WHAT AM I BEING ARRESTED FOR? >> I'LL tell you in a minute. >> Absolute garbage. >> I'll let you Don't make it worse for yourself. >> Inside room 138, the mother is erratic. She makes claims about human trafficking, stolen government checks, and 4 years of drugging. Deputies have heard the full version before they reached the door. The deputy's job is narrow. Get her out of the room, off the property, and on her way. He is not there to investigate the claims. He is not there to adjudicate 4 years of grievances. He is there to execute a trespass. He explains this clearly. He tells the daughter, "Help her pack, get her things, get to the car. That's it." The daughter has a different idea. She wants the deputy to Baker Act the mother, place her on an involuntary psychiatric hold. Under Florida statute 394.463, that requires a specific set of criteria. The person must be an imminent danger to themselves or others. The deputy evaluates the mother directly. She's agitated. She has unusual beliefs, but she's coherent, responsive, and denies any intent to harm herself or anyone else. The criteria are not met. He explains this. The daughter disagrees, loudly. And here is where the situation changes direction, not because of the mother, but because of what the daughter does next. She accuses the deputy of being paid off. She tells him she'll contact the higher. She claims the motel is involved in human trafficking. Each time the deputy offers a path out, she blocks it with a new accusation. The deputy keeps his tone level. He offers the exit three times. He explains what he can and cannot do. He does not raise his voice. He does not match her energy. What he does is start watching. And this is where it gets worth paying attention to. The daughter never comes out and threatens the deputy. But she's building towards something, and the deputy can see it. She tells him her people are nearby. She mentions contacting higher authority. Then she asks, in a way that's less question and more challenge, "What are you going to do?" The deputy tells her, "Help her get her things, or she's going to take a ride with me." He says it plainly. He says it twice. He is not bluffing, and he is not escalating. He is giving her the last clear exit. She doesn't take it. Instead, she tells the deputy to get out of her face. She accuses him of spitting on her. She begins cursing directly at him, not around him, at him, closing the distance as she does it. Under Florida statute 843.02, resisting, obstructing, or opposing an officer without violence is a first-degree misdemeanor. The officer doesn't need to be physically touched. The conduct just has to rise to the level of opposition. The deputy had been documenting since the moment she opened the door. Every warning, every offer, every redirect, it's all on the body cam. She handed him everything he needed. "You're going to suffer the consequences." That line lands right before the handcuffs go on. He wasn't threatening her. He He reading the result. After arrest, she repeats the question 12 seconds apart. "What am I being off?" The deputy answers the same way each time, "Resisting." She asks, "Resisting for what?" He says, "Because you're laughing." She had been laughing at a deputy who had just warned her. The daughter, identified as Ray, was charged with resisting an officer without violence under Florida statute 843.02. First-degree misdemeanor, up to 1 year in county jail, and a $1,000 fine. The mother was not Baker Acted, she was not arrested. She was trespassed from the property, the original outcome of the call achieved despite everything that followed. The deputy gets an A. He offered multiple exits. He documented every warning. He never escalated beyond the moment. Under Graham versus Connor, officer conduct is measured against what was known at the time, and his decisions hold up at every step. Ray gets a D. She arrived to help and turned a simple trespass call into her own arrest. The deputy gave her at least three clear exits. She declined all of them. Florida law does not require physical contact to charge resisting, and she gave him more than enough without it. A lesson worth noting. Demanding a Baker Act while displaying the very behavior it was designed to address is a difficult position to argue from. She wanted the criteria applied to her mother. The deputy was watching her. The mother gets a C. Her distress appeared genuine. Her behavior was the catalyst for the original call, and her refusal to simply leave made an already difficult situation harder for everyone, including her daughter. If you want more body cam analysis, the interactions that don't go the way anyone planned, hit subscribe. We break it down every week. Drop a comment. Should the daughter have been charged, or did the deputy have other options? We'll see you in the next one.
