This case began with what seemed like a routine complaint. Two men were spotted lingering around a Walgreens store where they had previously been trespassed. What started as a simple trespass call quickly escalated into something much more serious. >> Is he still here? Did he leave? You want that one? >> He was wearing uh just what he was wearing glasses and gray hair. >> Yeah. >> Hello. >> Yes, sir. >> How's it going, gentlemen? >> Good. You >> guys doing all right? >> Yes, sir. >> Sir, haven't seen you in a while. >> How you doing? >> You been all right? >> Yeah. >> Good. So, we're here for some complaints of people on the property. Can I get your guys' license, please? >> And complaints of people on the property from who? >> From the store. >> Really? >> Really? >> I just got here. >> I know. And uh I think I spoke to you about being after property. You're not on doing business. You can't be on property. >> You told me that? >> I believe so. >> I don't remember that. >> What's your name? >> Billy. >> Billy? >> Yeah. >> Let me get your license. I know your name, so I don't need your information already. >> Yeah. I don't know what the complaint is. Did anybody complain to you? I just got here like 2 minutes ago. >> Your bike? >> Yes, sir. >> Are you trespassing the property from Walgreens? >> We both are. >> You guys are here knowing that you guys are trespassing. >> I just I just got here a minute ago. He was sitting over here. I came over to see if he was all right. >> Okay, >> let's stay here. We're going to have to arrest. >> We're going to have to arrest him. >> They're trespassing >> these two here. >> Yep. >> Now, we can pull up Torres's case. >> That's what we're going to do right now. So, on a second unit cuz we'll do a show up. Make sure we got one and the same. If he's one of the same. So stalking is a misinterception. All we need to prove that it's a continue a continued thing if it's already been documented. If it's one of the same. >> And then we also have we can get witness statement from the assistant manager and the girl in the liquor store saying he's come around looking for her. >> Sorry. We'll get right back. Let's go backwards. Did this dude already leave? >> Yeah. Hold on one sec. Let me get back. >> I I trespassed the gentleman on the left. >> The one with the hat on. the white the >> No, I trespassed him. So, you know, I don't know how many times I got to keep trespassing these people and they just they don't they don't care. At least he's not drunk. Usually, he's usually in talks, but it just keep moving them along and they just they just keep >> proving the problem. >> Yep. We're going to do a show up, but uh the female advised, she took a report a couple weeks ago saying that the gentleman in black has been following her, stalking her. She cleaned the battery. There wasn't a witness present. She called us today. He's come into the store. He's trespass warrant from said property. So he's already going to jail for trespass already and coming around trying to talk to her, acting weird and suspicious. She says this was going around for 3 weeks already. She feels uncomfortable and it's causing her emotional distress. >> And now basically now she can't even take the bus which she lives in Florida City. >> Commenter asking her about her kids, her family, all that stuff. She feels uncomfortable. I'm going to see if she wants to pursue charges for stalking because this is already an apparent pattern and we have a documented instant report already on this as well. And he has continued and he's trespass. Second gentleman. >> So he's trespass. Okay. Because obviously it's a public place if he's like has business there. But the trespass >> he basically he came into the store now to see if she was there walked all the way to the back of the store, saw she had customers and walked out. Then he also has walked into the liquor store. So the the girl in the liquor store and the assistant manager all saw him walk in there tonight as well. >> And he's trespassed. He's on property. We have the letter that I did from this property that the owner does not want people here. We do not have to contact her. >> I'm just checking the second mail to see if he's trespassed from the property. If he is, he's going to go to jail as well cuz I believe I warned them already not to be here and they just do whatever they want to do. >> So, he's going to come talk to you. Oh. >> Hello. >> Who was present when when they saw him in the store? >> In this store? >> I think it was only regular customers. >> Did your manager see him? You say you're mad. >> Well, I I called him and I'm like, "He's here. He's here." So, he know who I was talking about. But he's like, "He can't go on the camera." >> My manager, Marlene, tomorrow, I was just on the phone with her. She said, "Tomorrow you guys could come by >> and she could show the camera when he walked in here and he walked out." Then he >> No, but you're telling me that he walked in here. You saw it? >> Yeah, he walked in. >> Would you be able to identify him if we put you in our car, put her lights on, and tell us that we're out with the same person? >> Yes. >> All right. >> All right. >> We're going to do a show up. >> All right. >> Print out the form. We're going to put her in our car, and then we're just going to drive her around. >> Okay. >> All right. Go to district 4 under Outlook on the server and there's going to be a show up instruction. >> Print that form off then we'll read it to All right. All right. >> And then you said that's your sister over there. >> My sister-in-law. Yeah. All right. Do I have to leave the store? >> It's He's literally We may have him, we may not have him. We just want to make sure that >> Okay. >> That's fine. You can tell him. >> Go ahead. >> He's right there. >> Oh, that's him. >> Yeah, that's >> 100%. >> 100%. >> Okay, then we're just going to talk. All right. >> Yeah. I cuz I remember his name. I read his ID as Billy Jr. But I don't remember his first name. And this we looked up the case. I just want to make sure that we have the right person. >> Pull up a picture and it was it was him. Exactly him. >> And you said that he's been coming to the store and he's been stalking you and all that stuff. Could you give me if come to the store? You know when customers come to the store and they'll buy liquor and >> are your eyes usually like watery? Do do you feel like you like you about >> just seeing him is is just >> it's causing emotional distress? >> All right. Do you want to press charges against him? >> Yes. If I feel like I'm being harassed, especially at you coming to the bus stop, that is harassment. >> But that's stalking you. You told them to stop. Correct. >> I don't care what nobody say. That's harassment. You're asking me where I live. Do I need a ride? Harassing. >> How many times you told them to stop? >> Two, three times. Like you come to the store, I'm cashing out. Okay. Then come to find out you're banned. You're not allowed in the store. I'm not allowed to sell you liquor. I mean, my manager should be in trouble, too, because you guys didn't let me know he's banned. You should at least have up a picture of him. You know, when you walking into a hotel and you're like, "This person is >> banned." I spoke with the imagine the the head manager herself. She's out of Miami. I talked to her. So, we she signed a an agreement with us. It's recently. She signed it about a month ago, maybe two months. She signed a no trespass warning program with the Monroe County Sheriff's Office. >> It authorizes me to enforce trespass on private property and take people to jail. She told me if someone's been trespassed on the property, I do not have to call her. I could take him to jail. As of right now, he's going to go to Joe cuz I found him on the property with somebody else. >> That's number one. I just want to make sure that the person that we're out with is the same person that was stopping. >> So, we're going to talk to your We're going to talk to your sister and see if he was the one that came into the store as well. And then we're going to pace forward. I'm going to give you a statement form everything that he's done to you leading up to you to write it down for you. Write it down for me. Okay. >> Okay. >> We don't need it. When she walked out, she even told So, just print out. Just give it a Just give us a statement form and we'll go for it. >> It should be a second a second one, but that one's for a battery. This is for stocking. Okay. >> Different offense shift. >> Yes. >> Can I talk to you for a minute? >> Yes. >> Okay. Look, here's the deal. I want to be straight up. >> Okay. >> All right. He's been on the side of this building all day. >> Mhm. >> Drunk, falling over, sloppy. I couldn't get him up cuz he couldn't even stand on his feet. >> Okay. >> I left. I went to Publix. I went and did some errands and stuff like that and I left and I came back and he wasn't there and then I rode back by him and he was asleep in the bushes. >> Okay. >> It's like nothing long. Okay. So, I went and charged my phone >> and I came back sitting back over there again. >> Okay. >> So, I was here I've been here all 5 minutes >> just make sure he was okay. >> Okay. >> Because otherwise he was going to be so intoxicated that he was going to be spending the night here. >> Okay. >> He's been here all day. I have not. >> Okay. I was here five minutes when that officer walked up to me. >> Okay. >> And all he was doing was checking on his wolf. >> Okay. >> Okay. So, you know where I'm going. >> Okay. That's fine. >> What's your name? >> Sergeant Davis. >> Davis. I know O'Keefe. I know Hager. >> Okay. Okay. >> They're all day shift. >> Yep. >> But that's when I got came up here. >> Did you go inside the store at all? >> I went in to get fill my water bottle. >> Okay. >> Yes, I did. >> Do you have a trespass from this location? >> Yes, I do. >> Okay. So, I guess that's what they're investigating. Okay. I just got here. So, they're going to just talk to the fill my water bottle. >> Okay. But a trespass means on the property, period. So, but like I said, they're going to talk to them and see see what >> But my main reason was coming here was to check his welfare. Okay. Cuz he's been camped out here all day. Last time my wife when I left here earlier, I stopped to see how he was. When I left here earlier, do you want to listen to me? >> I'm listening. >> When I left here earlier, he was laid over. >> Okay, that's regardless. Point is, you're trespassing on a property that you have been trespassed for before. If you had a concern for him, you could have called us. We could have taken it care of it. Okay. And you went inside the store, which you obviously are trespassed from. So that's what they're investigating. >> And that's that's what we're going to wait to see what these >> All I did was go in there and fill my water bottle. >> Okay. >> I had no water. >> Okay. >> And no way to fill it. >> That's not the store's problem. Okay. >> Yeah. Well, the store didn't trespass me. If you want to know where the trespass originated from, it didn't originate I've talked to the manager here. >> She did not trespass me. O' Conor. >> Mhm. >> Okconor went in there and told them that he didn't want us sitting over here. I asked Anna, you have >> I said, "Why did you Can I finish?" >> I said, "Anna, why did you trespass me? What? You saw us sitting there all the time. You would pull right up. She parked right here every time." >> And so, you never said anything to us. Okay. >> Then all a sudden, no, Connor goes in there and tells her that he doesn't want us sitting here. >> He trespasses cuz Anna said, "No, I didn't trespass you. The police did." >> Well, yes. I don't know what Anna's involvement, but we have permission from the owner of the store that wants us trespassing. >> Organize is the general manager. >> Gotcha. All right. Well, we have a letter from the owner that lets us whether employees want people trespass or not. It's our discretion. >> So, that bypasses manager. It's you should probably if you can call records and you can ask them for a copy of that. >> Our central records department. I can get you the number for them. >> Who's the upper keys commander now? Here. Here we have uh Lieutenant Brian. I meant sorry, Lieutenant Kellenburgger. And we have Captain Brian. >> Captain Bryant. >> Brian. >> Captain Brian. >> Brian. B R Y A N. >> Oh, Brian. >> Brian. Yes. >> Brian. >> Yes. >> Okay. >> And this is in regards to a trespass. >> I will tell you as soon as I'm >> Nigel. Okay. >> So, you're good to go. >> Before we ask you any questions, >> you are officially trespass on the property. Please do not come back here, man. I don't want to take you to jail, man. >> All right. You're good to go, Nigel. You been drinking today? Huh? >> You been drinking today? You want medical to call you? You want medical to check you out? >> I'm all >> cuz I seen you drunk. You look pretty sober to me. I've seen you drunk before. You don't look drunk to me. >> I'm not feeling bad today. >> You want me to call rescue the least friend to check you off? >> I I'm all right. I'm feeling better. Drink some water. >> All right. I know you take time to get up, but in a reasonable time, I need you off the property. All right. >> Sounds good, man. >> What employee is that? >> One of the females there. Have you come in there asking her about where >> does he want to speak to us knowing his rights? >> He said he wants to speak to us. >> All right. So, Deputy Deputy Joe Torres did a report for a battery, correct? With the victim, Franchesca, about 7 days ago. >> Battery for who? >> For one of the employees. Your name is Franchesca. That you were listed as a suspect in in a case. >> A battery? >> Yeah. >> I was listed in a battery. >> Yeah. >> You remember a battery? >> And the battery took place where? >> Here. Here >> at the bus stop. They never talked to you about it. >> I walked up. She was sitting at the bus stop and I walked up because she was all by herself out there closing and I said, "Are you okay?" She's on waiting for my mother. >> And how many times has this happened since then? >> One time. That's when the first day she started. I went in there and I made a purchase in the liquor store. She was working in the liquor store. >> I saw her walk over to the bus stop and I went over there and I said, "Hey, how you doing? Are you waiting on the bus?" She says, "No, I'm waiting on my mother my mother." I said, "Okay, I just want to make sure." She was in the dark. This was after closing and she had just gotten into it with one of the employees by one of the employees. Okay. >> Okay. She said, "I got into it." He he told me I had to mop the floors and I told him, "Screw her." And then all a sudden as I'm talking to her, her mother pulls around >> and picks her up and I leave. >> But she was sitting at the bus stop in the dark all by herself. >> Did you go in today and talk to her today? >> No, I didn't. I did not. She was working on the other They moved her. >> They moved her from the liquor store to the other side because the other employee told me she was stealing out of the till and they were running the cameras to see who stole the money. >> All right. So they moved her to the other side. All I did was walk in there and fill my water bottle up and walked right out of the store. I didn't say a word to her. I saw her behind the register, but I didn't say a word to her. I walked fill my water bottle up as pos. >> Have you asked employees about her or anything like that? >> No. The employees have told me about her that somebody was stalking her and they that that's why she's not working in a liquor store anymore and now she's moved on to the other side. And the other one employee told me, well, they're investigating it right now because money's been stolen. Mhm. >> So there's two other guys that got fired and they're were investigating her >> and they were running the cameras to see because there was money missing. >> All right. >> On her ship. >> Did you ever ask to any of the other employees about her if you know? >> Never. >> And she told you to stop. >> And she told you not to talk before. I'm 62. >> I understand. >> But she said I said, "Are you waiting for the bus?" You said, "I'm waiting for my mother." As a matter of fact, go to >> Sure. You don't want me to call you meds, man. They'll come here. They'll check you out. You don't got to go to the hospital just to make sure you're okay. for >> Yeah, I'm okay. >> Just tell me you're not feeling good. I know you're you're up there in age, man. >> You have to listen to it all day. >> With the job, unfortunately. >> Yeah. >> But, uh, did he just come up? How How long's he been chilling with you? >> How long has Billy been hanging out with you? >> I was sleeping back. >> Came over here, sat down. >> He come riding up. His kid gave him a bag of chips. Just been sitting here a few minutes, rolled up. You know, >> I I don't understand. >> Okay, I got to get my backpack. >> We'll take your backpack. >> Okay. Take me to jail, but you're trespassing. I believe you let you go. >> He's not trespassing. >> He is trespassing. >> As deputies investigated, they discovered that one of the men identified as Billy had a troubling history with a female store employee. Witnesses confirmed he repeatedly entered the store despite being banned, followed the employee, and even made unwanted physical contact in the past. The victim described feeling unsafe, harassed, and emotionally distressed. Deputies also noted that the store had signed an agreement authorizing law enforcement to enforce trespass without prior manager approval. With this evidence, what started as a trespass issue now pointed to a patent of stalking. >> Trespass before me. >> If he was trespass, I'll be taking you to jail. You're not trespass. >> You'll be going to jail if you were trespassing. >> All right. >> 11 to 13 in custody. >> Billy, you're right. Nigel, uh, Mr. Billy, uh, expired three months ago. It's only good fires in in a month. >> Oh wow. >> They're only good per year per statute. >> You can't give me a notice to appear. You got to take me to jail for trespassing. >> The the owner wants us to take people to jail. They do not want notice of peers. >> What owner? >> The owner of the >> This is a corporation. There is no owner. >> Well, the manager of the property. >> The manager. Anna, you called Anna? >> Yeah. No, I didn't have to call Anna. She spoke out to me. She told us that she wants people arrested. And there's a CAD report and a letter on file with her signature on it saying that she wants people arrested after trespass warning. >> Okay, that sounds that's a good story. I hope you're sticking to it. >> I am sticking to it. So, he's trespassed. If he does come back, call us. He goes back to jail. You could talk to the manager. She could request everybody that's trespassed from the property. They could put a >> Some people do, some people don't. You can have pictures on it. >> So, you know who's there. >> Mhm. >> That's up. That's up between you and your boss how you want to run it. But, uh >> I mean, I told she asked me if I want a picture. I said yes, I do. So, >> Well, we'll give you a can we give her a copy of the trespass? >> Say trespass. >> The current one that we have so she could post it here. Yeah, >> we'll give you >> a picture of him. That's what you want to post. >> Yeah. I mean, his picture's going to be public record as soon as he gets arrested. >> As soon as he goes to jail, you can take a picture of that. But I'll give you the trespass warning that we issued him. >> Okay. >> We're going to issue him another one today cuz his expired next month and we issued another homeless male a trespass as well. >> So, he's homeless. >> So, you had the the battery incident that other you know, the bus stop incident where he put his arm around you. >> Yes. >> Okay. And I felt uncomfortable cuz I'm just there sitting on my phone scrolling watching TikTok and I felt this hand around me and I'm like what the He's like oh it's me. I'm like you don't touch me. He's like oh really? I said oh really what? He's like so I can't touch you. I said the next time I'm going to hit you. What do you mean? >> So then the 18th he came into the store looking for you. >> And I wasn't here cuz I guess he came in the morning but I ran into my coworker and he's like oh can I ask you a question? I'm like yes. cuz like it has a guy that's asking for you. Um, >> do you seize, Billy? Do you Sorry. Do you withdraw from alcohol? >> I'm sorry. >> Do you withdraw from alcohol? >> Can I withdraw? >> Do you with Do you have withdrawals from >> Absolutely. >> Okay. Let the jail know so they can get you down to the infirmary so they can start put you on medication. >> So, let them know. Right. >> And that was for COPD, not for alcohol. >> Yeah, he's got the inhaler and he's got medication. >> And what time is it? >> It is 9 9:50. Yep. So if anything they'll like I said you have withdrawals they will do a well as when I worked in the past they will arrange a secondary transport for you and they will bring you down to the jail themselves cuz they can't host they cannot house you in plantation key cuz you'll be on withdraw protocols. So they will send a secondary van up there and they will take you down to Key West. I'm pretty sure that hasn't changed since I left the jail. >> In the end, Billy was charged with trespassing and stalking. The court sentenced him to 12 months of probation, 18 days in jail and ordered him to stay away from the victim.
