April 15th, 2023, De Moine, Iowa. Officers responded to a late night domestic disturbance, and Iowa's mandatory arrest statute governed every call they made from the moment they arrived. >> Did you call? >> Yeah, I between them. >> Um, who's them? >> My brother and his girlfriend. >> Yeah, that's his girlfriend. We were over at uh my parents house cuz I'm watching them. They're in Texas right now. >> Mhm. He gave me a call saying this this hit me bleeding and stuff. Ended up dropping her off on the corner down there. She was like grabbed the steering wheel and stuff trying to swerve. >> So this didn't happen here. >> No, this happened like four blocks down. >> Okay. >> And uh she was hitting him in the in the face. >> Why are you here? Because I Well, my brother's inside. He called me and he wanted to make sure that somebody was here just in case she's acting. >> So, this happened somewhere else and now my parents who lives on Wakanda on the way here just about 2 hours ago and we're trying to get a hold of her parents cuz we did not want to call the Costco. She refuses to cooperate or anything and she's kicking stuff off the boards. I saw her stuff on the board. She did not say nothing. Yeah. Okay. >> Who are they? And who are they to each other? Girlfriend, boyfriend? How long? Uh, off and on since they were a little younger, but she's been out here for about a year, I think. Okay. Together. >> Yeah. Man, my brother is on the floor. Yeah. Yeah. What's her name? What's her name? Hello. pretty easy. It's not like my boyfriend kicked me out. Um I don't know what you guys >> What led up to that? Why did he kick you out? >> Well, because >> what what led up to that? >> We got into a fight and he kicked me out. So, you guys need to save me. I just don't know where to go. I'm sleeping here. >> Let's figure it out first before we start talking. >> What What happened tonight? Like why why are we here? >> What's What's boyfriend's name? >> So is it is Isabelle? Is that your full name or is it just Izzy? Isabelle. >> Yeah. What's going on? So, moral of the story is I'm kind of stuff right here. I'm just trying to get her out peacefully. >> Okay. Does she live here? >> She lives here, but lease and death a few times and you know, like I don't I don't know what to do. >> Well, you know, you know, you can't just throw her stuff out and get her out. She's got a right to be a peaceful option. I know I know I understand from your perspective, but you don't understand like how peaceful an option that gave her. I didn't act like I didn't like I didn't keep out or like grown like that. That's all her. I said herit as far as likely as a man. I said her [ __ ] nicely. I got there and I'm like, "Hey, bro. Like you got to go." Like this has been an ongoing thing. She's been here multiple times. >> What happened tonight? Just let's get to the bread and or meat and potatoes here. >> So, where where do you want to start? >> I want to start with where some sort of assault took place because >> that's what we're here for. >> I'm driving on South Union trying out my parents live on Wani Drive. Mhm. Which is where our brother was. My brother Cody out there on Drive. I drank a beer and she drank a beer. >> How much you had a drink tonight? >> What? >> How much you had a drink tonight? >> I've had it quite quite a bit. I've had like two drinks at home. This is in my fridge, which was not >> You've been home for like 2 hours, right? Like this happened like 2 hours ago. >> Probably like it's 1:30 in the morning. >> Yeah. Right about 2 hours ago. So, we're driving across South Union and she's arguing with me about what me and my brother were talking about and what she was talking about. Okay, man. What is there to talk about? Thank you, sir. Is it Sharky? Is it Are you able to shut down the way? >> No, I got another officer out there talking to her. I want to be I want to see him. >> So, uh, she's driving and so I turn crazy and she kind of stop. I don't know which one of these trees I turn. I stop. I just turn cuz I'm pull over on the right side of the road. I stop doing her office. whatever when I turn on and then she starts popping me a couple more and starts grab off me like at that point when I'm trying to turn me and I'm like almost for a minute to try to like stop boom stops the truck in the middle of the street like in the middle of the street kind of like you are not going to hit me in the middle of the street and she goes okay so we keep driving a little more she spits on my face as we're coming up the hill I think it's southeast spit right up there by I didn't go. Um, so I my phone or her phone technically, which I paid for, which she's already smashed my phone. That's Patty stuff. I know. Uh, so I tell her to tell her phone card. And I'm like, okay, you want like Patty, go home. Like, get your phone. I'll have your [ __ ] packed up by the time you get home. Shut up. Go home. We've already done this multiple times. She has a court case. We're trying to team. I'm like, girl, you got a court case. Literally, I'm hurt. Uh for uh I spoke to two police officers in this apartment. >> So you have any marks tonight? >> Uh I uh do >> you see that? >> Yeah. Those are >> I think I have a couple. That's from me getting my tire guns off. [ __ ] on your wrist. >> Uh she did leave. I think these are old. >> What was How was she hitting you in the car? Uh, literally like this like the palm of her. >> Yeah, she has she right or left. >> Uh, that would be her right. You think she reached all the way? >> She reached all the way. But I'm not She's How many times did she twice at the house? >> So, you guys get into a little bit of a fight. Um, did this happen here? Where did it happen at? >> Happened like in like on this on this street. I don't even know what street. So you guys were in the car when this happened >> driving. Okay. So tell me a little bit about this fight. Was it just arguing or did he get physical? Did he lay hands on you? Did you lay hands on him? >> I put my hands on him. >> Okay. >> And then what? Then he like put my he threw my phone out in the in the like at a stop like he threw my phone out. I got out of the car to get my phone and he drove off and I walked home and then all my shit's out here. He won't let me go inside to go pee. So can you guys just like take me to jail or something? Like do whatever you want to do. I don't know where to go. So I really want to pee. >> Breathe for me. Okay. Breathe for me. We're We're just learning what's going on. No one's going anywhere yet. All right. So, what led you up to to hitting them? Did he touch you first and just kind of a self-defense deal or did he say something rude and you snapped on him? What What happened there? >> He didn't put any hands on me. >> Okay. >> At all. >> So, >> so why'd you hit him then? Because >> you're just mad at him and snapped. >> Yep. >> Okay. So, you and How long have you guys been together? >> We've been on and off for a few years, but like we just talking wise. Well, we've been together for like a year just straight on. >> Okay. >> And you guys, >> he didn't do anything wrong. He was just all me. >> Okay. >> So, >> well, takes takes a big person to to own up to mistakes. You guys both live here together. >> Yeah. >> Okay. Okay. How long have you lived here together? >> Almost a year. >> Okay. Been together about a year. Lived here about a year together. Do you guys have any kids or anything? >> No. >> Okay. Is Is he okay in there? Is he injured? >> Um his brother said that he had a cut on his lip when he came here. So he can see if he has one. >> Okay. >> If he didn't do anything wrong, it was me. >> Okay. Have you guys ever had a physical altercation before? >> Um, not really. Um, I do have a thing where like I'm obviously I'm going to get in trouble for this. Um, one time I was like drinking and then I started acting crazy. He thought he said that like I was acting possessed or whatever. So he called like my family and he asked what to do and they said to call the cops which is like almost like a sick sword because I I was active possessed but like he called the cops and they came here and then all of a sudden like I don't remember this but he said and the cops said that I charged with the cops >> and they took me. >> Okay. >> So I spent the night in jail already before. So >> Okay. >> But I don't remember it. All right. >> That's okay. So, it's uh Isabelle, right? Is that I S A B E L? >> Yeah. >> And what's your last name? >> N O C E L O T L >> N O O C E >> N O C E L L O T L >> L O T L >> Yep. >> How do you say that? >> Don't say the T is silent. >> Okay. So, N O C E L O T L. Okay. What's your birthday, Isabelle? You got your phone back, looks like. What's the phone number to reach at? I'll tell you what's going to happen right now. Let me go check on and see what he's saying and then we'll uh we'll see about you using the restroom. All right. And we'll go from there. Does that sound like a plan? Okay. You seem like a like a decent gal. You're not going to try and do anything crazy, are you? Okay. >> Okay. >> Is he got your idea on you? >> I got her info. I got her info. Okay. She's got to use the restroom. >> I know that. I'm just like, can I should I let her in? I'm not trying to be like, but like I'm getting beat up. Like, should I let her in or should I just keep her out? Like, I don't know what to do. She can't mail you. Like what what can I do besides how long you been in domestic violence? Sorry language. I don't know what to do, bro. Should I leave or like around my apartment? It's like what do I >> No. So here's the deal. You guys are in a domestic relationship. >> I'm sorry. I'm sorry. Can I talk? Thank you. >> Yeah. So yeah. So you're obviously but so 2 hours ago you were driving up One of our ladies after Southbound for 2 hours we were trying to call her sisters mother whoever we call we were literally trying to end this uh peaceful resolve like we were not like it took 2 hours to drive at this point. So >> okay so what does that mean? We're going to facilitate her using restroom. never sorry for us Izzy, here's the deal. All right. Tonight, you have to come with us, okay? >> Um, appreciate you being cool with us. Obviously, you owned it from the stake, but uh, you got a job to do, okay? Go and stand up for me. Okay. Have a sip of water. If you want to bring that with you, you can. >> All right. Go ahead and place your hands behind your back for me. All right. >> I'll double lock these for you so they don't get any tighter. Okay, Izzy, do you have any weapons on you or any drugs or anything that's going to get you jammed up? Jail? >> No. >> Okay. All right. Go in. You want your phone to go with you? [laughter] Is he forgone under this? Okay. I just got to check your pockets. Okay. [laughter] Have a seat for me. All right. Hey, Bryce. You good? Okay. I'm going to get started with paperwork then. Okay. Okay. I'm going to tell you, you leaving her stuff out like that >> when she gets out tomorrow morning is not going to be a good idea. Okay. >> So, listen. Okay. She's going to go to court in the morning. She's not going to have a bond. She's going to see a judge. They're going to serve her with a no contact order. On that no contact order, there's going to be a stipulation that she's allowed to come back here with officers and get her stuff. If you leave it out on the front step and somebody steals it, she could charge you with or she could accuse you of theft, okay? For causing her property to get stolen. So, listen, man. I would honestly pull it back in here, put it all in a corner or something and just facilitate getting her out because this address is going to be listed on the no contact or she's not going to be allowed back here. Okay. Is there I'm not trying to sound like that guy. I know it's a mixy situation. Is there any way we can like not take her to jail, bro? I'm not trying to be that guy. >> You guys are in a domestic relationship and she caused physical injury. So, by law, we have to. Somebody has to go to jail. >> I mean, I don't want her to go to jail, bro. I know she really is a good girl. >> Not saying that she's not, but we're bound. >> I know when you already put her in. >> I mean, the cuffs go the cuffs come off as easy as they go on. But in a domestic situation, I could liter I could literally be charged by the courts for not making if you had if she hit you and left no marks and you didn't want her arrested and we didn't have any marks to go off of, we could get it. But there's a difference between simple domestic and domestic causing bodily injury. Any sort of scratch is a bodily injury. Okay? And we don't have a choice. So hang tight for me. There's going to be another officer that rolls up. Why do I have to? >> Um, I'm going to take the other one off. Whose cuffs are these? Um, take away >> Iowa Code Section 236.12 strips officer discretion the moment there are reasonable grounds to believe domestic abuse, assault, causing bodily the injury occurred. Reasonable grounds, not probable cause. That line is set low deliberately. The subject stated before any restraint, before any arrest decision that she struck her boyfriend unprovoked, out of anger. Miranda versus Arizona requires warnings only upon custodial interrogation. Standing [clears throat] outside answering questions voluntarily does not meet that threshold. The admission stands. Officers documented visible marks on the boyfriend's wrist. Iowa defines bodily injury as any physical pain or impairment surface level marks qualify. That documentation completed the probable cause record and close the mandatory arrest trigger under section 236.12. Iowa code section 562A.27 requires formal eviction proceedings before a cohabitant can be lawfully removed. One year of shared residence establishes teny regardless of whose name appears on the lease. The boyfriend had no legal authority to lock her out. Iowa Code Section 708.2. A domestic abuse assault causing bodily injury requires an intentional assault, a household member victim, and [clears throat] resulting bodily injury. All three elements were met by admission, by documented injury, and by one year of cohabitation. The charge is an aggravated misdemeanor, up to two years in county jail, and a fine of up to $6,250. County jail, not state prison. That classification controls where time is served and what collateral consequences attach. A pending assault on peace officer charge from a prior incident at the same address court date 2 days before this encounter eliminates first offender treatment. A judge has grounds to impose active jail time rather [clears throat] than supervised probation. Officers receive a B+. Dual interviews were clean. Mandatory arrest advisement precise. Tenency guidance accurate. The subject receives a C+. She admitted fault without prompting. and complied fully, but the conduct itself and a pattern of assaultive behavior within 48 hours drove the grade down. First takeaway, in Iowa, once bodily injury is documented, a domestic victim cannot [clears throat] reverse a call. The boyfriend asked officers not to make an arrest. The statute had already answered that request before he made it. Second takeaway, one year of living somewhere is teny. No lease required. Placing someone's belongings on the porch and locking the door is not eviction. It is a separate legal exposure on top of everything else already in play.
