That's right, man. We come back and grab it later. Thank you. Now, I need to know your name, please. Okay. Prior to this incident, Sber had been involved in a previous police encounter that also resulted in the use of physical force. >> CCTV footage from August 2019 in Palmyon CBD shows Cebu, again in his wheelchair, being pursued across Goa Square by three police officers who believed he had stolen alcohol from a bottle shop. Police Vision Australia was unable to obtain bodywn camera footage from this incident. After two bottles are taken from Cebu, an officer is seen placing them in a nearby city planter. Cebu moves toward the planter, at which point he is grabbed by the throat with sufficient force to tip his wheelchair backwards and rotated around. A female officer retrieves a bottle. As Cebu moves toward her, she is seen pushing him away. Cebu then swings his arm toward the female officer. He is stopped and subsequently handcuffed. In 2023, the Darwin Local Court found Cebu guilty of assaulting police during that arrest and of later spitting at an officer. But lawyers from the North Australian Aboriginal Justice Agency, NAJA, have appealed the conviction in the NT Supreme Court. In September 2024, the Supreme Court allowed the appeal in part. The court quashed the two convictions for assaulting police during the arrest, finding they were affected by unlawful police conduct and that admitting the evidence would bring the administration of justice into disrepute. However, the court upheld the conviction for assaulting a police officer by spitting, ruling it was sufficiently separate from the earlier unlawful conduct. Back at the watch house, shortly after the arrest at the markets, bodywn camera footage shows Cebu arriving still visibly distressed and repeatedly complaining of a broken tooth. Darius, >> we got to lift you up, Darius. >> We're here to help you. I broke my tooth, man. >> Jack, >> Derek, give me hand. Give me hand. I'll give you >> it. If I sit you up this way, you cross your legs that way and we'll carry you out that way. Okay. >> Will that work for you? >> I'm just going to leave my legs straight. >> That straight there. >> Okay. Let me push you back this way first. Okay. >> Is that all right, brother? >> All right. Now we'll put your legs push his legs that way. >> Now I'm looking at that leg backwards. Okay. >> I want to see the fell eye. >> No. He's gone now. >> Yeah. He's [ __ ] nothing, man. >> [ __ ] watch us now. We're going to look after you. Okay. >> Are you ready? >> I just need I need two people or one person. >> My leg. My leg. >> MY LEG IS DEAD. MY LEG IS DEAD. GONE. I CAN'T EVEN MOVE my leg. I can All good. >> Leave me alone next time, you know. >> All right, mate. >> We'll look after you here. Okay. So, I just want you to calm down. Okay. >> Get the out of here. >> Yeah. Well, we'll sort that out as soon as we can. Okay. My job now is to get in touch with your carrier. Okay. What are my character? The custody officers attempt to process him, asking routine questions to determine whether he is fit for custody. Cebu appears to decline to answer the questions, making the ordeal increasingly more difficult for officers. Is this Darius's property as well? >> That's Darius, is it? >> Man, I want to lose my life. >> I want to do anybody, mother. Hey, you know, you mother, >> right? Is that his property? >> It's not a black fella. >> Just calm down here. Okay. >> Yeah, I can come down here. But I'm not for that little mother. >> Don't worry about them. >> Yeah. No, no. Leave me alone. I'm talking about him. I'm not talking to you. >> Is this your property up here? And shut the [ __ ] up and ask me nothing. >> Is that your property up here? >> Please just ask me nothing and I'm asking him as a question. I'm not asking question you to you. And yes, I'm saying can you understand that I'm saying? >> Yeah, I can understand. I've got my job to do here. I can see your reaction. >> You think that I'm a stupid mother? >> I ain't not, man. You don't even think about that. You guys can help me or do a thing to me like a little bit. If you can do it yourself, that would be good. >> Is that something that can come out there? >> [ __ ] man. >> Darius, don't be silly. Okay, we're here. Look after you. >> Just leave me alone. I'm not PARAP MOTHER. Calm down. >> I CAN MOVE. LOOK, >> I CAN MOVE my leg. >> Just calm down. Listen. >> What about you? You can move your leg. >> Yeah. The officers decide his wheelchair is unsafe for the cell. Despite Cebu's protests and concerns about pressure sores, they place a mattress on the ground instead. Cebu refuses to sit on it, throws a blanket, and as one of the officers grabs his arm, Cebu bites down on the officer's thumb. The bite did not break the skin. >> Is it going to be better to put the mattress on the ground for you? Now you sleep on this chair. >> Chair chair floor on the floor. I get I'll get more sore. I'll get more sore. I'll get more sore when I sleep. >> Well, we're going to put you on the I'm going to get more. I'm going to get more pressure. I'm going to get more pressure. Come on. What's up, bud? >> All right, I'll get you some food. All right. Can we sort some food out for those you please? >> In the courtroom, officers on duty during Cebu's protective custody maintained that they were attempting to help him. We weren't going to put him on the concrete floor, but defense lawyer Philip Bolton SC said police breached policy by removing his wheelchair without proper assessment. arguing decisions made against the will of the defendant involve force that was not normal force. Judge McDonald ruled the arrest that took place at the markets was clearly and obviously excessive, unreasonable, and unlawful. Judge Macdonald agreed during the custody in the watch house that the wheelchair should not have been removed, calling the oversight inadvertent or unintentional. But he found that the 2019 and 2023 cases each showed issues with police force. And in the 2023 arrest, the method and force used were excessive, unreasonable, and unlawful. He ruled the unlawful arrest explained Cebu's behavior at the watch house, making the bite evidence inadmissible. Cebu was charged with one count of assault a member of the police force. For this, Cebu was found not guilty. The judge noted NT police may consider disciplinary action against the officers involved, but declined to speculate.
