welcome back folks to the DUI Channel we are in Mundelein Illinois we're on January 30th 2020 at 2 20 p.m a Mundelein Police Officer observed a vehicle traveling 64 miles per hour in a 30 mile per hour Zone Southbound on Lake Street the officer conducted a U-turn and caught up to the vehicle once farther down the road the driver pulled into Bill's Pizza parking lot at 624 South Lake Street as he approached the vehicle the driver stepped out of their car as the officer's investigation begins [Applause] to stay in the car oh yeah traffic stop also you didn't see me no I didn't I was actually on the phone it's all good um do you happen to have your driver's license on your police I'm off my line the reason I'm stopping right now is you're going real fast here on Route 45. I wasn't actually behind another car I was following that car um honestly can I actually be honest with you yeah I just got pulled over I actually went to court for actually speeding so I'm I'm really like in a jam right now I just got out of jail okay I'm not I'm not gonna lie to you if I was speeding I I apologize you weren't behind anybody when I saw you when I passed you I promise I'm gonna explain when I passed you you weren't behind anybody you were you were leading the pack and I got you doing 64 and a 30. so 34 over the speed limit do you happen to have a driver's license on you or no actually you don't have one at all you can send it or it is it is um I was actually going to pick up something for my pregnant girlfriend if you can actually let this slide because I just I just got I promise you I just got pulled over and um about two weeks ago yes um I went to it I'm on parole right now so I promise you I will now I'm on parole for um having a gun as a felon uh you can charge so you can search the car everything anything you want if you could let me just get enough answers no no no no no I promise you can search it there will be anything nothing at all I just can't take another stop it's okay if I could step out sir I promise you I won't no no do me a favor just stay in the car do you have any type of idea that shows your picture and and as long as you're in front don't get arrested because I have to go to work tonight where do you work I work at lafournette it's a bakery oh it's in Chicago Illinois what's what's your first name Justin Justin why are you speeding if you don't have a license because I'm actually gonna rush but it's because you know my girl she's pregnant I have to get money right now I'm going to donate plasma I'm going to a bio life it's in Bolingbrook right now um I promise you I'm not doing anything that I'm not supposed to do okay do you have any idea on you at all or yes as long as I just please don't don't let me get in trouble right now because I understand that I was in the wrong um here it is I just got my ID my parole officer told me that I need to get an ID so we can check out my information or whatever because I just got out of prison um I promise you I'm trying to turn my life over uh where do you live I stay with my girlfriend she's on and where and Waukegan okay okay so you don't live at this Chicago read anything there you know what I mean she just something to me hey hello fingerprints already okay who do you know out here my girlfriend that's it she has Insurance she has the registration and everything okay do you know anybody in Mundelein or anywhere close to Mundelein she's about 30 minutes away 30 minutes away does she have a license she a valid license she's actually a truck driver she with anybody right now no she's by herself and um she won't be able to make it to me her car obviously so I mean okay honestly I promise you sir if you if you have let me off with a warning I promise I won't speed anymore I will get you where I need to go well here's here's the issue man um you said you just got arrested for this two weeks ago so it's not like you know I can give you a warning you don't have a license you're suspended first of all and you just got arrested a week or two weeks ago working on it but listen make this hard on me sir I'm not listening just listen listen listen you're talking over me so much just just listen Okay I want to try to make this I I it seems like it's Financial issues mainly it is that's why you're suspended for financial issues I don't want to be more of a financial burden on you so I need somebody to come pick up the car can you get somebody to come pick up the car does she know anybody local or anybody that can come get the car though um no you're gonna have to come back with me I'm gonna give you a ticket back at the station and then uh okay we're just gonna this is gonna this is gonna really violate my parole sir I'm really trying to be a good citizen yeah and I'm trying I'm trying to I'm trying to work with you too okay I appreciate it because there's there's a big fee with Tony dude but if you're standing I appreciate everything that you're trying to do for me server I really need I can't I can't take any mishaps okay I gotta bring it back to the station today okay bring it back to the station give you two tickets and then you know you can be on your way but I'm trying to work with you here so I don't have to tow the car yeah okay what about when you were arrested two weeks ago did that mess with your Pearl it didn't but I know that this is really like it I'm two strikes is not going to really work well have you let your parole officer know about the last time I did okay what do you say that I can't get locked up again okay well I'm not gonna lock you up I'm just gonna bring it back to the station right now yeah I know but I can't let you I can't let you walk away from this man I gotta do my job this is part of my job I understand this is your job I'm not trying to resist arrest or anything you have to take me in I will go in but I'm really trying my hardest right now because I need is where I gotta go at this point in time because we're behind on our rent we're behind on a lot of things so I understand which that you have to have a job to do and I understand that I was in the wrong and listen and and I respect the fact that you're financially in hardship that's why I'm trying to work with you right now so you don't have to pay for all the crap that comes with Towing your car anything okay hurting you right now I know listen man I gotta yeah I understand why don't you ask her to try to get an Uber over here see what we can do about picking up the car okay or if she knows where you're taking me to the murder line police department on the line we should be able to pick me up from there yes less than an hour by the time she gets there will probably be done what's her name she doesn't have a valid license she does expired I just it's attached to the pl it's attached to the car hang on a second let me check so he's suspended it's for financial I'm he's got insurance now but I'm trying to work with him so he doesn't have to get the car towed but all right here's she does have a valid license I'm sorry it was it was invalid um school bus driver let me talk to them see if they're okay with leaving it parked here for a minute and we'll see what we can do okay all right brother we're gonna we're gonna leave the car okay um you're parked you're not in a spot so we're gonna have to straighten you out they're okay with you leaving the car here for a little bit you're gonna come back with me I'm gonna give you a couple tickets and then uh and you'll be released okay she's got to come out here and pick up the car as well I can't release you and you come pick up the car okay all right nice why don't we put that cigarette out okay right now it's all right if suspended okay it was for uh Financial so a lot sometimes reinstatement fee for something or finished finished paying a ticket or something it could be a variety I know what at the end of the day it's my fault I can't really blame anybody I'm just it's out of our control it's why license is suspended I can't be mad if you guys what's up whatever did you uh you put the key in there right yeah okay or will it not messing up a roll I have no idea what what the terms of your parole are please traffic doesn't necessarily violate your parole but I don't like I said I don't know about the terms of your parole so most mostly time with parole we just have to report felonies um but it'll say in your paperwork if it needs to be reported to your parole officer but most of the time it's just felonies in my experience I can't say for sure but you smell any okay there was a are you gonna search the vehicle no because I'm not Towing it you can search incident to arrest even after the fact when he's already I saw a pill container in the glove box yeah I couldn't tell what was in it okay a couple pill containers in there whose are they that's ours okay they actually have her name on it all right I'm gonna take a look okay nothing of evidentiary value was found during the search of the vehicle the suspect was arrested for driving with a suspended license and transported to the Mundelein Police Department on Route the officer noted that the odor of alcohol became much stronger on the suspect as he was being transported in his cruiser with the windows closed upon arrival the suspect was taken to the DUI processing room for further evaluation all right oh look at those handcuffs off here all right let me ask you another question man how much you had a drink today one beer yeah okay how long ago an hour ago okay the reason I ask if I can smell especially when you got the car I could smell it pretty strong come on for me um I want to do a couple tests okay just to check you out um you take your coat off for me please first test I want to do is check your eyes okay do you have any problems with your eyes no no uh your glasses contacts anything like that no all right um have you taken any medication today on any drugs no um any recent head injuries or anything no okay do me a favor stand over here against the wall all right so um put your feet together just like this arms down your sides you see my finger right here all you're going to do is follow my finger with your eyes your eyes only You're Gonna Keep Your Head still just move your eyes with my finger okay just keep doing I want you to stay in this position while I explain the test there's a walk and turn test so when I tell you to begin you're going to take nine Heel To Toe steps down this line when you get to that ninth step you're going to keep your front foot planted you're going to take a series of small steps turn 180 degrees and take nine Heel To Toe steps back You're Gonna Keep Your Arms down to your sides you're going to look at your feet you're going to count each step out loud okay I'm going to demonstrate it so you know what it looks like so you got your right foot in front of your left Heel To Toe it's gonna look like one two three four five six seven eight nine you keep that front foot planted series of small steps 180 degrees nine back one two three four five six seven eight nine okay um make sure you touch Heel To Toe uh stay on this line arms down on your sides look at this foot look at your feet and counties okay you understand the test yes okay very good yeah just keep going this is unbearable balance I really am okay one to two three four five six seven eight nine you said how many all the way to the end no nine around do nine more right two three four five six seven ready wow okay and then you don't need to do the extra ones oh so the next test I'm gonna ask you to do is a one leg stand so when I tell you to begin you're going to raise either foot six to eight inches off the ground and keep your arms down on your sides you're gonna look at that raised foot you're gonna count out loud one thousand one one thousand two one thousand three until I tell you to stop okay once you stand right on that line with your toes on the line yeah so either foot whichever one you want six to eight inches off the ground just like this legs legs straight arms down to your the legal limit is 0.08 so your DUI but I mean honestly like I said I'm not a bad guy I don't get into a lot of trouble with it if you can actually look out for me as much as you can all right well here's the deal man that that changes stuff a little bit okay because your DUI and your driving while suspended okay I promise you I'm really trying to change my life around I understand I still make bad decisions and it doesn't it doesn't seem like it based off of today okay I'm not trying to knock you in any way but there's a lot of stuff here right now uh go have a seat for me um you're gonna be charged with DUI okay yeah because your DUI you're you're way over the legal limit uh dispatch can you have a total respondent bills please uh we gotta tow the car insurance I know but this changes things like I said this changes okay I know what your DUI okay she's getting the car I won't drive but no more drunk I promise but there's laws that go with DUI there's there's Illinois law that goes with DUI okay tell me I haven't abide into everything that you needed me to advise I promise you so I'm not I'm not a bad apple I'm not trying to I know and I'm not saying you are but I'm trying to turn my life around this is not going to happen right now there's nothing I could really I don't know what I can say to to make yeah uh let's give let's give your girlfriend a call tell her not to go there or she's gonna come here first to get the car sorry because I have to go to work I just got out what time do you start work I'll start at one o'clock in the morning sir we don't have the money we're fine we're financially unstable she just lost her job she just got a job back she won't get a check until next Friday sir pretty please please okay I'm asking from the bottom of my heart you can do whatever you need to do with me can you leave the car for her she needs the car okay I'm listen listen when you get arrested for DUI there's there's listen there's law that comes with DUI that says the car has to get towed and it gets put on a hold the reason the reason for that but listen the reason for that is because they don't want somebody to get released and go drive the car again I know I know you're saying you're not going to do that but that there's a law that says you have to do that okay this is really gonna [ __ ] us up like we will be homeless after this if we can't take care of what we need to take care of I have a job she just got her job back this is the only car that we have we we're barely hanging on to anything we can't pay bills we're trying to pay our rent I'm going to donate plasma just so we can make ends meet yeah I'm really trying sir I understand that you have a job to do and I I know that there's probably slim to none chance that I can talk you out of whatever it is that you have to do as a police officer but I'm I promise you up to no good I'm not intentionally doing anything to incriminate myself or incriminate us as a couple because I'm trying to do good for both of us I understand that I was drinking [Applause] when I was drinking I didn't know that I needed to do other things throughout the day because this is my off day my off days are Wednesdays and Thursdays I had no food I was gonna have to drive but something came up dramatically we have to pay bills I had to go donate plasma just so we can make ends meet so I mean I'm begging you sir and listen so when it came to the suspended and I was trying to work with you really hard but when it comes to the DUI that like I said there's certain laws with the DUI I understand look my grandmother was a police officer she was a police officer 40 years I know the law sir I understand it almost down to the team I know that I was in the wrong I promise you that I there's no there's nothing else that I can do to unjust like show you that I understand that I was not 2011 it's gonna be 55. the suspect Justin later submitted to a breath alcohol test um yeah like like the warning says that if you if you blow over a point zero eight your license is suspended for six months if you say no I'm not doing it all it's a 12 month suspension because that's a penalty for refusing um so in the last 20 minutes if you ingested a alcohol food drink regurgitated vitamins smoke or chewed gum you know it's up to you if you want to do this or not if you do I'm going to hold it you got to blow into this drop pretty hard you're going to see a little lever you got to keep it up hang on a second tell anyone if you want to Walmart you got a little harder if you don't want to you can push hard for refuse yeah blow hard though the results yielded 0.089 breath alcohol content in court the defendant was charged with driving on a suspended license speeding 26 to 34 miles per hour over the speed limit driving Under the Influence with a breath alcohol content of 0.08 or more and driving Under the Influence or DUI the first charge in former DUI charge was disposed as NOAA prosequay this means that the prosecution chose to no longer pursue the case Justin pled guilty to both the speeding offense and the latter DUI charge during sentencing on November 20th 2020 judgment was withheld on the DUI charge following one year of monitored supervision on November 19 2021 nearly 22 months after the offense date the verdict was formally disposed as terminated satisfied for the two charges the defendant was ordered to pay total assessment value of 3726.29 as of March 25th 2023 the entire balance is outstanding including supervision Justin was further sentenced to no alcohol consumed no possession of illegal drugs no entering places where alcohol is sold no bars or taverns attend an alcohol program and an evaluation I'm truly sorry I I can't Express how sorry I am I know that you have the right job but you have please can you try to at least understand that I'm really in a bind here I'm really trying to get my life together I made a couple bad decisions yes and I apologize for it I'm gonna apologize for the fact that I had to involve you into my mood and you don't have to apologize to me this is nothing personal like I told you on the street man this is me it kind of is because of my life I know but it's not what I'm saying it's nothing personal on my end this is the job that we have to do okay if you want me to um [Applause] first or she's going to get a car first all right Stacy please get her closer in case you please get her car can you not negative they're for the um registered owner um here come on over here let's give her a call real quick let's just let her know what's going on um you got to use this phone over it has to get told man I told you when it comes we can't afford this right now we really can't so can we like figure this out to the point where we can at least make it to where it doesn't hurt or affect her this is her car I know she just got her job back she doesn't get paid until next Friday I work in Chicago and live in in Waukegan sir I won't be able to get to and from work at least she can drop me off you feel me I'm not trying to you know get over on you I'm not trying to get over on the system or anything I literally this is I donate plasma I'm trying to like do better for everybody including myself I'm not trying to you know make it sound good to where I like I'm just helping other people can you please help me out I can't I honestly can't when it came to the suspended driver's license I could and that's what I was doing but like I said when it comes to DUI which is your DUI there's there's certain rules that come with DUI and one of them is a car has to get towed because you didn't have to call it in though what do you mean I didn't have to call him from man to man I mean I'm trying to bleed you my case what are you asking me to do just totally uh look away from a DUI I I can't do that man that's part of my job here let's give her a call real quick okay so she doesn't uh go there we can't deal with it you're you're really putting us out of a home right now Ren is about to be do we need bills to be paid she needs that call we need that car sir we need that car okay what happened when you were arrested uh last time for a driver you had to pay for it we had to pay for the car to get out and we were lucky to have the money for that we don't have it right now okay I'm really trying this is why I'm going to donate and listen like I said I'm not trying to knock you in any way but why would you put yourself in that position again it's not that I had to I had to like I said I drank I didn't know that we needed to pay bills I had to put myself in a position and to get the money to pay for the bills that we need to pay that's why I was going to donate plasma that's the only reason why I wouldn't have went anywhere today I promise I wouldn't have drove if I if I drink I'm not a drinking and drink this is why this is my first time I'm 29 years old why do you think I never got caught drinking and driving because it's not my thing but this is something that I needed to do because we need to move forward in our life and I'm trying to make myself a better person I really am why did you ever drive you what is she driving because she was drinking more than I was okay so then how was she gonna come pick up the car right now because that was earlier I didn't I don't trust him because she's a female she can't handle liquor the way that I can handle it all right well let's give her a call before she goes over there looking for the car okay we got to give her a call over on this phone over here listen man I know I know it's frustrating trust me I do and it sucks and I honestly wish there was some other way around that but like I said when it comes to the DUI there's nothing I can do for that so why don't we go over here and give her a call on this phone okay do you need you know her number by heart or no is this is it gonna still be the same situation I'm not going to be locked up longer than what I was going to be today no you're gonna be getting out of here today I don't know what your what what's with your parole I don't know that's another thing like I just got through doing time after the joints there's no way that you guys can like look at this as like okay maybe this guy's me along this lesson I'm not trying to all right let's give her a call you're suspended okay so how much does it cost you last time where did you get arrested for last time this first suspended where was that arrested win pretty much gonna lose a car right now I can't we can't afford this we neither one of us get paid until the week after next Justin what are you asking me to do man I've been trying to work with you but things have changed I can't we can't afford this I'm really trying I'm really trying like I'm I'm back into a wall right now I'm not out here being Reckless and doing intentionally to get in trouble I'm really trying to turn my life over I'm not
