Sheriff in the state of Florida, you cannot search a vehicle with probable cause anymore. >> You have no idea what you're talking about. >> You know I have a video? >> And you're going to jail. >> And I have it all on video. >> That's excellent. So do I. >> This is about to be a money maker for me. I got lots of petty money. >> On July 11th, 2024, the Santa Rosa County Sheriff's Office clocked an SUV doing 95 in a 65. Deputy Lynn pulled it over. What he found inside would make this stop anything but routine. The deputy smelled marijuana before the conversation was 2 minutes old. The driver gave three different answers in 90 seconds. Nothing, then a pen, then a pen and a blunt. Each one slightly more honest than the last. None of them complete. Here is where it matters. Marijuana possession in Florida is a misdemeanor. THC oil concentrate is not. Under Florida law, any quantity of cannabis extract is a third-degree felony. The deputy found five separate pens. That is five separate felony counts. Up to 5 years each. Sisters. >> Hello, how are you? Hey, I'm Deputy Lynn, Santa Rosa County Sheriff's Office. I want to make your acquaintance. My lieutenant here told me she stopped you for 95 in a 65. Does that sound about right? >> Yeah, but I was following a car in front of me. I don't understand. Like >> Well, then y'all were both doing 95 in a 65. Does your speedometer work? >> Just now it said it said 65 or something. >> Okay. Does your speedometer work okay? >> Yeah, it was working. >> What did it say What did it say you were doing? >> I was just keeping up with traffic. And then I didn't even >> So, when you were keeping up with traffic, what did it say you were doing speed-wise? Did you look at it? >> I didn't look. I swear to god. I was just going with the flow. >> I got you. Hey, do me a favor. Would you mind stepping out with me real quick and talking to me in front of her car over here? What's up, Demauri? How you doing, man? >> Am I Am I going to jail or something? >> No, just come over here and talk to me. You got shoes on? Okay, you got shoes on. I'll make sure you don't stand on this hot asphalt. Hey, listen, is there anything in that vehicle I need to know about? Any marijuana in There's nothing in there. Why am I smelling an odor of marijuana and coming out of your vehicle? >> I don't know. >> Okay, has there been marijuana in there? >> I would just rented it earlier. >> Hold on. Hold on. Hold on. STOP. >> I JUST RENTED IT EARLIER. >> Where's the marijuana at inside the vehicle? I DON'T KNOW. I'M going to give you one opportunity to be honest with me before I take you to jail for possession of marijuana. Listen to Listen to me. Listen to me. I'm telling you there's marijuana inside the vehicle because I can smell it. Okay, do you have a medical marijuana card? Listen to me. Here we go. Now we're being honest. Okay, so listen to me. Where is the pin at inside the vehicle? I don't want you to grab it real quick. I'm going to get it in just a second, but I'm going to search the remainder of that car. Am I going to find anything else in there that you shouldn't have on you I'm right here. Listen to me. Am I going to find anything in there you shouldn't have? Marijuana, methamphetamine, crack cocaine, ecstasy, I'm asking you to be honest with me because I'm going to search the car. Hold up and stop [ __ ] DON'T WALK INTO TRAFFIC. DO ME A FAVOR, GIRL. Stand on this grass right here. Now we got a blunt and a pin. That's it. That's it. That's the two things you can check. But you told me that was it just a second ago when you said JUST A PIN. LISTEN LISTEN TO ME. HOW DO YOU SAY YOUR NAME? MARISHA, let's start over with each other, okay? Because you haven't been honest with me yet, all right? I don't want to take you to jail. I'm not HERE TO SO, listen to me right now then. Listen to me right now. Let's start over and let's be honest with each other. Marisha, how you doing? I'm Deputy Linton with the Sheriff's Office. I smell marijuana coming from inside your vehicle. Do you have a medical marijuana license? Okay, so is there marijuana inside your vehicle? Okay, where's the marijuana at inside your vehicle? Okay, what kind of marijuana product is it that we're talking about inside the vehicle? Just a rolled blunt. What about the pin you were just telling me about? Okay, so a pin and a blunt. That's what we got in the I'm not going to find any raw in there. Am I going to find any bud? Am I going to find any pills and [ __ ] that you shouldn't have in Who's little kids are these in the back seat? Why aren't they buckled up? Why you got two of them sharing one buckle? >> This is what they rented me. I didn't know. >> Okay. How many people you got in there total? I see you got the four in the front and who's in the back? >> Um the four kids in the back. We're 15 minutes from my sister's house. That was we were staying there. >> Okay. All right. Have you ever been in trouble with law before? >> No. >> Are you on papers, probation, community control, anything like that? >> No sir. You can run my name. >> Then this is just as simple as Listen to me. This is just as simple as this. If all you've got in there is a little bit of a blunt and you got a little bit of a pen Listen to me. Stop interrupting me. If that's all you got in there is a little bit of a pen and a little bit of a blunt not an entirely huge deal. Now this deputy, she might write you a citation for the speed or something like that. But listen to what I'm telling you. >> Okay. Okay. >> What I'm going to do is I'm going to search that vehicle. Okay. >> Yes sir. I'll grab it for you. >> I need the little ones to step out. We can have them stand in the grass over there. But do Listen to me. Come here. I didn't tell you to walk away yet. >> I'm I'm sorry. My anxiety is thrown off. >> I'm not trying to throw your anxiety off. I want you to listen to me for a second. >> I'm sorry. >> I'm trying to kind of put your anxiety at ease. >> I know. I'm just so I I >> Do the little ones have shoes they can wear because there's fire ants and what not out here. All right. So let's put some tennis shoes or whatever we got on them. Let's have them stand in the grass. But I don't want them getting eaten up by bugs. Okay? So put the shoes on them first. Okay? You got shoes on? All right. Cool, man. Step on out for me, Demorian. Come stand back here by my lieutenant for me, Demorian. Go stand right back here. Y'all got shoes on? All right. Put your shoes on. I don't want you getting bitten up by bugs. Fire ants and what not. All right? >> Charles 3 >> What's up, bro? >> While the search was running, so was Deorians name. What came back from the database had nothing to do with marijuana. An active extradition warrant out of Louisiana, aggravated assault on a law enforcement officer, not a ticket. A felony warrant with full extradition authorized. The deputy had every legal basis to charge the driver with five felonies. He chose not to. He had told her at the beginning, if it is just marijuana products, you are not going to jail. He honored that. The THC pens were seized, she was released. That is the call a professional makes. Then a third vehicle appeared. The driver's sister arriving to pick up the children. The deputy told her to return to her car. She did not. He told her a second time, then a third. Each warning was clear, each was ignored. She told officers the search was illegal, that Florida had passed a law eliminating odor of marijuana as probable cause. She was certain. She cited it on camera. The law she described does not exist. Florida courts continue to recognize odor of marijuana as probable cause throughout 2024. The argument had no legal basis. After the final warning, she stepped back toward the scene. The officer told her, that is an arrest. She came back anyway. He placed her in handcuffs for obstruction of justice. Her own phone, which she had been running the entire time to document what she called an illegal search, captured the arrest in full detail. She told the officer this case was going to make her money, that she had lots of petty cash for a lawsuit. The officer noted that he also had video from a department body cam with audio, running the entire time. >> Brass knuckles for It's a present that's considered a concealed weapon. Yeah. Can you have brass knuckles in Florida? Hey Deorian. Go and turn around for me, man. >> That's not his stuff. It's not the marijuana. >> to You hold this. Hurry. >> It's the bag with the >> to get you to launch your back for me. >> The bag was mine. >> Just hang tight. WE'LL BE RIGHT BACK. SO, DEORIAN, I'M PUTTING TO PUT RIGHT NOW, BUT CUZ YOU GOT A WARRANT out of Louisiana. >> Warrant? What? >> What happened? >> Hold up. Listen to me. I'm going to explain it to you. Don't pull away from me though. You don't want to fall on the ground. You got a warrant out of Louisiana for aggravated assault. >> Is it aggravated assault? Is that what they said? Okay. >> Aggravated assault. We'll talk about it in just a second. Hang on one second. Back up for me. >> What did he say? What did he say? What did he say? What did he do? >> We'll discuss it in just a minute. I'll explain it in just a second. He's got a warrant out of Louisiana. I believe they said aggravated assault, but I'll double check on that. >> Aggravated assault? What's that? >> Aggravated assault. It's just what it sounds like. Aggravated assault. Yeah, you know, you can kind of say it that way. The warrant I'll let you have a seat in the back of my car for just a second, okay? We'll just get you out of the heat for just I'm not trying to embarrass you on the side of the road having to stand here in handcuffs, okay? So, you're just detained right now. So, what happens Listen to me. What happens is you have a warrant out of Louisiana. We send a hit to Louisiana. Okay? The hit comes back either confirmed or they won't want you, okay? One of the two things. They're either going to say, "Let him go. We'll get him at a later time and date." Or they're going to say, "Go ahead and send him to us." Okay? If they say, "Go ahead and send him to us." you'll be taken to Santa Rosa County Jail. We'll go from there. >> Right. >> If not, I'll let you go. You can deal with your warrant on a later date and time. Do you know what Do you know what the warrant's for? Do you recall? >> Can Okay, wait. All right. Can you Is this like All right, look. What's up? Okay, a a warrant for aggravated assault? >> Mhm. Aggravated assault on a police officer. >> On a police Wait, what? >> I think they said on a police officer. Here, let me have you a seat. I'm going to I'm going to look at it. >> Give me a second, man. >> Just please try to try to just get >> Yeah, I'm going to figure it out, bud. But right now, like I said, you're being detained. You're not under arrest quite yet. You're being detained. I want you to sit down. Watch your head for me, okay? We'll get your information. Give me a second. >> I don't know what none of that is. >> Your mom, right? >> Yeah. >> Okay. So, what she's telling me is she that he has a warrant out of Louisiana, okay? A full extradition warrant out of Louisiana, which means >> He got a ticket or something? >> No, it means he caught a criminal charge. >> Yeah, but like how Did How did he get >> Has he been in with law enforcement in Louisiana? >> I don't know. He He's >> He don't tell you nothing? >> No. He He bounces back and forth with his friends and his family. >> here to I'm here to tell you then. The Morgan got in some trouble, it sounds like, in Louisiana, and he's got a warrant for his arrest for aggravated assault. I'm going to look at the exact specifics of that in just a second when I can look at the exact specifics of that. But, meanwhile, we're going to deal with what we got sitting on your rooftop, and then I'll come back and get you some more information in just a second, okay? Stand by. >> Yes, sir. Hey. >> I'm here. Why are they searching the car? >> Okay, who are you? >> I'm here. Don't worry. >> Who are you? >> Why are they searching her car? >> Okay, you're not involved in this. I need you to go back to your vehicle. I need you to go back to your vehicle. >> Why are they searching her car? >> Okay. Go back to your vehicle or you can go to jail. Go back to your vehicle. >> No, it's not. Go back to your car. >> Go back to your car. >> Go in handcuffs and go to jail. >> Betty, just go to your car. All right, just know it is illegal. Go back to your car. >> If you come back out here, I will take you to jail. >> For what? >> All right. >> Daddy, you should just go, please. >> No, please, please, please. >> to jail. >> Daddy, no, please, no. I don't have police's number. You're going to Don't end that video. They're illegally searching your car. Last year it was passed. Any smell of anything is not a probable cause to search a vehicle. And I got a lot of money to play. I will sue. >> You are now under arrest. You are now under arrest for obstructing justice. >> Obstructing justice? But, did I walk up and do anything? I'm here to >> Yes, you did. Doesn't matter. You're going to jail so I'm going to have to get your kids. Hey, LT. Do you have a cage? You pull away from me one time, you're going on the ground. Do not pull away from me. >> pull away from you, officer. >> You're pulling away from me right now. >> I need my phone, please, and my keys. >> 10-73. >> Make sure the video does not end. I'm recording for my safety. >> Yeah, I'm coming. I need another one of cage. I don't want to put them in the same one. >> 23, we need another unit over here. >> So, I'm under arrest for not even stepping 10 ft near you? >> No, you're within 10 ft. You were in her face. >> You know I have a video? >> You're going to jail. >> And I have it all on video. >> That's excellent. So do I. >> Okay. >> No. No, I gave her fair warning several times. >> never even approached you. I was nowhere near you, officer. >> you to back up multiple times. >> But I was never near you. >> You're going to jail. >> Let's go. illegally searching her car. You do realize that's probable cause, right? >> up on your statutes. >> Pull it up right now on your phone. >> I'm not arguing it with you right now. >> Call call call a higher up. Ask them. >> That is a higher up. She's a lieutenant. >> So, she would know that it's illegal. In the state of Florida, you cannot search a vehicle with probable cause anymore. >> You have no idea what you're talking about. Hey, y'all stand back over there by that car for me. >> They have the kids, guys. The kids out on side of the highway. I'm here to pick up the kids. My phone is here to record my statement. >> Give me your phone. >> You are not You know you're not allowed to take that. >> Yeah, I am because you're going to jail. Sergeant, hold that. Give me your keys. You're going to jail for obstructing justice. I told you multiple times to back up. >> stood near you. I know. Ma'am, I am scared for my life and I would like to record this. I am scared for my life. I never I never even got 10 ft near him. All I did was walk up and ask why are they searching the car. >> can you turn that off? >> I'll show you the video. It's not your business. >> It's that a 10-50? They will actually be here with the kids. >> 26, show me 10-15 on him. But I got one more detained. I'm going to get you some 14s in a second. >> Okay, but they're on the highway. >> Sergeant, can I walk over to your car? Is that all right? >> I would like to >> Are you guys ready to go? Okay. I just want to put them together. I can't put them together. I don't know their relationship to each other. >> That's my sister and I'm here to pick up the kids. I have it all on video. I did >> This would be This would be All All go. Let's go for a walk. >> I like my belongings. I have to turn >> emergency lights. Can't you see? I HAVE TO TURN EVERYTHING OFF, SIR. >> Are you going to keep pushing against me and wind up on the ground? >> Listen to the deputy. >> Now, >> my truck. >> do you have anything on you that's going to get you in trouble when you get to jail? >> No. >> All right, do you want to search her for me? >> I don't even have a record and you're doing all of this. >> You did this. You walked up on us and refused to leave. >> You stopped us. I asked her a question on what was going on and you harassed me. >> have anything on you that's going to poke me or stab >> No, ma'am. I cannot wait for this case. This is about to be a money maker for me. I got lots of petty money. This is insane. Arresting someone with zero zero charges or anything. >> That doesn't mean you're not committing a crime currently. >> We Oh, we have it on video. >> I know we do. >> Yeah. I never said You walked up to me >> She's good. >> and grabbed me. Can I please turn off the lights on my vehicle? >> Yeah, we'll take care of that. Go ahead and sit down for me. Once you have any step in. Hey tomorrow, step back out with me. So, yep. Swing your feet around. No, no, no, no. This one of your feet got to come first. All right. So, here's the deal. They confirmed your warrant. Yep, yep. I'm going to pull your foot right here. There you go. They confirmed your warrant so they are going to extradite. So, at this point, I'm going to empty your pockets of whatever you got on you, okay? Just chill out, man. It's all right. All right, look. You got four coins in your pocket right there. That's going to go with that cash and cattle on you. I'm going to dog-ear out your pockets. >> This is crazy. >> It is crazy, isn't it? >> Yeah. >> One more coin. That's a total of five coins along with the paper money you got in the front. You don't worry, about else on you. >> No, sir. Nothing's going to get you in trouble when you're introduced into the jail? Anything in your shoes? I don't want you to come over here man if there's anything in here, but if you want to. I'm just giving you the opportunity to be honest. Step away from me. All right, so look at the back of it if you can. As much as you can. So you're going to be placed under arrest and you're going to go to jail today for your warrant out of Louisiana. You don't have any charges with me. I'm going to explain to you in just a second as soon as I get a chance, okay? I'm going to sit down and I'm going to look at the screen with you and I and you and I are going to look at the screen together here in just a second, okay? Watch your head when you step in, okay? So this is what you're losing today, okay? Listen to me. Listen to me. Please don't interrupt. You told me earlier you had one stick blunt. You got two. You told me earlier you had one pen. You got five. You didn't know you had five in there? And listen to me also, that one's in the warrant's bag. He could be going to jail for it. You know Let me explain to you how that works. Let me explain something to you. This right here? That little bit of dab oil in there, I don't care what they call it in Louisiana, it's a felony here in the state of Florida. The warrant more than anybody should know that. This is a felony in the state of Florida. Any quantity of THC oil concentrate is a felony. You got one, two, three, four, five. Five counts. Five counts of a third degree felony. You look at five counts of a third degree felony, possession of controlled substance. Possession of marijuana, that's a misdemeanor in the state of Florida. I'm not going to take you to jail for any of it cuz I'm not trying to take you to jail. That wasn't my intention from the very get-go. Like I told you when I first started talking to you back in the car, what did I say? I said I said listen, I said if you just got marijuana products we're fine with it. We're not fine with it, we're going to seize them, but we're fine with it. You ain't going to go to jail, right? Didn't I tell you that? It's all my man of my word. I'm not going to take you to jail for marijuana products. It includes K2 and all. I could again, that's five counts of third degree felony right there. Possession of controlled substance. You told me you don't have a medical marijuana card. That's where we're at. Okay? So, this is where I'm at with it. You're going to lose these products today. Okay? Take a good look at them. >> That's fine. >> That way you don't say Deputy Lynn stole my joints from me. Okay? These are the items you're losing today. You're not going to get these back. I'm going to put them in for destruction. Like I told you, I'm not going to charge you with anything. That's why I told you to get going. >> Okay. >> Now, your friend friend, sister, what is she to you? >> My sister. >> She's your sister. Your sister's going to go to jail today. >> Um >> Because she's obstructing justice. Whose car is that? That's my question for you. >> and her. >> Okay. Is there somebody around who can get that car for her? >> Louis, her husband, he's 15 minutes away. That's where we was at. >> Do you have his phone number? >> No, I'd have to ask her. >> Okay. So, I'm going to let you call Louis to come get the vehicle, otherwise I'm going to have to tow it cuz it can't sit here on the side of the road. I don't want to tow her pretty purple Cadillac over there. >> Yes, sir. >> All right. So, Louis needs to come get the vehicle. We'll address that in just a second. Do you have any questions for me so far? >> Yes, >> His is confirmed. They will pick him back up and they're going to send him back to Louisiana where he's going to address whatever he's got going on with his warrant. I'm going to review that here on my computer in just a second to get the exact >> The outcome. Demorian was arrested on the confirmed Louisiana extradition warrant for aggravated assault on a law enforcement officer. Louisiana authorized full extradition. He was transported to Santa Rosa County Jail to await transfer. The driver's sister was charged with obstruction of justice and resisting arrest without violence. Florida statute 843.02. A first-degree misdemeanor carrying up to 1 year in county jail. Berisha, the driver, was released without charges. Her cooperation made the difference. Two lessons. First, when an officer gives a lawful order to return to vehicle, return to your vehicle. Proximity to an active law enforcement scene after repeated warnings creates criminal exposure entirely separate from whatever brought you there. Second, citing a law that does not exist is not a defense. It is a transcript. Deputy Lynn gets an A. He gave fair and repeated warnings before every escalation. He kept his word to the driver on the marijuana charges when she cooperated. He processed a complex multi-subject stop. Four kids on the roadside, one warrant subject, one obstruction arrest, calmly and methodically throughout. Under Graham versus Connor, officer conduct is judged on what they knew in the moment, not in hindsight. Every decision here holds up. He did not let a loud argument and a phone camera change the outcome. D'orean gets a C minus. He was cooperative on scene and did not create additional problems after the cuffs went on. But, he was traveling across state lines on an active felony warrant for assaulting a law enforcement officer. That warrant did not expire because he crossed into Florida. It just waited for someone to run his name. Marisha gets a B. She was not fully honest at first. Three rounds of incomplete answers before she disclosed everything. But, she cooperated once directly confronted. She kept the children calm, and when the deputy gave her an opportunity, she took it. Her cooperation is directly why she left the scene free. The sister gets an F. She drove to a traffic stop she was not part of, ignored three lawful direct orders, asserted a law that does not exist, and recorded herself doing all of it. She arrived to pick up children. She left in handcuffs. The video she intended to use as evidence became the clearest record of her own obstruction. Under Florida statute 843.02, obstruction does not require physical contact or violence. Returning to an active law enforcement scene after a clear lawful order, that is the charge. She met every element on camera, twice. If you want more body cam footage, the moments that matter, with the law explained, hit subscribe. We post every week. Drop a comment.
