Tell me what you got to do cuz tell me why you pulled me over. Tell me why you can't hit people. >> I makes that car >> What is his problem with me? Why >> On February 24th, 2023, a routine traffic stop in Boynton Beach, Florida became anything but routine. A stop sign, that's how this started. When an officer pulls you over, Florida law requires you to stop, remain in the vehicle, and provide your license, registration, and insurance. That's not a request, that's a statutory obligation under Florida Statute 316.126. Instead, the driver pulled her car forward, exited the vehicle before the officer even reached her window, and immediately began demanding to know why she was stopped before providing a single piece of identification. >> It's on 15 court now. You can't really got to stop me. I'll be at Wayne PD tomorrow. Got eight [ __ ] police officers that have my house cuz I pulled in at my house for a traffic stop. Then you want to grab my girlfriend, bring her to the floor for a traffic stop? This is [ __ ] for real. Do better. Do better. Do better. All of y'all, do better. Go find real crime. >> Uh I didn't get any of your information yet. I didn't get none of your information. Uh you're under arrest for obstruction, okay? Cuz you're way too close to my traffic stop. You walked in my traffic stop. >> I was I was far enough, sir, where you could take two steps away from me. >> You shouldn't have been that close to me. >> You I was far enough for that. So, that means he's >> That sequence matters. The moment you exit the vehicle and refuse to identify yourself, you've elevated a minor traffic infraction into a potential custodial situation. The officer now has to manage an unknown subject, not a driver with a stop sign ticket. The officer asked for her license 11 times. She responded with questions, arguments, her name spoken aloud, everything except the document in her hand. Her name alone doesn't constitute identification under Florida law. The license does. And here is where the situation escalates beyond a citation. A bystander, the driver's companion, approaches the traffic stop and begins filming at close proximity while the officer is still managing the driver. The officer orders her back. She doesn't move. Under Florida statute 843.02, obstruction of an officer without violence is a first-degree misdemeanor. The statute doesn't require physical interference. Ignoring a lawful command and remaining within the officer's immediate working space is enough. Two arrests, one traffic stop, one stop sign. The driver was taken into custody for resisting an officer without violence. Her companion was arrested for obstruction for not backing up when told to. >> situation. >> I'm doing a traffic stop. The young lady operating this motor vehicle ran a stop sign, okay? >> Uh-huh. >> a legal traffic stop. She gets out the vehicle. She says, "Oh, why you stopping? Why you stopping? Why you stopping?" I said, "Identification. License, registration, insurance." She did not want to provide license registration. She said, "Tell me first." I said, "Hey, provide me your information and I'll tell you why I stopped you." >> That's her mom on the phone. >> She refused to provide the information. Next thing this lady comes up within this close to me. I said, "Ma'am, back up." Redirecting my attention from this young lady like this. >> Close to you. >> uh the one with the white tank top. She continued to stay there and record in this close proximity, okay? The first one got arrested and she's being under arrest, too. >> For what? >> Obstruction. >> Obstruction? >> Tow? You got a tow coming? >> Yeah, yeah. I called for the tow. I got a zero here. >> You got a signal 40? >> Yeah. >> May unit 12 respond to our other 40. Male advising both females breaking a windshield with an object. >> Okay. It's probably that one. >> Yeah. That thing's open. >> Um I'm already sure. I need to go up there. >> 9069 >> 380 Sorry about that. >> Is that a break or a bad or >> Um >> I'll be behind you. >> Subject being difficult, not responding. >> I got her ID right here. >> Just grab that. Bring that with you. >> Yeah. >> Take her to her father. I'll let you talk to your dad in a few, okay? You didn't see anything happen? >> Would I be able to have another police officer here while I explain it to you? >> Say what? >> Would I be able to have another police officer here >> No, I'm the arresting officer. I was there. >> You're but no one else can be around. >> So I was I was I got my phone. >> you didn't explain it to me. No problem. >> So you don't want me to explain it to you? Okay. You don't want me to explain it? >> Yes, sir. >> You can explain it. Yes. >> Okay. >> But get somebody else to come around cuz I don't feel safe. >> All right, that's fine. Well, I'm going to Listen, so if officers are on a traffic stop, the officer can be on the station. You can't walk up on an officer. >> Okay. >> If you want to record, it's fine. >> Yeah. >> You do that from a distance. >> Yeah. >> Not close proximity. >> You wouldn't have moved me like that? >> I'm sorry? >> You wouldn't have moved me like that today? >> Like what? >> You did this in front of me. You didn't have to move me like that. >> Okay. >> I was far enough away that you didn't have to move me. >> No, you can't. >> So I can't be on the sidewalk? How far can I be? >> Sidewalk. >> The sidewalk? >> Not within their close proximity. >> Okay, then I didn't know that. >> Well, now you I was talking to her at the time. I'm sorry? Well, I I I told you to step back. You said, "No, I can record." But listen, But listen, I got so much I'm dealing with I deal with her and I'm dealing with you. Simply, you can record, it's fine, but it has to be from a safe distance. >> Okay, no problem. I was told to go to the sidewalk. I would have went to the sidewalk. >> Well, I had so much going on with her, with you. >> So what happens if only they get you? >> I'm sorry? >> You don't want a police officer back here? >> Yeah. Yeah. You don't No. No, you Yeah. Yeah. >> Officer back here? >> I I I can't I gave you a command to do it, a lawful command, and you refused to to comply with that lawful command. Therefore, therefore, I grabbed you. I I grabbed you. I told you No, you didn't. So, therefore So, so therefore, since you were in that close proximity, right? And you obstructed the delivery of a lawful arrest. But, listen, I'll let you talk to your dad. Are you okay? Cuz he he said he would talk to you. Just check and make sure it's what that is. Okay. It's it's all right. Just realize that things can go bad. And I I got to tell you that I understand that you want to know what's going on. You don't know what the hell is going on. You see your friend, you see your police going on. You want to you want to try trying to find find out what's going on. But, like all the officers are getting that close, I don't know you. I don't know your intentions. I don't know what you're about. Um I don't know. All right? You see that your friend is going wild. I understand that you want to try to calm her down. You want to try to calm her down. Who's my mother? >> Whitney's mother. >> All right, give me a second. So, I understand that you want to calm her down and everything, but it's like I I I don't know who you are. I don't know what your intentions are. >> Y'all tell me what's going on. My child never been arrested before in her life. >> Okay. So, I got you. Need medical assistance? Okay. So, I did a traffic stop on her, right? Immediately as I stopped the car You guys take care. Immediately as I stopped the car, she she jumped out the car. Right? And then she's like, "Why are you behind me for?" I'm like, "My my lights are on. This is a traffic stop." Okay? I asked for her information. She said, "Tell me why you stopped me." I said, "Ma'am, give me your license first. Give me your information. I don't know who you are." Uh she's not willing to give her information. Then next you know, it's her girlfriend or friend Her girlfriend or friend uh Her girlfriend Well, me and her still talking and everything. Um and then her girlfriend or friend pulls up, got the cameras out and everything. Um due to her not providing me her name, due to me not knowing what's going on, I go to detain her while I'm trying to detain her, she's like pulling away, doing this and that. And then she and her friend is all is is there. Her friend gets arrested, too. And then uh she >> What do you mean? What about my baby? Got to arrest her you guys >> I I just told you. >> No, for what? What is her charge? >> I I don't know. Hold on. >> I So, hold on. I I gave you the whole story, but if you want to know the charge, it's it's resisting arrest. But >> What does that mean for my child? >> Uh she'll she'll she'll be out soon. >> Is she going to Is she going to the gun club? >> She She went to the went to the gun club? >> Oh my god. >> Ma'am. >> Why are you taking them away? I know you. You're like the nicest cop I ever knew. >> Well, listen. Listen. And then once you watch the body worn camera footage, ma'am, then you can you can see exactly why. >> Oh my god. I just don't get it. I think she could have went so much better than what it was. She was already somewhere. >> Well, listen. So, the >> She was already somewhere. >> No, no. >> She was in front of her people's house. >> Exactly. She had She The car just stopped there, but the I already initiated the traffic stop. >> I get it, but what I'm saying, like you could have just killed it right there because like >> No, but then it's how she how she made it. She was like >> She said you She didn't have a reason to be pulled over. >> No, no. Exactly. Exactly. She did not know that. And I was prepared to tell her. >> the traffic stop? >> Stop sign. That's it. Exactly. >> She was just home, bro. >> No, no. But she was driving She was driving. It wasn't like I just randomly pulled up behind her. She was driving. >> She said she a stop sign. Oh, I'm so scared about the gun club. >> Now, let's address the Miranda issue. The driver shouted on camera that the officer hadn't read her her Miranda rights. That is a widespread misunderstanding of American law. Miranda warnings are required before custodial interrogation, not before arrest, not at the moment of handcuffing. If officers don't intend to question you, Miranda is irrelevant. The arrest itself is lawful the moment probable cause exists. In this case, probable cause existed the moment she refused to provide identification during a lawful traffic stop. Miranda had nothing to do with it. When officers searched the vehicle, they found a loaded handgun concealed in a backpack. That discovery added a layer to this case that neither the driver nor her companion anticipated when they decided a stop sign ticket wasn't worth cooperating with. Back at the station, the officer gave the companion a clear breakdown of exactly where her rights ended and where obstruction began. You have the right to record police. That right is not unlimited. Distance matters. When an officer gives a lawful command to step back, compliance is not optional. Despite the mother's protests and the neighbor's disbelief, the law doesn't negotiate on scene. The driver was charged with resisting arrest without violence under Florida statute 843.02, carrying up to 1 year in jail, 12 months probation, and a $1,000 fine. Now, the grades. The officer gets a B+. He maintained composure under sustained verbal pressure, asked for identification the right number of times before escalating, and clearly articulated the charges to family members on scene. The escalation to physical control was prompted by non-compliance, not initiated unprovoked. Minor note, earlier communication of the reason for the stop may have de-escalated before the confrontation stage. The driver gets a D. She was stopped for running a stop sign, a correctable minor infraction. What followed was entirely self-inflicted. Exiting the vehicle before the officer approached, refusing 11 requests for identification, and physically resisting turned a $60 citation into a criminal arrest record. Under Graham versus Connor, the officer's response tracked the threat level she created, not the stop sign she ran. The companion gets a C minus. She had every right to record. She exercised that right at the exact wrong distance, ignored a lawful command, and was arrested for it. The lesson here is narrow, but important. The right to film doesn't override the officer's right to control the immediate perimeter of an active stop. One stop sign, two arrests, one loaded firearm, and a case that could have ended with a ticket. If you want more breakdowns of the moment suspects don't expect to be caught on camera, subscribe.
