Hey, put your hands. Bring it back. Put your back. >> Hold on. No, no, no. Excuse me. >> Hey, excuse me. >> Get back. >> My mother charge. [laughter] Y'all some >> Christmas Eve, Indian River County. A woman is on the ground. An officer says he didn't know she was pregnant. And by the end of this call, three separate charges are on the table. On December 24th, 2024, officers were dispatched to a report of a physical altercation. A couple fighting in the middle of the road. A neighbor called it in after hearing yelling outside. When officers arrived, they didn't find an argument. They found a woman actively hitting her husband. That distinction, argument versus active assault, is what shapes everything that happens next. >> Stop. Stop. >> Hey, put your hands. Bring it back. Bring it back. >> Excuse me. Excuse me. Listen, listen, listen, listen. >> You talking about that is doing too much. >> Okay. So, what you talking about? >> Okay. But what we trying to tell you just said, I just put you in jail. I never put you in jail. >> I never put you in jail. >> And then you tell people these people thinking that we weren't here together. We was here the whole time. >> You came here with when I went in the house. And then when I came across outside, you say whatever your altercation was with the in the car to >> you know who this person is, you laughing and [ __ ] about this situation. >> No, it's not funny at all. But I'm going to >> Okay, but why you sitting there talking like you don't know like you didn't know what was going on? You talking about the altercation with this dude and you smiling like you know who he was. I told you I didn't know. >> I told you. >> Yeah. >> Okay. >> All right. Officers moved in to separate the two. She didn't stop. She pulled away and officers took her to the ground to gain control. Under Graham versus Connor, courts don't judge an officer's use of force by hindsight. They judge it by what a reasonable officer would do with the information available in that moment. In that moment, officers knew one thing. A woman was actively striking a man, and she was now resisting being separated. What they didn't know yet, because nobody told them, was that she was 3 months pregnant. A bystander is filming and yelling that officers never asked, but under the reasonleness standard, an officer isn't required to interview a suspect before intervening in an active assault. The claim makes for a powerful moment on camera. It doesn't change the legal analysis of the takedown. While officers restrained her, a second story was unfolding across the street. A man claiming his car had just been stolen. Torn shirt, bleeding knuckles, a stranger with dreads who allegedly jumped in and drove off. No suspect, no plate, no witness who could confirm the vehicle even left the block. Officers treated it exactly the way this kind of claim should be treated on body camera, politely and with visible skepticism. Back at the arrest, the woman keeps making the same argument. She's not a threat. Her hands are already behind her back. So why is she still on the ground? It's a fair question with an unsatisfying answer. Compliance during an arrest isn't measured moment to moment. It's measured by whether the underlying resistance has actually stopped. She gets medically cleared. She refuses transport to the hospital and officers move to handcuff her for transport. She was charged with three separate offenses. Battery, battery on a law enforcement officer, and resisting arrest without violence. In Florida, simple battery is a first-degree misdemeanor. Battery on a law enforcement officer is not. Under Florida statute 784.07, that charge gets reclassified up to a thirdderee felony. That's up to 5 years in prison for the same physical act, just directed at the wrong person. The lesson here is simple. The person you're allowed to grab in a fight and the person you're allowed to push away from you are not the same person. One of them is wearing a badge, and the law treats that difference as a felony, not a technicality. officers get a B+. They separated an active assault quickly. And once the pregnancy became known, treatment on scene never escalated, the only mark against them. Nobody flagged the pregnancy claim on camera before the takedown, which is exactly the kind of gap that ends up in a use of force review. She gets a D fighting through the separation and pushing an officer turned a misdemeanor domestic call into a felony. The car theft story from across the street never got attached to her case. It was somebody else's night on the same night. If you want more of these, the calls that look simple and turn into three separate charges by the end, subscribe. We post every week. Drop a comment. Do you think the officers handled the pregnancy claim correctly? We'll see you in the next one.
