On April 17th, 2023, Orlando police responded to gate 24 at Orlando International Airport. A passenger had called in a woman screaming and acting erratically. By the time the day was over, she would be facing four criminal charges, two of them felonies. Her name is Sher, and this is the footage nobody at that gate expected to end up in a courtroom file. Officers are attempting verbal deescalation. They have already spoken with her husband. She is not interested in talking. Every question they ask gets the same answer. Leave me alone. This is a public airport. There are passengers watching from every angle. Officers know exactly where they are. They are choosing their words carefully. So is she. In Florida, disorderly conduct under statute 877.03 is a secondderee misdemeanor. 60 days. That is where the charge sheet starts. What happens next is where it ends. >> In the area of gate 24 that a woman was screaming and acting erratic. >> Hello. >> Don't touch me. >> We're not touching him. Hold on. >> We're going to put you in this seat. >> Okay. >> That way you're out of sight and it may keep things from getting She's pretty understandable. Yep. Exactly. Guys, >> she just bit one of the officers on camera in a crowded terminal. That single act rewrites everything. Under Florida statute 784.07, battery on a law enforcement officer is a thirdderee felony. Up to 5 years in state prison, per count, not per arrest, per count. This is not a version of the disorderly conduct charge. It is a standalone felony. Intentionally striking an officer you know is on duty. The body cam captured the act, the context, and the reaction simultaneously. Prosecutors rarely get a cleaner case. Florida law draws a precise line between two versions of the same charge. Resisting without violence, a misdemeanor. Resisting with violence, a thirdderee felony under statute 843.01 up to 5 years. She is giving them both on the same footage. Officers are still holding. They are not striking. They are not using the taser they warned her about. Every additional second of resistance is another element being established on camera. She says she has kids. She says she has a family. The officer says he knows. None of that changes what was just captured on the body cam. Florida's battery statute does not have a family exemption. Officers are now moving her out of the gate area. The stretcher call is coming. This is a tactical decision. It reduces injury risk for everyone involved and limits ongoing resistance in a public space. What we are watching in this section is the difference between how she thinks this is ending and how it is actually ending. The charges are already written. The body cam is still running. 1 2 3 up she goes. The stretcher is deployed. She is placed. She is cuffed. The gate area is cleared. 9 minutes after the first officer arrived, it is over. Sherry was charged with disorderly conduct, battery on a law enforcement officer, resisting without violence, and resisting with violence. She is innocent until proven guilty in a court of law. Combined maximum exposure on the felony counts alone up to 10 years. The officers get a B+. They gave her every available offramp. Multiple attempts, calm voices, patience in a public terminal with an audience. Under Graham versus Connor, the force used is evaluated on what officers knew in the moment, not in hindsight. The stretcher call was measured. The grade is not an A because 9 minutes of active resistance in a crowded gate is not textbook, but it held until she made it impossible. Sherry gets a D. Officers never struck first. They spoke. They stepped back. They asked. Every off-ramp was available and visible. Under Florida statute 843.01, resisting with violence is a standalone felony on top of the battery charge. She handed prosecutors both on the same recording. There is a constitutional right to remain silent. She did not use it. There is no constitutional right to bite a police officer. She used that instead. Quick lesson from gate 24. The moment physical contact is made with an officer, the charge structure changes immediately. It does not scale with frustration. It scales with conduct. What you do in those seconds is what gets filed. If you want more body cam footage, the moment suspects don't expect to end up on camera, hit subscribe. We post every week. Drop a comment. What do you think the sentence should be? We'll see you in the next one.
