But instead of complying, the rider attempts to escape, cutting across traffic and trying to make a U-turn. Unbeknownst to the officer, this isn't just a reckless driver. I ran up here and grabbed him and turned it off. You know what he was trying to do? He was trying to get through traffic, turn around, go the other way, run from you. Yeah. As the arrest continues, officers begin searching the rider's backpack for evidence. Inside the bag, they find more than just a few personal items. Hidden in a pocket is a clear plastic bag containing a white crystalline substance, suspected methamphetamine. Alongside it, two digital scales, a silver lighter, multiple clear bags, and dozens of credit and debit cards in various names. They also discover a bottle of prescription pills not in the suspect's name and liquid medication he claims belongs to his mother. The total weight of the meth is later confirmed to be approximately 9 g. Combined with the scales and multiple forms of payment, officers now have evidence of drug possession with intent to distribute. All right. But yeah, he had dope on him. He looked at that little Yeah, it's meth. All right, I'll try to get it off again. Maybe I had a dig on. It's been painted over. Get off the phone, lady. Did you not want to go in post? As soon as I grabbed him, he started like, "Oh, okay. I'm dying." I'm like, "You're just fine right there. I'll wait here. Um I'll just park right here. Wait here for 85 to show up. Sure. So, yeah. Well, you got handcuffs on, dude. Look, I can wiggle it up and down. Killing my arm shirt. There's nothing I can do about that. You're in custody, sir. You're in handcuffs, sir. my head, my arm, my everything. I almost died, sir. Well, I have that, too. All right. What I would suggest is put your back over there. Put your feet up in the seat. Okay. Try to get more comfortable that way. I'm not taking you out of handcuffs. And they're not going up front. I wasn't saying take them off. I was just saying lose them over one click or two or something. That's all I was asking. It's too late for you. You go anywhere. You already got me. I'm I was [ __ ] just asking that cuz my arm broke. You can see three scars on it. Okay. I got scars, too, man. I got metal plates. I got all that [ __ ] All right. Scoot back. Scoot back. All right. Sir, we're going to wait here till the tow truck comes and picks up your vehicle. All right. Then we got some other stuff to discuss. Okay. Can I Can you at least make me one phone call? My mother You'll make phone calls from the jail, dude. I don't know her number. You get Your phone was on your property, right? Close to my Was it in your pocket? It was in my jacket. Okay. All that stuff's in your hood right up there. All right. So, we're going to take that up there to jail and get phone numbers out. You're not going to let me make phone calls. Not right here. No. All right. I'm going to shut the door. [Applause] Huh? Hope not. That means it'll hit me. That won't be good. As the situation winds down, officers begin writing up the long list of charges. But the rider, now sitting in the back of the patrol car, won't stop asking questions. He wants to know what's going on. What's he being charged with? Can he make a phone call? Can he call his mom? Why is he being charged with reckless driving? Patiently, the officer explains again that the suspect is facing charges for possession of methamphetamine, probation violation, driving under the influence of drugs, suspended license, no motorcycle license, no insurance, no registration, reckless driving. Even with all that laid out, the suspect continues to press the officer trying to negotiate or talk his way out of the situation. But it's clear now there's no getting out of this one. Hey man, you had a warrant for probation violation, too. Huh? Out of Guette County, probation violation. Uh original charges a assault. Okay. Well, you got violation probation. So, they've already confirmed that. They confirm your violation probation and your driver's license suspended and you don't have a motorcycle license. Not tonight. And you don't have registration on that bike. You don't have registration on the bike and there's no insurance on the bike. I thought I had a title for it. Yeah, you got a title in your bag. I saw that. But it's not insurance and it's not registered. It doesn't have a tag. Registration's been cancelled. Huh? Not for that. [Music] 10. Careful. [Music] Sit back and relax, dude. You want your windows down or you good? There you go. What? I can't hear you. Yeah, man. I I'll get your helmet. All right. I'll put it right up there. All right. I haven't got it yet, but I will. Key for the bike. Where's it at? Oh, yeah. I got all that off. Hey man, I'm working on the impound for her now. If you want to go ahead and pick it up, I'll have it down here in a second. All right, I'll go ahead and get her loaded up. Sorry, it's right here. That's just where you want to leave it. It is what it is. I guess I can pull on up in this lane and get out of this one. Okay. Yeah, that works. That That' be better for you. It works for me. All right, I'm going to go get your helmet. I'll be right back. Huh? Yeah. Yeah. Just probation violation. Violating your probation. That's all I know. They violated it somehow. I don't know. I don't know. Drug use or not showing up or not checking in or not paying. I don't know. With the methamphetamine already secured as evidence, officers now need to determine if the suspect is driving under the influence. After reading him his rights and explaining the test, officers escort the rider, still in handcuffs, to a nearby parking lot to conduct field sobriety evaluations. The writer admits to using methamphetamine approximately four to 5 hours earlier, but insists he isn't impaired. During the test, the suspect struggles. He shows clear signs of impairment on the horizontal gaze nestagmas test, stumbles during the walk and turn, fails to maintain balance on the one leg stand. Based on these results and the earlier admission, officers formally charged the rider with DUI, driving under the influence of drugs. All right, man. I'mma read off something to you. Okay. Can you hear me? Can you hear me? Here. I'll step out and talk to you. All right. I'll read you this real quick. You have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to talk to a lawyer and have one represent you while you're being questioned. If you cannot afford a lawyer, one will be appointed to represent you before any question. You can decide at any time to exercise these rights and not answer any questions or make any statements. You understand? All right. How much have you had a drink tonight? Nothing. You hadn't drank anything? No drink? Sir, can you have trash can or no? Do what? Trash can or no? No, you can leave it right there, dude. You sure? Yeah. All right. How much drugs have you taken tonight? When's the last time you done meth? Like four or five hours ago. Okay. Yeah, I do. Cuz I can tell you're high. No, I'm not really sure. You're not high now? You're coming down from it cuz you you stay high on meth for quite a while. is I said four or five hours. Okay. It's been a while. I've been waking up and everything. Okay. How do you use it? I [ __ ] snorted a little bit. Okay. All right. Would you be willing to uh do some field sobriety evaluations? I mean, obviously, you're arrested. You ain't going to be driving out of here. You're going to be going to jail. All right. I think you're DUI. All right. Yeah. Under the influence. I don't know. Okay. Well, I believe you are, and that's what I'm asking. Will you be willing to perform field evaluations? I guess I don't [ __ ] see why not, but sir, the only reason I [ __ ] put into this lane is my throttle wasn't working as gas alone and it sputtered out and everything. So, I had to [ __ ] stop and I ended up in this. Well, you passed me in all that traffic back here driving down that center turn lane, drove out that gore and then you lane changed back into this traffic. All right. I didn't know if you s left to go straight to and then when I get up here, you're on the wrong side of the road still gassing it up in a car in front of you that happened to be a police car. That's when my throttle added up and I thought he was going to [ __ ] see what's going on and she just put me in cuffs like that. That's why I was asking you, can you help me get it on out of the street? Yeah. And I would love if you could do that [ __ ] but I understand your job, my grandpa and everything. 511 code for All right. East Side Towing's taking your bike right now. Okay. Do you want to do it? I already said I guess. Yes. Yeah, why not? I mean Huh? Why not? I mean, I got the cuffs on me. That's the only thing. Yeah. What I'll do is I'll pull in that parking lot over there and I'll get you out of cuffs. All right. And we'll do some fields over there. Okay. I got 511 ready. We got a unit available at 59 with me at Verizon. Do field pride evaluations. Can you explain what do I got to do? How do you what do I need to do for you for the test or whatever? For the what? You're going to follow it with your eyes. I'm going to watch your eyes. Then you're going to walk a straight line. You're going to hold your leg up. Stuff like that. Is that something you want to do? Okay, then we'll go over there and do it. Make sure. All right. If you do find on those evaluations, then I won't charge you a DUI. But obviously, I think you're under the influence. Okay. I can promise you everything. Do you drink alcohol? Never drink in your life? I have before, but I don't like it. Okay. My dad before he died and my mother on top of that. That's not what I was told. I don't know who told you that, but they told you wrong. Okay. You cannot drive a vehicle till you have a driver's license. Period. Cannot drive a motorcycle till you have a motorcycle license. Period. Why does it say when license suspended? Yeah. Yeah, ma'am. Hold on. I don't I've never heard that. Your driver's license was suspended last year in se uh December. fingertip here. Right there. Say why? No, it doesn't show me where or anything. It says why. Failure to appear. You didn't show up to court for something. It doesn't show me where at. 298 298 Huh? What? Well, you got a warrant. Probation violation. Okay. Reckless driving for those maneuvers that you did back there. And then I believe that's crystal meth in your bag. Correct. You had it in the little uh lighter looking thing in your pocket, then in your book bag in that black container that I popped open. Suspended license and DUI is the least of your worries right now. I'm telling you. All right. That meth. That's the big one. The meth. What? Methamphetamine. I know. I know that. I said it. You said what? You said it's something. It's the big one. It's It's what you're most in trouble about. Okay. You also got some kind of liquid in a bottle over there. It's not prescribed to you. It's my mother. It's your mother's? Yeah. Why is it in your bag? You can call her right now. She'll tell you I was taking it to her. She asked me to pick it up for you. Where'd you pick it up at? My grandma. What is it? I ain't looked it up yet. Her um her mouth and everything. Because if it's a controlled substance and you're in possession of it, that's illegal. Only she can have it. She asked me to pick it up. That's all I could say about that. She asked me to. Then what's those pills in there? Because I hadn't looked those up either. It's a white bottle. It's got description on there. It's not your name. It's paint little round pills. I don't really know. What's your mother's name? Huh? What's your mother's first name? Christina. Okay. What does she prescribe that for? She she had like a bad something like that. The nurse or doctor prescribed it to her to control her coughing and everything cuz it was hurting her. Okay. Oh my gosh. Come on, dude. All right. You good? Yeah. I'm gonna get out of here. I'll get out of your hair now. Yep. Sounds good. Have a good evening, man. You, too. All right. As soon as he rolls out, we'll pull over there and do these fields real quick. So, I don't know if you notice, but my mother's medication. Yeah. If she [ __ ] if I talk to her about it and everything and tell her what happened, that'd be something for court. that court has done yet. Yeah. I mean, if it's if it's a controlled substance and I charge you with it, that' be something you have to take up in court. Okay. But if it's a controlled substance and you're a drug addict with meth on you, you know, I'm going to charge you with that cuz I think that you're taking it. I didn't know that. He said he wants to do fields. He wants to do fields. Yeah. Like Okay. [Music] Nope. Been stretching. Okay. I mean, they sent you and I was like, h they probably need to send someone else, you know, but All right, man. Hop out. When you do, face the vehicle for me. All right. Listen to me. If you do anything stupid and try to take off running, I already know who you are. Okay? I'm not going to chase you. I'm not. I might. Okay? But I got all the evidence to charge you with everything tonight. And I know exactly who you are, so I'll just take a warrant out for you. Okay? You understand? You run across that road and get hit and you live, I'm going to charge you for that, too. All right. So, I'm going to take you out of them cuffs. Don't do anything stupid. Yep. All [Music] right, go and pull your jacket up. Just so you know, you're still under arrest. You're not free to go. All right, just walk over there. Right here. Face me. All right. What I'm going to do, I'm going to put my finger right there in front of your face. I'm going to go side to side. All right. I'm going to check your eyes like we talked about before. All right. Do you have any medical issues that prevent you from walking or standing? Just from my accident. From your accident. But you've been able to walk here. Yeah. You got a little wimp. And you're standing right now. But yeah. Okay. You able to see me right now? Yeah. Blurry, but yeah. Okay. Follow my finger with your eyes and your eyes only means keep your head still. Okay. weather goat. 538. I think about 68. [Music] All right, I'm going go up this time. All right, cool. See this white line right here? I want you to line up on it. Put your left foot in front of your right foot. Yep. Put your left foot in front of your right foot. Heel to toe. Just like this. I want you to keep your hands down by your side. Don't begin till I tell you to do so. You understand? All right. Don't start until I tell you to do so. I'm going to demonstrate it for you. I'm going to tell you everything that is that you have to do. You just stay right there. All right. What I'm going to have you do is take nine heel totoe steps. Okay? I want you to count out each step. I want you to make sure that you take nine steps just like so. One, two, three, and so on till I reach my ninth step. Once I reach my ninth step, I'm going to have you pivot on your lead foot by taking a series of small turns around it just like this. Then I'm going to have you take nine hill to toe steps back. One, two, three, and so on till you reach your ninth step. All right. Make sure that you look down at your feet, keep your hands down by your side, you don't stop until you finished. All right? And you count out each step. You understand my instructions? All right, you may begin. You got to turn around. Come back. Okay. All right. You can face me. Put your feet together. Arms down by your side. There you go. Just like that. All right. This time I'm going to have you raise one foot. Whatever foot you want to. It can be your left foot. It can be your right foot. All right. I want you to hold it up just like this. I want you to look down at your feet and count out 100,00 1,002 1003 and so on till I tell you to stop. You understand my instructions? Okay, you may begin. [Music] 800,000,000 10,000 11,000 12,000 13,000 14,000 15,000 16,000 1700 18,000 All right, you can stop. All right, turn back around for me and putting you back in handcuffs. We have finished the evaluation. Okay. Which hand is it? Is it this one or the other one? All right. Here. I'll tell you what. I'll do this for you. I'll put you in two cuffs. That way it's more comfortable for you. Go and bring it back here. So, as far as you're going to have to bring it back right there. Okay. The less you try to squirm around in the car, the less it's going to hurt. But if you keep moving around like you were earlier, it's going to hurt. On July 1st, I almost died. I got you. Well, I'm just I'm just telling you, you will feel better. They remove six plates from my head. Everything. All right. That method you took about four or five hours ago is still in your system. All right. So, you will be charged with DUI tonight. Why? Cuz I believe that you are under the influence. All right. So, let's hop back in the car and I'm going to read something off to you.
