like come on. I should have. Hey, who who the [ __ ] is that? Who is that? That's a cop. That's another D. Y'all came dick. Mhm. For [ __ ] shoplifter. Y dead ass. Yeah, we take it seriously around here, right? And considering the police department's on the other side of this building. Who? >> The police department is on the other side of this building. >> Oh, for real? >> Yeah. >> Oh, that's King 2.5. Mhm. So it's literally right on the other side. >> Like where like where where is that? Like that is making it very difficult. >> So you know I mean this could be a petty disorderly person's offense, a disorderly person's offense depending on the amount that was taken. >> It was not no m >> three stuff. Yes. Three not a lot. Three stuff. Three things. >> Three things. Yes. >> Okay. >> Can you saw the camera? >> Not yet. He's pulling it up now. >> It's not that quick. >> It's an incident. What? >> It's not that quick. He's got to go pull up this footage. >> So, so what are y'all talking about? What yall was talking about? >> He's got video of you in the store. I just saw that. I'm getting the video out of the store with merchandise. You didn't pay for anything. >> They're saying you didn't. >> What? Let me see right there. Let me stay right there. No. Yeah. Your friend got it. I'm going to go look. >> The receipt's there for like three items. >> The receipt's there for three items, right? >> Yes. Exactly. >> Right. >> Exactly. No. >> What kind of candy is that? >> Sour Patch Kids with a purple bottom. That's what she grabbed when she was in the candy. She's going to fill the bag. The other soaps are in here. >> Mhm. >> And then she'll walk out. >> Are you able to barcode like Cuz that's I think still might be on the hood of our car. I don't know. I got to look. Rodriguez versus United States drew that line. A stop cannot last longer than reasonably necessary to resolve its original purpose. Ashley was held nearly one hour without an arrest. That is where the constitutional tension sits in this footage. Ashley refused consent to search his vehicle 14 times across 40 minutes. Under Schneckloth versus Booamonte, consent must be voluntary, and the specific way the officer framed the choice deserves closer examination. The officer told Ashley, "Give consent and you leave with your car today. refuse and the car gets impounded while officers seek a warrant. Tying consent directly to whether a person keeps their property is the kind of conditional pressure Schneckloth identifies as potentially coercive. Ashley kept saying no and the refusal held because no video evidence ever supported a warrant. But the constitutional question about how that consent environment was constructed does not disappear simply because the final outcome was correct. Abby Foster was handcuffed and placed in the rear of a locked police car before any formal arrest was announced. While sitting there, officers asked her name, how she arrived, and who she came with. Miranda versus Arizona requires warnings before custodial interrogation. Burkimer versus McCarti confirmed the test is whether a reasonable person would feel free to leave, not whether the officer has formally said the word arrested. Handcuffed in a locked police car is custody. Any statement Foster made in that pre-arrest window carries a suppression risk. The formal Miranda adisement came only after the arrest announcement, roughly 1 hour and 17 minutes in. That timing gap is something prosecutors would have to address before any of those statements could reach a jury. Foster also refused to give her name the entire time. [clears throat] In New Jersey, that was legally defensible. The state has no stop and identify statute. Unlike 24 states where such laws have been upheld under heel versus 6th Judicial District Court, New Jersey cannot compel identification during an investigative stop. The shoplifting charge is solid on the elements. New Jersey statute section 2 C2011 requires purposeful taking of merchandise without paying full retail value. Store camera showed Foster placing Dove soap in her bag. The transaction log confirmed no payment during her visit. The receipt she carried was timestamped 1:16 in the afternoon and the manager confirmed Foster was not in the building at that time. She had picked up a discarded receipt from the selfch checkckout kiosk. It collapsed the moment officers checked the time stamp. Merchandise under $200 keeps the charge in municipal court as a disorderly person's offense with a statutory maximum of 6 months in county jail. First-time offenders in New Jersey typically receive conditional discharge, no conviction, no incarceration if conditions are completed. Officers recovered a card from foster bearing someone else's name. New Jersey statute section 2C 21. Six fraudulent use of another's credit card is a fourthderee indictable crime carrying up to 18 months in state prison. moving the case from municipal court to superior court. Foster also gave false information about her identity in transportation repeatedly. New Jersey statute section 2 C293 covers hindering apprehension. The shoplifting alone was a minor offense. The conduct during the investigation built a significantly larger legal exposure on top of it. When the camera review ended with no footage placing Foster at Ashley's vehicle, officers had no probable cause for a warrant and no legal basis to seize the car, Ashley was released. The Fourth Amendment worked as designed refusal held because the evidence never came. [clears throat] The lead officer receives a B. He honored the refusal when the video produced nothing and read Miranda correctly at the arrest point. The conditional consent framing and the pre-arrest questioning of Foster inside the police car are the two marks against an otherwise competent investigation. Ashley receives a B+. He said no clearly under sustained empoundment pressure for close to an hour and the refusal produced the result the Fourth Amendment exists to produce. One note disclosing prior arrest history was voluntary in future stops. That information is better kept to himself. Foster receives a D. The shoplifting was documented entirely on camera before she said a word. Every statement during the investigation added charges. The false receipt, the refused identification, the card in someone else's name, compounding a situation that started minor and ended somewhere more serious. Three things this footage makes clear. The right to refuse a vehicle search works in practice, not just in theory. Ashley said no for 40 minutes under explicit empoundment pressure. The camera produced nothing and he drove away. Miranda protection attaches when custody begins, not when the officer formalizes it. A person handcuffed in the rear of a police vehicle is in custody, and questions asked in that moment require warnings first, regardless of whether anyone has used the word arrested. Every statement made during a stop is usable. Silence cannot be introduced as evidence of guilt. What a person says can be. Ashley knew that distinction and applied it. That is the most practical thing anyone can carry out of an encounter like this one. Let us know if there is an interaction or legal topic that you would like us to discuss in the comments below.
