When I start winning the fight, he goes, "I've got one leg. I've got one leg." >> Punched me and pushed me down and my leg came off and I started screaming. On the 26th of July, 2024, a confrontation between an off-duty Queensland police officer and a disabled man at Clear Island Waters resulted in serious allegations of assault. Queensland Police Constable James Michael Clark, aged 39, appeared at the Southport Magistrates Court on August 14, pleading not guilty to charges of common assault and assault occasioning bodily harm. Police body-worn footage played in court showed Clark telling a senior constable he knew from work that it was two versus one and that Shetty only mentioned his prosthetic leg once Clark started winning the fight. Mate, oh, what's going on? I'm in this lane. He's going 100 Look where the damage is on my car. Look where the damage is on his car. He's cut right across me bro. And then tries to have a fight with me, so I go over here to have a chat with him. Yeah. And he's in my face calling me a So, I push him back with two punches. Yeah, yeah. So, he goes grabs hold of me, holds me to the ground, breaks my glasses. Yeah. And then he goes, when I start winning the fight, he goes, "I've got one leg. I've got one leg." Uh I couldn't be in the car and I got on the left lane and uh from behind he just pushed through. So, when I came in to try to talk to him, he was really aggressive and then uh uh my friend was watching. He punched me in the genitals, pushed me down and my leg came off and I started screaming saying I'm I'm disabled and he's still like punched me around and he had to come and pull him off. He was kind of put off that I went ahead and >> In front of him? Yeah, and so he pushed through. Uh I was on the lane, so it and he got on the bus lane to like you know like And that happened today then? Yes, just now. That's And this is your car, obviously? Are you the registered owner? Uh my wife is, but we both are registered on it. Okay. Registered driver. Okay. And he pulled me down and he did the first punch on my genitals and soon as I fell down my leg came off uh and I told him, but Fernando had to physically stop him, but he was really fun about it. Okay. I fell off cuz my my prosthetic leg twisted and uh we we asked I asked him I said I'm I'm I'm a disabled guy, just back off and the other guy, a P-plater, he really had to come and uh kind of stop it and he was just like laughing and just, you know, almost like laughing at me and just saying [ __ ] it. So, basically this is a non-injury non-injury traffic crash. You're not injured from it? Non-injury traffic crash. You're not injured from it? No, from the traffic crash it was just after we got out of >> punched him in the groin, caused him to fall over, his leg fell off and then this guy and another witness had to push him away and get him off him. Well, yeah. There's different sides to the story. Can I have a chat to Yeah. Just give us a moment, thank you. I said what did he say to that? I I don't know the facts on it, but there's three sides to the story. Yeah, yeah, sure. Yeah, sure. Prosecutor Rodney Kite told the court that after a traffic collision with Sachin Shetty, Mr. Clark allegedly punched Mr. Shetty in the groin without provocation before tackling him to the ground. This caused Mr. Shetty's prosthetic leg to come off leading to bruising on his knee. Clark maintained he acted in self-defense saying, "If I wanted to really hurt him, I would have. That was not my intention. I was defending myself because I felt scared and provoked." Magistrate Jane Bentley adjourned the matter to a date to be fixed. Clark's bail was enlarged.
