Initially, Wright was convicted in the local court. But when the matter reached Newcastle District Court, Judge Ross Hudson overturned the ruling, finding that the officer had breached both policing and liquor laws by failing to provide a lawful reason for ejecting Wright. Instead of citing intoxication or quarrelome behavior, senior constable Blair told Wright he was being removed for carrying on like a twit, a justification judge Hudson said was invalid. The judge ruled the removal itself amounted to an assault which caused the entire case to collapse. The decision not only cleared right but also referred senior constable bear to the Law Enforcement Conduct Commission or LEC for investigation into possible excessive force.
