Like he [ __ ] has abusive man that has texting me. Can you not press battery on me, please? Like they're arresting me, dude. [screaming] Alexa, Alexa. Alexa, >> on July 25th, 2024, West Palm Beach police responded to a call in a downtown parking garage. A man was found bleeding. He said his girlfriend had chased him through the garage, attacked him with a bottle, and tried to run him over with her car. She was still on the scene when officers arrived, and she had a very different version of events. Here is what officers knew walking in. A victim covered in blood, witnesses reporting a car used as a weapon, and a subject already framing herself as the one being wronged. In Florida, battery is typically a misdemeanor. But when a motor vehicle is used as a weapon against another person, the charge becomes aggravated battery with a deadly weapon, a secondderee felony. Up to 15 years per count, she did not know that yet. Or if she did, she did not believe it applied to her. >> What's going on? >> I just got hacked by a female. I'm not name dropping. I got my eyes burn. Come here. Come here. Get a burn right here. Right here. Hey, let me try to figure out who else is. This is just >> Hey, I'm on the bike, bro. Just stay with him. But they they saw everything. You might just get them real quick. >> Well, let me see if the females in there. >> Hey, what's the female working? >> I don't know. is over there. Just a minute ago. Just a minute ago, they were arguing on the third floor. He came down. Okay. Wait. >> Yeah. What did you guys see? What did you guys see? Actually, >> we were walking. We were waiting to stop that white girl right there. Where come that girl? >> Yeah. inside the parking lot. >> All I got right now are you Baby that. You can do that. I can have you. >> No, I don't want to be said. >> I want to go to work. I'M TIRED OF THIS man abusing me and then these random [ __ ] TEXTING ME. I'M TIRED OF IT. You I have pictures of the abuse. You want to see the pictures of the abuse? >> I do. >> I got pictures of abuse, bro. >> Religion. >> What the Did you think this is my You want to You want to do it? >> What's that? What's that? What's that from? What's that from? And when did that happen? >> What's your name? What is your name? I need to know who I'm talking to. What's your name? >> Right now, you you don't want to give up any information, but you have to because this is an investigation and now it's not your choice. You have to give him the information. And that's what I'm trying to get you to understand further trouble. >> So you don't get yourself in further trouble, right? And get unnecessary charges on you that you don't have to. That's why I need to know who I'm talking to. So, can I please have your garlic? >> I don't know. >> What's your name? >> Yeah, you hung up like a >> He's not going to answer. >> He's not going to answer. >> Who Who is that? >> I'll give you his name. >> What's his name, >> bro? Like, this is [ __ ] abuse. I'm tired of this. >> What is his name? >> This is abuse, bro. Like, I'm tired of this. Do you see this? It's abuse, bro. This is abuse. This ising abuse. >> What is that from? >> This ising abuse, bro. >> What's that from? >> I'm tired of it. Like heing HAS ABUSING MAN THAT HAS texting me. >> I'M TIRED. I'M MENTALLY TIRED. LIKE THAT'S NOT FAIR. THAT IS NOT FAIR. >> You're not telling me what happened. >> No, you need to talk to him. >> Hello. >> Yeah. Are you you're downstairs with uh the officer? >> Yeah. >> Okay. >> Okay. Yeah, that's okay. Uh we are here. So >> yeah, thank you. >> Can I block? >> No, because I'm tired of this victim blaming [ __ ] Y'ALL ALWAYS WANT TO blame the victim. This is I'm tired of it. This is physical abuse and mental abuse. This [ __ ] IS TEXTING ME. WHO IS THIS? I DON'T EVEN KNOW HER. WHY IS SHE TEXTING ME? WHY IS she texting me? I don't know her. I DON'T EVEN KNOW WHO she is. I don't even know her name. >> I don't know this's name and she's texting me. I'm getting physically abusing that this is texting me. THAT'S NOT FAIR. >> I DON'T. I don't know who. I'm not going there. >> I'm not going there. >> He's not. >> Are you guys dating? >> He's not pressing charges. >> Are you guys dating? >> He's not pressing charges. >> How long have you guys been dating? >> It doesn't matter. He's not pressing charges. I'm not giving you any photos. >> How long have you How long have you guys been dating, >> bro? Like almost a year now. >> Almost a year. Yeah. >> Well, hold on. Tell I found a bottle, but it's a plastic bottle. Ask me if it's a plastic bottle or a glass bottle. Okay. Last night, you guys for two days straight and this has been texting me since last night on some abusive. Oh, like Oh, you're embarrassing yourself. If I was if that was my man, he wouldn't be texting me. I wouldn't let him text. Huh? >> Can I have my ID back, please? >> No. >> For what? When officers explained the arrest, she did not ask for a lawyer. She did not stop talking. She went straight to the one argument she had that the man bleeding in front of her was actually the abuser. There is a right to remain silent. It exists precisely for moments like this one, she chose not to use it. What followed was 20 minutes of footage that would become the prosecution's exhibit package. Every statement she made, every charge she added, all of it on camera. Officers requested she identify herself. She refused. Under Florida law, a person lawfully detained during a criminal investigation is required to provide their name. Refusing is itself a violation. She had created a problem on top of a problem. She showed officers what she said was evidence of abuse. Photographs on her phone. Officers looked, then they continued with the arrest. The photographs did not change the calculus. The man bleeding in front of them did. When she was told she was under arrest, she asked her boyfriend to drop the charges. Officers explained calmly twice that in Florida, domestic battery is not a victim-driven charge. The state decides, not the victim. >> He's cleaning the battery. So, I have >> no like call him first. >> I'll let you call. >> Can I call him to do this? Okay. >> You want to leave all your jewelry in the car or you want to take it? >> Bro, can you not press battery on me, please? Like, they're arresting me, dude. He's going to hold the phone for you while we put you in. >> They're arresting me. Can you tell him not to? >> He's saying he's not pressing charges. >> Here, give him the phone, >> bro. THEY'RE TELLING ME HE'S NOT PRESSING CHARGES. >> LISTEN. LISTEN. >> They're literally [ __ ] arresting me because of you, bro. I hate you. >> You have no reason to arrest me. He's not pressing charges. >> What? >> Video. Somebody reported it. >> And it's and and and and it's a it's a domestic situation. >> NO, LIKE I HAVE TO GO TO WORK. I don't know my wife's phone number. >> Okay. We we'll set that up for you. Okay. >> Do you want to leave everything of yours in the car? >> Do you have a family member that's close? >> Dad, can you call for >> No, I want to go. >> I want to go. >> Yes, I can right now. >> Yes, I can. >> Relax. Don't do that. Please don't. >> I need to go. I need a >> I need a >> Don't make it happen. JUST GIVE ME A SECOND. >> Don't do that. >> Put the other >> He said he's not charges. >> Why are you doing this? >> Please don't do this. >> HE ABUSED ME. I'M THE PROBLEM. >> OKAY, LISTEN. LISTEN TO ME. LISTEN to me. I do not want you to get any other charges. [screaming] >> [screaming] >> STOP. STOP. STOP. STOP. STOP. STOP. STOP. STOP. STOP. STOP. STOP IT. STOP IT. Stop it. Stop. Stop. Stop. STOP. STOP. [screaming] STOP. STOP. I'M so tired of these. I'M SO TIRED of this. [screaming] >> We're going to have a combat 15. You got to calm down. >> I want to talk to you. >> Calm down. >> STOP IT. STOP IT. STOP IT. STOP. Stop doing that. Stop it. >> Stop it. Get out of here. >> Huh? >> You put weight on her. >> I'm just locking her legs up. >> I'm holding her. >> I got her up and I'm just trying to lock her legs up. >> HEY, RELAX. RELAX. RELAX. This is not helping your situation. Relax. Calm down. >> Let go of me. >> No, I can't. I can't cuz you're trying to hurt yourself. Okay. Stop it. Stop it. Stop it. Stop biting yourself. Please. Please stop. Please stop biting yourself. Stop it. Stop. Stop. [laughter] >> We got you have >> Yeah, I should have waffles. We got to get the cuffs in the back if we're going to hobble us. >> They should be in the door. >> This is the moment the footage turns. She understood for the first time that there was no argument left to make and she responded the only way she had left physically. What you are watching is not a use of force incident. It is a restraint response to active resistance. Officers used their hands and body weight to prevent a person from injuring herself. Every action was narrated out loud on camera. She banged her head against the patrol car. Officers told her why that was a problem. Any injury she created herself would be indistinguishable from one caused by officers. She kept going. A combat 15. A medical distress call was requested. Hobbles were discussed and applied. At no point did any officer strike, tase, or threaten her. The restraint was physical, continuous, and documented. I got >> Come back out. Come on. Come on. >> You got to stop, bro. You got to stop. >> You got to stop. Here. >> Here. I got her. Here. Hold this. You got to stop. >> You guys don't give a Don't give a I'M NOT GOING TO TELL YOU WHY THE I'M like this when I'm being abused and [ __ ] No. you. I have bruises. I HAVE SCARS, BRO. Don't bang your head. You see what you're doing? What you're doing is causing injuries. So now [laughter] when we see injuries, we don't know if you caused them because you bang. >> Now we don't know if you if you [laughter] bang your head or how you got those injuries. So stop banging your head. So you can stop injuring yourself. >> Double lock them. >> And now you have an alocation. you are. Do you have a hanging here? >> Please stop. >> Bro, you're really tall. >> You guys are crazy. >> Well, I mean, I'm not locked together. Locked in the car. So, >> open the other door. Yep. Can you tell me what happened? >> I just got back from lunch. >> I'm going to find a parking spot. I'm getting to the second floor and all I see is that gentleman like he was in between all these cars and all I see is her. I thought it was actually like a like a parking spot type of thing and all I see is her literally about hit about hit the other cars. She was about to hit him and the other cars and he's over there screaming, telling her to >> She's over there telling her, screaming, telling her to stop, stop. Stop. >> When you say hit him, how? >> With the car. She was about to run him away. >> So, she's following him. Okay. >> She was literally following him. Okay. >> And he went to he he was looking like he needed help. And I just I just kept stopping to make sure he was okay cuz I didn't want to be I didn't want that to happen. And all I saw was him recording telling her to stop. She got out the car, went in the back seat. I don't know what she went to go grab. I passed her when I seen her in the back seat. >> Mhm. >> And then that's when I left and I got to the fourth floor. All I seen is him trying to leave, trying to escape. And she kept calling him with the car. And then that was the last thing I seen until I got to the fourth floor and I parked. >> That's when I seen her. She almost ran me over getting out the car. >> Were you on foot or in your car? When she >> I was on foot when I got out. I was already on foot. I had parked my car and I was getting out the car and right when I got to the um rear like the back of my car. Yep. >> That's when I she came onto the fourth floor and started speeding through and went to the roof. >> Gotcha. All right, honey. We got to handcuff you to the bed. Okay. You're okay. We just got >> like you can handcuff you. >> Thank you, honey. We appreciate it. We appreciate you being cool. >> We're just procedures. >> You're cool, man. You're real cool. >> I'm that girl. >> WHAT'S THAT? I IS THE GIRL. I'm the girl. >> You okay? >> Not too tight, right? That's okay. >> All right. He's going to get that arm. Okay. >> What the did he say about me? >> Yeah. >> I'm going to be honest. We haven't talked to him yet. >> You haven't? >> No. Uh, can I get your >> No. No. Really? You haven't talked to him? Not yet. >> Not yet. >> No. >> Not yet. >> Not yet. >> Not yet. >> Can I get your [laughter] wrist, please, dear? >> Here. Come here. >> It's okay. Hurry. Here. Can I get your wrist? >> I'm sorry. Like, >> can I get your wrist, please? >> Thank you. >> Thanks. >> It's okay. It's going to be It's going to be loud. There you go. >> Said he's done. So, >> you said that? >> Yeah. Okay. >> Um, then maybe I should I'm call >> fluids here. >> What am I on? >> Nothing. Just fluids. >> What am I on right now? >> What do you mean >> right now? >> You're at the hospital. >> Okay, but where is >> He's at home. >> Can you call? >> Uh, let me go see if I can find his number. Okay, >> I don't care. Like I I'll be >> chill. While this was happening, a second officer interviewed an independent witness, a woman who had been parking her car on the fourth floor when the incident unfolded below her. The witness described watching the subject chase the victim through multiple floors in her vehicle. She described the victim screaming at her to stop. She said she watched the subject nearly strike both the victim and other parked cars. This is what changes the case, not the subject's account, not the photographs on her phone. an uninvolved third party under no obligation to stay who saw the car used as a weapon and said so on camera. She was transported to the hospital and cleared medically. Once calm, she apologized. Officers acknowledged it. The handcuffs stayed on. She was charged with aggravated battery with a deadly weapon, aggravated assault with a deadly weapon, and resisting an officer without violence. Three separate counts. The first two alone carry up to 15 years each under Florida law. Under Florida statute 784.045 45. Intentionally threatening or striking a person with a vehicle constitutes use of a deadly weapon. The eyewitness account provides the element of intent the statute requires. The prosecution does not need her statement at all. The officers get an A. They absorbed 20 minutes of chaos without escalating it. They documented every contact, narrated every decision, and secured an independent witness account that confirmed the victim's version on every material point. Under Graham versus Connor, every decision here holds. The subject gets an F. She used a car as a weapon. She attacked a man who ended up covered in blood. She resisted arrest, adding a third charge to her file in real time. And she spent 20 minutes on camera, insisting she was the victim, while the eyewitness 50 ft away closed every door she thought she had opened.
