Officer Banks called Bree Police Burns. I'm pulling you over. You're doing a 54 and a 35. Any reason for that speed tonight? >> Where's the 35? >> Before you got off the bridge and just came off the bridge. All this is 35. >> Behind the wheel in Florida. That is 34year-old Haley Brooks Smith. Golf Breeze officer Shawn Banks stopped her for speeding. >> I was going 40, I thought. >> Nope. You got your license, registration, proof of insurance. >> You don't have to have a license to drive cars. >> Yes. Yes, you do. >> You do not. >> 15741 with me. The group has their own interpretation of the US Constitution. >> I know my right. What right is that? >> I I do not have to have a driver's license to drive a car. I am not This is not a commercial vehicle. >> Okay. >> I know my right. >> Okay. Are you failing to give me your driver's license? >> I don't have to give you a driver's license to drive a car. This is not a commercial vehicle. >> Okay. >> I'm not driving. I'm traveling. >> Okay. >> I have all the laws back here. >> Okay. So, you're not going to give me a driver's license? >> I'm not going to give you a driver's license. I don't have to give you a driver's license. >> Okay. >> I'm I'm traveling. I don't I don't have to have a driver's license to drive a vehicle. >> Okay. And what state is that? >> Any state. It's common law. Natural law. >> Okay. >> Constitutional law. >> Okay. >> Miss Smith could not be more wrong. >> You need to get a supervisor out here. >> I do. >> Yes. >> Moments later, a supervisor arrives and helps Sergeant Banks >> remove Smith. >> So, you do need a license to drive a vehicle >> and you do have to identify yourself to these officers. I I do not have to have a license to drive a vehicle. >> Yes, you do. >> I do not. >> Out of the car now. Undo the seat belt. >> Turn the vehicle off. >> Turn it off now. >> Officer Schaefer. Yes, I do. >> You can call somebody from Santa Rosa County Jail. >> I live right down there. >> Where is your ID out of or your license out of? Mississippi. >> I just thought you didn't have one. You just said you don't need one. >> This is This is This is ridiculous. >> It's not ridiculous. We're not going to play any of these games with you tonight. >> You can't arrest me. I haven't done anything wrong. >> If you don't have a valid driver's license, we most certainly can. >> Can I at least lock my car? >> We will make sure it is secure. >> What are you going to do with my car? >> Probably tow it. >> At this point, the police inventoried the items in her car. One officer finds a plastic baggie with white powdery substance inside the driver's backpack. The substance later tests positive for cocaine. >> Excuse me. Give me your full name. Drugs inside the vehicle. You are under under arrest now for possession of felony narcotics. >> I didn't give y'all permission to search my vehicle either. >> Your vehicle's being towed. We're inventorying it. We're not searching it. >> Yes, you are. You're searching my vehicle. >> That's true. And Miss Smith did not give permission. However, the US Supreme Court has held that inventory searches of an impounded vehicle are lawful under the Fourth Amendment. >> You say that our laws don't matter to you. So, what does it matter? >> I don't have to mind laws that aren't They aren't valid. >> They're valid laws. >> They are not valid laws. >> The United States and the state of Florida seem to think they are. >> The United States has a Constitution. >> I know the Constitution, too. I also know that the states have the right to govern themselves. >> Has been turned into >> decide which laws to follow. >> Take orders from anybody. >> Nobody's giving you orders. >> But the God defense did not help Miss Smith. Arrest records show she was charged with cocaine possession, drug equipment possession, driving under the influence, and a moving traffic violation for operating a motor vehicle without a valid driver's license. Court records show she was also charged with speeding and driving with expired tags. The cases for those charges of speeding and expired tags remain open as of the publication of this video. No charges remain for the cocaine possession. So either Miss Smith completed a diversion program that allows non-violent offenders in Florida to get 12 months of treatment to have the charge expuned or prosecutors decided not to charge for drug possession. Either way, kudos to officer Shawn Banks and the other officers in the Gulf Breeze Florida Police Department. They handled this incident professionally and calmly, even as Miss Smith asserted an extreme and incorrect claim about her rights. For the record, all drivers behind the wheel of a commercial vehicle or a private one must have a valid driver's license and vehicle registration. If police pull over your vehicle for traffic stop, passengers can refuse to produce a license or ID. But there is no wiggle room for the driver. Some sovereign citizens have attached a license plate like this that claims private, no driver's license or insurance required for non-commercial use or private mode of travel. But that claim is wrong. And every sovereign citizen Karen, who has asserted that defense in court, has lost. By the way, one of the heroes of the farright in Congress is Georgia Republican Marjorie Taylor Green. But she is trying to hide from some bad news and she just got torched. So this morning, it's still not clear if Marjgerie Taylor Green is or is not a member of the House Freedom Caucus. >> It's been [clears throat] more than two weeks wants to know >> since members of the far right group voted to remove the Georgia Congresswoman. Since then, Green has reportedly not responded to multiple attempts by caucus chair Scott Perry and other top members to communicate with her and her staff. Is this is this like a scene out of Seinfeld where George is is fired but he never acknowledges it? >> Check out that video at the link below. I'm David Schustster. Thanks for joining us.
