At first, this sounds like a routine Key West ordinance violation. Sleeping or lodging inside a vehicle isn't allowed here. But notice the immediate problem. The man says he has a valid license, yet he doesn't have the physical ID with him. What starts as a warning is already becoming much more complicated. >> I'll move it though. >> Well, if you ain't got a license, you can't move. >> I have a license. This is my ID. >> All right, I'll just move it tomorrow. >> Huh? >> I'll just move it tomorrow. >> No, where's your ID? >> I don't have my I just got I just got a ticket. >> All right, then your name and your birthday is fine. >> Justin. >> Justin? >> Yep. >> Is that J E S S I E or is that J E S S I E? >> What is What is this for though? Like what do you need? >> Can I record this one? >> Can I record it? >> Sure. I mean, our our body camera is recording as well. >> Do you have any weapons in the car? >> No. >> Okay. So, City of Key West has the ordinance against lodging in a vehicle. >> Okay. >> So, we got to know everybody who's sleeping in their car and they're not allowed to do >> I'm watching a movie. >> Okay. Well, either way, this is also no overnight parking here. >> I'm not I'm not parking here. I'm moving. >> Okay. You were parked for the moment, right? >> Yeah. Out of Minnesota. >> That's the reason why we're talking to you. >> Okay. >> Okay? >> Okay. >> Does that answer your question? >> Yeah. >> Okay. So, go ahead with your name and date of birth. >> For what though? >> Cuz we got to document the warning that we're letting you >> To document a warning that way we We're out here with you and >> I I haven't done anything wrong. >> You're lodging in your vehicle. Basically, it's that or it's a civil citation, which is a monetary fine that you'd have to pay to the City of Key West. We're here to just educate and warn people on it right now. >> You mind if I record this for a minute? >> I I I already told >> Oh, that's fine. I don't mind. I told you our body camera is recording as well. Okay. So, all I'm asking now, you said you didn't have your driver's license with you. >> No, I got a birth certificate. I have a birth certificate. >> And that's fine. And all I'm asking right now, I don't need to see your physical ID. I'm just asking for your name and your birthday to run it, verify that you have valid driver's license so you can go ahead and drive it. >> No. >> But so you can move your vehicle cuz there's no overnight parking here. >> I'll just move it tomorrow. >> So, where Where But I haven't done anything wrong to have to show you anything. >> be a documented warning in the system. Otherwise, you're going to be issued a civil citation for lodging in your vehicle. You just can't lodge in your vehicle in the city of Key West. >> Okay. >> All right. >> So I'm not lodging. I'll just move it. I have I haven't done anything like that. I'm just in there watching a movie. Like what What It's What time is it? 12:30? It's 12:30. So like I've only It's not even overnight. So I don't understand how it's lodging. >> You have all the elements inside your car. Sleeping bag that you were laying back on there inside your vehicle on the back seat of your truck. >> I was watching a movie. >> Okay. So right now you're going to be issued a citation for lodging in your vehicle. We're going to give you the opportunity again to provide your identification. >> It's in the glove box. >> I asked you for your name and your birthday. That's all I needed. >> I'll give you my birth certificate. >> That I mean that that'll that'll work. That's all we had to do to get through this. Okay? I asked for your name and your birthday. Said you don't need to see your birth certificate. All I need is your name and your birthday with See your ID's out of. >> I'll just give you my birth certificate and you do as you want with it. Is that cool? >> If you have your birth certificate, it's in the the glove box. Do you have anything in there that I need to be aware about? >> No. >> No weapons? Okay. Okay. What state is your ID out of? >> It is out of Minnesota. That's all That's all the information right there. >> Okay. >> Camping used to be able to go anywhere and just like camp and park or whatever. Now it's like I feel like everybody's strict about it. >> So why though? Like >> Because we're like a tourist place, you know? So >> I don't know what's happened to like the free world. They're like I don't know. Nothing's free but like So since I got a ticket tonight or whatever it is, am I good to stay here tonight? I mean you gave me a ticket technically. So like I might as well just stay here. >> Well, that's not a ticket for parking. >> What is it? >> It's a civil citation for lodging in your vehicle. >> That's illegal? >> Yeah. >> I'm just going to take a nap in here after you guys are done. If you already gave me a ticket, what I mean, if you already giving me a ticket for tonight, like I'm I'm just going to go to sleep in there just cuz you gave me the ticket and then I just want to do it again. You know what I mean? I mean, what are supposed to people supposed to feel or do like when you guys are hovering over me like this over over a civil citation? Like isn't this a little dramatic? What's the big deal if I'm not doing anything wrong or breaking a law? Just feel like, "Hey, you can't park there." Nope, you know what I tell you? Okay. I do I do understand. I'm not trying to be ignorant. I do understand. I can't stand up or what? There's no reason I have to sit. I'm not a dog. >> So, what's a social? >> I need to talk to my lawyer. I need to talk to a lawyer. So, why did they why did they keep doing this to me? >> Right now it's a civil. It's not criminal. >> Well, regardless, they try to question me so much. I said, "I need to talk to my >> like look at it as a like as a traffic stop, right? If you you will get pulled over because your like tag light yeah, is not working, right? It's not like, "Oh, can I have a lawyer for that?" No. >> I know, but like you guys keep asking me questions in a roundabout cuz first you said it was civil lodging and now it's like what am I doing here now? I gave just you said you needed identification. I gave >> So, because to put your name on that ci- citation, we need to know your name and because you're probably from the different state >> I did give my birth certificate. It's all information. >> Yeah, but you are from the different state. You're not from Florida, right? So, from because you're not from Florida, we need a little bit more information to find your information, right? So, there is. >> So, if I get mail in Florida, I'm technically a Florida resident. >> Um if you have a like Florida ID or driver's license. >> Okay, your birth certificate showing your last name is p u g h. >> Okay. >> Okay. >> Our system shows that you have a driver's license out of Minnesota with last name s k e >> Yeah. Why you asking me this information? I need to speak to a lawyer. Let me go. Like am I under arrest? >> Right now you're being issued a citation. >> Am I under arrest? >> You're being issued a civil citation. So, right now you're not under arrest. No, but you're not free to leave. >> Okay, not until we conduct finish this investigation. >> Like I'm done speaking with y'all. Like I gave you all the information I gave birth give it. I'm not being rude. I'm not being ignorant. I gave the information. I'm not I'm not speaking no more. Tell your lawyer. >> Just have a seat there, bro. Not on the seat. I don't want you to fall in the water. >> I don't want to talk to anybody anymore. I don't want to talk to any of you guys. I told you I want to talk to a lawyer. >> You asked for our supervisor. >> No, I said I want to talk to a lawyer. >> Okay. And you're not free to leave. >> I'm not. Just sign it up. >> Okay. >> I don't want to ask any more questions. So, please don't ask them. >> The only thing I was going to tell you is >> I'm not answering no I'm not being a dick. I'm just not >> He's not asking questions. He just want to >> I'm letting you know your driver's license out of Minnesota is suspended. So, if you're caught operating a motor vehicle from this point on you're going to be arrested for driving with knowledge on a suspended license. >> Okay. >> This is a civil citation. Basically, it's not an admission of any guilt. All I need here is a signature from you. >> I'm not signing that. >> This is stating >> I'm not signing it. >> that you have a court date Monday March 5th. >> You have all the elements of lodging inside of your vehicle. >> Elements of lodging, a blanket? I was watching a movie. >> Okay. So, you have the elements of lodging in your vehicle. >> Hm, okay. >> And you're telling me that you're refusing to sign this citation. >> If if I don't sign it, then what? I'm asking my >> supervisor about it. >> Okay. >> All right, I'm here for this. >> Ask him. >> Okay, then I'll come back and I'll I'll let you know. >> Thank you. I appreciate you. >> He's a convicted felon. He's been here since January at least. >> Okay, which he would know the rules, you know, because they tell you that and apparently said he gets his mail sent down here to the homeless shelter, but doesn't know where it's at, can't give the address of it. >> a murder charge for sale of a controlled substance. And last year >> Oh, that's >> Somebody overdosed on his [ __ ] >> Nice. >> So, you going to explain to him the the K9 aspect? >> What's his name? >> Jesse. >> All right, Jesse. Jesse, how you doing? >> I'm well. >> All right. Uh, I'm just to let you Do you dog did alert to your vehicle that you're driving? Um do you have the keys to open it? >> No. >> All right. So, you're not going to let me search the vehicle? >> This is the moment everything changes. The canine reportedly alerts to the odor or presence of narcotics inside the vehicle and Jesse refuses to unlock it. Whatever you think about his decision, the officers now believe there may be something far more serious happening than someone simply spending the night in a truck. >> For what? >> My dog made a positive alert to the presence and or odor of narcotics in the vehicle. No? You'd rather go to jail for obstruction? >> Yeah. I didn't do anything. >> Okay. So, if you didn't do anything, so if you allow me, you can unlock the car and do my search, be done with that, continue on your way. >> I'm No, like it's my property, no. >> Okay. 10-15. >> No. The drugs are in the back. Wow. >> Drugs. Are those the keys? >> Yeah. >> Yeah. Everything you had up adds up to more and more of our suspicion. There's something else going on besides just you sleeping in your truck. If not, then you're just being a jerk. Oh, it's going to be towed as well. Uh but we'll need access to do a uh vehicle search. All right. Is there anything illegal on your person? >> No. >> All right. Is there any If there's anything else on your person, anything illegal? >> No. >> get to the jail, >> Okay. >> we can say that it's introduction of contraband to the facility you're charged with. >> I don't have any. >> Check the inside of the truck. Just hold on to it. We just undo the battery? >> I can disconnect the battery. >> Thank you, sir. >> No problem. >> You're the man. I can smell weed, but trying to see what else you got. Good [ __ ] Oh, yeah, it's probably weed in it. I'm just going to set it on the back of the truck so we don't lose anything. >> This is changing name paperwork? >> Yeah, he changed his name for some reason. Hm? Well, if he did all this for some weed in his car and being suspended, he's just not smart. >> Powder in the door? >> Powder in the door? All right, I got a wipe. Matt, you want to try to test this to see if you think it's something else? Pink and yellow? Amphetamines. >> Amphetamines? >> Positive detection, methamphetamine. Maybe that's why he didn't he didn't want us to get into the car. >> Well, and you said he's got prior drug convictions, right? >> Yeah, it's all something about drugs. >> I found a little baggie in here. >> Step Step over there, the wind's blowing towards you. Right here. >> He does look okay. >> I don't know. Where's the Ziploc? Yeah, it's cocaine. Look at that [ __ ] Yeah. All right, so that's cocaine. Where's the Ziploc? I wonder if he's transporting somehow. >> Well, let me look under the car. >> Yeah, dude, cuz this is like sealed. >> No, it's successful K9 sniff, key throwing, >> drug going >> His mom's car key. >> Yeah. Who throws their mom's car keys in the ocean? That guy. >> He threw his keys in the water. >> Yeah, his mom's
