Come on. Hop in. Hop in for me so I can get your stuff. >> No. Can I hop all the way in? >> I have >> I have >> You have what? >> I didn't hold on. >> You have what? >> I'm okay. Trust me. I No, I can't. >> All right. Hang on. I'll be right back. It's 2:04 a.m. at the University of Tampa. Officer Bar spots a vehicle driving the wrong way, completely ignoring a do not enter sign. But she didn't just miss the sign. She literally bulldozed through a row of traffic cones to get there. When questioned, the driver, 22-year-old Aninsley Fitzgerald, offers a bizarre defense. She claims her friends told her to just skip the cones. Is this a case of terrible peer pressure and bad navigation? Or are we looking at a driver who is too impaired to realize she's on a one-way trip to jail? Watch how quickly this story falls apart. >> Mrs. Gerald. >> Yeah. >> How are you tonight? >> I'm doing good. >> You know what happened? You know why they >> So they were telling me they're my friends. I don't go to school here. They were just telling my friends that I should like to pull into here and I just wasn't sure like what to do. So, I was pulling I mean I was pulling in and then they were like, "Oh, skip the skip the cones. Skip the cones." And I didn't think it was right, but I mean I kept going. >> Okay. What? You were just visiting here for the >> Yeah, I'm just dropping them off. I mean, it's not Yeah. >> What do you live around here? >> I live in South Tampa. That that address is not current. That's my parents. I just moved. >> Where were you all coming from tonight? >> I picked them up somewhere near downtown. >> Okay. You And how much have you had to drink tonight? >> Not much at all. >> Okay. What did you have? like one drink and that was because I drink wine with my dinner. You >> drink wine? >> Yeah. Okay. >> I have like one glass. It's not Yeah. It's not >> the back bumper in your car. >> It's been gone for a long time. Somebody crashed into me a long time ago and it fell off >> and I just I don't have the money to fix it. So, it's >> Okay. You want to hop out from real I'd like to check and make sure you're okay to drive. Okay. >> If you would shut the door, we'll go up here away from everybody. I'm not here. >> Do you have any medical problems or anything? >> Uh, nothing crazy. No. I mean, my hip's been fractured. My right hip has been fractured and I played hockey my whole life and I'm in the army. So, I mean, >> okay. >> Pain, but like nothing crazy. No. >> Um, how long ago did you fracture the hip? A >> couple years. >> Did you have to have surgery or anything? >> Uh, no. I had an MRI done, but >> Okay. physical therapy or anything like that? >> A little bit. Yeah. >> Okay. But you feel like you're back to normal now? >> Yeah, I'm pretty I'm okay. It's sometimes it like acts up, but it's nothing too bad. This um this knee too with the same like ligament tear. I I don't remember again basic training but >> Okay. And do I mean how does your legs feel right now? Your hip? Everything's okay. Are you able to walk? Okay. >> Yeah. >> Are you on any medications? >> Not not right now. No. >> Okay. Anything else physically like your back, your feet, anything like that? >> No, I think it's okay. >> Okay. Have you ever been told you've had anything wrong with your eyes? >> No. >> Okay. What I'd like to do is begin by checking your eyes. Are you okay with that? >> Yeah. >> If you would put your feet together like I'm doing and then your arms down to your side. >> All right. See the red light in front of you? What I'm going to have you do, I'd like you to follow that light with your eyes, but keep your head still as I move that back and forth. Okay. 31. Keep your head still. >> Oh, >> I also do move a lot. >> Try your best to stand still. I know it's hard. >> Yeah, it it's really hard for me. Trust me. Oh my god. Okay. All right. You said you're not on any medications right now? >> No. Okay. I mean, like cough medicine, but if that counts, I mean. >> Yeah. >> No. When did you Well, when did you last take it? >> 2 or 3 hours ago. Okay. What type of cough medicine was it? >> Uh I took started taking the mucus. >> Okay. >> I do have a prescription for allergy medicine. >> That's fine. The mucin mix that you took that was a cough cough medicine that you regular like the very like the normal >> like a liquid form of it or the pill >> liquid >> liquid and you just took like the the one normal dose. >> Okay. All right. I'd like you to do um two other exercises. Okay. Um involves walking on a line and then standing on one leg. >> Okay. >> Could you do that for me? Uh yeah, I'm not going to lie. I'm not going to lie. One leg kind of hard because you know ouch. But yeah. >> Okay. Um this is a little bit crooked right here. Why don't we uh do me a favor? Just just wait right here. Come on over this side. That's just too crooked right there. >> All right, let's stand right. We use this yellow line right here. Oh, the yellow line. >> This yellow line. Yep. We use that one straight down. Don't worry about the angled ones. Yep. So, what I'm going to um do is I'm going to give you the instructions. I'm going to show you how to do this. Okay. >> Okay. >> Um while I'm doing all of that, I want you to stand on the line with your left foot on the line >> like this. >> So, put your left foot on the line first. >> Okay. >> Yep. And then take your right foot, place it in front of your left foot, so it touches heel to toe. They're one. Make sure one foot is directly in front of the other foot. And then place your arms down to your side. Now, don't begin walking until I tell you to start. Okay? Okay. All right. So, when I tell you to, I'd like you to take nine heel totoe steps, counting your steps out loud as you walk down the line. You're then going to turn around, walk back down the same line. Nine heel totoe steps counting your steps out loud. Okay? I don't want you to start just yet. Okay? So, your first step will be number one, and each step needs to be heel to toe like this. One, two, three, and so on until you get to nine. On your ninth step, I want you to leave your front foot on the line. Remove only your back foot, taking a series of small steps to complete a turn, just like this. >> Okay. >> Okay. And then you're going to walk back down the line. Nine heel to toe steps, counting your steps out loud. One, two, three, and so on until you get to nine. So, while you do this, I would like you to look at your feet as you walk. >> Count your steps out loud. Keep your arms down to your side. Then, once you begin walking, don't stop until you completely finish this. >> Okay. >> Do you have any questions on how to do this? No, I should begin. >> Okay, you can begin when you're ready. >> 1 2 3 4 5 6 7 8 9 I'm going to face. I'm sorry. I'm an army. >> 1 2 3 4 5 6 7 8 9 Okay. All right. Next, what I want you to do is actually you can come stand right here off of the line. Just stand right in front of me. Just stand like right here. Just put your feet together, arms down to your side. Now, don't do anything until I tell you. Okay? >> This one when I'm going to show you first. Okay? When I tell you to, you're going to raise one foot. Doesn't matter which one you do. You're going to raise it so it's about 6 in off of the ground. >> Okay? >> Point your toe straight out just like this. >> Look at that foot and then count out loud. 1 1,002 1,003 1,004 and so on until I tell you to stop. >> All right. >> Okay. Make sure you keep your leg straight. Don't bend it at the knee like this. Make sure it's straight. Make sure >> I do move a lot. I have like I just I move a lot. So I Yeah. >> Well, what do you mean? What do you mean by that? >> Like Yeah. Yeah. >> Just like arm twitching and stuff. >> Yeah. I can't. It's hard to move. >> That's fine. But I can do it. >> If your If your hands and stuff move like that, that's totally fine. But what I want you to do is try to keep your arms down to your side, your leg up or your foot about 6 in off of the ground. Make sure your toes pointed out, not up in the air, but out like that. >> Okay. >> All right. Do you have any questions on how to do that? >> No, I'm good. >> All right. You can begin when you're ready. >> Make sure you're looking at your foot. 10002,00034, 105, 106, 107 Oh, good lord. 108,09, 2010 2011 2012 2013 2014 2015 2016 178 >> just continue from where you were. 2018, 2019, 2020, 20,21,22,30. >> Okay, you can put your put your foot down. >> Yeah, put your hands behind your back. Put your hands behind your back. Do don't resist. You're going to get you're going to get charged with something else. Okay. >> You are being placed under arrest for DUI. >> I'm not. >> No, I'm not. >> Hey, come on up. >> I'm not. I'm so scared. Can you what? >> I come up here. >> Come on up to the front of the car. >> I can't stand. >> Stand still. >> No, I can't stand on one foot. I'm sorry. I can't. >> Well, it's not just about standing on one foot. Okay. It's a little bit more than that, right? We are going to go down to the jail and I'm going to ask you to do a breath test. Are you willing to do the breath test? >> Hold on. I'm I'm sorry. Hold on. >> Do you have anything illegal on you? >> No, I have to >> any any pills. >> Did they already leave? >> Yes. Do you have any pills or anything like that in your pockets? Okay. >> Can I take a minute? >> I'm going to have you. You got to have the seat in the back of my arm. Okay. I'm >> sorry. I Come on, Becca. >> I have no I >> You have what? You You can tell me. >> No. >> Okay. >> Are you active military right now? >> Yes. >> Okay. >> I have no I have >> me to roll the window down for you. I >> just have to slow down for my own spot. Okay. Can I have my phone and everything out of my car? >> I'll get it for you. >> Yep. >> It's not I >> Come on. Have hop in. Hop in for me so I can get your stuff. >> No. Can I >> Hop all the way in. >> I have >> I have >> You have what? >> I hold on. >> You have what? I'm okay. Trust me. I No, I get All right, hang on. I'll be right back. Heat. Heat. Double There are so many open containers in here. It is >> everywhere you look. >> There really It really is. Everywhere you look, there's container or something. >> She insisted on having just one glass of wine with dinner. But the inventory search paints a very different picture. Legally, once she's under arrest, officers conduct a search of the vehicle. Watch as officer bar finds a literal graveyard of open containers, seltzers, twisted teas, and tequila. Does this look like one glass to you? A Millerite can empty. Here's a box for a silver patron tequila. There's nothing in it. Another seltzer empty. Another seltzer empty. Seltzer empty. That's the twisted te I was talking about earlier. This car is a wreck. >> Can I have my phone with me? >> Not up here. No. You'll be okay. >> Is it coming to the jail with me? >> Yeah, it is. >> You promise? >> Yep. Yep. I'm going to sit inside. No, I >> it won't be with you, but you will be able to access it for like phone numbers. They won't let you. >> Yeah. Yep. All right. Um, are you willing to do the breath test there? Uh I No, I can't force you to do it. Um >> I don't do that. >> Okay. If there there Have you ever Are you familiar with what happens in Florida if you don't do the breath test? >> No. >> Okay. So, basically what happens is if you don't do the breath test, um your license gets suspended. Okay. >> For DXT for one year. Okay. >> Um let me look at your license. Hang on. Make sure there's nothing else on here. I'm assuming there's not. >> U suspended license. >> Why? >> Failure to pay >> failure to pay traffic fines on November 6, 2023. >> Um >> again, November 6 and 2023. And then insurance, [snorts] >> okay, >> on March 16. I'm sorry. >> What's that? >> I wasn't aware of that. I'm sorry. >> Okay. >> I wouldn't [snorts] be driving if I knew that. Sorry. Yeah. Basically, um so what'll what would happen with you? You >> the options for you are um if you refuse the breath test, it's a one-year suspension. If you do the breath test and you blow over a 08, it's a 6-mon suspension. Either way, you can go and apply for a hardship license so you can drive for work and necessities. So, um those are the uh those are your options. You know, I mean, really, there's only two options. Either take it or you don't take it. It's totally up to you. Oops. There we go. You're welcome to read along. I'm going to read this paragraph right here. Okay. Some of this is not going to apply to you. So, when I'm done reading this, I'll explain that. So right here, if you refuse to take the test, I have requested of you your driving privilege will be suspended for a period of 1 year for a first refusal or 18 months if your driving privilege has been previously suspended or if you have been previously fined under Florida statute 327.35215, which is voting under the influence for refusing to submit to a lawful test of your breath ur. Additionally, if you refuse to take the test I have requested of you and if your driving privilege has been previously suspended or if you have been previously fined under Florida statute 327.35215 for refusal to submit to a level test of your breath, urine or blood, you will be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusing to submit to testing is admissible as evidence in a criminal proceeding. So out of this, the 18 months and the additional misdemeanor charge does not apply to you. >> Okay? >> The only thing that applies to you out of this is the one-year suspension and this refusing to submit to testing is admissible as evidence in a criminal proceeding. >> Okay? >> Meaning that if it were to go to court, I could say yes, you refused. >> Okay? >> Uh do you understand that? >> Yeah. >> Do you have any questions about that? Uh, what is it if I take it and regardless of the results? >> You're well, no matter what, regardless of the results, you're charged with the UI tonight. >> Okay. >> So, it doesn't matter what the results come back as, you're still charged with the UI. >> Okay. >> Does that answer that question? >> Yeah. >> Okay. Do you still refuse to take the test? >> Yeah. >> Okay. Hang tight. I got a couple of things of paperwork I got to do real quick and we'll get you inside. Okay. Are you are you um active reserve or active duty? >> Reserve. >> Okay. Cuz I saw a reserve card in there and um I just want to make sure [clears throat] we didn't have to make any notifications and I don't I don't think we do. >> Aninssley Fitzgerald refused the breath test, triggering an automatic one-year license suspension under Florida's implied consent laws on top of her existing suspensions for unpaid fines. The one drink defense rarely holds up against body cam footage like this. What do you think of the officer's patience here? Let us know in the comments. Hit that like button and subscribe for more transparent lookins at law enforcement. >> What is going on radio? >> Yeah, just because just cuz we're going to bring you there. >> Wait, I being communicated. >> Sorry. >> This is weird. Why am I not being communicated? >> Where is my car? Where the car? >> My car is at 1:30. My car. >> Around 6:00 p.m. in Hoboken, New Jersey, Officer Salgado responds to a reported hidden run involving a parked Tesla. The driver of the striking vehicle claims she was just distracted by an alarming text message. But as officers close in, they realize that a distraction might be a cover story for a much higher level of impairment. >> I'm going ask you a question. Did you drink? >> Are you drunk? >> No. Positive. >> Yes, I'm positive, but I am certain. >> Okay, do me a favor. >> I'm not going to move my vehicle cuz I need to contact my insurance. >> Step over there. >> All right. Can you send me another unit and also send me somebody that's SFSC certified, please? >> What are we doing? >> I'm going to have somebody that's feel so like that they could test you if you're drunk. >> But also, but can you understand my nerves are now skyrocketed? I understand that has nothing to do with the fact I also observed you swerving >> up the up the >> I got a text. I apologize. Yeah. >> So do me a favor. Go ahead. >> Maybe we can also track my record on my text. >> Are you okay? >> Are you impacted >> a little bit? No, but I'm okay. >> How are you impacted? >> I was inside the car. >> Oh, that was your car. Serge, I observed an ata uh in between the middle of the block on Willow Avenue and First Street between First and Second. Uh the female appears intoxicated. The striking vehicle. Yes. To I just have a traffic built up here. I'm just going to try to clear some of this out. I just need extra unit to come down uh in the area first in Willow. So, just stay with the female for our proper. Okay. So legally, can I ask your officer name? >> I'm officer. Are you hurt? >> No. >> She will also send me 34. >> No. >> All right. Put this down. >> I got a text that alarmed me. >> I was very present and I apologize. >> Okay. >> But I did get a text that was alarming. >> Your car has to stay there. >> Yeah. I'll be in my >> No. Uh, just stay here for now. I need your license, registration, and insurance. >> It's present. >> It's present. It's right here. >> Your license, registration. >> Yeah, it's inside. I'm not going to walk outside. >> Oh, man. My poor car. >> Can I get your I need your license registration? >> Um, I understand, but we're in the middle of the street and I need you to get out of the middle of the street. >> I can't. There you go. JR, I'm just going to move my car. Can you just stay with her? >> Give me a second, buddy. Right. So, if we can have another unit a second and Willow to block all traffic there, please. And then, just so we're clear, I got an emergency text. Like, that's why my phone is down here. I would like everything if anything is being recorded. I got an emergency text. >> Okay. >> And I'm not I'm not validating. >> What? >> And here's my license or registration. So, whatever we need to do, >> what I got, >> where would you like me to go or what would you like me to do? Um, can I see your registration? >> This is That's my answer. I don't >> You don't have your registration in your vehicle? >> That should be it. No. >> Can you try and get your registration? >> I'm not sure. >> I can turn the car off. Yeah, for sure. Here. >> No. >> Nobody's in the back seat. >> No. Yeah, we're good. Everything is fine. Like it's this is being more drawn out than what it should be. But I am obl whatever you guys need. >> Okay. >> So, >> no, I'm just saying it's not out as it should be. Whatever you guys need. >> Well, it's motorcycle accident, so it's kind of extra. >> I should never And this is why you never look at a text. >> Was he involved? Sir, was your vehicle hit? >> Yeah. >> Okay. Um, >> where did she strike the vehicle? >> No, no, my car is back there, though. >> Oh, it's on the way down there. >> Yeah, >> she she was trying >> to 14 on the pullet. >> She ran away. She didn't stop. >> Okay. >> Rose, just watch out. I'm going to pull these vehicles. >> I looked at I got a text message and I looked at it. >> Okay. >> So, and my phone I'm leaving my phone there. So, >> where you coming from? Guttenberg. >> Where we What's in Guttenberg? You know, >> I've been working as a content creator. >> Like everything is fine. >> That's where you were Guttenberg. >> Yeah. >> Where do you live? >> Rose. >> Where? >> Right over here. >> What's that? What's that? >> In Hamilton Park. >> Okay. >> Gotcha. >> I'm Bailey. How are you doing? >> Okay. Nice to meet you, Bailey. >> Just my body cam gone. Okay. It's recording. >> I That's great. Can we make sure that it's recorded here? >> It's fine. Keep the door like this. So the >> whatever you guys have. Okay. >> This is just I'm allowed to drink, right? >> Water? >> Yeah. And coffee. >> Okay. Did you have anything to drink like alcohol wise at all today? >> No, not in the past like hour, 2 hours. 3 hours. When was the last time that you did drink? >> This morning. >> What time? >> Uh, when I arrived, I did a drink concept for my sponsor, but I didn't drink the full drink. >> What was it? What' you drink? What' you have? >> It was a mule canned cocktail. >> Okay. >> By drink. And it was one cocktail. >> Okay. >> So, how many how many in total did you have? >> This one. >> One. Okay. And this was I believe it's about 4 to 5:00 now, right? >> Yeah. Give or take. >> Give or take. And this was about >> 1:00 for content. >> Understood. Okay. So, what's going to happen is that this officer is going to perform a field of body test on you. Is that okay? >> Let's make sure you're safe to drive. Okay. >> Well, yes, but also can for insurance purposes, can can everything get recorded? >> Yeah. When my body cam's on, it's activated. Everyone's body cam on. It's activated. Of course. No problem. So, he's gonna uh perform the first body test on you. Okay. We're going to take come out the car and he's going to bring you over there. >> Uh, Alex, you're doing it, right? >> Yeah. >> Okay. >> Hi, Alex. >> That's Officer Miller. And you can >> Officer Miller. >> It's okay. You can call Alex. It's okay. >> You just take my car right there. >> I'm so sorry. >> Watch your Watch yourself. I don't want you to fall in like that. You can leave your car though. >> I know. My poor tire. >> Yeah. This probably going to have to get to I don't think you can drive this, right? >> I think you can drive a little. >> Yeah. Okay. We'll see. >> Understood. >> I don't know. I'll go. >> So, >> just stand by. He's going to >> I got a text and it just swer I'm so sorry. >> One text looked. >> Yeah, it's We don't >> It was driving is super >> This is why we talk about >> So, we can talk to Officer Miller. >> Hi, how are you? like he's like almost 40. >> Um >> you're going to stand right here and face me. >> And so just so we're clear, I know it may not matter. I have an ACL injury. MCL injury. >> I will make sure to >> So by limp or any inaccess, do you also um do you wear contacts or glasses as well? >> I need glasses into a certain regard, but I'm not wearing them right now currently. >> Okay. I will make note of that. Okay. The bigger note is if I limp in a certain regard, >> I have a full partial ACL chair and MCL chair that I'm currently recovering from. >> Okay, no problem. I will definitely note that if uh it comes to that. Okay, >> thank you, Mr. Miller. >> No problem at all. Here's what >> Do you prefer me to call you Officer Miller or Mr. Miller? >> Whatever your preference is. >> No, it's your preference. It's to your discretion. >> So, I'm just going to have you stand right here. You're going to face me on this line. >> Okay. You're going to stand with your feet together and your hands at your side. Okay. You're going to follow the tip of my finger. >> Which tip? Which finger? >> You're going to follow this finger. Okay. >> Got you. >> All right. >> Um I'm sorry. With your eyes and your eyes only. You're going to keep your head still. >> You want my jaw still? >> Uh yeah. You're going to keep your face looking at me, but you're going to follow with your eyes and your eyes only. Okay. >> Yes, sir. >> Thank you. Do I have no head? Sorry. Hello. I'm not sure. I'm not sure. >> That's from our bar. Okay, you can relax for a moment. Uh, the next test we're going to be doing is going to be called the walk and turn test. Okay. >> Um, >> this is the one I'm blurry about because of my ACL in. >> No problem. I'll I'll definitely make note of that. If anything, >> like this everything you make note of right now, I feel like I'm being >> under a deep surveillance. Yeah, I'm deeply worried because I don't want >> I understand. >> Pay attention here. She immediately pivots to a medical excuse. The ACL tear. While injuries are real, officers are trained to look for divided attention failure. Watch how she struggles to follow simple instructions not related to her leg, like keeping her balance while listening or starting too early. Is it the injury or the alcohol? >> I'm going to be taking three steps. We're on. >> When you conduct the test, you're going to be doing nine. Okay. >> Okay. >> 34. We're taking Bravo. >> I'm really worried about my but you've already considered >> and correct. So, what you're going to do is on your line. >> Yes, sir. >> You're going to have your left foot on the line. You're going to have your right foot in front of it. Okay. >> You're going to stay in that position until I tell you to begin the test. Do not start the test until I begin. Okay. You're going to stay in this position, though, just like this until I tell you to begin the test. >> Okay? And I tell you to You're going to be taking nine steps. Okay? For de, again, for demonstration purposes, I'm just going to be taking three. >> One, two, >> three. >> Once you get to your ninth step, you're going to take a series of small steps. >> I've never turned. >> No problem. Do you understand? You're going to take a >> without stepping off the line, you're going to take a series of small steps. >> A small swift turn. >> Don't Don't move from the starting position that I started you from. Okay. >> I know. I'm just doing my best because of my ACL tear. >> I understand. All I'm asking you to do, >> this is my first time without a brace. Like, >> so all I'm asking you to do is to stay in the starting position as so. >> Oh, of course. Do not move until you tell me to move. >> Yes. So, you're going to take a series of small steps. >> You're going to take nine steps back. Okay. >> One, two, three, and so on until you conclude the test. Mhm. >> Throughout the duration of the test, you're going to keep your hands at your side and you're going to keep your eyes, you're going to be watching your feet while you walk. Okay. >> My hamstring. >> I understand. Okay. >> Cuz just because of my ACL tear. >> All right. Do you understand the directions for the test? >> A little bit. But do you understand that? >> Yes, I understand you have an injury. I'm I'm taking that into consideration. Okay. >> But I'm fighting beyond. >> Okay. No problem. You may begin the test now. Okay. >> The beyond the test is me stepping. >> Nine steps forward. a series of small steps and nine steps back >> and you're going to keep your hands at your side. Okay. Are you refusing to take the test? >> No. I mean, no. >> Okay. So, then I need >> I don't want there to be a miscommunication ACL. >> There's no miscommunication. I'm going to make note of this while you're doing this. Okay. >> I just want to make sure that >> Okay. You may begin the test. Thank you. I have an ACL. >> I understand one. >> Thank you. Uh just stand at this line for me. You're good. the the that test is complete. Okay, no problem. >> Okay, what's our next test? >> What you're going to do, you're going to stand at that right there at that line. You're going to stand with your feet together and your hands at your side. >> Yes, sir. >> I'm going to be demonstrating this test. Okay, for this test, you can choose your leg, a leg of your choosing, 6 in off the ground with your foot horizontal to the ground. And you're going to be take counting out loud. One, Mississippi, 2, Mississippi, 3, Mississippi, 4, Mississippi, 5, and so on and so forth until I tell you to stop. During this test, you're gonna keep your hands down at your side and you're going to be watching your foot while you count. Do you understand the directions? >> I I think I do. Can I repeat them to you just so I'm sure? Because I'm being tested in a way that >> No problem. >> You would like me to put one foot and elevate it in front of the other. What starts as a simple traffic infraction quickly spirals as signs of impairment emerge. Watch closely as the driver's story shifts and a routine stop turns into a field sobriety showdown. >> Good morning, ma'am. >> Hello. >> I'm Officer Bailey, Tampa Police Department. Do you have any idea why I pulled you over? >> No. >> All right. When I first saw you, you were coming southbound on 15th Street, approaching the four-way stop intersection at 4th Avenue. It took me this long to catch up to you. All right. But you didn't stop at that four-way stop. It was right before you. Not Not the intersection right where you saw that police officer on the traffic stop, but the one before that. >> The one in Neore. >> Yep. The one in Eore >> outside of the parking garage. >> Right. >> The stop there. >> The stop there. >> Yes. the four-way stop at 4th Avenue and 15th Street. All right. Do you have your driver's license, registration, and proof of insurance? >> Did I do a California roll? >> I'm sorry, I couldn't hear you. >> Did I do a California roll? >> Yeah, you rolled through the You slowed down, but you didn't stop. >> Where you coming from tonight, ma'am? >> Uh, Eore. >> Where in Eore? >> Reservoir Bar. >> All right, Miss Shank, do you work there? >> No. >> Okay. I'm sorry I couldn't hear you. >> Two beers. >> Two beers. >> I don't think I have my current um insurance. >> Do you have it on your phone? >> I can text my mother and see if I have it. >> So, you don't have the app yourself? >> I do not. >> All right. Do you have a valid driver's license? >> Yes. >> No, you already gave it to me. I'm just asking you if you if it's valid. >> Yeah. >> All right. You mind stepping out of the vehicle for me so I can make sure you're okay to be driving? Let's go stand right over there on the sidewalk. I'll be with you in just a moment. All right, Michank, step over here so we're not in the way. All right. Now, the reason I asked you to step out of the vehicle is based on observations I'm making while talking to you. I'm a little concerned about your sobriety and I do want to make sure it's safe for you to human driving. Now, do you suffer from any kind of medical problems I might need to be aware of? You're not diabetic? Do you take insulin? Have seizures? High blood pressure? Taking medication for any reason? Do you have any problems with your eyes other than needing glasses? Are you blind in either eye? All right. Now, one of the things I'd like to do to help me determine your sobriety is check your eyes. Is that all right? Can you take your glasses off for me? Just stand right here on top of that light. Just hold your glasses in your hand. Stand with your feet together just like I'm doing here. Sides your feet touching just like I'm doing. There you go. Hands all the way down at your side touching your legs. All right. Can you see the light I'm holding in front of your face? What color is it? >> Red. >> All right. Here's what I want you to do. I want you to look at that red light and follow the red light with your eyes only while keeping your head completely still. Do you understand? Need a yes or a no from you? >> Yes. Sorry. >> Sorry when I'm squinting. I'm bad prescription. You open your eyes a little more for me. >> Sorry, I can't see. Try not to blink so much. >> Sorry. My eyesing with this >> wind. >> Tell you what, let's let's turn this way. Stand with your feet all the way together. Hands all the way down to your side. Is that better? We can put your glasses back on. All >> right, ma'am. So, >> I am seeing some indications in your eyes that's causing me a little bit of concern. Okay. So, what I'd like to do is continue my investigation and ask that you perform some additional field sobriety exercises. That would consist of you walking a line and standing on one leg. Now, do you have any injuries or physical defects that would prevent you from being able to walk a line or stand on one leg? Um only this knee has a little bit of a um injury that's recovering from last year. >> Okay. So you hurt your knee last year. What what did you do to your knee? >> It was my miniscus tore. >> Okay. Did you get it fixed? >> Mm- I just wore a knee brace for a little while. >> Okay. Did it Did you recover at all? >> A little bit. It's a little bit um >> Are you able to walk normally without a cane? >> Yes, walk normally without a cane. >> You think you'd be able to walk a line and stand on one leg? A leg of your choosing. Okay. You want me to do those exercises for me? Okay. Looks like you got a nice line right here that we could use. I'm just going to readjust my car. If you just stand right over here, I'll be with you in just a second. Okay. All right, ma'am. You see this line on the pavement here? All right. Here's what we're going to do. I'm going to give you some instructions. I'm going to demonstrate what I want you to do, and I'm going to give you an opportunity to ask me questions if you have any. It's all going to be pretty straightforward. I'm not trying to trick you or surprise you, okay? But it is important that you follow my instructions exactly. So with that being said, if there's anything that you don't understand, just make sure you ask questions when I give you the chance because once you start each exercise, you will not be able to stop in the middle of the exercise to ask any questions. Does that make sense so far? Okay. Now, I know this sounds like a silly question, but I have to ask. Do you know your right from your left? Show me your left hand. Okay. Very good. All right. Here's what I want you to do right now. Okay. Okay, go ahead and take your left foot and your left foot only and place it on the line. Next, I want you to take your right foot, place it directly in front of your left foot, so the heel of your right foot is touching the toes of your left foot and put your hands down at your side touching your legs. Now, stay in that position and don't do anything else until I tell you to. Do you understand so far? I need a yes or no from you. >> Yes. >> Okay. Now, when I tell you to begin, you're going to take nine heel totoe steps down the line. Turn around like I'm about to show you and then take nine heel to toe steps back. I'm going to demonstrate for you. It's going to look just like this. From the starting position, start walking with your back foot. Look down at your feet as you walk and count each step out loud like this. 1 2 3 and so on until you get to nine. Once you get to nine, keep your front foot on the line. Take your back foot off. Then use your back foot to take a series of small steps around your front foot to turn around. Once you've turned around, take nine heel to toe steps back. Again, look down at your feet and count each step out loud as you walk like this. One, two, three, and so on until you get to nine. Make sure every step touches heel to toe. Keep your hands down at your side the entire time. Don't step off the line and don't stop walking until you complete the entire exercise. You understand those instructions? Do you have any question? >> Nine this way. Turn around nine. >> Correct. Do you have any other questions? >> Nope. Sorry. >> You think you understand? >> Yeah. Sorry, my left knee hurts. >> Okay. Now, if you don't have any questions and you think you understand, whenever you're ready, you can go ahead and begin. All right, you can go ahead and relax. All right, I want you to turn and face my car. All right, that car right there. Yep. >> No, ma'am. I want you to stay right where you're at. Turn and face directly towards my car. There you go. Just like that. I want you to stand with your feet all the way together. sides of your feet touching, hands all the way down at your side touching your legs. Now stay in that position and don't do anything else until I tell you to. Do you understand so far? All right. Now, when I tell you to begin, I want you to raise one foot, either foot of your choice, about 6 in off the ground with your foot parallel to the ground. Now, 6 in is about that high. It's about the height of a soda can. I'm going to demonstrate for you. It's going to look just like this. either foot of your choice about 6 in high. Notice how my foot is parallel to the ground, both legs straight, hands down at your side, touching your legs. And then while looking down at your raised foot, I want you to count out loud like this. 1,00 1,002 1,003 and so on until I tell you to stop. Don't raise your arms for balance. Don't hop. Don't sway. And don't put your foot down. Do you understand those instructions? You have any questions about the instructions? All right, see I got to grab my watch. >> All right. Do you have any questions about the instructions I gave you? Do you think you understand 6814? All right, ma'am. If you don't have any questions and you think you understand, whenever you're ready, you can go ahead and begin. >> Make sure you're looking down at your foot. 910 2011 2016 Can I step on my knee that's not the miniscus hurt one side >> All right, you can stop. >> All right, go ahead and put your hands behind your back. >> Yeah. Can I use my knee that's not on my >> ma'am? I gave you the opportunity to use whichever knee you felt comfortable with. That's the one you chose. That would be the one that I would I'm saying indications of impairment. I do believe you're impaired at this time. I'm placing you under arrest for DUI. >> The decision is made. Notice how he articulates the totality of circumstances. It's never just one thing. The driver immediately pivots back to the knee injury defense, but the officer has already noted the inconsistencies. Now the handcuffs go on and the real tension begins. >> Are you sure? I'm sorry. I gave you I give you the chance to pick which one you wanted. >> Well, I I'm usually used to my left. I haven't used it in activity for a long time since I got it hurt from working out last year. >> Haven't worked out since. >> Do you have anything on you I need to be concerned about? >> I do not. >> All right. This is something I say everybody I ask everybody, okay? I say to everybody, if you happen to have something on you that you're not supposed to have, like drugs or weapons, and it gets missed during the search before you go to the jail, >> and then you go into the jail and they find it in the jail, you could be charged with a felony for introducing contraband into the jail. >> So, hypothetically speaking, if you did have something, this would be your chance to let me know about it. You understand? >> All right, step over here. Do you have a a wallet or cell phone in the car you need to grab for you? >> Yes, I absolutely do. >> Okay. Where is it? In the front seat, probably >> in the front seat. >> My van's back. My phone is green. Is my friend okay to Uber home? >> Yeah, she's going to be able to drive. >> I'm really not able to just use my other knee that works correctly. >> I I gave you the chance to pick which one you wanted. >> Well, I'm so used to >> And that's the one you picked. >> I'm used to using >> All right. Step right over here, ma'am. But that's not the only reason I'm I'm making the arrest. There's there's other signs that that I'm observing while during this whole exercise. Step right here in my bag. >> Grab it for you, ma'am. >> I'm going to grab it for you. Go ahead and step up for me. >> Wallet? >> Yes. >> Not in the car. >> Your wallet, please. That's her wallet. It's not your wallet. >> She wants her wallet. She She asked for it >> and her phone. >> I don't have her phone. >> Okay. Can you step out, please? >> Unfortunately, we do have to tow the vehicle. >> Okay. You are free to go. You can call yourself an Uber, walk, do whatever you want to do. Call a friend, family member. >> So, I'm just curious. You pulled over. Why? >> We're running a stop sign and it's on video. >> And there was how many other people running a stop sign today? >> Ma'am, I'm not going to get into a debate with you. Okay, you're free to go. Have a safe night. >> I will. >> Okay. >> Gladly. She'll be at Orient Road Jail. >> Is she in your car? >> No, ma'am. >> She's in the other car. What do you need, ma'am? >> What do you need, ma'am? >> Let's talk to my friend. >> Okay, she's going to jail. >> For what? Because everyone around here has [ __ ] video proof. Again, again, you you can debate this later on, but >> I don't need to debate because he's not going to debate it with you right now. He's about to leave. >> Can I talk to my friend? >> He's about to leave to go to jail. Okay. So, I need you to step out of the way, please. >> Break down numbers and give it to her. >> Thank you. >> As long as he can call you. >> Exactly. >> Take off. >> The cop officer speak. >> I have, ma'am, several times. >> Can you let me know next time what the cop officer's cop car number is? >> You You could ask for that. You You didn't ask for that, ma'am. >> So, okay. I'm going to ask now. What the cop cop car >> Okay. So, if you want his information, I can tell you information. You don't have to yell at me. You don't have to raise your voice and do any stuff. You have a casual conversation with me like I'm having conversation. >> Can I have it now? >> Okay. >> I'll give you his name. Step over to my car. Stay by the way for his car. Thank you. >> Come over here. No, you didn't ask for this. So, don't say it was hard. If you ask something, if you ask for something, I will give it to you. You don't have to have an attitude with me or nothing like that. Okay? I will talk to you like a human being. >> So, get it. You don't need to [ __ ] talk to me like you're some [ __ ] >> Well, you just need to learn how to talk to people. I'm not cussing at you. I'm not raising my voice at you. You are cussing at me. Have I say anything profane for you for your job? >> Yeah, I'm good. I'm good. >> That's your job. >> I don't need to tell you what to do. >> No, you need to ask a question if you want to answer. >> Thank you. Can I have my friend's information? >> I already gave you information. That's Officer Bailey. >> Give me anything. >> His name's Officer Bailey. >> You're welcome. You have a good day. >> That's it.
