STOP. >> WHAT HAPPENED? >> STOP. [screaming] STOP TRYING TO PUNCH ME, KICK ME. >> [screaming] >> WHAT'S THAT COP? >> MAY 31ST, 2023. Key West police responded to a trespassing call at a local bar. Two women, both intoxicated, had been asked to leave and refused. When officers arrived, they tried to resolve it simply, show ID, go home. That option closed fast. In Florida, trespassing after warning is a misdemeanor. Simple, low stakes. The women could have walked away with nothing more than a warning. Instead, they chose to argue about jurisdiction. One of them told the officer he was not the president of the country. She was correct. That is the last thing she was right about that night. Here is the legal moment that changed everything. Officers requested identification. Under Florida statute 856.021, when police have reasonable grounds to believe a person is loitering or causing a disturbance, identification is required. Refusing to provide it and attempting to walk away, that is obstruction, not an argument, a charge. Watch what happens when the officer says the word jail. Neither woman stops. Neither woman complies. One of them begins physically pulling away from officers. Under Florida law, any knowing resistance to an officer performing a lawful duty, even without a punch thrown, qualifies as resisting without violence. That charge was already loading before anyone threw a hand. The other woman escalated further. She grabbed, she kicked, she tried to bite. Each of those acts is battery on a law enforcement officer under Florida statute 784.7, not simple battery, a third-degree felony. Five years per contact. She made multiple contacts. One woman invoked the Ukrainian war, her brother, her country. It is not irrelevant, it is heartbreaking in its own right, but Florida courts are not moved by personal circumstances at the point of arrest. What matters legally is what you did in that moment, not why you believe you had the right to do it. She told the officer she was a lawyer. That is an interesting claim to make while actively striking a uniformed officer on camera. Attorney status does not create immunity from arrest. It does not suspend Florida statute 784.07. If anything, legal training makes the choice harder to explain later in a courtroom to a judge on video. At this point in the footage, officers have been managing this situation for nearly 10 minutes, five of them against two women. One observation, the officers never stopped explaining. They gave warnings, they gave reasons, they offered exits. The women declined each one in sequence. This matters legally. It establishes continuous opportunity to comply before force was used. The attempt to bite an officer is not a footnote. Under Florida law, biting that breaks skin can be charged as aggravated battery, a second-degree felony, up to 15 years. The officers called for a spit mask, that is standard protocol. It is also a data point. When you need a mask, the resistance has reached a threshold. Most defendants cannot explain to a jury. There is a moment in this footage, around the 14-minute mark, where one of the women says, "If you are police, I will not do anything." She means it. She calms. She cooperates briefly. Then reverts. That fluctuation tells us something. The behavior was not entirely beyond her control, which makes the prior conduct a choice, not a crisis. That distinction matters at sentencing. Hobble restraints, taser warnings, multiple officers restraining a single subject. This is what escalation looks like when every de-escalation option has been refused. Under Graham versus Connor, the Supreme Court standard for use of force, officers are judged on what a reasonable officer would do given the totality of circumstances. Biting, kicking, punching, and removing handcuffs. That totality justifies every tool used here. Here is where it shifts. One woman says, "I will go where you want. I will not struggle." She complies. She is secured without further incident. Her cooperation window at the beginning was the same window available to her now. She simply chose to open it 17 minutes later. Cooperation affects sentencing. It does not rewind the charges already documented on camera. The second woman still in the patrol car is kicking the interior. She has already been warned about additional charges. She is receiving them in real time. Each kick is a documented act of battery. Each act is a separate count. At this point in the incident, the legal exposure is not growing linearly. IT IS COMPOUNDING. >> [screaming] >> I HAVE A I HAVE A LAWYER. I HAVE A LAWYER. YOU DON'T HAVE A [ __ ] PROBLEM. YOU'RE A [ __ ] [ __ ] WITH A DICK. DON'T TOUCH ME. >> STOP. >> TOUCH ME. >> YOU'RE GOING to get PUT BACK IN HANDCUFFS. >> I WASN'T IN THE CAR. >> [screaming] >> I WASN'T IN THE CAR. I WASN'T IN THE >> OFF. YOU NEED to put IT BACK ON. >> I WASN'T IN THE CAR. WHY YOU TOUCH ME? [ __ ] >> BECAUSE YOU TOOK THE HANDCUFF OFF AND THEN YOU STARTED TO PUNCH ME AND KICK ME. >> WHY YOU PUT ME THERE? WHY YOU PUT ME THERE? YOU PUT ME THERE FOR NO REASON. I KNOW. I KNOW. >> [laughter] >> I KNOW. >> ON. >> YOU KNOW WHAT? YOU go to the jail. You You go TO THE JAIL. >> [screaming] >> YOU GO TO THE [ __ ] JAIL. >> I KNOW. DON'T TRY BITING ME. STOP BITING. Stop trying to bite. Sarge, we got to close this pool, huh? We got to close THIS >> WHY YOU WHY YOU WHAT AM I DOING? WHAT AM I DOING? >> [screaming] [screaming] [screaming] [screaming] [screaming] [screaming] >> YOU GOT TO LISTEN. I'M LISTENING. WE'RE TRYING TO PUT THE HANDCUFFS ON. >> [screaming] [screaming] [screaming] >> STOP KICKING. >> [screaming] >> STOP KICKING. CUZ WE'RE TRYING TO PUT THE HANDCUFFS BACK ON. YOU'RE NOT >> [screaming] [screaming] [screaming] [crying] >> DON'T PINCH MY DON'T PINCH MY HAND. DON'T PINCH my hand. You're not listening. WE'RE TRYING >> [screaming] >> WE'RE TRYING TO GET THE HANDCUFFS ON. YOU'RE STILL NOT LISTENING. STOP. You got it back there? >> Don't bite me. Don't bite me. Don't bite me. We're going to find me a mask, too. Guys, step away. Everybody step away. Stop fighting. Stop. We are as soon as we're done. Let me check this one. All right. Ready? Hang on. She's on her legs. Go ahead and get up. Get up. Are you getting her up? One, two, three. You got her? Slide up. >> Here, let me relax for a second. Come here for a second, okay? >> What happened? What happened? What did I do? >> What did you do? >> What did I do? >> STOP. STOP. >> YOU GUYS WANT ME TO UNTIE THESE HANDCUFFS? >> YEAH. >> What are they doing? What are they doing? >> Hold on. Hold on. >> What is this already? >> We're going to stop. Just stop. >> What is this already? >> Stop grabbing on her. Look at yourself. >> Relax. >> What is this already? >> Relax. >> You hit me in the face with the cuffs? You hit >> You're good to go. All right. Hold on. Let me undo these. Do we have different Watch yourself. >> I just I just laughed at him. >> Stop. Just relax. >> face? >> What are they doing? Yes, I see your face. >> All right. You're good to go. >> What did I do? What did I do? I see your face. >> Yeah, we got her. Pull her right there for a minute. >> Unless they know where you guys are going. And then send me up. >> Okay. We're going to have to just do the transport. Yeah. >> This is >> Do we have a hobble or no? >> She's on with a hobble, yes. >> Yes, she got on She got on the hobble. We're redoing it. >> You're good? >> All right. >> All right, listen. You're going to get tased. You want tased? You want tased? All right. You might have to say You're going to You're probably She's Do you want tased or not? >> to get tased? >> Then stop resisting. >> Okay. You're >> Stop resisting, okay? Stop. You're going to get tased. All right? >> Right. >> I don't know what they do, you know? I don't know what they do. >> They do what they want. >> You're going to get tased. Stop. >> She got the hobbles. All right, three pull out. >> All right, yeah. Let's grab Hold on. Hold on. Hold on. We got to go back this way. Okay, so the uh There you go. Just got to get that off. There we go. Now we can bring her out. All right. All right, I'm coming back out. >> To get the handcuffs on. >> Come on out. Come on out. >> Come on out. >> You're going to get tased. >> Okay, stay right there. Stop resisting. All right, you're going to get tased. >> Yeah, I know. >> That's what's going to happen. >> Yeah, they're just >> You want to try those? >> Yeah, just keep those on right now. >> All right, we're not just keep pushing on these ones. >> Yep. >> I will go where you want. You don't have to stay on my feet. >> Relax. Relax. >> You don't have to stay on my feet. >> Yep. >> I just go where you want. Let's see. I will not struggle or something. >> All right, so now >> I don't want the worst day pain. >> I double cuff this one. >> I will cuff my other cuff down here. >> Try those on her. >> I know what cuff What cuff I'm wearing here. >> Let's just get this and get them started if they are. >> Yeah, let's get them. >> So >> Okay, we'll just leave them like that. >> Yep, leave them like that. That's fine. So, let's get the hobble. Hobble? >> Yep. >> Let's me see that real quick. You guys got a hold? >> Yep. >> All right. >> I'm dying. I'm looking at you guys. You are gods. >> Relax. We're trying to get this on you. >> I want to call the police. >> We are the police. >> I want to call the police. I want to call the police. >> You're ready? >> Hold on. Quiet. >> Search. >> Did she get the other one off? >> Nope. Yes, she got it back off. >> You're going to get taped. Stop. >> I have a right lawyer, PEOPLE. >> STOP. STOP RESISTING. STOP. WHERE YOU WANT TO >> STOP. STOP. STOP RESISTING. >> WHERE? WHERE? >> They're trying TO PULL YOU >> HOLD ON. >> You want HER ON THE GROUND? >> SHE'S GOING TO. SHE kicks up again. >> Kick your foot up. >> [laughter] >> She's in my car and she's kicking in there. No, we don't need to get her out. She's kicking in the car? Yeah. Hold on a second. Hold on. All right. All right. Got her? I think we just got two of yours. >> Final charges: battery on a law enforcement officer, resisting with violence, resisting without violence. In Florida, that combination carries a maximum of 11 years and $11,000 in fines for a bar that asked two women to leave at closing time. The math on that decision to stay, to argue, to fight does not work in their favor. A quick note on what we watched, officers showed restraint under sustained physical assault. They warned before tasing. They explained before escalating. They offered exits repeatedly. That is not weakness. It is procedural discipline under Florida's use of force statute. Every step they took is defensible. The footage is the record. Lesson, the moment a property owner or their staff asks you to leave, the legal analysis ends. You either leave or you trespass. Every choice made after that point to argue, to resist, to fight adds charges, not reasons. The law does not require the establishment to to justify the request. It only requires you to comply with it. Now, the grades. Officers A, they maintained composure through sustained resistance. They warned before every escalation. They gave opportunity to comply at each stage. Under Graham versus Connor, their use of force was proportional at every point. Professional execution under difficult circumstances. Woman 1, D. She had multiple opportunities to stop this before it became a felony situation. She chose to escalate at each one. Her identification refusal triggered the lawful arrest. Her physical resistance triggered the felony charges. Her cooperation when it finally came was too late to remove what the camera already captured. Under Florida statute 784.07, intent is not a defense. The act is the effect. Woman 2, D. Kicking in the patrol car, removing handcuffs, physical striking of officers. She compounded the charges systematically. The claim of legal background makes each decision harder to present as confusion or panic. The footage does not support either explanation. Florida courts will not need much persuasion. If you want more body cam analysis, the arrests, the decisions, the moments the law meets real life, subscribe. We break down the footage and the statutes every week. Drop a comment. Given everything on camera, what do you think a fair sentence looks like? We'll see you in the next one.
