You literally just called yourself Listen to me. You literally just called yourself to jail. >> Stop resisting. Get off. I'm not resisting. >> On October 15th, 2022, Corporal Moore executed a warrant built on a stolen vehicle report. An ex-girlfriend filed it for a car still titled in her name. Five legal issues followed. >> Hey, Canon, the number's no good, so we're just going to walk up. What's his name? What's his name? >> Ramondo. >> Ramondo. Hey, man, we're not going anywhere. Step out. >> Did he say he was going to look here or what? >> Nah, I just moved. Hey, this is the sheriff's office. We need to speak to Ramondo. Can you hear me? I'm sorry? What did you say? >> Uh Ramondo said >> Okay, well, his car's here and we just saw him out front, so we know he's inside. What did he say? What did he say? They got him in the back? You got him in the back? What did he say? >> Oh, he said that he's them that we're making contact with >> Oh, >> okay. Contact at the door. Hey, where's Ramonda? >> He's not home right now. >> We saw him sitting out front, okay? We're not going to play that game. He needs to step out now, or it's just going to be a long drawn-out process that we I really don't feel like dealing with, to be honest with you. >> I don't know what's going on. >> I need to speak to him reference his girlfriend. He's not in any trouble, but we got to get this dealt with today. We literally just saw him sitting out front. So, I really don't want to go through this process of damaging your house and doing all this stuff. We just need to talk to him. >> Okay, I'll go get >> Okay. Ma'am, I understand that, but we just saw him sitting out front on the porch. So, I'm really not going to have this discussion with you rather he's here or not. I know he's here. It'll really just be simple if you have him step out, we can talk about we can talk to him about what we need to talk to him about and be done with it. I'm sorry. Yes, ma'am. My name's Corporal Moore. We saw him sitting up on the front porch. This is reference his girlfriend from Polk County. We just need to speak to him. He's not in any trouble, but we're not leaving cuz we know he's here. >> Okay, I'm I'm I'm >> I really don't want to have to delay this any longer and get your house involved and damage that and do all that stuff. I really don't want to have to do that. If he'll just step out since we know he's here, we can be done with it and and move on about our way. Still there, ma'am? >> Yes, I'm here. Hold on 1 second. >> Okay, thank you. >> I'm holding on. >> Are you related to Amanda? >> No. >> Okay. Oh, okay. Someone from Polk County or not? Did you know about that one? Well, that's a problem. Where's he at? Look, I don't want him to get hurt. Okay. I mean, we don't know what's on the other side of the door. >> totally understand. >> Right. >> I want to make sure what's going on here. >> If you just literally yell for him to walk out here, then nobody he's not going to get hurt. Like this is very calm situation. >> This is in my house. Honestly, as soon as he gets back, whether I mean the caller or she responds to the ring camera. >> Where Where is he in the house? >> Look, I know he's in >> I'm not trying to put you in a bad situation, but I don't want to get you in the middle of all this stuff. But if if you decide not to help us, I think he does end up being in there, you're opening yourself up to liability and you could be charged with this stuff. I don't want that for you. So, I don't think you have any involvement with this stuff. So, I know he's in there. I literally saw you guys just sitting out on the front porch. Um it's just a matter of getting him out. >> Do you want to just ask him? I mean, I'm just waiting on whatever is going on with this in my house. >> Are there any weapons in the house that you know of? Is he armed? Has he ever been armed? Have you ever seen him with guns? Look, like I said, we're not here to do all that stuff. We just need to talk to him and get him out. >> This is making me nervous when you talk to me. >> Well, fortunately, we've been contacted by another sheriff's office, so we're just following up on their issues. I don't really know what the involvement is with them over there. It's in Polk County, so we don't really communicate with them. We're two different counties, so they need to get some information from him reference whatever female they're out with. And that's it. >> Okay. >> Was he the one that went through the blinds or was that you? >> I was the one that >> That was you? Are they in the house? >> Oh, yeah. >> Where's he at? Armando, step out, boss. Step out behind him, man. >> I'm just going to step him out. >> Huh? >> I'm just going to step him out. I'm just stepping >> What's the What's your girlfriend's name? >> Why am I being detained? Calm down. >> Stop resisting. You're going to jail. All right. >> Take a seat. >> All right, you got to come out. Don't let go of that. >> I'm not. >> I want to talk to you. We got two security here that are not normal. Put her in the car. You literally just called yourself Listen to me. You literally just called yourself to get jail. >> STOP RESISTING. GET OFF. I'm not resisting. >> WOAH. YOU RELAX. COME ON. >> HOLD ON. LET me lock these. You were twisting my arm and then my arm >> Well, you're not listening to us, so >> Get off my arm. >> No. Yeah, come on, man. >> You're good. Can I just talk to my girlfriend? Let's get on the giant. >> Hey. >> What's in my music got lyrics about killing >> Yep. >> I'm going to check on the children. >> All right. >> She's She's watching my niece and kids go to jail. >> Yeah, she's going to jail. >> I lost my keys. >> It's called resisting. >> And you're not talking to me. I was right here. I lost my keys. >> Okay. You literally just involved yourself in something you did not need to be involved in. >> in something? You guys said you were coming to talk to him. He came out and then you let a damn dog and everything rush into the house. >> When you get >> That's not talking to somebody. You was under arrest. You could have said that. >> When you're given When you're given a direct order, you comply. >> Can you get this out of my face? Thank you. I don't need it off. I just want it off my face. >> Allie, they're probably inside. They're probably inside. >> Okay, I'm in the handcuffs. >> No. >> Get off. You are literally hurting my wrist. >> When you don't listen >> the other wrist or something. >> They're inside the house and the kids locked the door and they're not letting us in. >> All right, just put them in one of their cars. Come on. Hey, we need a car. >> Do you have a warrant or something? >> Hey, we need one of your cars. >> Do you have a warrant or something that you showed us? >> We don't need a warrant. >> walking into our house. I don't have to stop talking. >> Yes, you do. >> No, I do not. I can talk. This is America. I'm walking. >> Have a seat in the car, please. >> Should I get that out? >> No. That's the sheriff's office. You need to open the door or we're going to have to kick it in. How old are they? Like small kids? >> One was like probably like 10 and then two other smaller children. >> Uh I need you to get those kids to open the door now or we're going to have to boot your door down. >> Um they need to open the door? >> Yeah, they need to open the door. One because they're small children and we need to check on them and make sure they're okay because your son and his girlfriend are in handcuffs. >> Okay, so Hold on. I'm going to call the dad. My other son is old enough to be there, but I'm on my way. Hold on. >> Okay. Have them start taking the car out of the system. Yes, ma'am. >> Issue one, the doorway. Under Payton versus New York 445 US 573 1980, an arrest warrant lets officers enter a suspect's home when they reasonably believe he is inside. Deputies had watched Romano on the porch minutes earlier. One caveat, if the house belonged only to Kashmir, Steagald versus United States 451 US 204 1981 would require a search warrant to enter. The footage does not settle where Romano lived. Romano, however, came to the doorway. Under United States versus Santana 427 US 38 1976, a person standing in a doorway is in a public place. Officers may seize him there without entering. Issue two, the warrant itself. Deputies ordered the stolen vehicle cleared from the system during the arrest. That order suggests the report behind the warrant was unreliable. Under Franks versus Delaware 438 US 154 1978, a defendant may challenge an affidavit containing deliberate or reckless falsehoods, but the falsehood must belong to the affiant, not merely an informant. That makes the challenge harder than it sounds. Officer exposure is a separate question. Under United States versus Leon 468 US 897 1984, evidence survives when officers rely in good faith on a facially valid warrant. Civil claims face qualified immunity. Malley versus Briggs, 475 US 335 1986, protects all but the plainly incompetent. Deputies executing another county's warrant rarely cross that line. Issue three, deception. Moore told the family Romano was not in any trouble. Under Frazier versus Cup, 394 US 731 1969, police deception during investigations is not automatically unlawful. Lawful, however, is not the same as wise. Issue four, Kashmir's speech. Asking for a warrant and objecting to the arrest is protected. City of Houston versus Hill, 482 US 451 1987, holds that the First Amendment shields verbal challenges to police. Physical contact is different. Moore says Kashmir shoved him and struck his face. If accurate, that is battery on an officer. Speech protection ends where force begins. Her own complaints of a twisted arm and a hurting wrist raise a separate question. Graham versus Connor, 490 US 386 1989, judges force by objective reasonableness at the moment it is used. Issue five, the children. Deputies threatened to force the door to check on small children inside. That rests on the emergency aid exception in Brigham City versus Stuart, 547 US 398 2006, not on the arrest warrant. Caniglia versus Strom, 593 US 194 2021, rejects a broader community caretaking rationale for entering homes. Only a genuine emergency qualifies. >> There you go. Yeah. Processing. >> Good. Okay. Okay, don't let anybody in that car yet cuz we haven't collected everything. Um Huh? The weed in the front seat and the browns in the trunk. Uh sorry, your mom. Okay. So, Rome Romello Romano Okay. He has a warrant um for a stolen car, which is that car. Um so, whatever uh shenanigans his girlfriend pulled Yeah, okay. I got you. That has nothing to do with us, unfortunately. So, I don't know what her deal is or why she would do that. >> The it's it's a it's been ongoing battle, but >> So, as of right now, that's obviously what she pulled down there. Uh she got him to write a warrant and she got him to list the car as stolen. So, we saw the stolen car, we knew who was inside, we knocked on the door, the uh other female I don't even know her name. I don't know her name. It's Cashmere. Cashmere answered the door. Um Uh the male came up to the front door with her. We asked him to step out so we could talk to him. Um he didn't want to step out, so we tried to grab him out. He yanked back in, turned into a whole mess um cuz she was fighting with us and stuff. It didn't have to go down that way, but unfortunately >> So, she's going to >> Yes. Uh for resisting and batt LEO. Cuz she shoved me and hit me in the face. So, that's where we're at. >> But y'all weren't coming for her and >> No, she could have had nothing to do with it. But he already had the warrant, like I said, obviously whatever's going on but with that girl and I guess Polk County or wherever it is. Um that's between them. We had She had nothing to do with it but she decided to insert herself. So, that's that's where we're at. >> Can you please spell um Kashmir and Miracle? Miracle? >> I think all the kids are over here, too, by the way. >> All the kids are over in the house or in the next house. >> She can She can She can explain cuz we're not going to put their business out there. If they want to tell it, they can. >> You mean the big girl? The big girl? She's 20 years old. She's not a child. They tried to take her to the county jail. She knows cuz they have a warrant. I know, you know. That's the deal. >> Unfortunately, when they put it in the other person's name, though. >> It it He said he was going to >> Never never do that. Never put your car in someone else's name. I don't care if you think you guys are the tightest couple. You don't know a year down the road, 6 months, whatever, something happens and then all of a sudden and then this This We see this a lot. I get it. It's just we don't have nothing to do with that. You know what I mean? Like we can't control that. Like So. >> Corporal Moore receives a C+. The warrant was valid, the staging was sound, and the welfare check on the children showed good judgment. But telling the family Romano was not in trouble left no cooperative baseline once the truth surfaced. An arrest warrant existed, yet the answer to Kashmir's question was that none was needed. Moore met the legal minimum, not the smart standard. Romano receives a B minus. His grievance is sympathetic, but pulling back from the threshold as Moore describes it, turned a challengeable warrant into a resisting charge. The right move was to step out and let an attorney dismantle the warrant in court. Cashmere receives a C. Her questions about the warrant were constitutionally grounded, but alleged physical contact with an officer during an arrest is battery, however unjust the arrest appears. She started with protection and ended with exposure. Lesson one, a car title left in an ex-partner's name is a liability waiting to activate. Lesson two, deception has a short shelf life at a front door. Once it breaks, what follows is rarely voluntary. Lesson three, challenge a warrant in court, not in a doorway. Resisting converts a defensible position into a new charge. Lesson four, speech is protected, force is not. Cashmere's arrest turned on what she allegedly did, not what she said.
