Just one more time for me, okay? Okay, Ms. Bush. All right. We're actually going to come over here to this parking spot over here. A critical discovery emerged. The driver's license was suspended. Florida statute 322.34 makes this a separate criminal offense. The driver possessed a medical marijuana card, but refused field sobriety tests, accepting only a breathalyzer for alcohol detection. Florida statute 316.193 [music] explicitly covers alcohol, chemical substances, and controlled substances as impairing agents. A breathalyzer alone cannot detect marijuana or prescription drug impairment, making the driver's selective testing offer strategically revealing. Field sobriety test refusal is voluntary in Florida, but eliminates exculpatory evidence and permits consciousness of guilt inference at trial. Once probable cause existed through witness testimony, officer observations, suspended license, and test refusal, arrest became legally justified. for me, okay? All right. Do you see this second white line right here? Let me see that white line there. This one right here, exactly. All right. So, I see you're wearing some sandals, all right? I need you to stay in that position until I tell you to begin. Do you understand? Okay. Let me get into it first. Okay. I need you to stay in that position until I tell you to begin. You understand? Yeah. Okay. When I tell you to, you're going to take nine heel-to-toe steps along that line. When you get to your ninth step, I want you to leave your lead foot on the line, make a series of small steps around, and then take nine heel-to-toe steps back in the other direction along the same line. Get through this cuz I know I'm not under So you're saying you wanted to do it without the shoes on. Is that what you're saying? All right, so get get back in the starting position, right right foot on the line. Or excuse me, your left foot on the line, right heel touching your left toe. Nope. There you go. Just like that. There you go. Yep. All right, you can begin. Close. One. Two. Three. Four. Five. Six. Seven. Eight. Nine. 10. Nine. Nine. You say nine, right? Yeah, nine was the instruction. Nine. Nine. Seven. All right, Ms. Bush, it'll look exactly like this, okay? 1,001, 1,002, 1,003, and so on until I tell you to stop. Okay? All right, there's four things I want you to remember while you're conducting the evaluation. I want you to keep your eyes on your raised foot at all times. I want you to count out loud in the manner I instructed you to. I want you to keep your arms down by your side at all times. Once you pick that foot up, I don't want you to place it back down until I instruct you to. You understand all the instructions? Anything you want repeated? Do you need me to repeat the instructions? You understand all the instructions? All right, I will tell you when to begin, okay, Ms. Bush? All right, begin. Okay, you can stop. Okay? You can stop. All right. So, Ms. Bush, again, we're going to stand with our feet together and arms down by your side, okay? All right, when I tell you to, I'm going to have you tilt your head back and close your eyes. When I tell you to. All right? I'm then going to give you a command of left or I'm going to give you a command of right. All right? You understand your left from your right, right? Now, if I say left, I want you to touch the left tip of your finger to the tip of your nose, and then immediately return your hand back down to your side. If I say right, tip of your nose, and then immediately return your hand back down to your side. If I say right, I want you to touch the right tip of your finger to the tip of your nose, and then immediately return your hand back down to your side. All right, Ms. Bush, couple things I want you to be clear on, okay? This is not the tip of your finger. This is the pad. This is the tip. Okay? I want you to touch tip to tip, okay? You You understand all the instructions? And then the other thing I want you to keep in mind is this, after you touch the tip of your finger to the tip of your nose, I want you to immediately return whichever hand back down to its side, okay? All right, go ahead and get back in the position I had you in. Palms out there. There you go. All right, tilt your head back and close your eyes for me, okay? Close your eyes. Left. Right. Left. Right. Right. Left. Okay? All right, Ms. Bush. Okay. All right, Ms. Bush, again, I'm going to have you stand with your feet together and your arms down to your side, okay? Can I have a seat? Can I have a seat? Go ahead. You guys want to do that anyways, y'all do it. It's okay. IT'S OKAY. >> [screaming] >> WHAT THE HAPPENED? YOU IS HURTING MY ARM. MY ARM. MY ARM. MY ARM. THE DRIVER'S RESISTANCE transformed a routine arrest into a prolonged struggle. Violating Florida statute [music] 843.02, resisting arrest without violence requires willfully obstructing an officer in lawful duty execution, regardless of underlying arrest validity. Graham versus Connor establishes that force reasonableness must be judged from the officer's perspective, considering severity, threat, and resistance. Officers employed graduated force [music] progression, verbal commands, physical guidance, then pain compliance when the driver braced against the vehicle. While legally defensible, supervisory professionalism lapsed with profanity and dismissive commands, falling below leadership standards. Florida statute 827.03 addresses child neglect. Operating a vehicle while impaired with children present meets this definition. Officers receive a grade of B+. The investigation [music] was legally sound with proper force escalation. But supervisory professionalism could have been maintained better. The driver receives a grade of D. Test refusal eliminated exculpatory evidence, and active resistance added a criminal charge while traumatizing her children. The witness receives a grade of A-. Her detailed observations and willingness to report suspected impaired driving exemplify responsible citizenship. Key lessons. First, medical marijuana authorization provides no immunity from DUI prosecution if impairment exists. Second, roadside resistance accomplishes nothing. Legal challenges belong in court through motions to suppress and trial proceedings, not physical non-compliance. Third, field sobriety tests offer opportunities for exoneration. Refusing them removes your chance to demonstrate sobriety while creating adverse inferences. Fourth, presence of children elevates DUI severity, but doesn't override lawful arrest authority. [music] Compliance minimizes their trauma. Fifth, law enforcement professionalism matters at every rank. Frustration doesn't justify dismissive language, especially from supervisory personnel. Sixth, witnesses who report impaired driving protect public [music] safety. Good Samaritan laws protect good faith reporters from liability. The charges filed included drug possession, DUI, resisting arrest without violence, [music] child neglect, driving with suspended license, and probation violation. Final case disposition remains unknown, but the body cam evidence provides substantial foundation for prosecution on multiple charges. MY ARM. >> [screaming] >> COME ON. STAND UP. STAND UP. STAND UP. MY ARM. STAND UP. MY ARM. STAND UP. >> MY ARM. Stand up. Stand up. I want to get out. Put your foot in the car. Put your foot in the car like this. Put your foot in here or I'll drag you in again. Why won't you guys do a breathalyzer? Put your Put your foot in the car. PUT YOUR FOOT IN THE CAR. WE'RE NOT GOING to ask you AGAIN. YOU GUYS NOT going to release me. You guys Put your foot in the car. You guys get her Get her feet in Get her feet in the car like that. There you go. I didn't do nothing. I'm a good person. I didn't do nothing. I DIDN'T DO NOTHING. Grab her shoulder and bring her forward. All right, sit up for me, babe. I didn't do nothing. All right, stay. I DIDN'T DO NOTHING. STOP GETTING OUT. >> YOU KEEP PULLING MY ARM.
