A woman flags down an officer on a Fort Myers Street. She says the car in front of her just hit her and drove away. July 12th, 2023. Fort Myers, Florida. The officer runs down the suspect's car and makes the stop. What happens in the next 12 minutes has almost nothing to do with the hit and run. It has everything to do with what the suspect does next. The suspect's position is straightforward. The other driver is lying. Her car has no damage, and this entire stop is a waste of her time. She also mentions more than once that she works for the government. She appears to believe this changes something about how the stop is supposed to go. >> And she literally rammed my car and was like, "Yeah, I got you." >> Two young stupid dumbass girls could have killed more than just me. >> Today for what? Yo, treat me like I don't work for the government myself. >> On July 12th, 2023, Fort Meyers, Florida police pulled over a female suspect after an alleged hit and run. Ma'am, get in your vehicle and then get in front of her. >> Thank you. >> Hello. >> Hello. >> I'm Officer Char of the Fort Myers Police Department. The reason I'm stopping you is as I'm driving by, she's waving me down saying that you hit her car. She >> You can look at my car. It's a white car. >> I've been on the phone the whole time. May nobody call your supervisor, too. Yeah, call your supervisor. >> All right. What do you need a supervisor for? >> I'm calling your supervisor cuz first of all, if she making a false report, she going to jail first and foremost. You're wasting my time. Not only that, I work for the government my goddamn self. So, you think that I'm going to be out here and hit your car and keep going? >> It aggravated me, sir, because she came through the goddamn thing. She damn near killed me on Ortiz with aing ladder. Hank leaning. Hold on cuz I'm talking to the officer. >> So So just like I said, that's what she said. I'm just trying to figure out exactly what's going on. >> That's why I can't call your supervisor. Pull pull her ass up. If I hit her car, I have a mark on my car and she should have one on her. >> So I'm going to before I call supervisor, I just want you to explain to you when I ask for him to come, he's going to ask me for what. Okay? So, I need a legitimate reason to ask for the supervisor because right now I'm investigating a traffic crash. >> You You ain't investigating a traffic crash because if you were investigating a traffic crash, it'll be damage to her vehicle and mine. I can't hit you if you coming behind me first and foremost. How would I hit you if you coming behind me? She got a whole a ladder in her trunk. So, if I hit you, right, I shouldn't know what's hanging out your trunk. >> That's what she said to me. I'm investigating cuz I got to find out if that's [ __ ] and I got something to do. That's why I'm frustrated. But look at you playing with a car in traffic. TWO YOUNG STUPID DUMB ASS girls could have killed more than just me. I've been here with my damn thing hooked up. >> It's aggravating. It's aggravating. >> So, let me go talk to her. See what she's saying. Cuz all she told me was she hit me. That's why I stopped the car. Okay. So, give me one minute to go figure it out. >> Let me go figure it out. >> As the victims. >> So, we literally just got off work. We're on getting off the highway. on um MLK. >> We're turning on super routines. >> Okay. >> She's in behind us. Obviously, I have a ladder and we're trying to be safe. >> So, I turn left. She starts swerving. >> It's the merge. >> The merge. You know the merge area. >> Yeah. When you're going south on Ortiz. >> Yeah. She literally starts swerving to get around. >> There's a car in front of us. There's multiple cars in front of us. She can't make it around [ __ ] Then she hacks like crazy. Then she swerves and like cuts me off literally like I had to stop and break check and everything. >> Then I was like >> So she she cut you off in front of you. >> Yes. Then we took a picture and we were trying to take a video of what she was doing and then when >> Do you have those I can look at? >> Yes. And then when um what's it called? We got to the roundabout. She had like >> on her teeth or this one that we just shoe maker. She literally was like slowing down cuz she saw that I was there trying to take video of her. And then I went to go around her. She had more than enough space, sir. >> Yes. >> And she literally rammed my car and was like, "Yeah, I got you." And then she tried to drive away. >> And then I was like, "Are you serious? So you're going to hit me and then drive away? You can't even talk to me like a human being?" >> Where what side of your car did she hit? >> The left side. >> Damn it. I didn't get out to look. >> I was trying to chase her down after she hit me. >> Is there damage? >> Where where did you feel the hit? >> Back there. >> I don't know. Somewhere >> on your side. Like your side. >> Somewhere on this side. >> A little bit of >> then it's probably here. >> Can you step out for me and just take a quick look? >> Yes. >> Yes. I do have random damage cuz >> Yep, that's her. We don't That's not >> Oh, sorry. Yeah, that's the door right there. >> Yep. >> Okay, >> that is her right there. The white vehicle. >> And it's just ridiculous. You know this the fact that people drive. >> Ma'am, just stay back there while we're still trying to figure it out. >> I got something to do and you playing. >> BUT WHILE YOU PLAYING COMMON SENSE, YOU DON'T KNOW WHERE. >> MA'AM, YOU'RE GOOD. GO sit in the car. >> Ain't nobody hit YOUR CAR. AIN'T NOBODY >> GO BACK TO YOUR CAR NOW. >> GO BACK TO YOUR CAR. >> WE'RE NOT DOING THIS. GO BACK TO YOUR CAR. >> CALL YOUR SUPERVISOR. >> I'LL call him for you, BUT YOU CAN'T. >> THANK YOU. BECAUSE Y'ALL WASTING my time. SOMEBODY HIT YOUR CAR WITH NO DAMAGE. THAT DON'T MAKE SENSE. >> GO BACK TO YOUR CAR, PLEASE. >> THAT DON'T MAKE NO SENSE. I'M YOU TRYING TO SHOOT AROUND ME ON VERONICA Shoemaker and and and got mad because you couldn't run me off the road. Then you weigh the police down AND TELL THE POLICE. I HIT YOUR CAR. I'MMA HIT YOUR I WORK FORING GOVERNMENT. CALL YOUR COUNTY GOVERNMENT. >> MA'AM, can I have your license, please? >> No. No, I want your supervisor. NO, IT'S NO CRIME COMMITTED. MY CAR AIN'T HIT NEITHER. >> SO, stop and listen to me. Okay. So, so now so now I'm requesting your driver's license so that I can call your supervisor so that I can do the crash report. If you do not give me your license, I'm going to put you in handcuffs. >> You go ahead and please >> coming out. Go ahead and let them go. >> Ma'am, go. Yes, that's fine. >> That's fine. >> Go in front of my car. >> No problem at all. >> No problem. >> Go to the front of the car. right here. Take a seat. So, I'm going to explain it one more time. You can give me your driver's license so I can do the crash. I'mma put you in handcuffs. >> You first and foremost. Let's be >> I'm done because you keep turn. >> That's fine. That's fine. Put me in. You don't even have no report to file because they went to bull. Let go of your phone. Let go OF YOUR PHONE. >> WHY DO YOU HAVE MY PHONE? WHY? Because you're going in the back of my car. >> I'm not under no arrest. That's okay. You're being detained for no detain for what? >> Because you are. >> Why? Why are you putting your hands on me and get in? >> I'm glad that you are. Go ahead. Go ahead. Go ahead. >> You're ridiculous. Cuz I know my right. Cuz I know my rights. Cuz you got a white girl making a You want to THROW ME ON THE FLOOR. OH, SUCH A BIG MAN. >> Such a big man. I'm on THE SIDE OF THE ROAD IN AING handcuff because a white lady make up something just like Imit Hill. What y'all going TO DO? SHOOT ME next cuz a white lady said something and maybe choke me out like y'all did Alton Sterling. Maybe that cuz a white lady said something, right? I can just make it up. Damn. 60 years later, the white lady finally say she lied. They lynched that black boy. Killed them dead for nothing. A lie. And this what I'm dealing with >> right now. Aing lie. Then you see the [ __ ] Look at her. You can see the fake in the eyes. You see that? You can see it. Sit >> sit in the car. >> You sit. >> Sit in the car. >> You see them though. You >> Here is what Florida law actually says. When an officer is investigating a traffic crash, every involved driver is required to provide identification. That is not a courtesy request. Refusing that request knowingly, willfully in the face of a lawful order is a separate criminal offense. Florida statute 84302 resisting an officer without violence up to one year. That charge does not care who you work for. It applies to everyone present, including government employees. Meanwhile, backup arrives and speaks with the two women in the truck. Their account is calm, detailed, and consistent. They have photos. They have video. They stayed at the scene. The officer inspects the truck. There is physical damage on the driver's door consistent with a lateral impact. The crash is no longer a he said, she said. It is a physical record. The suspect exits her vehicle uninvited and walks toward the victims. Officers redirect her back to her car. She is not yet under arrest. She is still being given the opportunity to hand over a driver's license. She does not take that opportunity. She takes the opposite position loudly at length in front of two officers in a body cam. The officer's language at this point is precise. Give me your license or I will put you in handcuffs. That is not an ultimatum offered lightly. It is the last step before an arrest becomes legally necessary. She tells him to go ahead. He does. She is placed in handcuffs on the side of the road while her car is still running. Once in custody, the suspect does not stop talking. She invokes EMTT Tilt. She invokes Alton Sterling. She describes the scene as institutional racism in real time. The officer, for his part, is running her name for warrants and completing the crash report she refused to cooperate with. Her boyfriend arrives at the scene. The officer explains the situation in two sentences. There is damage consistent with the crash. She is not going to jail for the crash. She is going to jail for the obstruction. The victims, for the record, did not want to press charges. They wanted a crash report, a document, a signature. That was the entire ask. She was charged with resisting an officer without violence under Florida statute 84302. Bond set at $1,500. She faces up to one year in jail or 12 months of probation and $1,000 fine. She did not go to jail for the hit and run. She went to jail for the 6 minutes after. The charge she received was entirely self- constructed. The officers get a B+. They confirmed the physical evidence before escalating. Every warning came before every action. When the suspect made their job legally necessary, they did it cleanly. The slight deduction allowing the suspect to approach the victim area before control was established. minor, but it created a moment that did not need to exist. The suspect gets a D. The victims had already told officers they were not pressing charges on the collision. The only thing standing between her and a crash report was a driver's license. Under Terry versus Ohio and Florida crash investigation statutes, an officer conducting a lawful investigation has the authority to detain and require identification, refusing that is a crime. She refused it for 6 minutes on camera. She mentioned her government employment four times. The statute applied to her the same way it applied to everyone else on that road. Employment status is not a Miranda exception. The witnesses get an a calm, documented, consistent. They handed the officer everything he needed in the first 2 minutes. They stayed out of it after that. The right to remain silent existed throughout this entire encounter. At any point, she could have stopped talking, handed over the license, and driven away with a copy of a crash report. She chose differently. The body cam recorded every second of that choice. If you want more body cam footage, the moment suspects don't expect to end up on camera, hit subscribe. We post every week. Drop a comment. Was the arrest justified or did the officer escalate too quickly. We'll see you in the next one. >> How's it going? >> So, this is my girlfriend. She on her way to come get me. >> And whatever happened, like I said, I don't know what happened. >> I guess the car claim to get she hit one. So, my understanding is she pulled over, correct? >> No, I did a traffic stop on her to stop her. >> Oh, okay. >> Uh there. So, I'll slap you right there. Okay. There's damage consistent with the crash. All right. She's not going to jail for the crash. She's going to jail for the obstruction cuz I asked her for ID so I can complete the crash report and we're going to leave it at that because she they don't want to press charges. They just wanted a crash report. >> And it's everything she did after that. That's why she's going. >> Okay. So she she >> I understand that. But when I'm like, "Hey, you need to stop." And I put you in handcuffs and you shove me up against my own car. That's not going to fly. >> Okay. So she's going to go for the obstruction. I cannot release the car to you because she's the registered owner. All right. So that's kind of where we're at. >> Is there any way we can get the car to my dad? >> Can't. She because she was in the commission of the hit and run in this car and she was in this car when I took her out and taking her on the obstruction. That car is going to get choked. All right. Sorry to be the bearer of bad news. That's just how it's going to go. >> Yeah. Yeah. She's on this side right next to that officer. >> Wolver. He's going to talk to her for a second. >> If that was right, I was so automatically whatever they said, that's what he went for. He didn't think he if I hit you. If I hit you, realistically, they [ __ ] started from head. So then not only that, he snatched my phone. He is [ __ ] his bag. >> He had so tight. This man >> that was you don't do that. So if I'm GOING TO BE PISSED OFF this female ass. >> The suspect was charged with resisting an officer without violence and was issued a $1500 bond. She faces up to one year in jail or 12 months of probation and a $1,000 fine.
