Get out of the car now. >> GET OUT OF THE CAR. >> [screaming] >> WHAT IS GOING ON? >> I TOLD YOU TO PULL INTO THE SCHOOL AND you took off and floored IT. >> I DON'T WANT to go to jail. >> On May 5th, 2023 in Orange County, Florida, a lieutenant running radar in a school zone flagged a driver doing 28 mph in a school zone. He was not going to write her a ticket. He was going to tell her to slow down and let her go. That decision lasted about 4 seconds because the moment he signaled her to pull into the school parking lot, she floored it. What she was protecting and why she ran will take less than 9 minutes of body cam footage to explain completely. >> Okay, so when I tell you to stop your car, stop the car. Go ahead and get on out. Get out of your car. Get out of your car. >> getting out of my car for you. >> Okay. Kayla, unlock the doors now or else we're going to take you out of the vehicle ourselves. Does your shirt say Cappy's? Oh, you work at Cappy's? Oh, okay. I'll make sure that they know what's going on here. Kayla, if you do not undo your window or unlock the door, we're coming in, my friend. So, you better do it. Make a good decision. Yeah, she's a little on the heavier side, too. >> One of those two things is going to happen. Cuz you're told to get out. >> No, I want to know why. >> You already fled from me back at the school. I told you to turn into the parking lot and you took and you fled from me. That's why we are stopping you. >> We're not going to argue about this. >> I do not care who your officer or anything. >> I've gotten trouble for clocking people when you don't have a gun. >> Quit dropping names. This has nothing to do with that. >> Okay. Hey, stay 10-12. I'm going to get a window punch. >> I got a function. >> Oh, oh, he has a punch. Oh, it's fine. Open the door. >> Sure. >> There you go. >> What I [ __ ] >> Get out of the car. Get out of the car. >> You want to ask ME? >> GET OUT OF THE CAR NOW. >> I'M I'M GETTING >> GET OUT OF THE CAR. >> GET OUT OF THE CAR. >> GET OUT OF THE CAR. PUT YOUR HAND BEHIND YOUR BACK. >> HEY, SERIOUSLY, CALL BRADY. CALL BRADY. >> GET YOUR HAND BEHIND YOUR >> BEHIND YOUR BACK. >> I DIDN'T DO nothing wrong. >> Relax. Relax. >> I'm pregnant. You're hurting me. >> Put your hand behind your back. Put your hand behind your back. Just listen. Just listen to her. >> If you would have listened [laughter] the first time, WE SHOULD NOT BE IN THIS SITUATION. CORRECT? CORRECT. I told you to pull into the school and you [ __ ] YOU TOOK OFF and floored it. IF YOU WOULD HAVE PULLED INTO THE SCHOOL, WE wouldn't be in this situation, Kayla. >> Sit up. Get on your knees. >> I can't. >> Get on your knees. Roll over then. Get up. >> It's just the little thing I did. You ripped my undershirt out. Please. I'm exposed. Please. >> Stand up for me. >> I can't. This is really tight on my wrist. It's going to hurt if I pull up. I promise. >> That's your problem. Get up. >> I didn't I'm not GOING TO >> GET UP. GET UP, KAYLA. >> I DIDN'T I DON'T WANT TO PLAY THIS GAME. WHAT AM I WHAT AM I TELLING YOU WHAT AM I WHAT ARE YOU DOING RIGHT NOW? >> 50 for male and one secured. >> I saw him show up 10:15. >> What am I going to jail for? I didn't >> Fleeing and eluding. Fleeing and eluding. I told you to pull into the school and you took off. >> I want to please watch my kids. >> You're not calling anybody. >> Nobody's going to get my kids. >> You're not calling anybody, my friend. Stay sensitive while I put on my gloves. You did. >> Please, I've never been to jail in my whole life. >> tell you what was going to happen? Did we not tell you what was going to happen? >> I don't care. >> What did you guys do? >> Well, now you should be more scared cuz you didn't listen. >> See, I literally didn't do nothing. >> Just relax now. You're not going anywhere else. Just listen. This is only going to help you. >> I don't want to go to jail. >> Okay. Jail. >> Please let me out. Please. >> All you had to do was listen. >> Please, I don't want to go to jail. I'm sorry. >> I don't care. YOU'RE GOING TO JAIL. >> I'M PLEADING WHAT did I do? What am I being charged with? I didn't do nothing. >> Really? Cuz your attitude got you real far, didn't it? >> How is my attitude a crime? That's what I'm asking you. What am I being charged with? >> Fleeing and eluding. You're already told that. >> Fleeing and eluding for what? >> From her. >> I told you to pull into the school. You decided to drive evasively and and say screw you and you took off in the school ZONE. DON'T EVEN SAY YOU DIDN'T DO IT BECAUSE YOU DID IT, KAYLA. OKAY? >> LISTEN, I'm not trying to be >> Don't worry. I'll just let Kathy's know about about your actions. That's fine. >> Spread your feet. That was totally unnecessary. Totally unnecessary. >> I have weed on me. >> Good for you. >> Okay. Do you want to get it off of me or do you want it >> Can you just shut your mouth for a moment? Thank you. >> The weed I got >> If you even dare to try to take off ONCE I UNCUFF YOU, I'M GOING TO TAKE THIS OFF AND YOU'RE going to dig in there and you're going to get it out. You understand? >> It would be really dumb to try to take off right now. >> I'm not going to >> parts. >> So you you ran from me because you have weed in your inner vagina. >> If you are going to jail, it's a felony, right? >> Thank you. >> No, you're going to jail, my friend. >> That's where we're going. >> Should have thought of that before. >> I told you to pull over, you said screw you and you took off down Sansbury. All right? Wrong move. Wrong move. I wasn't even going to write you a ticket. I wasn't going to do anything, but now you you have done screwed the situation up. >> You'll lose your right >> Okay. >> Well, you get to >> Yeah, you just lost your right to drive right now. >> Go to law school. You're under arrest. You lose your rights. >> I have no right to call my baby to get my diaper >> Now that that vehicle's getting towed. >> Since right now. >> All right. Um, let me just go move this seat out of the way and she can ride with me. I don't want to ride with her. >> You don't. You don't. >> I don't I I want somebody else. >> You don't have a choice. Go ahead, cause yourself more problems. You just tack on more charges. >> I just want to get my hands on it. I can't even get out of my car to get my baby cuz I can't even cash my check. >> have thought about that earlier. >> My cat my check is right there in my seat. I need the car seat. >> I can't feed your kids, but you got that. That's sweet. >> That's not even mine. That's my boyfriend's. Please. Please. Please, I'm begging you. >> Come back here. No, come on. >> I can't even get my shoes or nothing? >> Okay. >> But he was running radar and I was in front of the school and and I could see clearly she was doing I would say at least 35 but >> I would That's exactly what I said, 35. >> You had her at 28 but visual estimate 35. >> her clocked at 28 but I visually she was doing 35 when she passed me. >> I'm going to write her on the clock though but thing of it is is that then I could smell the weed. >> Yeah, I could smell the weed. >> but I didn't. I said, "All I was going to do is tell her to slow down, take a 10-8. That's it. No time for this." So I was like, "You got weed in your car too? Well, go ahead and pull in there." Boom, dude, she took off. I shouldn't have said it. You know, looking back. But anyways >> Well, you're getting her for fleeing. >> I'm going to get her for fleeing um >> So you >> and for the resisting because she wouldn't get out of the car. >> Yeah. >> I don't care what you have to say either, Kayla. You just committed a felony so you're getting charged with a felony. Oh, I am. Are you going to jail, my friend? Don't worry about all that, Kayla. Don't worry about all that. Really? Do you want This is my card. >> I don't want to talk to you. >> Good. Oh, I'm going to close it. Don't worry about that, Kayla. Nobody wants to see you here or anything else, Kayla. You need to stop working at Cobby's cuz you eat so much food. So don't worry about Johnson, he's going to be in a lot of trouble so don't worry about him. Stupid you. Here's the thing, that was my lieutenant that initially stopped you, okay? He had you on radar at 28. I could tell you were going faster than 20 in the school zone. Yes, I do visually estimate sometimes we're allowed to do that because it's part of our radar training. All right, I just had to take it to court. Okay. So to and from work. >> So, you see me out here all the time, right? >> I see you every single day. You're right there. >> So, you should know it's a school zone. And Kayla, like, I wasn't going to The only thing I was going to tell you Kayla is to turn in there. I don't care if you got weed. I don't care. We can't charge it anyways. It doesn't matter. You're not getting charged with weed. You know what I was going to do Kayla is tell you just to just to slow down. That was it. And I was going to take the weed from you and put it in for destruction. That's it. And we wouldn't even be here. >> Wayne 143, now. >> All right. >> You got white lights. A little bit better. >> Thank you. >> Wayne 143. >> I got the copies. Over here. So, I know everything that you have. Let me see where else. Got it in your nose? Yeah. Thank you. >> Wayne 143. >> In Florida, the charge for what she did in that moment is not a traffic ticket. It is not even a misdemeanor. Under Florida statute 316.1935, willful fleeing from a law enforcement vehicle is a third-degree felony, up to 5 years per incident. She said she didn't want to go to jail. She said it before anything else. And then she made every single decision that guaranteed she would. When officers caught up to her, she locked the doors. She refused to exit the vehicle. She refused to roll down the window. She told them directly she was not getting out of her car. Every second she stayed in that car was another second the charge count stayed open. Officers gave her multiple verbal warnings. They identified themselves. They told her exactly what was going to happen if she didn't comply. She had every opportunity to stop this. She declined each one. When the window punch came out, that was not an escalation. That was the result of a decision she made 90 seconds earlier. Once she was out of the vehicle and on the ground, officers discovered the real reason she ran. She was not protecting a weapon. She was not hiding cash. She was hiding marijuana, and she told them exactly where. The officer's response to that confession is the most important line in this entire video. So, you ran from me because you have weed in your vagina. That is not a question. That is a man doing the math in real time. Here is what the math actually looked like. She was going 28 in a school zone. The lieutenant smelled marijuana. He was not going to charge her for it. In Florida, small personal use quantities were effectively non-criminal at officer discretion. His plan was a verbal warning on the speed, nothing else. She ran to protect something she was never going to be charged with, and by running she earned the one charge she was genuinely afraid of. Locking herself inside the vehicle added a second count. Florida statute 843.02, resisting an officer without violence, a first-degree misdemeanor, up to 1 year. She handed them that charge for free on top of the felony she had already earned on the road. She repeatedly invoked her pregnancy during the arrest. Officers acknowledged it. They adjusted their approach. The law, however, does not contain a pregnancy exemption for fleeing a traffic stop. At booking, she was charged with one count of resisting an officer without violence. Bond was set at $500. The fleeing and eluding charge was confirmed on scene by the arresting officer. The officers in this footage get an A. The lieutenant flagged a legitimate speeding violation in an active school zone. He gave a lawful signal to stop. When she fled, he pursued within policy. When she barricaded, he and his partner gave repeated lawful commands before using minimum force. Every decision holds up under Graham versus Connor. Officers are judged on what was known in the moment, not in hindsight. Every step was proportionate. Kayla gets an F. She was looking at a verbal warning and a free exit. She chose a felony instead. She locked herself in the car and added a misdemeanor on top. She argued the entire time, which as the officer noted, did not constitute a crime, but it did not help her either. Under Florida law, she handed prosecutors a clean case. Radar confirmation, body cam footage of the flight, a witnessed barricade, and a confession on camera. There is no version of this that ends well for the defense. The right call at any point in those first 4 seconds was simply to pull into the parking lot. Lesson: A traffic stop only becomes a felony when you decide it does. The moment a driver flees a lawful signal, the charge jumps, not because of what the officer finds, but because of what the driver chose to do. Compliance at the stop does not mean agreement with the stop. You can comply, take the ticket, and contest it in court. That option disappears the second you floor it.
