No, I just >> Officer Christopher Skavony later arrived on scene to assist and asked Shona to exit the vehicle and perform additional field sobriety exercises. He started with the horizontal gaze nestagmas HGN test. During the HGN test, officer Skiovioni observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation and the onset of neistagmas prior to 45°. He also observed vertical nestagmas in both eyes. The second exercise was the walk and turn test, but she was unable to perform the test. During the walk and turn test, Shaa did not touch heel to toe on each step. turned improperly and did not complete test when attempting to return to her starting position. The final exercise was the one leg stand test and Shona failed to raise her foot in the proper fashion while placing her foot down before the test was complete. >> I I know what you're concerned about. I get it. But we have we're here now. We got to do this part. >> I know. >> Okay. So, we're going to >> so much I went to rehab and everything like I know that's not what you want to hear right now. >> No, it's it's fine. I went to rehab for some like heavier [ __ ] and that's not what I'm about anymore. >> This is my birthday and I was just trying to get us home cuz she was really sick. Okay. >> And I know that's y'all are y'all are doing your job. So >> So right and in that spirit we have to do this part right now. Right. >> We we'll worry about your friend. We'll worry about the car in a little bit. Okay. We're going to get through this part right now. Okay. >> So first thing I'm going to have you come over here. >> Okay. >> You can stand like this. Face me. All right. stick. Come come this way a little bit in the middle of a slope. That's fine. All right. So, what I want you to do is stand with your feet together like this. Keep your arms flat down at your side. Okay. Do you see the tip of my finger here? >> I do. >> Okay. When I tell you to, you're going to follow the tip of my finger with your eyes and with your eyes only. And you're not going to move your head. Do you understand that? Okay. >> Okay. Before we do that, do you wear contacts? >> I don't. >> Okay. Do you use glasses for anything? >> I don't, but I should. >> You should. Okay. All right. Can you see up close? >> I can a little bit. Yeah. Yeah. I can. >> All right. So, I'm not going to shine this in your eyes. It's going to be right over it. Okay. >> So, you see >> I do. >> Okay. All right. Again, just follow with your eyes only and don't move your head. >> My legs are shaking. >> It's okay. I know. I know. >> I'm so sorry. >> It's okay. You're right. We're going to We're going to get through it as easy as we can. Okay. >> Okay. >> All right. >> Don't move your head. Okay. >> Come back. >> Don't move your head. Just your eyes. >> Okay. 124. >> It's so far off the side that it's hard to see, but I'm trying. >> Just do your best. It's all right. >> Just keep following it. >> Mhm. It's so cold. I'm sorry. >> Okay, just put your hands back down. I know it's cold. If you need to wrap your hands through your sleeves, that's okay. I know it's cold. Just try and keep them down at your side. Okay. >> Okay. >> We're almost through with this part. >> Okay. Just keep following my finger. >> Yeah. You guys know that you guys hear any Okay, last one. I can't see all the way. >> It's okay. Just It's all right. >> It's all right. Like I said, you just got to look up. It's okay. >> Okay. All right. Come over this way. Michelle Dickerson will be >> actually come on the sidewalk. >> Yeah, this is valid. No warrants. >> Oh, it's so cool. >> It's okay. All right. So, what we're going to do, just stay right in the middle like this. All right. So, this is going to be it's called a walking turn. I'm going to demonstrate and explain the instructions for you. But first, I'm going to tell you how to get in position. So, imagine in front of you there's a straight line. So, what I want you to do is put your left foot on that line. Put your right foot in front of your left foot touching your heel to your toe just like this. and keep your arms flat down at your side. And I want you to stay just like that and don't move until I tell you to begin. You understand that? >> Okay. >> Can I put my coat on or you just want me to stay like that? >> Yeah. No. Is your coat in the car? >> If it it is. >> Hold on. Come over here. Come over here. We can grab it. >> I'm sorry. >> No, it's okay. I'll say it again. So again, imagine in front of you there's a straight line. On that straight line, I want you to put your left foot on the line. Put your right foot in front of your left foot just like this, touching heel to toe. And keep your arms flat down at your side just like this. >> Okay, good. Now stay just like that. Don't start moving. And stay in that position until I tell you to begin. You understand that? All right. So when I tell you to begin, you're going to take a series of nine heel to toe steps down that line. As you're taking each step, you're going to look down at your foot and you're going to count each step out loud while keeping your hands flat down at your side. It's going to look like this. One, two, three, and so on until you reach your ninth step. Once you reach that ninth step, you're going to keep your lead or front foot flat on the line. And you're going to take a series of small steps turning to your left. And then you're going to go back down the line and another nine heel to toe steps just like this. 1 2 3 and so on until you reach that ninth step. >> All right. >> So again, >> while you're taking each step, remember to touch heel to toe. >> Look down at your feet the whole time. Count each step out loud. >> Keep your arms and your hands flat down to your side the entire time. Do you understand that? I do. >> All right. Go ahead and get back into the starting position. >> All right. You can be good. 1. 2 3 4 5 6 7 8 9 1 2 3 4 5 6 7 8 I'm so cold. I'm sorry. I'm sorry. I'm so >> sorry. We're almost done. >> Holy [ __ ] I'm so >> Okay. >> I'm so nervous. I'm so cold. I'm sorry. You want to keep going? >> Yeah. >> Go ahead. >> All right. All right. One last one. Okay. It's all right. So, stay just where you are. Okay. >> Come over a little bit this way. What's that? >> Oh [ __ ] >> Down. Okay. >> All right. Face me. >> Yeah. >> All right. For right now, keep your feet. >> Okay. >> Starting just like this. Keep your arms and your hands down to the side. All right. So, when I tell you to begin, you're going to raise uh one foot either foot of your choosing. Um you're going to raise it approximately 6 in off the ground. You're going to keep your foot parallel to the ground. It's going to look like this. Okay, while that's raised, you're going to look down at your foot the whole time and you're going to count out loud 1,00 1 1,002 1 3 1 1004 105 and so on until I tell you to stop. >> Okay. >> Okay. Do not put your foot down. >> Okay. >> Keep your arms and your hands flat down to your side the entire time. Remember to look down at your foot the whole time and count out loud the way that I told you. Do you understand that? >> I do. >> Okay. Ready? And go. One 100 1,00 2 100 3 100 4 100 5 100 6 100 7 100 8 1 9 100 11 100 >> 13 100 14 100 1500 Okay, you can start. >> You can stop. >> Based on her erratic driving, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises, Shona was placed under arrest for operating a vehicle impaired OVI.
