Stand. What are these? >> Um It looks like methamphetamine. >> It does look like methamphetamine. I appreciate your honesty. Thank you. On July 6th, 2025, a Santa Rosa County deputy initiated a traffic stop on a vehicle observed crossing lane markings multiple times on Highway 90. What followed escalated into a felony methamphetamine arrest. Hi. >> Hi. >> How are you? >> Good. How are you? >> I'm good. So, my name's Deputy Davis Santa Rosa County Sheriff. >> Hi. >> Please put it in park. >> I thought it was in park. >> Is it in park? >> Yeah. >> Okay. My name's Deputy Davis Santa Rosa County. All right, the reason for the stop when you pulled out in front of me on Berry Hill and then you took that sharp right turn, all right, you went over the dividing line to make your turn, all right, then we came down to 90, you turned took a right off Shavers, and I watched you bounce over the right the fog lane twice and the center lane once, then you cut across traffic to get to this parking lot where I actually had to stop and let you pass me, all of which are giant red flags someone's driving impaired. >> I'm not impaired. >> All right, so you've had nothing to drink? >> No. >> Nothing, no prescription meds that would uh uh affect your >> I am on um I haven't taken any though. >> You're on what? >> Pain medicine for um my mouth. I had my surgery. >> Okay. And what uh about When was the last time you took your prescription? >> You're good. Go ahead. >> Okay. >> It's been a couple days? >> Yeah, it's been a few days. >> Okay. All right, do you have your driver's license, registration, proof of insurance with you? >> I don't like >> I appreciate you. I don't This was stuck to the back of your license. I don't want to litter. >> you. How you doing, ma'am? How you doing, ma'am? I'm good. Have we met? You look familiar. You don't know? Okay. It's probably a good thing if we haven't. You still living over on Legend Creek? >> Oh, yeah. >> Okay. Appreciate you. >> I'm not sure about my registration. It actually just expired on the 3rd. >> So, this is a gap. Okay. So, you just haven't put the new cards in? >> Yeah, I just haven't gotten them yet. I have them on my email. >> That's fine. I can take it on the I can take your insurance on the phone. Do you have the registration with you? >> Um I thought I did, but it's in my uh >> I could have sworn I just saw it in your hand. All right. So, while we're looking for that, if you go back through my body camera, I ask everyone the exact same questions. 17-year-old kids, 98-year-old grandmas. I ask everyone the exact same thing. All right? Any knives, guns, explosives, anything in the vehicle? >> No. >> No? Is there anything in the vehicle that's not supposed to be? >> No. >> No? Do you use marijuana? >> Um I do. >> Okay. Have you smoked marijuana in this vehicle? >> Um >> I You know what? Before you answer, I do not care about a little bit of weed. All right? Cuz over the perfume >> There's a joint I have a joint in here, but I didn't smoke it in here. >> No one's in any trouble for a joint. All right? That's No one's in any trouble for a joint, okay? I can promise you that. All right? If that's all it is, then it is no big deal. All right? Um I appreciate your honesty, but it's just the joint. No methamphetamine, no cocaine. >> No. >> You Do you have your prescription pills in in car? >> No, I don't. >> You don't? Okay. No problem at all. Um do you have the registration? I do still need to see that. >> Here it >> Appreciate you. Okay. So, I'm going to hand these two back to you. All right, make sure that you get the insurance card updated. Okay? Um and I'll be right back with you. Do me a favor, um just stay in the vehicle. I know you you want to go in Walgreens, but you stay in the vehicle till we're done, okay? >> Okay. >> Easy search for weed. >> Nice. >> I just found some weed. >> Nice. >> Um All right, I'm going to add her to the car real quick. I haven't ID'd the passenger yet. Um and then we're going to pull them out. All right? >> 10-18 >> I added my driver. If you could like run her, also Milton PD is out with me. Okay, what was your first name? >> Lana. >> Lana. Okay, Miss Lana. So, I'm someone who I I like to explain things so people know what to expect. Okay? So, I appreciate your honesty about the joint. I am going to take your joint from you. All right, don't reach for it. I'll We'll get there. All right? But, what's going to happen now is because you do have marijuana in the car, I'm going to have you step out. You're going to wait with this deputy uh this officer back here. I'm going to have your passenger step out. He's going to She's going to wait with the deputy back there. >> Um I actually don't have marijuana in the car. >> You told me you did. >> No, I don't. It's not there. >> You told me it was in your hand. >> I thought I did that electronic cigarette. I don't have any marijuana. I thought I had it right there, but I don't I didn't I never cuz I don't ever bring >> Let me explain it to you a different way. The reason I asked you I asked you about marijuana is cuz I could smell it. I can still smell it. So, that's why I asked you about marijuana. You were honest 233. You were honest with me about it, and I appreciated that. >> Well, >> But, let me put it to you a different way. What is in this car that you don't want me to find? >> nothing in this car. >> Cuz I'm searching it either way. So, what's in the car? >> There's nothing in my car. >> Okay, then you have nothing to worry about. I You You me you had weed. I smell marijuana. >> did, >> I don't have marijuana in the car. I thought there was a joint right here because we were sitting >> I'm going to have you step out and wait with this officer back here, please. Please and thank you. You This is a lawful order, it's not a question. It's a lawful order, it's not a question. Step out of the car, please. >> You're not allowed to search my vehicle. >> I have probable cause to search your vehicle. >> cause. >> Step out of the vehicle, please. >> have probable cause. >> Do it now, please. >> You're not allowed to search my vehicle. >> Ma'am, step out of the vehicle. If you do not step out of the vehicle right now, I'm going to take you out of the vehicle. >> Okay. >> It is that It is that simple. >> car at all. >> Then you have nothing to worry about. Step back with this officer back here, please. >> The first constitutional question arises here. Deputy May had already detected the odor of marijuana before asking the driver about it. Under the Carroll doctrine, Carroll versus United States, 1925, the unaided olfactory detection of marijuana by a trained officer establishes probable cause for a warrantless vehicle search. This is not a consent issue. Florida courts reaffirmed the standard in State versus Betts in 2002. The odor alone is sufficient probable cause, regardless of whether the driver denies it, recants, or refuses. The driver's permission is legally irrelevant. The driver's recantation carries no legal weight. Probable cause is not extinguished by a suspect's subsequent denial. The odor, not the admission, is the operative legal fact. The search was authorized before she said a single word. When the deputy orders the driver out, he is invoking Pennsylvania versus Mims, decided by the Supreme Court in 1977. Officers may order any driver from a vehicle during a lawful stop as a matter of routine without additional justification. This rule exists strictly for officer safety. Refusal to comply is not an assertion of rights, it is obstruction. The driver's claim that the officer is violating her rights by ordering her out inverts the constitutional framework entirely. Mims is not a technicality, it is settled law. >> 233, go ahead and start me another normal. Okay. So, I asked you about marijuana >> I >> and I said to you on camera, recorded, that over the smell of the perfume, I could smell it. And then you said, "Well, I do have a joint here." >> And you need to smell it. She really thought that there was joint was in the side the >> But what I'm trying to explain to you, just so you understand, is that the smell alone is enough for me to >> was just trying to be honest with >> And and I'm totally cool with that. >> I understand >> explaining to you that the smell alone is enough for me to search that car. Okay? So, I ask you again, is anything in that car that's going to get you in trouble? >> No, there's nothing. >> I ask this on a more important note, is there anything in there that is going to poke me, stick me, or hurt me in any way? If I get stuck with a needle, I'm going to be pissed. >> That's ridiculous. >> It's not ridiculous. It's something that I've seen. >> answer your job, but no. >> Yeah, well, I don't Wait, well, I don't give you permission to search my vehicle. >> You don't I don't need your permission. >> Yeah, you do. >> No, you don't. >> Yes, you do. Yes, you do need my permission because you have >> to explain probable cause to them? >> No, it's not probable cause. There's nothing there. >> Cuz I've tried three times to explain it to you. I'm I'm searching that vehicle. >> I thought there was You're not I I'm not giving No, marijuana is not cuz I have a medical card anyway, but there's no marijuana in my car and you don't have permission to search my vehicle. >> Okay, I don't need it. >> You do need it. >> I don't need it. >> Okay, well, I'm going to search my vehicle. >> So, >> There's no marijuana. I tried to be honest with you because I thought that I put it in my car because I was sitting there. >> And I appreciate And I appreciated your honesty. >> Because there's not any marijuana in my car. That's the problem. >> So, if there's nothing in your car, what's the issue? >> Because you're violating my rights. >> If you ever a problem with anything I've done, I will give you my business card and my sergeant will review the body camera. >> right >> Chad's a personal friend. Call him. >> You're not Yeah, you're not >> I am. >> not right. No, because I got pulled over before and they searched my vehicle. I had nothing on me. It was a whole bunch of cops. And >> Yeah, 10-4. Go do your thing. I got it. >> No, you're not >> Oh, we're going to we're going to hold on for a second cuz either way I have PC to search this car right now. >> I don't have any PC. I'm like you don't have the right to search people. I have nothing wrong. I did >> Hold on. >> Cuz I too have a camera in my car. >> That's great. >> You're being ugly for no reason. >> I've been nothing but polite to you. >> You're pulling me out of my vehicle when I need to be at home. Like >> pulled into a wall at CVS. >> I know because I'm getting cleaning supplies. I own a cleaning company and I'm >> You know we can we can ask you to exit the vehicle for our safety, right? It's called Pennsylvania versus Mimms. It's case law. We can pull you out of the car. We have the lawful we can do that. It's lawful. >> For what? >> For any reason. >> What do you mean? >> We can pull you We can ask you to step out of your car for any reason. I'm not going to I'm not going to stand here and have court on the side of the road. All right? You're going to sit on that bumper. You're not going to move from the bumper. All right? You're not grabbing your phone right now. All right? You're Don't go Don't go near that car. You're You're good. I'm letting you know don't go near that car. I don't need it. >> Yes, you do because I've done nothing wrong. I've done absolutely nothing wrong. >> So, we're just waiting for another deputy to get here just so cuz there's two of them, one of you. I don't know if you just heard me or not, but I asked you to sit on that bumper and stay there. Thank you. Cool. Do you have your mental card with you? Your mental card with you? >> It's expired. I have to get a new one. It expired actually on the 3rd. >> All right. So, last chance. I'm searching the car. Is there anything in it? >> There's nothing in my >> Cool beans. >> You're not I don't give you permission to >> I don't need it. >> Yes, you do. You're violating my rights. Then file a complaint that someone will review the body camera and you'll be fine. So now you can put the cigarette down, turn around, put your hands behind your back. And you can do it right now. Drop the cigarette. What are those white crystals on your driver seat? Mhm. You're not under arrest right now, you're detained. Sit back here. Put your butt on the bumper. Can you read her, please? >> Just kidding. >> Yeah, I got him. Yep. I don't know. I don't know which. It's a yes or no question. It's a personal yes or no question. It is a personal yes or no question. Do you want to speak with us or not? It's It's not like that. It's a yes or no question. Nothing is decided yet. I'm going to test these, but before I talk to you, I need to know whether you want to speak with me or not. Do you want a lawyer or do you want to remain silent? Yes or no? I'm going to ask you one more time, and if you don't give me a yes or no, I'm going to take with you? You what? >> I don't mind speaking with you. I don't >> I'm going to take that I'm going to take that as a yes then. What are these? >> Um It looks like methamphetamine. >> It does look like methamphetamine. I appreciate your honesty. Thank you. So, how much more meth am I going to find in the car? >> I don't know. >> Appreciate that honesty, too. >> I got you. I was asking her to put her purse in the trunk. Um We find narcotics in the vehicle. >> Mhm. >> So, she was in the vehicle with her purse, correct? >> Yep. >> So, put my purse in the car? Isn't it I mean, I don't know. Mine I'm This is not my car. It's not my personal whatever. >> Yes, but you were in the car where narcotics was found. >> Yes. >> So, you have to >> So, >> Oh my god. >> It's just what it is. >> Okay, that's fine. You can put it on the >> Just give it to Deputy Oda. >> Okay, you have nothing >> No, for sure. >> All right. So, she was sitting Is that a roach? >> Yeah. >> Okay. >> I knew I smelled the pot, man. >> I don't know >> And an open container. >> Yeah, I smelled it, too. >> Here. >> Here's one driver's license. Here's an ID card for someone else, Jeffrey >> Mhm. >> Um she only had these prescription pills in the >> Are they prescribed to her? Can you copy two? One by Florida DL, one by Florida ID. Yeah, tippy Yeah. I'm pretty sure that the reason that they're on the seat is cuz they tucked them down the front of their pants. >> did. >> Yeah. Well, I got enough to 10-15 both of them, so. >> So, it's simple. I haven't searched anything right here. >> I did this door so far. >> Okay. >> Um but if you want to hop in, I would I haven't touched their glove box yet. >> Um I think she probably you know what they >> I don't know. If they do >> doubt like 100% they got stuff. >> Oh, yeah, 100%. Damn. Freeze. Click, click. Click, click. >> The room has been searched by the officer. >> Okay. I know you heard Officer Oldfield read her Miranda, okay? But it's an individual thing, all right? So, I'm going to reread these to you and then ask you the same question at the end. >> Okay, that's fine. >> Okay. You have the right to remain silent. Do you understand these rights as I've explained them to you? >> Yes, I understand them. >> Having these rights in mind, are you willing to speak with me? >> I mean >> It's a yes or no. >> Yes, you may ask a question. >> Okay, cool. So, between the two of you, all right? I have three meth shards that pre- presumptive meth shards that are found on underneath where you were sitting, and I have two underneath where you were sitting. >> There's >> Okay. >> shards underneath where I'm sitting >> Yes, on the seat. >> That's not me. That's not on the >> to ask you if there's anything in your area that >> It's not my car. >> No, is that the one from the front seat? >> Uh, no. >> Oh, okay. So, >> here's here's both of both of you. Hold on a second. Dog, can you kill my take downs, please? Um Stop. Just stop for a second. All right? Here's here's what I think I'm like 80% sure is going on. All right? Y'all saw me get behind you. All right? Which, believe it or not, is what I think changed your driving pattern to the point where I thought you were highly intoxicated. Sorry, you. You were driving. Honestly intoxicated. And that's why I pulled you over to begin with. All right? I think that while I was behind you, you were shoving meth down your pants thinking that your females and that we're not going to be able to >> Don't you have gloves on? >> Hey, whose chip bag is this? >> Stuffed in between the center console and the passenger seat. >> Whose bag of Ruffles is it? >> I have found you and nothing to eat. I've been drinking alcohol. >> So, you're saying it's hers? >> I'm not saying it's anybody's. I'm just saying that's not mine. I just got in the car and drove with her. >> Okay. >> Oh, that's my son's and my daughter's ashes. >> Okay. No problem. We're not We're not We're going to be respectful with it. So, I retract my previous statement. You didn't shove it down your pants. You shoved it in her chip bag. Cope a setic. Um You're both going for methamphetamine possession. All right? When you get to the jail, you're going to be Stop. When you get to the jail, we'll stop. When you get to the jail, you're going to go through a body scanner. You're going to When you both get to the jail, you're going to go through a body scanner. Okay? The body scanner is going to be a giant X-ray. And if you have anything on you that you are not telling me about now, it's an additional felony. A misdemeanor in the streets is a felony in the streets. Okay? Cool. Have we separated out who the It's her It's her >> I had cookies. >> So, she's saying it's not her She So, it's not her chips, but it's her car and it's not your chips. >> I had cookies in my bag. We had cookies. >> So, it's not her chips and it's not your chips either. So, there's just a bag of meth. >> I just got in the car. We were eating cookies. I have The only thing I had to eat is cookies to try to absorb some of my alcohol. >> That's not how that works, just for That's not how That's not how it works. >> That's not how it works at all. >> I've lost a lot of DUI trials. That's not how that works. >> Deputy Carey, I'm going to solve this real quick. You're both under arrest for DUI. >> Carroll and Mims operate as two independent legal pillars simultaneously. One authorizes the search, the other authorizes the exit command. Neither requires the driver's agreement. Both are constitutionally settled. This is the complete legal foundation of this encounter. Under Florida statute section 893.13 subsection 6a, possession of methamphetamine is a third-degree felony, up to 5 years in state prison. The discovery of white crystalline shards on the driver's seat shifts this from a marijuana investigation to a felony narcotics case. The driver's identification of the substance as methamphetamine before Miranda warnings is a spontaneous utterance, not a product of interrogation. Under Miranda versus Arizona, Fifth Amendment protections attached to custodial questionings designed to elicit a response. A volunteered statement is admissible without Miranda. Deputy Nay administers Miranda warnings individually to each suspect, procedurally correct. Miranda is not a collective right. Each person in custody must be separately advised, separately asked, and separately waived. Anything less creates grounds for suppression. Methamphetamine found in a chip bag between the center console and the passenger seat invokes constructive possession under Florida law. Two elements are required: knowledge of the contraband's presence and the ability to exercise dominion or control over it. Because the bag was in a shared area accessible to both occupants and neither claimed ownership at discovery, both can be charged. Ownership is not the standard. Access and knowledge are. This is why shared vehicle spaces carry compounded exposure for every person in the car. Following her Miranda waiver, the driver admits the methamphetamine is hers. A knowing and voluntary waiver renders subsequent statements admissible. She waved, she spoke. The admission is constitutionally usable at trial. >> LTC Hey LTC, how you doing? I'm sweaty. You want to see something cool? >> I'm at 233. >> Huh. >> Yeah. >> That's a pretty good size rock. >> Yeah, they they have no idea how they got there. >> I did not know they sold those >> [laughter] >> Uh I think it's lace. I think so. >> At least you didn't dump it in a drink or something. >> I can go to charger with the entire weight of the drink. >> That's what you do. Just made meth all she did. >> Yeah. >> And you know those big rocks hang up in the glass up >> [laughter] >> Well, I mean >> There might be a few little chip crumbs mixed in here with them. >> Oh, it'll be all right. >> After you eat it, you'll know the difference. I'll I'll get back two different test results. >> Inconclusive on one. No [laughter] no loose chemicals located. >> Cheddar sour cream. >> Cuz that come back positive for cheddar sour cream, you know you got the right right bag. I should throw what's in this. >> Sour cream and onion flavored or cheddar and sour cream flavored meth. Huh. That's that's that's one I I'm not going Lana, you and I are going to have a conversation. Let's go. I'm going to use your car, old Phil. All right, he's over there. Lean on the push bumper right here. Okay. So, now that we know we're caught, right? Talk me through it. From when I got behind you, where was the meth when I got behind you to where it ended up in the Ruffles bag? >> I don't I don't know about the chip bag. I don't know what's >> I thought you said the that the meth was yours. >> It I cuz I don't know what's in the car. I've had so many people I just got back from Vegas. Like I haven't even cleaned my car out yet. I just got back and I got >> I would like you to know that it's close to $300 worth of meth, maybe more. >> I don't know. I don't know. I had cookies but I don't know where where they came from. >> 233 worth 10 points. Okay. So, >> But if it was in the seat and >> Did you tell that officer that the meth was yours? >> Yeah, because I don't want her to get in trouble because I don't know >> So, are you saying it because you don't want her to get in trouble or you saying it cuz it's true? >> Um it's true. >> Because it's true. So, you knew the meth was in the vehicle, then? Let's Let's jump on the Right right now Right now we're running alongside the truth train. I want to jump on the truth train. >> I don't know about the bag. I don't know about the bag. >> Okay. So, you don't know how the meth got in the bag. >> I don't. I've had people I don't know what's in it. I don't know what bag >> Let me ask you this. Did the Ruffles bag The Ruffles chip bag >> I get I mean I get that >> Miss Lana, you're already Miss Lana, you're already you're already caught. Just the truth The truth shall set you free. Okay. It's yours. How did it How did it Those Those meth shards get in the in the chip bag? Cuz that's a hun- That I know for a fact when you bought that meth it was not in a chip bag. >> I guess it was thrown in there. >> By? >> Uh I'm not sure. I don't really know. I just don't want those people to go to jail because I don't know >> Miss Lana, the reason I'm asking you to tell me the truth right now is cuz you're both already going to jail. It's already done and set. you >> didn't have anything to do with it. >> There was meth directly under where she was sitting and >> have anything I just picked her up. She didn't have anything to do with it. >> I just picked her up. She didn't have anything to do with it at all. I just literally I just >> set your friend down a bad path. All right, because I have no way of believing you right now. >> going she had I really I picked her up and she's going to help me with my home inspection. >> Okay. So I'll ask you again. How did the meth get in the back? Because what I'm what I'm getting from this our little conversation here is that because I feel like if you threw the meth in the bag and the meth is yours, you would say, "Oh, yeah, I threw the meth in the bag cuz there was a phone line behind me and I wanted I didn't want to get caught with it." >> All right, there you go. >> Okay, but hold on. That's an example, all right? But from your initial statement to me "Oh, I don't know how that meth got in that bag." leads me to believe that you had threw it to her and said, "Hey, you tuck this and tuck it back there." >> how it got I don't know what you're talking about. I don't know about the drugs. >> Okay. So, as of right now you're both going. All right? I just want you to know that. >> Do you have anything >> So, Deputy Carey, if you would be so kind as to >> Can Can you >> I don't play I don't play the chatty boy thing. >> No, I'm just saying like can you >> Can I what? Let you go? >> No. >> With a with a with a almost close to trafficking amount of methamphetamine in a neighborhood that's already struggling? You want me to let you go? >> I don't know. I I have a lot going on right now. I do and I don't >> Deputy Carey, do you have a lot going on right now? >> I just I had just had surgery. My daughter broke her foot. I just got back I I have cancer. >> I'm close to $20,000 in medical debt right now. >> I'm sorry. >> I'm not out here driving around with meth. She's she's back and forth on it. >> No, I don't know where it is. I don't know where it came from. >> See? >> No, I don't know what he's talking about. I don't know what bag he's talking about. >> Please put your foot on the bumper. Thank you. >> I What was in the seat? I You want your receipt? She's been She's been read if you want to read it out loud. So, you don't know about the methamphetamine bag is what you're saying? Okay. So, right now, what's your first name? Tiffany. Right now, I I swear we've met before. You know who that is? >> I'm just kidding. I love my daddy. It's David but it's been a little controversy over the last few days or few months. It's been a little controversy. >> after. Um so, right now, Miss Tiffany, we are running alongside the truth train. All right? The truth train is right beside us, but I want to jump on it. Okay? Truth train. So, what happened in that car? Cuz that meth was not in that duffel's back. >> I don't know what happened. What do you mean what happened in the car? >> the meth get in the bag? >> I don't know. >> How did the meth How did the meth get in the bag and then tucked directly next to your seat? >> I just got in my seat, which is her seat in her car. I just got picked up because I wanted her to pick me up. I don't know what to tell you about the meth bag and the trip bag and the whatever bag. >> Okay. >> I did not get in the car until just a minute ago and I literally just was taking a ride with her. I had to get out of the house. >> Where were you going? >> What? >> Where were you going? >> Just getting the hell out of my house. >> Just to get the hell out of your house? >> Yes, I just went through a breakup bad. >> Okay. >> So, I don't know what to say. I had her pick me up. I've been at my mom's. I've been at my daughter's. I needed a break. I needed her to come and get me. She just picked me up. I just got in the car and then >> Where do you stay at? >> I stay over in Milton. >> Where in Milton? Where in the >> East Milton, but I'm not staying there. I was at my mother's house. >> Over on North Airport? >> No, I stay on North Airport. >> You stay on North Airport? >> Yes, usually, but I haven't been there in a week. >> Okay. >> I just left my house and I've been at my mom's and my daughter's. >> So, where was she picking you up from? >> My mom's house. >> Which is where? >> In Pace. >> In Pace? >> Yeah. >> Okay. So, when I got behind you on Berry Hill, where were you coming from? >> The house on Berry Hill you pulled behind us on. The house right on Berry Hill Road, right across >> Miss Tiffany, I mean no disrespect. You're making my head hurt. I'm >> Berry Hill's a pretty busy road. >> I'm done with it. I'm done. No, I didn't. Try again. Oh, okay. Yep. See, now that makes sense. My head doesn't hurt anymore. >> It doesn't matter. I don't know her. That's her friend. That's why I stayed in the car. She went inside and talked to her. >> Talk to her. >> Yeah, she just got back from Vegas. She brought her something and went inside. I stayed in the car and then we left. >> Charlotte something? >> She just brought her something from Vegas. She had a bag in the back. She said we have to stop at Charlotte's and give her something and I said, "Where is that at?" And she told me where it was and so we went there. It's because she's the one involved in whatever the she's got going on. I just got in the car. >> going back and forth saying that it's yours, saying that it's hers, saying that it's her yours, saying that it's hers. >> She just picked me up and I was just going to ride with her. I needed to get out of the house. I can't do this. It's not my >> So, what happened in the car? >> Nothing happened in the car. >> Nothing happened in the car. She didn't hand you the meth and say tuck this. You didn't see her grab that bag and tuck it. I am looking >> do a lot of things. >> Start listing them. >> Just putting it all around on the floor. She's putting it on her on her in her seat. She's putting her seat belt on. All of that. >> Okay. Did she tuck anything? Did you see her put something in her bra? >> I saw her tuck things around all of her seat and I said, "What are you doing?" And she was like, "We're fixing to get pulled over." She don't for sure. >> Yeah. >> So, I don't know what she was tucking. I don't know what she was doing. It's not my >> Uh if you don't mind, cuz I'm going to I'm going to >> She had something going on and she needs to own it. >> Okay. >> That's not even cool. >> Okay. >> taking a rap for somebody >> Drew, hold on for 1 second. >> You need to talk to him. Be honest. >> I am being honest. >> her tuck something in her bra? >> I don't know about her bra. I She was grabbing, tucking, and pushing things everywhere. >> Start listing places. Slow down, take a breath, visualize it. >> of her seats. >> Sides of her seats. >> Yeah, around the seat. She was putting stuff in the seat. She was putting stuff in the console. She was opening the the glove box and put it closing it back. She was freaking out. >> Okay. Okay. And at what point did you see the ruffles back? That ruffles back. >> I don't know. She had it wadded up in her lap. >> And then she put it where? >> I don't >> Do you know where did Have I told you where we found it? >> it by my seat. >> Right. >> She had something else. >> I know. That's what I was trying to tell you. >> Thank you. >> The passenger's account that she watched the driver hide items throughout the vehicle constitutes witness testimony to the driver's knowledge and intent. Simultaneously, it destroys her own claim of ignorance. Voluntary post-Miranda statements are not protected by second thoughts. >> I asked earlier. Is it what? More meth or is it glass? >> What she took. >> Okay. >> I'm telling you the truth. I don't know what she took. I just know she took. I'm telling you she took. I don't know what she took. She wouldn't tell me. >> Okay. Did you go through her bra by tucking anything yourself? >> No, I didn't. I swear to God. I don't have anything tucked at all. I will I will consent to search. I do not care. I'll wait for somebody to come and search me. I don't have anything tucked in my I don't have anything tucked in my bra. I'll shake my bra out. I don't care. And since when can't y'all search us? >> We can. We choose not to because as females and we're males, it doesn't never looks good. So, usually we try to have a female deputy or a female officer come and do that so that there's no impropriety. >> know that you don't have anything tucked, it's kind of one of those things, you know what I mean? >> Okay, ma'am. So, I cannot give you any legal advice, all right? But tonight you're going. >> Why am I going for her drugs? This is not okay. >> I don't have another choice here. >> Why? If she had a bag and she tucked the bag >> Not right now. >> She is not Lana, what are you doing to me? >> Stop talking to her. Stop talking to her. And then 2 seconds later she's going to say I have no idea what Lana tucked. >> She's not She's telling you the truth. I didn't. >> You're going >> She had her bag. She had her stuff. She tucked her down where she needed to do it in her car. >> You're going to go through a scanner. You don't have anything on you? >> No, I swear to God. And this is not my stuff. That's not fair. This is her car. It's her drugs. It's not >> Unfortunately, the only thing I can do >> right now is suggest you have better friends in the future. You better step back over here because >> this. She said that she had it tucked. It was her stuff. Her deal, her things, her stuff. She said that to you. >> seat. >> What in the hell? Why did you say THAT AND THAT'S NOT >> The show all her [ __ ] And she said it was all of her [ __ ] this entire time. >> [laughter] >> I'll do your stuff in the morning. >> All right, I appreciate it. All right, she's already loaded up and she's pissy. Godsend, man. >> Deputy May receives an A minus. His application of Carroll, Mims, and Miranda was procedurally precise and documented on camera at each step. Minor deduction, stating occupants can be ordered out for any reason. Mims applies specifically during a lawful stop, not categorically. Driver Tiffany receives a D. She incorrectly asserted the officer needed her consent for a Carroll authorized search. She refused a lawful Mims exit order multiple times. She then waived her Fifth Amendment right and admitted the methamphetamine was hers. Every decision compounded her exposure. None were legally required. Passenger Lana receives a C minus. She waived her right to silence, made contradictory statements, and voluntarily provided testimony that established the knowledge element of her own constructive possession charge. The instinct to appear cooperative produced the evidence most damaging to her own defense. Three lessons. First, marijuana odor alone authorizes a warrantless search. Consent and denial are both irrelevant. Second, a Mims exited order is not a rights violation. Comply, then challenge in court, not roadside. Third, invoking the Fifth Amendment after Miranda's is strategy. The right to silence exists precisely for moments like this one.
