I'm not with you. You had a recording device. I had no knowledge of being recorded. Warning. This story contains details some viewers may find distressing. In October 2023, a woman attended Goldberg's Dover Heights home clinic for what was described as a Lomi Lomi massage. The treatment was promoted as therapeutic, emotional, and restorative. She was told she would need to be completely naked and that a modesty towel could get in the way. For over an hour, nothing appeared out of the ordinary. But in the final stages of the session, Goldberg instructed her to turn over and placed a covering over her eyes. What followed was a significant escalation. The court heard he began touching her breasts before moving toward her lower abdomen and digitally penetrating her without consent. The victim later described feeling frozen, unable to respond, as the assault continued. Days later, as part of a police investigation, the victim participated in a recorded phone call with Goldberg. During that conversation, he admitted to the act. He apologized and acknowledged he had misread the situation. I am so sorry. That is not what you wanted. He went on to say he believed he had asked for permission, but obviously had not done so clearly. The woman booked the massage after hearing it promoted on the Kyle and Jackie O Show, where it was described as being like 10 years of counseling in a single session. An experience said to take people back to their childhood and even bring them to tears. I'm getting good vibes from Steve and you can tell he's very passionate about what he does. I'm getting spun around sideways on the table and >> I'm going off the ta- And you're crying and >> Yeah. It was something else. >> [laughter] >> Oh my god. She had never heard of Lomi Lomi before hearing it discussed on the Kyle and Jackie O Show. But the evidence didn't end there. Body worn camera footage captures the moment detectives attended Goldberg's Dover Heights clinic to arrest him. When police arrived, he was in the middle of performing another massage. But what followed was unexpected. Despite being informed he was under arrest, Goldberg indicated he wanted to finish the massage. Hello. Hello. Hello. Hi, it's just the police. Sorry? Is that Steven? Yes. Who is it? Do you mind opening the door? No, I can't open the door right now. I'm in the middle of a massage. Do you want to just step out quickly? Who Who is it, please? It's the police. Do you mind just stepping out? Um What's that? I'm Steven Sorry, is there someone? Yeah, I'm in the middle of a massage now. Oh, sorry about that. I'm in the middle of a session at the moment. That's okay. My name's Detective Senior Constable Matthews. Can I go see your identification through the garage door? We're just from Bonnyrigg Detectives, okay? Yes. I'm just letting you know that I'm using a body worn video at the moment, okay? So, it's for personal record on Friday, the 13th of October. Okay. So, I'm going to ask you a few more questions about that. You don't have to say or do anything if you don't want to. Do you understand that? I understand that. Anything you say or do I can record and use in court. Do you understand that? Yes. And like I said, I'm recording at the moment, okay? Yes. And I have a form I can explain to you, Yeah, I I understand. I I understand. I am in the middle of a massage right now. Yeah. I think we need to unfortunately end that massage. Well, this massage will be finishing at 12. Can it wait till then? We can You're under arrest. Yeah, so basically you are not free to leave. We can assist you in me, you know, sorting out this massage getting you out of the but the massage will have to end now. Then we've got the police coming. Yeah. Um I'd just like to be finishing this massage. That's all. Yeah, unfortunately we can't just continue to finish it. I've got a gentleman I've got a gentleman on the table who usually has a shower afterwards. Yeah. Okay. Is he If I open the door now, is he visible to me? Yes, he is. Maybe I'll just pop the door open. I'll tell him to put a towel on. Well, he's got a he's got a sarong over there. Well, that's that's the case. That's fine. So, is he covered at the moment? Uh yes, he's got a sarong on. Okay. I'll I'll go in. I'll tell him to cover up and inform him that unfortunately the massage has to end. Well, I can tell him. Yeah. I'll go in and tell him that. So, you see this is a crime scene for us. We don't want people coming and going. We don't want no more movement. Okay. So, um I'll just basically start again now. They're just going to wait upstairs and come down. Mhm. Just personally rehash everything just for the camera again. Mhm. So, the time is 11:44 a.m. on Monday the 30th of October, 2023. So, like I said before, my name is Frank Lucy, I'm a senior constable at work and I just want to um re-adjust that. Do you agree that we came here and knocked on the door? Yes. We both came and spoke to you, introduced ourselves, we placed you under arrest. >> Yes. And informed you of the allegations. Yes. Um I then asked you about obviously the consent for this room down here, which is the room that we are right now. Yes. And you signed that consent form. I explained that to you. Yes. And you signed that. Just for the camera now, are you happy to provide consent as well as verbally? Yep. Um And like we said before, you don't have to say or do anything if you do not want to. Do you understand that? And anything you say or do may be used in evidence in court. Do you understand that? Yes. Okay. Awesome. Um what do you want now? What's the problem? on I'm trying to show you this, too. Going? Yep. Yeah, I'll still come. Sorry. Ah, it's all right. I'll walk in. Sorry. You know this long thing? These tongs are here. All right. So, there's nothing else in your pockets or anything like that? No, there isn't. That's what you jumped in? So, we'll be about 10 minutes. Very good. So, thank you. Shortly after his arrest, Goldberg was transported to Waverley Police Station. There, he was processed into custody, photographed, and formally charged. He then participated in a recorded police interview lasting approximately 40 minutes. For the purpose of this report, we've condensed that interview to highlight the key moments. And Steven Goldberg, we are at Waverley Police Station interview room one, and the time is now 3:39 3:40 uh p.m. It's not very much in the first few years, I suppose. Yeah. And then Kahuna probably um eight or nine years nine years, maybe. Okay. And that's all word of mouth. And that's mostly like a word of mouth sort of Very much. Yeah. During questioning, he describes his practice as sensual, but not sexual. He explained the massage involving breathing, energy work, and emotional release. >> Uh Lomi Lomi massage business site, are you on on that? Yes. If we looked it up and it If you looked up and typed in Kahuna and Lomi Lomi, you'll probably find me because there's not that many in that in Sydney. Yeah, I'd be sort of up there cuz I've got quite a few good reviews and all that. So, I I don't know how Google works, but Um all right, and so if I can go back to if you do recall, do you know what day she turned up for this massage? I'm sorry. Do you know what [clears throat] day she turned up for the massage? Don't know when. What day it was? Well, you're telling me it was Friday the 13th. Yeah, but is that would that be a fair recollection? Do you like do you agree with that? Yes, yes, I would agree with that. He confirms clients were typically fully nude with optional coverings. The session would begin face down before turning over toward the end. Goldberg also confirmed that clients were often covered over the eyes using a cloth or sarong. He said this was to reduce light and enhance relaxation. Um do you remember that day when she when she arrived? I remember remember that she came and Yeah, had the massage. Can you just walk me through what you do remember of that day? Like her like you know, from her turning up to her leaving. Well, when she turned up, um I think she texted me or something out the front and I came to get her and we went [snorts] downstairs and uh I we sat in there and we had a a good chat, a good long She filled out the form and had a chat Mhm. about the massage, what she was expecting from the massage and in the sense you know, what what she knew about that massage. >> Mhm. And um uh just describe it you know, you know, just answering any questions that she might have had. Um also just explaining to her the the procedure for the massage. Mhm. You know, face down first all that sort of thing. Nothing untoward, very friendly, very um and she was she was very open about herself. Um I remember that she told me she had a uh >> [snorts] >> you know, well she didn't tell me she had a female partner, but she was talking about her partner. And then that's really all Yeah, and then proceeded with the massage. Just going back to you said they signed a form. What what sort of form is that? It's just a a half A4 size page form. It's just just got questions just you know, some basic details. I don't ask for their full address. I ask for their suburb Yeah. or postcode, you know, suburb or or postcode. Um just they ask for their contact details like phone number and email. Some give, some don't. Yeah. And then just asks are they pregnant? Could they be pregnant? They are female. Yeah. Um >> [clears throat] >> could they be pregnant? And it asks is there any injuries that they've had or any It's a very basic form, but any injuries and asks if they've um if there's anything that's relevant for them that I should know about for the massage. Yeah, there's no sort of like disclaimers or anything that It's just a generic form. >> It's a generic form. Down the bottom there is a disclaimer or it's not a disclaimer. It just sort of says that she they recognize that they're having the massage. It sort of says at their own risk. And that they just understand that they'll keep me informed if they have any adverse reactions or anything. Yeah. And what sort of massage did um like get? Is there like a selection of massages? You said like a package or Well, no, it it was a Kahuna Lomi Lomi massage and she chose I think she had the 2-hour one. Mhm. Um so I do offer 1 hour, but it's not recommended. An hour and a half is recommended. And 2 hours of course is is is even better, but it's not necessary. And I think I probably would would her that. flow of the message. Okay. And when this is occurring, when she's lying on her back, can she see this taking place? Is she watching? Um when I'm doing her face, uh clearly her face is not covered. Yeah. I allow the person to just lie there and breathe for a short while. And um without disturbing them, I go out the door. I can't remember what day it And now I might go out the door or I might stay in the room. They're lying there covered with the sarong. And um just breathing. Yeah. And uh usually just say a few words to them, you know, thank you for giving me the honor and the privilege of massaging you today. And um and then I'll help them off the table in a in a moment. Just checking to see that they're okay. Some people are still I mean, not in fairyland, but they they're still in the There's only one way out. Yeah, yeah. Yeah, yeah. And I then um uh help them sit up and swivel to the left. And then I use that same towel that I used for their feet. Um getting the oil and off [snorts] to just get some surplus oil off their back. So, they still got the sarong across them, but sitting up. And then I just wipe just wipe down the back from the neck down to the down the back. Um and the shoulders and the upper arms. What what does the rest of your day entail after her session? I don't know. I can't remember what happened on that particular Friday, but uh Friday nights usually with the family, so with the kids and the grandkids. All right. And so, did did you have any further correspondence after that massage? Uh not that I recall, other than the phone call she made to me. When questioned about a phone call from a week earlier, one covertly recorded by police, Goldberger appeared to minimize or failed to recall the victim's complaints, including allegations of non-consensual touching. What he didn't know was that detectives had lawfully recorded the entire conversation. >> It was about she was checking in about aspects of the massage and she uh expressed um that she wasn't that she wasn't happy. Mhm. That she she didn't that she wasn't happy with the massage. Okay. Mhm. That's the that was the the extent of it. I The essence of it um obviously the phone call was longer than this. Uh I expressed I I apologized if that if that was the case and um that that isn't what it I mean seemed and that that isn't how it it appeared at the time. Um and I'm sorry she she felt that way. And um but I thanked her for calling me. Um and at least voicing her um you know sort of her unhappiness. So is there anything further you want to tell me about this phone call that she she's raised some issue about the treatment? Is there anything in particular that you want to tell us about what she raised with you? No. Why do you feel like she's she's called you to reach out to you to discuss this issue? She was unhappy. >> Yeah. So obviously as part of that phone call on this investigation. um Um part of that is we, you know, applied for a surveillance device warrant with um which encapsulates this phone call that you're referring to. I'm so I'm sorry. It captures the phone call that you're referring to. >> I'm not with you. You had a recording device. Is that what you're saying? Yes, so as part of this investigation, right, we've [clears throat] applied for a surveillance devices warrant which can capture calls, essentially. The [snorts] device warrant number is ST 23-0770. And this is just a transcript of this conversation. Um and just to jog your memory, I know you said it was last week. So, Thursday, the 26th of October, 2023 at around 11:25 a.m. Would that be an accurate time frame? Mhm. Could be wrong. How could it be [snorts] wrong? And again, the number >> I had no knowledge of being recorded. Goldberg acknowledged aspects of the physical contact but maintained he believed consent had been given. In court, that explanation was rejected. The judge found that Goldberg knew the victim was not consenting and that the offending represented a serious breach of trust within a professional setting. The court also accepted that the use of an eye covering significantly increased the victim's vulnerability. The victim impact statement revealed the lasting consequences of what occurred. She described ongoing anxiety, panic symptoms, and hypervigilance. She no longer feels safe in medical or therapeutic environments, avoiding even essential health appointments. Goldberg was sentenced to 3 years imprisonment with a non-parole period of 1 year and 6 months. While the court acknowledged his prior good character and prospects of rehabilitation, it found his failure to accept responsibility, including pleading not guilty, weighed against him.
