OH MY GOD, MOM. >> On April 24th, 2024, a Santa Rosa County officer pulled over an SUV at Hamilton Bridge Road, a rolling stop, the kind that ends in 30 seconds. Officer Deore said he was probably not going to write a ticket. He had one additional step, his K9 partner. Routine, lawful, 90 seconds. She had a different view of that. She called her mom. She went live. She wanted witnesses. What she created instead was documentation. When the officer asked her to step out, she had one question. Why? That word from inside a locked car with a K9 on the way is where this stop changed categories entirely. >> At a stop sign. >> Hello. >> Hi. >> Uh don't let your dog jump out on that in that traffic day. Makes me nervous with that window down. Uh I'm Deputy Moore. The reason I pulled you over is because at that stop sign uh at Hamilton Bridge and Gro uh Glover, you didn't stop all the way. >> Oh yes, I did. Because another car was going through at the same time. >> And then after you pass through there, you're going a little bit little bit little bit over the speed limit. Okay. So that's the only reason why I'm stopping. >> All right, Mom. Turn on line 360. He's trying to tell me I just got >> Do you have your driver's license, registration, proof of insurance, please? >> He's trying to tell me that I didn't stop at the Hamilton Bridge um uh stop sign, which I did. >> And all these things hanging all these things hanging from your uh mirror here that are not like your beads and whatnot, those got to come down as well. >> Yeah. They said I didn't stop at a stop sign when there was two cars going through right before me. They said that um I was going too fast. So, pull up light 360 light 360. I have to where it uh shows the speed limit. Yeah. >> Uh give me a couple minutes to uh check everything out. Um uh probably not going to write you a ticket or anything, so I know you're a little bit upset about the speed, but >> Sorry. I just I get nervous cops. I don't know why. I always do. Well, I don't know about your history with cops. It's none of my business. But you and I never met, so it's not. You can relax. >> My problem. >> I promise you I'm very fair. >> It's a 30 figures period. I >> All right. Well, >> I'll be cool with me. I'll be cool with me as long as you're cool. >> You know, I'll be cool with you. You're cool with me. All right. Yes, sir. >> All right. Give me a couple minutes. I'll try to get you out of here as quickly as I can. All right. All right. Thank you. All right. >> She's got a little tiny dog, a little yapper. Would you mind just asking her to step out? Yeah. >> And then I'm going to run my dog around the car. Uh-uh. No. Sorry. >> Hello. Um, we're going to have you step out. Um, we're going to walk back here, but you're going to obviously need to hang on to your dog. He's got his dog. >> Why am I stepping out? >> Um, he I'm I'm telling you to step out of the vehicle. >> You can tell me to step out all you want, but why am I stepping out? >> Okay, cuz he's going to run his dog around your car. >> Why? >> Because he's allowed to. You can't just pull somebody over for something that he want you for. >> Ma'am, listen. I'm asking you. >> Okay. >> Call the attorney right now. >> Okay. Ma'am, let's go. >> Call the attorney right now. You don't just open car doors. I know my rights. Mom, >> they're opening up the car door. >> She's refusing to get out. So, >> you just come to me for a traffic stop and then you're going to sit here and be all over me. >> I'm not all over you. I'm asking you to get out of the car. >> You are. You just open up my door for no reason. >> Listen very carefully. Okay. Get out of the car. The next thing you do or you're under arrest. Period. >> You hear this, Mom? >> Last chance. >> What? Why are they making me get >> Last chance. >> You get here right now and call the cops. >> Excuse me. Do not JUST YANK ON ME. >> You're under arrest. >> You're under arrest. Becca. >> Mom. >> I want a supervisor right now. DO NOT DO NOT GRAB ME. I WILL SUE YOUR I WANT A SUPERVISOR right now. I want a supervisor. I want a supervisor right now. >> Dog down. >> You let go of me. >> OH MY GOD. MOM, I'm I'm so suing y'all. >> Give me your other hand. >> Give me your other hand. >> I HAVE ALEXANDER ALL MY joints out >> if you give me god minute. Jesus Christ. >> No. Open up my door for no reason. Dear, >> keep your hands right there. Just relax. >> My arms. >> Relax. >> Call the sheriff. >> Yeah. See, this is ridiculous. >> Are you serious? You're going to use your weight on my back? >> Nobody's going to wait on your back. >> All right, let's get her out of the road. And then >> I can't hit anybody. >> All right, we're going to help you up. Roll to your side. >> I roll to your side. Can you give me a second, please? Here. >> Okay. It's located. >> Okay. Can you put your weight on that foot? >> Not much, but >> All right. Ready? 1 2 3. >> I'm getting my phone. >> No, you're not. >> Yes, I am. I can. >> You're under arrest. Walk. >> Jesus Christ. >> We're done with you. >> I'm done with you. >> Okay. >> Yeah. All this is being recorded. Is your camera on? >> Yes, it is. They all >> That one is This one is All these cameras are wrong. >> I need you to spread your legs. >> Lean forward onto the car. Lean. >> Yes, you can lean forward. >> When you have dislocated ribs, you cannot bend forward. Here, I have Ellers. >> You have anything on here that's going to poke a stick? >> No. You have anything in your boot? >> No. Face face the I was trying to Yep. Heat. Yep. Is she going to go in your car? >> Okay. Is he She okay in there with him? >> Yeah. He's not going. The dog's not going in the car. Sorry. >> We're uh you all the way back. >> Yeah. >> Can you I know. Can you please my shoulder? >> I'm just making sure you're not falling. >> I know. You're I It got dislocated. Ow. Did you double up? >> I haven't. No, I haven't touched him. >> I don't know why he's still got to be so rough with me. >> He's not being rough. He just grabbed the crap out of my wrist here. Okay. Just understand anything that you have on you that you haven't disclosed that you taken to the jail is going to be another charge. You understand that? >> I don't have anything on me. >> Okay. I'm just making sure. Just giving you the opportunity now. >> Trying to just get my hair out of my face. All right. Come on. >> You okay? >> You okay? >> Under Pennsylvania versus Mims, an officer conducting a lawful traffic stop may order the driver out of the vehicle. No reason required. The stop itself is enough. Staying seated is not invoking rights. It is a separate offense under Florida statute 84302. Refusing a lawful exit order while an officer is in performance of a legal duty is resisting without violence first-degree misdemeanor up to one year on top of everything else that followed. She told the officer, "You can tell me to step out all you want, but why am I stepping out?" He explained. She called the attorney. She called her mom. The door was opened. She stayed seated. He gave her one last chance. Last chance. She kept talking. And that was the end of the traffic stop portion of the evening. The arrest was not quiet. She called for a supervisor. She announced the lawsuit. Her mom was watching the whole thing on FaceTime live from the beginning. There is a version of this stop where she steps out. The K9 runs the exterior. Nothing is found and she drives away. No ticket, no charges. That version required one thing. She did not provide it. The K9 ran anyway. Officers located marijuana and drug paraphernalia inside the vehicle, which answers the question she kept asking completely. Under Rodriguez versus United States, a K9 sniff of the exterior of a vehicle during a lawful stop does not constitute a search under the Fourth Amendment. No warrant, no probable cause required. Whatever the dog detects in the air is admissible. She refused to step out to prevent that sniff. The refusal triggered the arrest. The arrest completed the stop lawfully. The sniff happened anyway. In trying to stop one outcome, she caused a worse one. She was charged with marijuana possession and drug paraphernalia possession. In Florida, that exposure is up to six months in county jail and a $5,000 fine. The ticket she was not going to receive cost considerably more. The rolling stop that started this, the original violation, never became a ticket. The officer said as much at the beginning. What turned a verbal warning into a drug arrest was one decision. Stay seated and demand an explanation instead of stepping out and letting 90 seconds happen. Officer Deore gets a B+. He warned her. He explained he told her upfront he was probably not writing a ticket. He gave her multiple chances to deescalate. When she refused, he followed the law, not his frustration. Every step holds up. Under Graham versus Connor, officer conduct is evaluated on what a reasonable officer knew in the moment, not in hindsight. The force used here was proportionate to active repeated refusal after lawful orders. Nothing here is controversial. The driver gets a D-stopped for a rolling stop. Told she was probably not getting a ticket, then refused a lawful order, generated a misdemeanor, got arrested, and was found with marijuana. The drugs were there before any of the arguing started. There is a constitutional right to remain silent. There is a right to ask for an attorney. There is no right to refuse to exit the vehicle during a lawful stop. She exercised the one right that does not exist and left the others untouched. Her mom watched the entire stop on FaceTime live. That was the plan. A witness, someone who could confirm the officers were out of line. What the footage confirms instead is on the record. The body cam was running on both ends.
